good evening. and we have that big news tonight from new hampshire, where we have a winner in the republican primary, taking us one step closer to the presidential election in november. governor mitt romney has won. and he has won decisively. abc news can also project congressman ron paul in second. and governor jon huntsman in third. and since governor mitt romney has done no other republican challenger to a president has ever done, swept iowa and new hampshire. it's "your voice, your vote." and david muir is at romney headquarters for the rousing response there tonight. david? >> reporter: they are alternating mitt and their applause here. a huge win for mitt romney here in new hampshire. making history after winning iowa by just eight votes. now, new hampshire after, the first nonincumbent to do that. his son, and his tagg, matt, and craig up there behind him. tonight, he has made history. here's what the governor said just moments ago. >> this state has always been a very special place for our family. ann and i made a home here. we filled with great memories of our children, our grandchildren. the granite state moment is one that we'll always remember. we have our five sons behind us. and our daughters and family here. tonight, we celebrate. tomorrow, we go back to work. >> reporter: tomorrow, they go back to work, talking about south carolina. the campaign, telling me tonight, they are ecstatic about this win. they did quite well. and as you know, diane, the last 24 hours, mitt romney got under scrutiny, saying he likes to be able to fire people. talking about insurance companies. and americans should be able to fire them if they're not happy with them. now, they move forward to south carolina. they acknowledged to me this evening, that that will be a much different contest. they're already ahead in the polls. they think the win in iowa and tonight here in new hampshire, will buoy them as they move forward. diane, as i told you earlier, they went and saw "mission impossible." the younger children and grandchildren, seeing "the muppet movie." now, they move on to south carolina. tomorrow we'll be with them. diane? >> david muir at romney headquarters. let's bring in george stephanopoulos. what was in the exit polls about how this happens? >> the voters were looking for somebody who beat president obama. and they believe that mitt romney is that person. he got 59% of the votes. no one else even close. newt gingrich at 14%. ron paul at 11%. also, david talked about the front-runner treatment for mitt romney over the last couple days. we see some effect there. if you look at the voters who decided early, they went well for mitt romney. 45% to 25% for ron paul. among those who decided in the last few days, the vote was a little more splintered. his vote totals were going down. and another thing that happened tonight, diane. huge turnout from independents in new hampshire. they were nearly half of the republican primary. >> we've been saying this has to be one of the things the white house is going to watch the most. >> no question. >> stay with us here, george. as we said, ron paul did come in second. and jon huntsman in third. and abc's jon karl is tracking both of them. jon? >> reporter: diane, jon huntsman was counting on coming in first, second or third here. they feel good they came in third. they say it is on to south carolina. as far as ron paul goes, they point out that this is basically mitt romney's backyard. he was governor of the neighboring state. he has a home right here in new hampshire. they go to what they think is friendlier territory in south carolina. for ron paul and jon huntsman, they feel they have enough to continue on this campaign. let's go to jake tapper. he's been following rick santorum. and has been following gingrich. let's see what the results said for them today. jake? >> reporter: well, diane, rick santorum came out of iowa hoping for a big surge here in new hampshire. he has visited this state more than any other candidate except for jon huntsman. but, of course, he is not performing all that well. this is not a state that has as much of an emphasis on social conservatism as did iowa. so, he is underperforming here. he is looking forward to south carolina, where he says he will draw more distinctions with front-runner mitt romney and hopes to emerge as the conservative alternative to romney, diane. >> thank you, jake. moving on to south carolina, can they stop romney? >> the nomination is very hard for mitt romney to lose. this is the dynamic to watch over the next couple of weeks. the conservatives close ranks behind a single alternative to see if they can take out mitt romney? or will the establishment close behind mitt romney and give him the victory in south carolina. south carolina has been the suicider in every primary since 1980. if mitt romney wins there, you can bet he gets the nomination. >> and the ads are up and running. >> newt gingrich has a very tough ad against mitt romney right now. >> george and i will have full wrap-up on "nightline." the big results of this day in new hampshire. and we move on, now, with the primary battle in new hampshire today, a different but extraordinary debate at the supreme court. as