The guard was caught in the crossfire and shot in the arm. He will be okay. On sunday, a woman was injured when she was caught in crossfire outside that same starbucks. One candidate has declared victory while the other has not conceded in that very tight race for san jose member. Sam lacardo has been leading but many ballots still need to be counted. Abc 7 News Reporter david louie joins us from San Jose City hall. He is acting very much like the mayorelect. Reporter he really is. He even reached out today to some of the opponents his opponent. We have been expecting a 5 00 update from the registrar of voters. I have been checking on the tablet to make sure we have the latest numbers. No change, still that 2 difference with lacardo ahead. Election officials point out no race is over until every ballot is counted. Sam lacardo has decided he has been duly elected the 65th mayor of san jose, even as only 2100 votes separate him from his opponent, the county supervisor. I recognize the registrar needs to do their job. I will let them do their job but i think its really important for us to put these ballots behind us and get to work on the business of the city. Reporter his opponent was nowhere to be seen today, electing to issue a statement over doing an oncamera interview, which read quote, although i congratulated him this morning on running a great campaign, this race is still too close to call. The staff has an estimated 120,000 mailin ballots to count that were left at polling places plus 10,000 provisional ballots that need verification of voter eligibility. We never consider any race over until we have counted every last ballot and definitely when youve got a contest like this with a close margin, a lot of people are going to be watching the results as we continue to process the vote by mailin provisional ballots. Reporter the process is expect ted to run into the weekend. Lacardo says he will work to rebuild the police department. We know we need to rebuild this department. We are going to do it by working together. Reporter to that end, he and the Police Union President have been playing telephone tag. The city of berkeley has done what no other city ever has anywhere in the country, pass a tax on soda. Voters approved measure d with a whopping 75 of the vote. This could be the beginning of a big battle in the city. The latest now from abc 7 News Reporter lyanne melendez. Reporter big soda is downplaying berkeleys victory over the soda industry. So much so that its unlikely they will fight it out in court. We always look at all options but i dont think we are going to do that. The voters in berkeley have spoken. Reporter berkeley officials are sure they will. I dont think its a concern. I think its just a reality. They are going to do it. They feel i think they feel if they can stop it here either at the ballot box which they couldnt or in the courts, that that will be a victory that will shut other people down. Reporter the no on d Campaign People went on to say soda tax activists have been venue shopping for more than five years. Berkeley was lowhanging fruit and doesnt look like mainstream america. Former new york city mayor Michael Bloomberg contributed 370,000 towards the yes on d campaign and today announced he would support other communities who are thinking of fighting big soda. We are hoping part of the message is that resources will be available to communities that want to take this battle on. Reporter at least 30 other cities and states have failed to pass measures to tax sugary drinks. The soda industry spent more than 2 million on the no on d campaign in berkeley and more than 9 million in defeating San Franciscos measure e. The industry believes other cities will not take berkeleys lead. As to what you saw last night with the outcome of the national election, it doesnt seem like the voters all across the country have an appetite for more regulation and taxation. Reporter the berkeley soda tax could benefit other nearby cities. A wet mess today in san jose after a water main break near a retirement community. As you can see, there was a lot of water flowing from the break. It happened just after noon near the villages parkway and hounds estates. Crews were on the scene to shut off the water as quickly as they could. Roads in the area were closed until crews could get that water shut off. About 320 kids at Alamo Elementary School in Contra Costa County were let out of school early today. Heres why. A construction crew struck a four inch natural gas line near the school at about 9 00 this morning. Sky 7 was overhead as pg e worked for more than three hours to cap that leak. By all accounts we have heard, 24yearold Darryl Blackman was a good guy, standout football star from berkeley who tried out for the niners this past spring. But early saturday morning, his car slammed into the end of a guardrail, into the end piece called the etplus. I tracked it down at a cal trans yard in petaluma and a guardrail expert confirms its the same model being blamed for injuries and deaths across the country. 39 states have now banned the etplus but not california. Words cannot express my agitation for why these governments are just ignoring the facts. Thats what theyre there for. Theyre there to protect me and you. Turning back to politics, House Minority leader nancy pelosi is running for another term as House Minority leader. She made that announcement right after winning another term in congress but seeing republicans gain even more seats in the house and take over the senate, pelosi sent a letter to her colleagues this morning telling them she plans to focus on Voting Rights and Economic Issues if they elect her again as minority leader. Jerry brown will spend a record fourth term as californias governor. At 76, he is the nations oldest sitting governor. Age is definitely something you notice. But i do think having done this so often, i understand things better than i used to. You know, reform and a fresh face can often be exhilarating. But theres no substitute for experience. It was an easy victory for brown, who devoted most of his campaign to supporting two ballot measures which passed overwhelmingly. Proposition 1 helped secure the states water supply and prop 2 put aside money for state spending in lean years. His republican challenger Neel Kashkari says hes not done with politics and will run again. He may have an uphill battle. Heres a look at how the state voted. Coastal blue for brown, inland red for kashkari. In richmond, grassroots campaigns took on big oil and won. San franciscos Arts Commission hosts three exhibits a year at city hall. Artwork seen by everyone from the mayor to out of town tourists. The latest focuses on the bayview. Thats a Community Residents feel doesnt get the positive attention it deserves. Heres abc 7 News Reporter carolyn tyler. Reporter he has been working on these photographs since 2010. In the beginning, trying to connect with the residents was challenging. I didnt know the community well. Reporter the outsider found his way in through Providence Baptist Church Founding in the 1940s, where hes now a member. Once he got to know the people, us, and started talking to us, the community welcomed him with open arms. Reporter he earned the trust and friendship of people like 83yearold mary booker. We have had enough of all the negative stuff. Its high time somebody saw something that has maintained this community over the years. Reporter it is a tightknit community where gentrification is bringing changes. This exhibit is timely. You see a body of work. You see an honoring. You see sort of the kings and queens of bayview, the people who live their lives there and have grown up there and known each other through generations. Reporter his photographs are matched with dozens the subjects pulled from their own family albums. The first time there has been an exhibit quite like this. Not just formal portraits but through an intimate look inside of the history of families. These guys never sleep. They reportedly used licensed cabs to make deliveries for them this fall in San Francisco and los angeles. The wall street journal citing sources says amazon teamed up with flywheel, a service similar to lift or uber. Most of the deliveries took place in the Early Morning when demand for a flywheel from its regular customers was less. Amazon hopes to speed up deliveries and outdo brick and more to mortar stores, perhaps a response to traditional retailers providing same day and even one hour deliveries. Many gm car owners arent taking their vehicles in to repair potentially deadly faulty ignition switches. I have been reporting on this. Some 2. 6 million cars have been recalled for a problem blamed on at least 29 deaths. Yet few cars that have been recalled have been brought in for repairs. As added incentive, gm is offering car owners a 25 gift card if they bring in a recalled vehicle by december 1st. The recall began some nine months ago. Wh what agreat idea. Doctors believe more than three Million People in the United States currently have chronic hepatitis c. Federal Health Officials say there is no reason any woman should ever die from Cervical Cancer. The centers for Disease Control says thats because the pap smear is quote, the most powerful tool in the history of medicine to detect precancerous change. Quite a statement, obviously.
