I have no details on where negotiations stand with her at this point or if its looking like its going to be something that will resolve itself quickly or be extended into the commute hours. I know traffic on the southbound side was at least backed up to calaveras approximately 30 minutes ago. It is definitely going to impact and be a delay for people who are traveling southbound and northbound trying to make their way out of the area. For an exact amount of time, for how long it will take to clear those lanes, i dont have that information. Right now a building at san jose state has been evacuated after someone reported seeing a person with a gun. Police have blocked off a large area of the Lucas College Business Building near south 10th and san antonio streets. Police have not found anyone with a gun yet. But they are searching the building and the surrounding area right now. We will keep you updated on this situation and of course, on the person claiming they are prepared to jump off the overpass in san jose here during this hour and on our twitter feed. We do have other news this afternoon. There are accusations that San Francisco police and prosecutors are holding the wrong teenager for the shooting death of 14yearold rashawn williams. The public defender showed Surveillance Video that he says proves that. Abc 7 News Reporter Lyanne Melendez joins us in the newsroom with this story. This is a case known well in San Francisco involving rashawn williams, a freshman from sacred heart. He knew the two teens that approached him, one of them has been charged. Hes in juvenile hall. The other teen has been under the watch of police and with this new video obtained by the public defender, things may change very quickly. These september 2nd photos show two young men walking on mission and 24th. Their faces are blurred out. The one circled in blue is the teen accused of stabbing rashawn williams. He is wearing lightcolored khakis and a short sleeve shirt. Behind him circled in red is his friend wearing black pants and a sweatshirt. With long sleeves. The video shows that it is not our client who is responsible for the stabbing, that it is another individual. Reporter its this video that San Francisco public defender says shows the other teen stabbing williams. Williams with the yellow circle around him comes out of the Convenience Store on 26th and fulsom streets and the two teens turn around. Keep an eye on the teen in red and his right arm. The public defender says the moment he stabs williams, not the teen in custody, williams stabbed in the heart, then runs but eventually collapses. We are asking that the case be dismissed after this review and we are hoping that it happens sooner as opposed to later. Reporter the d. A. s office says it has seen several videos but has not charged the other teen because the investigation is still ongoing. These cases are always ongoing. There is always new information that comes around and we have to be deliberate and measured in the way that we respond. Reporter with these new events the d. A. s office is also investigating whether the teen they have in custody was somehow involved in planning and ordering the stabbing. Lyanne melendez, abc 7 news. A San Leandro Police officer shot a woman after police say she hit him with her car. The woman suffered critical injuries. Police say it began with a pursuit last night when Police Spotted a stolen vehicle and the driver tried to ram police cars. Then when she was cornered in oakland, police say she crashed into more patrol cars and officers opened fire. The Oakland Police departments homicide section is investigating which Officials Say is department policy. A Video Showing Police arresting a football fan at levis stadium is raising a lot of questions tonight. It was shot during the pac12 championship game friday night and police say there is much more to the story than what is being seen in that video. Abc 7 News Reporter vic lee joins us from santa clara with the latest. Reporter as you said, the video showed what happened during the scuffle with police. Police say theres a lot more which the video did not show. First of all, all of those security guards involved in the arrest were members of the Santa Clara Police department. The officers right over here. They say that the departments p. I. O. Says the security guards were members of this department used quote, sufficient force to make the arrest. The p. I. O. Says that the oregon fan is exceptionally strong, he is 511, weighs 240 pounds. Lyden declined to talk to us but referred us to his attorney who did not return our call yet. Friday night, halftime at the pac12 championships at levis stadium, the oregon ducks against the arizona wildcats. Inside levis stadium, it gets a little wilder. An oregon fan identified by police as 44yearold mark lyden gets into an altercation with a security guard, who is an off duty Santa Clara Police officer. The person shooting the video starts rolling when the guard is trying to arrest lyden. After telling the officer not to touch him, he tries to leave on his own through the crowd. This as someone, perhaps the person recording, wonders why the guard is brandishing a taser when lyden is not armed. At least one officer begins hitting the man with his baton. Other officers are involved in trying to subdue him. You will see one wrap his arm around the mans neck trying to bring him down. The officers shown in the video with a baton breaks it while hitting his leg. After an intense struggle, lyden is finally forced to the ground and put in handcuffs. This is what you see on the video. What you didnt see was what started the altercation. Police say lyden was with a crowd exiting from the stands to the concourse during halftime. They say he got into an argument with a Guest Services staffer and he was agitated and appeared drunk. He became belligerent, used profanity and our officers were forced to the scene. Officers attempted to calm him down and he wont listen to the officers. The officers made a determination to eject him. Reporter the lieutenant adds that lyden pushed an officer twice