the justices tackled questions americans argue, in our living rooms. what language and what nudity should be banned from network tv? abc's cecilia vega tracks the action on the court if for us tonight. >> reporter: from bono's f-bomb -- >> that's really, really [ bleep ] brilliant. >> reporter: to the infamous wardrobe malfunction. the supreme court is debating dirty words and images in primetime. right now, profanity and wardrobe malfunctions can get broadcasters slapped with six-figure fines. the networks, including abc, argue in this day and age, that's just not fair. justice samuel alito asked, what would it all mean for young eyes and ears? are they going to be seeing a lot of people parading around in the nude and a stream of expletives? he asked. >> [ bleep ]. >> reporter: that was the curse at the heart of this case. fox violated the fcc's rules on decency, based on a supreme court ruling from all the way back in 1978. back then, there were only a handful of broadcasters. but today, there are hundreds of outlets. and only old-fashioned broadcasts that use the airwaves face a fine. >> time has come to treat broadcast tv on an equal footing with all of the rest of the media. >> reporter: the fcc's inconsistent policing troubled some court justices. one bad word from a celebrity brings a fine. while a stream of profanity in the tv version of "saving private ryan" doesn't. justice elena kagan. the way that this policy seems to work, it's like nobody can use dirty words or nudity, except for steven spielberg. but should broadcasters be kept as the last island of civility in a television culture? chief justice john roberts is the only justice with small children. all we're asking for, he said, what the government is asking for, is a few channels where you can say, i'm not going to -- they're not going to hear the "s," word, the "f," word. justice sotomayor recused herself from this case because she dealt with it in a lower court, which means there could be a tie decision. any decision is not expected to come until early summer. diane, that means stay tuned. >> okay. thank you, cecilia. and now, it was rev your engines day. the 2012 north american auto show in high gear in detroit. amid big news, today, of even more mojo for cars made in america. japan's powerhouse automaker, honda, moving its high-end luxury brand right here to ohio. and that means american jobs. here's abc's chris bury with the hot, new cars in detroit. >> reporter: at this year's big show, the mo in motown stands for "momentum." 40 debut models. the chevy tru, and code. the new dodge dart. all introduced with the glitz and glamour so missing during detroit's doldrums. what's the message? >> i think the message is the car industry is alive in detroit and in america. >> reporter: the new year, looking up after a strong 2011. car sales up 10% for the year. americans buying nearly 13 million cars and trucks, the most since the dog days of 2008. even foreign companies see growth here. acura just announced it will make this new high-end sports car in ohio. the first time a japanese luxury model will be built outside japan. why build it in ohio? 100% are now imported. so is 75% of our apple juice, asparagus and processed mushrooms. we saw firsthand the amount of produce pouring in at just one u.s./mexico border crossing. it is staggering. the fda inspects only about 2%. it's mainly up to other countries and importers to ensure this food is safe. the fda is warning orange juice companies to come up with a way to ensure that this pesticide does not show up in the orange juice here. as of tonight, though, the government says your orange juice is safe to drink. but it continues testing. diane? and if not, what does? we asked abc's chief medical editor, dr. richard besser, to look into it. >> it's over. >> reporter: "sex and the city's" carrie bradshaw used the nicotine patch to quit. and 132 separate medical studies back up its effectiveness. but a new survey says that she might just as well have thrown the patch away. the new survey, looking at smokers in the real word, found people who tried to quit using nicotine replacement, had no more success than people who quit cold turkey. >> when you take a drug and put it into the real world, we have a lot of people who just don't adhere to instructions. >> reporter: a few of the quitters in this real world survey did not use the patch for the recommended eight weeks. >> they're almost experimental quitters. what you get is failure. >> reporter: so, what does work? human nature. by offering help to quit, and by making smoking difficult and expensive, new york city has cut the number of smokers by 35%. taxes here make a pack cost more than $14. and where can you smoke in new york? i couldn't smoke here in this restaurant. or even here, at the bar. at the office. or in this public park. or even here in times square. 25 states now ban smoking in businesses and restaurants. and that may work better than patches or gum, in turning us into a non-smoking nation. also key, tell your friends and family that you're quitting and get their support. it turns out that quitting takes a lot more than nicotine substitution alone. >> the bottom line, does the patch work?
