The white house tonight saying he will declare a National Emergency to get money to build his border wall. It comes as the president is expected to sign a funding bill in the coming hours that will keep the government open, but will only give President Trump money for about 55 miles of fencing. He asked for 200 miles. Tonight, democrats already calling the president s move lawless and a gross abuse of power. And they warn of what future president s, future democrats could do, if they do the same thing as President Trump. Abcs chief White House Correspondent Jonathan Karl leading us off. Reporter after some lastminute drama, the president told congressional leaders he will indeed sign a spending bill he does not like, removing the threat of a government shutdown. Hes prepared to sign the bill. He will also be issuing a National Emergency declaration at the same time. And ive indicated to him that im going to support the National Emergency declaration. Reporter the bill provides a fraction of the money the president wants to build his border wall, but he says he will find a way to build the rest. And its a big wall. Its a strong wall. Its a wall the people arent going through very easy. Youre going to have to be in extremely good shape to get over this one. They would be able to climb mt. Everest a lot easier, i think. Reporter one of the president s closest allies had said he could not sign the bill without simultaneously declaring a National Emergency. This is the time. That is a necessity. That would allow the administration to access billions more in wall funding. Reporter under a National Emergency, the president will attempt to shift money from elsewhere in the federal government, likely the pentagon, a move that will be swiftly challenged in court. Democrats call it a lawless act and a gross abuse of power. If the president can declare an emergency on something that he has created as an emergency, an illusion that he wants to convey, just think of what a president with different values can present to the american people. All right, so, lets get to jon karl, live at the white house tonight. And jon, its not just democrats like nancy pelosi right there who are unhappy with the president s decision here to declare a National Emergency. Many republicans have been raising concerns for quite some time. They argue what future president s could do, as well, for example, a democratic president after a series of mass shootings, the steps that president could take. Reporter republicans were making this point again today, saying it sets a terrible precedent that will be cited by a future democratic president. And david, abc news has learned that the department of justice has warned the white house that this National Emergency declaration is likely to be blocked, at least temporarily, by the courts, preventing the immediate implementation, as it is challenged, although im told by a Top White House official that the white house remains confident they will ultimately win on appeal. Homes actually sliding right off their foundations. In the bay area, san francisco, a home with a woman inside, you can hear her screaming for help as it slides down a hillside. In Southern California tonight, an Emergency Rescue for a driver escaping to the top of his car. So many scenes like this one. At this hour, 20 states under weather alerts, from california to kentucky, and this system will head all the way east by the weekend. Abcs chief National Correspondent matt gutman on the rescues tonight, including that woman who was screaming for help. Reporter tonight, an allout atmospheric assault in the west. You can see there is widespread destruction in that area. A road is missing. Reporter north of san francisco, a landslide amid six inches of rain and 50mileperhour wind gusts ripping a sausalito home from its foundation. Help me susan, im here. Reporter d find a woman pinned by debris in her home. I can see your hand were trying to get to you. Reporter susan gordon miraculously expected to be okay. Our will carr is there. You can see this home toppled on its side. Behind it, a ton of debris. And you can still hear all of that mud flowing down from the hillside. This entire area is evacuated. The big concern now, gas leaks and downed power lines. Reporter in this san jose neighborhood, fears of flooding. Police going doortodoor to evacuate residents. While in oakland, a big rig pushing that car out of the water. And in Southern California, flash flooding gouging out a chunk of this road near palm springs. The flooding also ripping apart this Riverside County home. Mandatory must go now evacuations in the area where the holy fire burned last summer. And multiple high water rescues, three people saved here, after their vehicle got trapped west of palm springs. Tragically, in corona, california, one of nine people rescued from floodwaters there did not survive. Now, this is the l. A. River, david. Normally just a trickle, not anymore. We mentioned those high water rescues. 30 of them just today in Riverside County alone. And those mandatory evacuation orders, thousands of people affected by them. Take lake elsinore, just south of where we are, its under its sixth mandatory evacuation in just the past couple of months. And officials there concerned over evacuation fatigue, with only about 25 of the people there actually leaving. David . Wow, the l. A. River so often bone dry, raging there behind you. Chicago police now say they have found the men in this surveillance image right here from the night in question, and tonight, we have learned they have raided the home where those two men live. And in a stunning turn, at least one of those two people there has actually appeared on that tv program, empire. Abcs alex perez is in chicago. Reporter tonight, Chicago Police say theyve identified the persons of interest in that grainy surveillance image and are now questioning them. One of them has appeared on smolletts own show, empire. Reporter but police say they have no evidence the two people were involved in the attack. Smollett is also being interviewed again by investigators. There was a second person involved who was kicking me in my back, and then it just stopped. And they ran off and the phone was in my pocket but it had fallen out and it was sitting there and my manager was still on the phone and hes like, whats going on . And i said, i was just jumped. And then i looked down and i see that theres a rope around my neck, which i hadnt you hadnt noticed it before . No, because it was so fast. Reporter smollett says he first thought it was all captured on surveillance. And then the detective told me that the camera inside of the casing was facing north, so they didnt have it. And that was disappointing. Reporter investigators asking to see his phone. They wanted me to give my phone to the tech for three to four hours. Im sorry, but im not going to do that. Why . Because i have private pictures and videos and numbers, my partners number, my familys number. I dont know who that is going to be, to hand over my phone. Reporter and david, we learned just a short time ago, that authorities actually carried out an overnight raid on the home of those two people that they have been interviewing, collecting shoes and Electronic Devices as evidence. In return, at least 25,000 jobs. The governor recently defending the deal and those jobs. It is irresponsible to allow political opposition to overcome sound government policy.
