They have charged the driver with murder and attempted murder. We should tell you that this video is difficult to see. This morning, 26yearold Richard Rojas is behind bars after this sudden and horrific crash in the center of bustling times square. Im still very upset. I mean, i was almost killed. Reporter in this surveillance video, which is difficult to watch, rojas car can be seen make its way down the street, and making a swooping uturn, plowing through the crowd. These images show rojas trying to leave the scene until a bouncer at nearby Planet Hollywood helped stop him. You went over there and you stopped him. I stopped him. From doing any more damage. Thats correct. Did he say anything to you . He was screaming, but there were no words. No words . Just screaming. Reporter more than 20 pedestrians injured. One killed. 18yearold Alyssa Elsman in town visiting with her family from michigan. Annie donohue was walking right next to her before she died. I walked away from her, and she was dead. And that was the woman you were walking right next to . Then i saw it cross the street, and 30 seconds later, she was dead. Reporter police say rojas, a navy vet from the bronx, drove his car down the sidewalk for more than three blocks, from 42nd street to 45th. Knocking down workers along the way before crashing into a barrier. Police say rojas told them that he smoked something that might have been synthetic marijuana before the incident, and that he thought the world was coming to an end. He had previous arrests including two charges for driving under the influence. They say just last week, he put a knife to a mans throat. A lot of people right now are calling you a hero. I dont consider myself a hero. I would just hope people would do the right thing. Reporter a true hero right there, and now police are still investigating, but at this point, they dont believe that this was terrorism. The driver will face a judge this morning. George and robin . President trump closing in on announcing his pick for head of the fbi. One of the front runners, former Vice President ial candidate, Joe Lieberman who ran with al gore. And President Trump is preparing for his First International trip this afternoon, as weve been saying. He is heading to saudi arabia first. He is reacting to the appointment of a special counsel calling the investigation into his campaign and russia, a, quote, witch hunt. As the president prepares to head overseas, he is hoping to turn the page on the toughest two weeks of his presidency. With his first foreign trip just hours away, a new headache for President Trump. The appointment of a special counsel to investigate russian meddling in the president ial campaign. Mr. President , whats your reaction to Deputy Attorney general rod rosensteins decision to appoint a special counsel to investigate the russian interference in the campaign . Was this the right move, or is this part of a witch hunt . Well, i respect the move, but the entire thing has been a witch hunt, and there is no collusion between certainly myself and my campaign, but i can always speak for myself and the russians. Zero. I think it divides the country. I think we have a very divided country because of that and many other things. Reporter the man who appointed the special counsel to lead the investigation was on capitol hill thursday. Did donald trump obstruct justice . Good afternoon. Reporter briefing all 100 senators on the president s controversial decision to fire fbi director james comey. Sharing why he selected a special counsel. To make sure that the integrity of the department of justice was protected and make certain the American People felt this would be handled fairly and justly. Reporter Democratic Senators at the briefing said rosenstein pushed back on white house claims that comey was fired because of his recommendation. He did acknowledge he learned comey would be removed prior to him writing his memo. Reporter shortly after that briefing wrapped up, President Trump offered yet another explanation for the decision, blaming comeys most recent congressional testimony. He had the poor performance on wednesday. That was a poor, poor performance. So poor, in fact, that i believe and you would have to ask him because i dont like to speak for her people, but i believe thats why the Deputy Attorney general went out and wrote his very, very strong letter. Reporter multiple sources say that rosenstein wrote his memo not because of comeys congressional testimony but because President Trump asked him to write it. As you know, jon, senators and others are calling on comey to testify, any update on that concern. Reporter comey says hes more than willing to tell his story in public but at least three congressional committees have invited him to testify, just havent gotten to ahold of him yet. They say they sent the information to a p. O. Box and havent heard from him yet. Thank you. Strange he hasnt responded yet. President trump says he is close to picking a new fbi director. Lieberman was a connecticut attorney general before he served as the states u. S. Senator. First as a democrat and then as an independent. He was the Vice President ial pick of al gores failed president ial race in 2000, but in recent years he has shown a more conservative bent, including endorsing john mccain in 2008. After leaving the senate, he has been working in a law firm in connecticut, george. This has the feel of a trial balloon. I wonder if hes going to get the nod, but so far, what kind of reaction is he getting from capitol hill . Reporter well, republicans like Lindsey Graham and john mccain are praising him, but some Democratic Senators are skeptical saying they dont want anybody who has been a career politician in charge of the nations premier Law Enforcement agency. Fbi agents ive spoken to are hoping for someone completely nonpartisan. If lieberman is selected, he could receive support from the fbi because he was the chief officer. He might be too independent, and well see what happens here. We will. The president is just hours away from his First International trip visiting five countries in eight days. I doubt he will be critical, and he feels donald trump is superior to barack obama because of his rhetoric against iran, and he has not ripped up the iran deal, but his Israeli Intelligence officials are shaken by President Trump sharing their intelligence with the russians even though publicly the israelis have said everythings fine. On the international scene, a chance for the president perhaps to hit the reset button, leave the domestic problems behind for mow . Reporter this is an ambitious trip in saudi where they will bring muslim countries together to fight extremism. If trump can get this out of the way without any gaffes, its likely to be seen as a success, and for now there arent any press availabilities, robin, so maybe that will happen, although theres always twitter. From the white house, on the one hand, it gives him a chance to put on the questions he is asking. In the past, we have seen special counsels and its hard to know where they will stop. You have to look at this broadly, george, as any time a special counsel is appointed, a white house cant be happy with it. I think in a very, very shortterm, its good news for the white house because it isolates