during his attempt to calm him down. To set the record straight, clark says no officer used a taser on him. He is charged with assaulting an officer and resisting arrest, two misdemeanor charges. Vic lee, abc 7 news. Now to our storm watch coverage. The rain is expected to arrive on wednesday night so lets take a look at some of the concerns for thursday which will be the day we get the full force of the storm. Heavy rain likely, three to five inches possible in the wettest locations. That of course raises the possibility of flooding. We can expect strong potentially damaging winds. There may be downed trees and Power Outages with these powerful gusty winds and the driving rain. Just be prepared for a messy day on thursday, probably a horrible commute. The storm coming in later this week could be the largest we have had in years. People all over the bay area are already preparing. In mill valley there is still flooding from last weeks storm. Barricades have been set up to prevent drivers from parking in a lot that flooded last week. While flooding is a primary concern, some Business Owners are also worried about how it will impact business. The issue is cars cant get here if its too flooded. So thats really all it is. There was one day last week we couldnt actually open so that hurt our business. But as far as the water itself, you know, we wait an hour or two, it goes down. Its not that huge of an issue except for those few hours during the day when we cant actually let customers in because they cant physically get here. Officials are warning both residents and businesses to have sandbags ready in case of flooding. Marin county residents are also encouraged to sign up for alerts so officials can update you on current hazards. Workers are scrambling to plug up a huge sinkhole in San Francisco before that fierce storm arrives. The hole opened up during last weeks rainstorm after a water main burst. That created a 20 foot crater in middle of lake street. This morning workers were still fixing the water main but said they expect to fill in the hole by tomorrow. In the meantime, several blocks around lake street and 6th avenue remain closed to through traffic. Happening now, protest leaders plan to rally again in berkeley after marches over the weekend turned violent and put activists at odds with police. Sky 7 hd found people breaking windows during last nights protest. A group called by any means necessary is organizing tonights demonstration. They are planning on gathering at bancroft way and telegraph avenue. They are motivated by two recent classes when grand juries declined to indict White Police Officers in the deaths of unharmed black suspects. Protesters will gather again in about an hour and people in berkeley are worried about more violence and vandalism. Heres a look at where they went last night. They started at telegraph and bancroft and made their way to shaddock. Then they split into two groups and made their way down shaddock and telegraph, where they took over and stopped traffic on highway 24 before Police Chased them off. Back up by shaddock by berkeley city hall, busting windows and looting along the way. Abc 7 News Reporter Sergio Quintana was there last night and joins us with todays cleanup and concerns about what might happen this evening. Reporter we spent much of the afternoon watching some contractors cutting up these big wood panels that they are then installing on some of those stores that were vandalized last night right here on this block of shaddock. There are about five businesses, just a few that were vandalized as last nights protests spiralled into violence. At the radio shack just down the street from here, a rogue demonstrator looted through the store and when he tried to leave, another protester tackled him. Then a melee broke out. From sky 7 hd we watched as vandals smashed out store window after store window. At cream, which is an ice cream shop on telegraph avenue, another mob tried to smash through the windows. Then other protesters tried to stop the vandalism there. The shop manager today tells me they were employees inside that shop when that attack happened last night. They were a little freaked out. Im just glad everybody was safe inside and we are honestly very thankful for the protectors who tried to protect the shop. Reporter Berkeley Police took a more handsoff approach. Protesters had complained they were too heavyhanded, saying police used rubber bullets and night sticks unnecessarily. Police from other Alameda County agencies were called in for backup on saturday night but last night, Berkeley Police tried to simply parallel the demonstrators, that is until they shut down highway 24. Of course, it does sound like a construction project out here but they are simply trying to board up a lot of the windows. We will hear more about that coming up on abc 7 news at 5 00. Thats because we are told a woman is threatening to jump from that overpass. In the back you can see all those cars stretching for miles. That is a backup that has been created because of this. Lets go down south now. Flames filled the skies in Downtown Los Angeles this morning after an Apartment Building under construction caught fire. The flames so intense, firefighters struggled to get it under control. Abc News Reporter ted rowlands is in l. A. Reporter flames so high they could be seen for miles and heat so intense, fire trucks were initially forced to keep back from the scene. You are talking about a blow torch of heat on two major high rises in the Downtown Los Angeles area. Reporter the inferno ignited overnight at an apartment complex under construction next to l. A. s main downtown freeway before firefighters could get close enough to battle the blaze two adjacent high rise buildings started to catch fire. They did have papers, they had blinds, window screens. They had actually started catching on fire or melting due to the amount of radiant heat. Reporter more than 250 firefighters converged on the raging fire running hoses by hand to get close while trying to prevent the other two high rise buildings from becoming a total