Now to new details in the amtrak crash that killed at least seven people back east. The derailment happened in philadelphia along the northeast corn corridor. Daylight revealed mangled wreckage. Reporter ama and larry, this train was going 106 miles an hour thats more than twice the legal speed limit for that stretch of track here in philadelphia. Think of going 120 miles an hour down highway 101. In this case the engineer knew something was wrong and he pulled hard on the emergency brake, but trains are big and they are heavy and they take time to slow down and this engineer was all out of time. . Just look at it. 660 feet of mangled amtrak steel, twisted now, much of it flipped on its side after a horrific and fatal derailment that once it seemed totally preventable and even the passengers knew it. And i just remember like a hit and i remember i flew all over the place. In this case it seems quite likely that speed caused the accident. And the National Transportation safety board now estimates based on the trains event recorders that regional 188 was traveling roughly 100 รท Miles Per Hour twice the legal speed limit as it p proached the curb that sent it hurdling over the rails and all seven cars jumped the tracks and several spun on to their side sending cell phones and luggage all over their bodies hurdling into the air. 20 hours later emergency workers still dont know if they found everyone. Its expanded this morning with officers and other personnel to look even further in case someone was possibly thrown from the train. The scene is a horrific and heartbreaking scene and my prayer goes out to the people who laugh their lives in this terrible tragedy for those who are injured and all of their families. One train looks like its in pieces. Reporter in those frantic first moments after the crash the cars still smoking and smoldering and the rescue effort under way, the mayor arrived. I saw people behind us walking off of that train and i dont know how that happened, but for the grace of god. Reporter the engineer is under no legal obligation to talk to ntsb investigators and so far he has declined to talk with them. The ntsb spokesman said he hopes that will change. I can tell you guys that you see this big satellite truck back here, but beyond those there are workers and heavy machinery and those folks are preparing the work of picking up those trains. Remember, these are 60ton cars each. They have to be brought out by cranes. The cranes are in place, but now they have to begin the work of actually moving those cars. Theyre moving them to a safe location where they will be investigated further by the ntsb. All that work is just in its infancy. They have so much work still to do here and ntsb investigators will be on the scene all night tonight and tomorrow. It will be a while before traffic along this northeast corridor is moving again. Reporter Larry Devon Ellis attended this school oakland tech and he was 14 years old when he was shot in the fruitvale district in oakland by someone he never knew. His family today was in court to meet the alleged gunman. Reporter this was this shootout with Hayward Police that provided the evidence to link 28yearold Donald Higgins to the murder of 14yearold devon ellis several miles away in oakland. Finally some justice in dealing with my sons murder. Reporter thats the 14yearolds father who was in court today as higgins was charged with several counts of murder and attempted murder. One day after his sons death, the alleged gunman barricaded himself inside his mothers home in hayward after Police Spotted him in a white, 2004, infiniti suv. We did not know what his mental state was and we were concern with finding him and capturing him. Reporter his suv matched the description given earlier by five other victims at Calstate University east bay. Police say several hours after higgins killed the 14yearold he shot several times at their car. They were not hurt. He was mad at something. Mad at the world, i guess, and he went out trying to kill as many people as possible. Reporter after the shootout, police found a handgun with a 30round magazine. According to the report the bullets matched casings recovered at the hayward shooting scene. Police say they have evidence and statements that connect higgins to the murder of the 14yearold. Devon attended oakland tech a School District spokesperson described him as a promising young man. The jury of seven women and five men is the same group of jurors that found 21yearold Dzhokhar Tsarnaev guilty on all counts for his involvement in the Boston Marathon bombing. The blast at the finish line in 2013 killed three people and injured more than 260. Throughout the trial the defense tried to paint the 21yearold as a lost, young man who participated in the bombings under the influence of his older brother tamerlan. Today prosecutors told the jury tamerlan was not the mastermind, that the two brothers were partners in the crime adding dzhokhars actions destroyed many lives and his actions earned him a sentence of death. In their closing arguments, the defense opened by asking the jury to choose life trying to humanize the convicted bomber describing dzhokhar as a quiet and invisible young man who grew up in the shadows of his radicalized older brother. The mission for the defense now convince just one juror to reject the death penalty. If even one juror is not persuaded for Capital Punishment here the judge must sentence him to life without the possibility of parole. Reporter theres been a rash of these crash and grabs where robbers use their cars as battering rams to get inside stores and the problem for police is that these robberies happen in the blink of an eye. They happen so quickly, the robbers are gone before police can respond. Shortly before 4 00 in the morning, the red Jeep Cherokee smashes into the store. Palo alto police agent mariana describes what happens next. They were wearing black hoodies and using some type of tool smashed open several jewelry glass cases and removed several items of jewelry. It happened quickly and the thieves were in the store no more than two minutes and five hours later a veteran officer finds a jeevp and knew exactly where to go and San Francisco creek, the thief his left along with their loot. This was the second crash and grab robbery in palo alto in several months. The photography store was hit in midfebruary, two men rammed the frontend store and pushed back the steel chain gate just enough so they could crawl into the store.
