Distribution of that fine. 950 million going to the state general fund and 450 million thats going to repair the pipelines. We want to see those numbers reversed. So that rate payers get more benefit out of this decision because well have to pay less. Reporter pg e says theyre still dissecting the judges ruling. Theyve made improvements to the gas systems. Thats what we want to make sure is being taken into account here. That the final decision that the cpuc votes on is taking all that investment into consideration. Reporter pg e still faces federal criminal charges stemming from the gasline explosion. They include obstructing the federal investigation. If found guilty wlg they could slapped with another fine. Says more money should go towards fixing aging pipelines. Over 950 million goes to sacramento and disappears in the state general fund. Thats not how we do things at the federal government level and typically money is to be put back into the infrastructure system so that the upgrades make californians safer. Thats clearly not occurring here. The former top federal official on this subject. Now heres a look at the timeline of events over the san bruno blast. The explosion happened september 9th in 2010. In 2011 pg e admitted it was missing documents for its pipelines. The state announced it was going to fine the utility. And in december pg eing admitted liability. In 2012 pg e announced a rate hike and penalty. The cpuc proposed a 2. 25 billion penalty. Earlier this year pg e was indicted for obstructing the investigation into the explosion. And then today two judges said it should pay 1. 4 billion. This is the pool at the center of the offfield troubles for ray mcdonald. He was throwing a Birthday Party at his home here when San Jose Police arrested him for Domestic Violence against his pregnant girlfriend. Today he was on the practice field getting ready for sundays game against the cowboys. Coach harbaugh wants to see the investigation play out but doesnt want anyone convicted of abuse on his team. If someone physically abuses a woman and or physically or mentally abuses or hurts a child, then theres no understanding. Theres no tolerance for that. The team is expected to decide later this week whether mcdonald will play on sunday. Tiffany wilson talked to players today and joins us from the stadium. His pregnant girlfriend called police and when they arrived San Jose Police officers say they saw visible signs of injury. San jose police are still investigating and have not turned it over. Legal expert steven clark says the nation is looking at this as a test case. People dont want to see just because hes a celebrity and an nfl player that hes going to be treated differently than someone else in the community. This time a team owner is suspended for six games. Indianapolis colts owner jim irsay was slapped with the suspension and a half Million Dollar fine for violating the leagues personal conduct policy. He was arrested in march. Police say he was driving drunk and on prescription painkillers. Irsay today pleaded guilty to one count of operating a vehicle while intoxicated. As part of his plea deal, he was given probation. He cant drink alcohol and his license was suspended for three months. A boy was injured while shooting with his dad over the weekend. They were in georgetown in el dorado county. They had a home made shooting range when something hit him in the chest. He was released on sunday. Investigators are trying to determine whether it was a ricochet or Something Else that hit him. Governor brown is asking president obama tonight to issue a major disaster declaration. That would make quake affected areas in napa eligible for federal relief funds. In the meantime, the cleanup continues. Crews in napa had to contend with a new water main break today. A man says the gushing water damaged the road. Crews shut off the water about half an hour after the rupture. Another sign of recovery, quake damaged schools are reopening now. Kids back in school. But students are finally back in class today. School opened with an earthquake drill. Whether they talk about napas earthquake will be up to each teacher. Were going to take our cues from the kids and the teachers know that. I think all of the students have done a lot of sharing themselves. I think its good we move past it to get back on track. Reporter things are not quite back to normal. Theyve built and decorated a construction wall to block off the section of the school thats still considered unstable. Seventh grade is now in the library. Eighth grade in 234e art room. And the principal had to move her office too. Educators here say being back together is what matters most. To see the kids so excited about being back, absolutely. I am just overjoyed. Reporter just last year they did 300,000 years of earthquake retrofit work here. Some grumbled about spending the money. Eng b nears have upgraded the bell tower in vallejo to a yellow tag. The brick wall on top of that tower toppled during the quake. But the sanctuary survived. The church said everyone worked together to make sure every mass was held and every free meal given out to those in need. We could not even get in to get our supplies out so we could cook in the parking lot. But the community responded. The Salvation Army sent around their mobile canteen. Concern tonight that home depot may have been hit with a Security Breach that rivals the target breach from last august. This story is still developing right now. Home depot is not confirming its been hit with a credit card breach. The retailer will only say its looking into some unusual activity that has contacted laurmt to help investigate. Credit card information from home depot is being sold on an underground site known to traffic stolen financial information. Krebs reports the breach could have begun in late april or early may and could achieve 40 million accounts compromised in the target breach. Home depot says if it confirms a breach has occurred, it will notify customers immediately. Apple will unveil ts its new operating system along with its new iphone next week. It will bring new features to iphone users. Even those who dont buy the new phone. App developers who started using the new system this summer revealed some of the features. Those features include audio and video text messages. There will also be new editing features for photos and youll be able to start a call on a phone and finish it on your mac. Also predictive text will finish entire sentences for you. Not just words. The next new car you drive may be able to alert you when youve become too distracted to drive safely. General motors is reportedly getting ready to produce the first mass produced vehicles that will track your eye and head movement. Nick smith is live in alameda tonight to explain how people who dont conserve are getting caught. Nick . Reporter i have to tell you this lawn looks perfect but it does not need water because it is actually artificial turf. However, there are homes throughout the east bay not doing what they should when it comes to water con vags. That could get you noticed by your neighbors and a visit from east bay mud. We were just using too much water on the lawn. Reporter because of californias statewide ban, camille has reduced her water use. But other east bay mud users havent been as concerned of either cutting back. And shes very, very prudent about her watering right now. She waters, i think its, two or three times a week. And thats all. Reporter the folks at east bay mud are seeing record complaints about lawns that are too lush when others are little more than sticks and stones. I was calling earlier to followup to a report of water waste that we received about your house. Reporter jolene is with east bay mud. In january east bay mud averaged 20 water waste complaints a month. In august there were 419. It is her job to record complaints and then hit the streets to investigate. Most of our water waste reports are coming from Single Family homes where the report is people have been overwatering their lawns. Reporter we were there as she looked for water waste. There were puddles, puddles, and more puddles. Any efforts made now are going to put us in a better position for the future. Reporter she left a flier on this door for Water Conservation along with her phone number to speak about the complaint. The investigation works like this. First east bay mud calls alleged violators. Then they send a letter. Next is the onsite visit from jolene. We are definitely not the water police. Reporter east bay mud says continuing violators could get restricted water use.
