The latest here right now is that members of san joses homicide unit are just going to arrive here to start this session as to why a man in his 30s was shot and killed in the chest here this morning. It happened at 4 25 this morning, and that is when a resident was leaving to work and noticed someone lying in the street and immediately called police. The officers arrived and they found the victim, a man in his 30s lying in the street, dead, and they ruled that a homicide. Right now, officers do not believe this is gang related and they say neighbors reported a loud disturbance at 2 00 this morning and increasing are saying they believe the disturb an is related to the homicide. Police really do not help on this since they arrived on the scene the officers have been canvassing the area talking to neighbors and talking on doors trying to get more information. The question this morning how did he get in there . Police got the call at 9 30 last night to come here to the montgomery bart station. A man took the elevator to the concourse from the platform and said he heard a crunching sound and a yelp. Bart officials found the body inside the elevator shaft and they found personal belongings including bedding on top of the elevator. Bart riders are surprised and asking some questions. Should Homeless People be in here . That is an another situation. I dont know about that. It is hard to deal with. That is part of the investigation, why was he here . The elevator is out of order. If you are handicapped and ride bart and you need the elevator you may want to skip the montgomery station or if you ride muni this is the internal elevator. They have one that comes up to street level but if you need to ride inside the subway area, the tunnel area, you need to pick another station.