loss. We had the intense heat that was affecting the freeway that was affecting the high rise and to get resources and everything down here was very difficult. Then to know that a high rise is starting to take off behind you, that is an extreme situation. Reporter the construction site is likely a complete loss but firefighters were able to save the two other buildings. There were no injuries associated with this fire and at this point, no official cause. Ted rowlands, abc news, los angeles. That fire has similarities to one that destroyed an Apartment Building under construction in San Francisco. You may remember the inferno last march in the mission bay neighborhood. Just spectacular, devastating fire. We will take a look at how that area has changed since the fire coming up on abc 7 news at 4 30. Stay tuned. San Jose City Council will likely approve one of americas first taxes on residents who rent their homes to people through Services Like air b b. If approved renters would pay a 10 tax, the same rate hotel guests already pay in san jose. The same law will legalize home sharing which is technically illegal under san jose law, and it will cap the number of days a home could be rented. The council will vote on that tax tomorrow. As we touched on earlier, pretty big storm is heading our way and will be here in the not too distant future. For the latest lets get to Spencer Christian with todays accuweather forecast. Lets get right to it right now. Live doppler 7 hd, we have increasing clouds around the bay area. Some breaks of blue, its not completely cloudy yet as you can see from this live view looking back at part of the skyline of San Francisco. These are the forecast features. Storm arrives wednesday night, heavy rain and wind will be moving through the bay area all day thursday and there is a possibility of flooding and wind damage. Lets take a look at this developing storm, well out to sea at the moment. Dry and mild in the bay area tomorrow but that powerful storm is steaming in our direction and we will start to feel its effects by Late Wednesday. Lets start the forecast animation. Wednesday evening at 7 00, at which point we will have maybe a little light rain developing up in the north bay. By midnight and into the overnight hours towards the beginning of the morning commute on thursday, we will see heavy rain spreading through all parts of the north bay and beginning to push into the east bay and down to the peninsula just south of the golden gate by the beginning of the morning commute. By the middle of the morning commute we will see moderate to heavy rainfall all across the bay area. Very heavy local downfors are likely. Midmorning, 10 00 in the morning, we will see just a long line of moderate to heavy rainfall right through the central part of the bay area and on we go into picking up midmorning thursday into thursday afternoon and evening. Moderate and heavy rain continues into thursday night. Start to lighten up a bit by friday morning and we will finally wind down by friday night. As we take a look at the rainfall projection for this big storm, you will see that by friday we may be looking at as much as four to six inches of rainfall in the higher elevations, one to three inches in the lower elevations. You can see why theres potential for flooding. Flood watch is in effect from wednesday night to thursday night all across the bay area and beyond. We also have high wind advisory, wind watch in effect from wednesday evening to thursday evening. Winds could be gusting 40 to 60 Miles Per Hour at times. We may see downed trees and power lines. And a High Surf Advisory is in effect for the coastal north bay from tuesday night to friday morning. There is a chance of dangerous rip current. In the sierra, winter storm watch in effect. We could see 10 to 20 inches of new snow above 5500 feet with strong gusty winds. Back in the bay area, cloudy skies tonight, lows in the low to mid 50s. Tomorrows highs, mild, mainly mid to upper 60s. Heres the accuweather seven day forecast. Once again, rain arrives Late Wednesday night, north bay. Heavy wind and rain throughout the day thursday. The trouble began just before 3 00 when a woman began threatening to jump from the overpass. The Highway Patrol has stopped traffic well before drivers reach that overpass. San jose Police Negotiators are trying to convince the woman to climb to safety. We want to update you on other breaking news thats happening in san jose. Police are doing a floor by floor search of the business tower at san jose state university. The building was evacuated more than an hour ago when someone reported seeing a person with a gun. Police have not found the gunman but have blocked off the Business Center while they search the area. That has caused traffic problems along south 10th and san antonio streets in downtown san jose. Abc 7 News Reporter Sergio Quintana has followed the story all day long and he tweeted this picture, saying day three of berkeley protests, contractors are installing wood panels over business windows on shaddock. And be prepared to get wet again. Forecasters say the biggest storm to hit the bay area in years is going to arrive later this week. It follows a deluge last week that caused some flooding. Local public works crews say they are ready but warnings are going out just the same. We should expect some problems although of course, we badly need every drop of rain. Investigators believe there is no connection between two massive fires that lit up the sky in los angeles overnight. One destroyed an apartment complex being built in downtown l. A. , huge fire. Windows in nearby buildings melted because of the searing heat. Another fire damaged at least ten businesses about two miles away. Several months ago, remember, up here a large fire swept through an apartment complex being built in San Francisco. An enormous blaze. Abc 7 News Reporter Tiffany Wilson takes a look at what happened since that fire in march. Reporter well, the building behind me is known as nb 360 block 5. It was supposed to open in august. That didnt happen, but they have made a lot of