Breaking news. After millions of americans watched the docuseries surviving r. Kelly, will there now be a criminal investigation, after disturbing allegations involving several underage girls. Theres also news coming in tonight on celebrity chef mario batali. And tonight, the dj pleading guilty in the murder of a schoolteacher, after dna from a genealogy website, dna from a halfsister, helping to solve the case. Good evening. And its great to have you with us here on a very busy tuesday night. And well get to it all. But were going to begin with the president , just a short time from now, delivering his first ever primetime address from the oval office. The president asked for national air time to make his case. Why he says the u. S. Needs to build a border wall. A promise he made often on the campaign trail. He also promised mexico would pay for it. Now, it would be u. S. Taxpayers. And all of this paralyzing government, day 18 now of the shutdown. Jonathan karl leading us off tonight with what weve just learned. Will the president declare a National Emergency to get the wall built . Reporter tonight, President Trump makes his case to the nation, selling his border wall with a primetime address. His first from the oval office, as the Government Shutdown takes a toll. This shutdown could end tomorrow. And it could also go on for a long time. Reporter 800,000 federal workers are not being paid. Farmers arent getting their government subsidies. Pilots are warning about Airline Security as tsa officers work without paychecks. Christine vitel, a single mother, works for the tsa at chicago ohare. I live 39 miles away from the airport. Thats one way. My gas is what takes up my money, right . I can go probably one more pay period without getting paid, but most people cant go one more day. Reporter the president says he understands what workers are going through. I can relate. And im sure that the people that are on the receiving end will make adjustments. Reporter he has made his case with a blizzard of false claims. And today, i asked Vice President mike pence about the administrations credibility under fire. How can the president be how can his word be trusted on this when he has said so many things that are just not true about this crisis . He said that barack obama has a tenfoot wall built around his house here in washington. You know thats not true. He said that some of his predecessors told him that they wanted to build a wall. But all four living president s have now put out statements saying that they never had any such conversation with the president. And then you saw Sarah Sanders say that nearly 4,000 terrorists come into the country every year and, you know thats not true, either. How can the American People trust the president when he says this is a crisis when he says things over and over again that arent true . Well, look, the American People arent as concerned about the political debate as they are concerned about whats really happening at the border. And thats what reporter theyre questioning his credibility. The white house said nearly 4,000 terrorists are coming to our country. Thats not true. Jon, nearly 4,000 known or suspected terrorists were apprehended attempting to come into the United States through various means last year. Reporter overwhelmingly at airports, not at the border. And jon karl joins us live from the white house. And jon, youve learned, the address, of course, just hours away, and the president still has not made a crucial decision before his speech . Reporter i just spoke to a senior white house official, who said the president is still making changes to that speech and he has not decided whether or not to declare a National Emergency, and thereby try to go around congress. No decision even now made on that. As for the democrats, they are already slamming this speech, predicting it will be filled with, quote, malice and misinformation. They also have demanded time from the networks, and david, they will get it. All right, jon karl, well see you a short time from now. And you heard jon karl ask the Vice President there about that figure cited by the white house, that nearly 4,000 suspected terrorists have come to the u. S. Illegally. So, we sent matt gutman to the border in texas. Tonight, what are the numbers . Heres matt with a reality check. Reporter as he makes his case for a wall, President Trump is painting a nightmare scenario of a border overrun. Regarding the crisis on our southern border, and crisis it is. We have a crisis at the border. Criminals and gang members coming through. And it is a crisis. Its crazy. Its crazy. Reporter in fact, the number of people crossing the border illegally has plunged over the past two decades. From 1. 