the problem as you say, and fixes on one small bucket. The longterm in this, its like a tree. You think the tree is russia, and you start digging. Theres a root system thats going to go throughout this and it can go any direction that Robert Mueller wants to take it. One of the things we saw this week, Kristen Soltis anderson, the republicans didnt know how to handle it, and for the first time, they were silent when big news came from the white house. Thats right. And i think in part of this, its because you have a lot of republicans who dont know how their constituents are responding to this. A lot of these members going to town halls and hearing anger from frustrated folks in their district, and they are not sure how close they want to say to donald trump especially if this investigation begins to go south. The next big public move could be, matt, if james comey gets back to the congress, the testimony of james comey. We saw the president go out with flat denial asking to put back from the investigation. How comey responds to that will be a dramatic and consequential moment. As we learned in 1973 in the watergate hearings, is every time somebody testifies, it makes it more problematic. What we know from the reporting, comey kept diligent notes and that will be a dramatic part of this thing, but the white house cant be pleased at either of these fronts in the congress or in the special prosecutor that james comey is going to be front and center in both of those realms. Reporter good morning. Youre right, several pending lawsuits and a federal investigation into whether fox news Parent Company violated any securities laws. With the passing of roger ailes, the question now, how do they move forward . There are very few human beings on this planet who are visionaries. Roger was one of them. Reporter overnight, bill oreilly speaking out about the passing of roger ailes. He was a tough guy and settled scores and that made him a big target. Didnt take any guff from the left or the right. He alienated a lot of people. He was very tough and a lot of people hated him and that hatred ultimately brought him down. Reporter oreilly telling listeners on his nospin news podcast, he thinks the fox news founder never really recovered after he was forced to resign last july following allegations of sexual harassment. His departure from fox news break his heart. There were accusations and he denied them, and ultimately, he walked away, and he was never the same. Reporter ailes steadily denied the allegations, but this work with remaining lawsuits against him and his former Network Still at large, his unexpected death calls into question what happens next in those pending cases. Roger ailes death will probably cause these lawsuits to be settled out of court. He was never deposed in either lawsuit, so he has never given his version of events under oath, so they have no way of directly refuting the allegations of the plaintiff. We remember our founder roger ailes. Reporter but as those cases go on, his former colleagues remembering him. Rogers legacy will live on through the fox news channel. Theres no doubt about it. Reporter roger ailes is survived by his wife elizabeth and son zachary and those who have brought allegations against their former boss and company are declining comment saying, theyre keeping that family in their thoughts and prayers. Im sure they are, rebecca, thank you. Joining us now is our legal analyst, dan abrams. So, we heard in rebeccas piece, do these cases have to be settled . They dont have to be. They might but they dont have to be. Theres an argument on each side as to who it could help. On the one hand you could argue that it helps the plaintiffs because roger ailes isnt there to respond so youll only hear one side of the story, his estate could say you shouldnt be allowed to private conversations if hes not alive anymore. Theres an arcane new york state law which typically doesnt apply in cases like this, which they may try to get to apply to prevent people from testifying about private conversations. A bunch of legal rulings. There are some pending cases where hes not even listed as a defendant. There is a huge difference between the cases where theyre suing roger ailes versus investigating or suing fox news. Any case that involves just suing fox or investigating fox is going to continue as is. He would have just been a witness. And those cases are going to continue. The tougher question is the ones where he was the defendant. Where he is the defendant, if he should lose those cases, the estate would pay . Thats right. In a case where someone dies, a car accident for example, the estate of the person who died takes on the responsibility. The plaintiff is then suing the estate of that person so thats going to be the case here. Anyone suing roger ailes in effect now is suing his estate and he moved to floor recently, probably in part because florida has very good laws when it comes to your home not being subject to any lawsuits, so theres a lot of maneuvering i think that was going on by roger ailes even before his death, and the legal maneuvering will continue. All right, dan, thank you. We switch to a scary carnival accident in Washington State where three people including a child tumbled from a ferris wheel, and abc news nick watt has the story. It was a funfilled evening that turned into disaster. Overnight, a basket on that ferris wheel, flipping over, sending three carnival goers plummeting up to 18 feet on the ground, striking the metal base. Witnesses reported their cart kind of spun sideways. Reporter the three, a 6yearold, a woman in her 40s both treated at a local hospital and 59yearold woman airlifted to a Trauma Center in seattle in Critical Condition. The accident happened at the socalled rhododendron festival held at a football field in washington, northwest of seattle. Festival organizers telling us overnight this was a tragic event and our thoughts and prayers are with all involved. Some of these rides send 2,500 people to the e. R. Each year. Why didnt you just take the computer away . I dont understand. Because when we did take it away, there was a lot of problems in our house with his behavior. Reporter al and christina confiscate the computer, even lock the router out in the car. Josh responds by lashing out, and then eventually dropping out of school. There was just a lot of anger. He hasnt been back on it since coming home. Of course at some point before School Starts theyll have to reintroduce it in a healthy way. Is this like Substance Abuse . Is it an addiction . Its interesting, a lot of the people we profile on tonights 20 20 have underlying issues like anxiety and depression and theyre using video games as a way to escape or numb anxiety, so that is similar. But the word addiction around video gaming or online social is very controversial. The American Psychiatric association is considering naming video gaming and Internet Addiction as a psychiatric illness or as a, quote, addiction but others argue its not. The World Health Organization is poised to make it a psychiatric illness, and many Asian Countries call it a Public Health crisis and have hundreds of Rehab Centers set up to treat it. Whatever you call it, not just kids and teens. No, its not. The average gamer is actually a 35yearold man.
