And then today two judges said it should pay 1. 4 billion. This is the pool at the center of the offfield troubles for ray mcdonald. He was throwing a Birthday Party at his home here when San Jose Police arrested him for Domestic Violence against his pregnant girlfriend. Today he was on the practice field getting ready for sundays game against the cowboys. Coach harbaugh wants to see the investigation play out but doesnt want anyone convicted of abuse on his team. If someone physically abuses a woman and or physically or mentally abuses or hurts a child, then theres no understanding. Theres no tolerance for that. He was arrested in march. Police say he was driving drunk and on prescription painkillers. Irsay today pleaded guilty to one count of operating a vehicle while intoxicated. As part of his plea deal, he was given probation. He cant drink alcohol and his license was suspended for three months. A boy was injured while shooting with his dad over the weekend. They were in georgetown in el dorado county. They had a home made shooting range when something hit him in the chest. He was released on sunday. Investigators are trying to determine whether it was a ricochet or Something Else that hit him. Governor brown is asking president obama tonight to issue a major disaster declaration. That would make quake affected areas in napa eligible for federal relief funds. In the meantime, the cleanup continues. Crews in napa had to contend with a new water main break today. A man says the gushing water damaged the road. Crews shut off the water about half an hour after the rupture. Another sign of recovery, quake damaged schools are reopening now. Kids back in school. Concern tonight that home depot may have been hit with a Security Breach that rivals the target breach from last august. This story is still developing right now. Home depot is not confirming its been hit with a credit card breach. The retailer will only say its looking into some unusual activity that has contacted laurmt to help investigate. Credit card information from home depot is being sold on an underground site known to traffic stolen financial information. Krebs reports the breach could have begun in late april or early may and could achieve 40 million accounts compromised in the target breach. Home depot says if it confirms a breach has occurred, it will notify customers immediately. Apple will unveil ts its new operating system along with its new iphone next week. It will bring new features to iphone users. Even those who dont buy the new phone. App developers who started using the new system this summer revealed some of the features. Those features include audio and video text messages. There will also be new editing features for photos and youll be able to start a call on a phone and finish it on your mac. Nick smith is live in alameda tonight to explain how people who dont conserve are getting caught. Nick . Reporter i have to tell you this lawn looks perfect but it does not need water because it is actually artificial turf. However, there are homes throughout the east bay not doing what they should when it comes to water con vags. That could get you noticed by your neighbors and a visit from east bay mud. We were just using too much water on the lawn. Reporter because of californias statewide ban, camille has reduced her water use. But other east bay mud users havent been as concerned of either cutting back. And shes very, very prudent about her watering right now. She waters, i think its, two or three times a week. And thats all. Reporter the folks at east bay mud are seeing record complaints about lawns that are too lush when others are little more than sticks and stones. I was calling earlier to followup to a report of water waste that we received about your house. Reporter jolene is with east bay mud. In january east bay mud averaged 20 water waste complaints a month. In august there were 419. It is her job to record complaints and then hit the streets to investigate. Most of our water waste reports are coming from Single Family homes where the report is people have been overwatering their lawns. Reporter we were there as she looked for water waste. There were puddles, puddles, and more puddles. Any efforts made now are going to put us in a better position for the future. Reporter she left a flier on this door for Water Conservation along with her phone number to speak about the complaint. The investigation works like this. First east bay mud calls alleged violators. Then they send a letter. Next is the onsite visit from jolene. We are definitely not the water police. Reporter east bay mud says continuing violators could get restricted water use.