6 Million People in 2001, when george w. Bush was president , to just over 400,000 in 2016, when barack obama was president , to 361,000 last year. The president insists terrorists are pouring in from mexico. We have terrorists coming through the southern border, because they find thats probably the easiest place to come through. They drive right in and they make a left. Reporter thats not true, either. The president s own state Department Says there is no credible information that any member of a terrorist group has traveled through mexico to gain access to the United States. In fact, a recent state Department Report shows more concern about canada, noting that canada is more often home to silent extreviolent extremis aligned with isis or al qaeda. So, lets get to matt gutman, with us live tonight at the border. And tonight, matt, americans, we know, are deeply divided over whether there is a National Security crisis at the border. But advocates continue to point to a humanitarian crisis there. Reporter thats right. An historically high number of families and children have been crossing into the United States, david. 22,000 children in the month of december alone. Some of them are presenting themselves to overwhelmed Border Patrol officials in groups of 100 or more. And the policies coming out of the white house lately havent exactly helped the problem, in fact, theyve exacerbated it. David . Matt gutman with us live from texas. Matt, thank you. Abc news will carry the president s address tonight and the democratic response. George and the team at 9 00 p. M. Eastern right here. In the meantime, we turn next tonight to the harrowing images, the life and death struggle between a Woman Police Officer and a fugitive with a gun. The officers dash cam recording as she approaches an suv. A man appearing to have been sleeping inside, but then her body cam capturing the moment he jumps up, pulling a gun. She pleads for her life. Abcs alex perez with the video tonight and we warn you, it is difficult. Reporter newly released Police Videos capturing the heartracing moments an officer comes face to face with death. What are you doing parked back here . Reporter Early Morning in the chicago suburbs last july, officer Brianna Tedesco approaches a suspicious suv. I just have to make sure you dont have any warrants or anything. Which im sure you dont. Reporter the driver gives a phony name, but hes actually kenneth martell, wanted in pennsylvania for the murder of an 88yearold man. Do you have anything in the vehicle with your name on it . Reporter martell hands over a slip of paper, but quickly reaches for a gun and pulls the trigger. No no no reporter the gun jams. For 20 agonizing seconds, she tries to disarm him, pleading for her life. No, dont touch it, no dont touch it, no no, please, dont shoot me, please, please reporter a backup officer racing to the scene, shooting and killing martell. Shots fired by police. One suspect down. Reporter david, authorities discovered the suspect actually had a number of weapons. The officer was not hurt. David . Alex perez tonight. Alex, thank you. Her former student, 9yearold alan jackson, was diagnosed with autism and doesnt speak very well. When his mother saw this, she says it broke her heart. I saw all of his new classmates and his friends along the wall, watching him being dragged down the hallway. Reporter she posted the video on her Facebook Page looking for justice. I feel like i needed to go to social media for my child to have a voice. I was horrified. When i saw it, i couldnt believe that she would drag him. Reporter this happened in october. And in a statement, the Greenup CountySchool District says, the student was assessed by the school nurse and the teacher was removed from the school. The child was new to the school, and the parents dont feel this was discipline. The state will decide if the teacher keeps her license. David . All right, steve, thank you. This water spout on the lake in cortland, ohio, on land then becoming a confirmed ef1 tornado, that, of course, means winds more than 95 miles an hour. Damaging homes, bringing down trees on top of cars there. Hazardous driving in michigan tonight. More than a foot of snow in some places. And, of course, Winter Weather advisories now stretching from West Virginia right up into the northeast into maine. Chief meteorologist ginger zee tracking it all again for us tonight. Hi, ginger. Reporter hi, david. So many of us have had such a mild start to the winter, like buffalo, new york, almost 20 inches below their snowfall average since december 1st. But look at that map, a hit of winter is coming at you, especially south of buffalo. Weve got a winter storm warning for 6 to 12 inches of lake effect snow. I think overall, if youre not in the lee of the lakes, you will certainly feel the wind. 20 to 40mileperhour gusts, were talking pennsylvania, new jersey, connecticut. Reporter todays court filing was manaforts response to charges that he violated his plea deal agreement. If the accusation of handing over polling data is proven true, it could be the first finding that a senior Trump Campaign official colluded or offered information to russians about the race for 2016.