progress since the day after the fire. It took 150 firefighters hours to extinguish a fire that erased months of hard work. This video shows the destruction just a few days later. Construction workers estimate the 172 unit complex was 80 complete prior to the march 11th fire. Investigators ruled it an accident most likely the result of welding work on the top floor. Johnny khan remembers watching the building burn. Today, crews hammer nails into new wood, rebuilding every inch of what was lost. Off camera, a worker told me there is still about a month of work behind where they were in march. The setback led to significant repercussions for the Furniture Store across the street. The showroom is empty, alienated by construction, closed off to foot traffic. The owner worries they may have to close. Overhead, cranes crown mission bay. The Warriors Arena expected to break ground soon and the new ucsf hospital should open in february. Mission bay residents consider this an awkward but exciting growth spurt for the neighborhood. I think its going to be a completely different area. We moved here four years ago and it was basically none of these big buildings around. Its going to be amazing. I hope theres more shops and restaurants because i work here and theres just not enough around here. Six people are dead after a private jet crashed into a house in maryland. Happened just outside washington, d. C. The three people aboard the plane and three residents of the home were all killed. Two nearby homes caught fire after the crash but werent as badly damaged. The accident happened less than one mile from the Montgomery County airport. The National Transportation safety board launched a team to investigate the cause of that crash. A new report by the Senate Intelligence committee is sparking controversy even before its release. The report details the use of torture by the cia and u. S. Intelligence agencies are expecting backlash both here and abroad after the details become public. Google will pay at least 19 million to settle claims that consumers were charged while their children made purchases using the apps aimed at kids. The Mountain View based tech giant has also changed its inapp purchasing process. Privacy researchers and consumer advocates are claiming that many mobile apps marketed to children still collect data on kids even with the new privacy laws on the books. Federal regulators started requiring App Developers to obtain parental permission in june of last year before they could collect information on kids younger than 13. Some games and other apps collect vast amounts of information including a persons location and even voice recordings. An oregon lawyer wants everyone to know what its like to drive as an africanamerican and she made the app to do it. Chris willis reports. We used the name driving while black because people of color experience a disproportionate number of traffic stops. Reporter maryann highlands a portland lawyer. African americans are stopped almost two times more than their white counterparts. Reporter and now she is an entrepreneur. Her new app driving while black is getting a lot of attention. Black people talk about the phenomena of driving while black and a yearning for resources to help navigate those encounters with the police so they stay safe. Reporter by they, she means everyone. The driving while black app is focused on africanamericans but she says its for everybody, to educate best practices to use during traffic stops, to know your rights and to stay safe, officers included. They recognize the challenge officers face on a traffic stop, that they are very unpredictable and a lot of times bad things can happen during a traffic stop to Police Officers. Reporter it was ten years ago when highland vowed to educate people, especially youth, about the dangers involved in a traffic stop. About ten years ago, when kendra james was killed during a traffic stop, i went to a Community Reporter there, she met her now business partner, melvin odenorr. The app includes a contact function. It will have a record function to record the stop. A complaint function that includes a commendation to give police feedback. And a function to help parents educate their kids. In todays racial environment, police say they welcome anything that helps. A lot of emphasis on interactions between Police Officers and africanamericans and so understanding that, this seems like an effort trying to improve that relationship. The driving while black app urges people of color to avoid tinted windows and to keep their headlights in working order. Portland police say from 2011 blacks are more likely to be pulled over for equipment and license violations than white drivers. Lets update you on other breaking news in san jose. An allclear given at the business tower at san jose state university. The building was evacuated earlier this afternoon after someone reported seeing a person with a gun. Police have not found a gunman, thank goodness, but they blocked off the Business Center while they searched the area. That building has now reopened. Drivers have been stranded for more than two hours now in both directions of the freeway is closed due the a woman threatening to jump. This is where its happening. She is threatening to jump on to 680. The woman climbed on to the overpass just before 3 00 this afternoon. Negotiators for the San Jose Police department are trying to convince her to climb back to the street. All of this happening while drivers have been stopped for a little more than two hours now. One of those drivers talked with us by phone just a short time ago. No one informed us of anything. All we were told was to exit the freeway, they are trying to get five lanes of traffic on to one exit. Now lets go back live to sky 7 hd and take a look at the backup. Nothing moving on the lower deck as you can see. Its hard to tell where the backup is because the freeway looks completely empty right now. Strange sight, isnt it, this time of day, middle of the afternoon evening commute. That stretch of highway deserted because its been closed in both directions.
