5-month-old sammy was diagnosed with a heart mur mur as a newborn. his parents had been taking him to a cardiologist. when sammy was admitted in sacramento last tuesday for flu symptoms, the couple said they did not like the hospital's care so they left, admittedly walking out without a proper discharge. >> they told us we need to do surgery right away. we want to have a second opinion from a second doctor from a different hospital. i took my son. >> reporter: they took sammy to kaiser permanente where records show the doctor who examined him said the baby was safe to go home with his parents. in a statement, sutter memorial tells abc news, "our nurses and physicians are bound by duty to call authorities if they believe a pediatric patient's health is in danger." but these parents say, there was no imminent danger. >> it's like people taking your baby away, stealing your baby, and you don't know what is going to go on. >> the parties in the case can't comment because of privacy. baby sammy is still in the hospital and will be transferred to a different one then he head home. a judge ruled that cps will make home visits. his parents had to agree to never again take him from a hospital against doctor's orders. cecelia vega, abc news, los angeles. >> pretty outrageous, right? >> really is. i love there are these laws out there that protect the children. and that's understandable because they need protection. they can't protect themselves. but i do also believe that this story -- missing a little bit of common sense. >> how about a little common sense? that's officers actually witnessed one of the ice cream trucks following the other ice cream truck. >> reporter: police say an attempt to steal away customers from mr. dingaling, malatino and scott shouted that snowcone joe ice cream was free. >> he had two vehicles, two ice cream trucks they were both engaged in the conduct. >> reporter: i called josh malatino. when asked about the incidents, he said his girlfriend was the owner and that his attorney could answer my questions, but calls to his attorney were not returned. police say last summer malatino was warned for using similar tactics. >> we have addressed issues similar to this with mr. malatino and his legal counsel, cautioning him against this type of behavior in the past. >> can you believe that one? >> i cannot believe that one. mr. temperatures. it is really a bizarre headline for may 2nd isn't it? >> it is. you can't argue with the numbers. 20 inches of snow from cheyenne, wyoming. how about denver, 80 degrees monday. bitterly cold 30s on tuesday. getting around has been very tough. the spring snow is welcome in colorado and wyoming. two states plagued by drought however. it is picking up the snow pack that feeds the area's water supply. so i guess that's a good thing. in southern california, strong winds are pushing a wildfire that's forced some people out of their homes. it's already burned 3,000 acres, along with one house and several vehicles. one firefighter was injured battling this blaze. it is unclear how it started and officials aren't saying when they expect to fully have it under control. >> so there is more snow on today's weather menu. >> let's find out what is out there, accuweather meteorologist jim dickey has inside information. >> good morning, john, diana. a map here this morning looking more like something out of march or even february. a band of snow stretching from the great lakes all the way down the front range of the rockies. thankfully, the snow ending in the denver area. this will continue through the day, this snowfall, unprecedented stuff. cold arctic air diving in, out of canada, meeting moist air drawn out of the gulf of mexico. that band of heavy snow will stay in place through the day. a wide area picking up three to six inches of snow through friday. does include omaha and minneapolis as well, locally as much as 10 inches of snow. this system will stall out more or less. it's going to keep heavy rain along the mississippi river through saturday. start looking for flooding, and already soaking rainfall with a slow moving system still overhead today. >> jim, thank you. >> three college friends of dzhokhar tsarnaev are facing federal charges in connection with the crime. three helped tsarnaev get rid of his backpack and laptop after the bombing. agents say text messages proves their involvement. but their defense attorneys say it is not true. >> we dispute and we will be looking forward to proving our case in a court. >> two of the 19-year-old suspects are from kazakhstan. the other is an american citizen. >> with no end in sight for syria's bloody civil war the white house is under growing pressure to take some kind of action. so far president obama has been reluctant to get involved, but as abc's jonathan karl reports that may be changing. >> reporter: embattled syrian president bashar al assad the man accused of using chemical weapons on his own people made his first public appearance in more than a month appearing entirely at ease on syrian state tv, touring an electrical plant in damascus. the white house is turning up the heat. >> syria's future cannot include assad. his hands are bathed in blood, the blood of his own people. he has no place in syria's future and no support from the syrian people. >> reporter: senior u.s. officials say the administration is now considering sending weapons to rebel fighters. they have requested anti-aircraft and anti-tank weapons. abc news has learned the first nonmilitary aid to rebel fighters arrived in syria and more is in the pipeline. including body armor, military vehicles, and night vision goggles. sending weapons would be a big escalation, and a move that president obama rejected last year out of fear that the weapons would end up in the hands of anti-american extremists. no decision has yet been made on whether to send weapons to the syrian rebels. one reason the idea is under active consideration is that it may effectively be the best of several bad ideas. a way to put pressure on the syrian government without committing u.s. troops. jonathan karl, abc news, the white house. an investigation is underway this morning into what caused the death of a popular doctor. dr. autumn klein collapsed in her home over the weekend. she was 41 years old and mother of a 6-year-old girl. police say she may have died from cyanide poisoning. klein was a professor of neurology and the chief of the division of women's neurology at pennsylvania hospital. >> vice president joe biden speaking out against violence against women. at a fund raiser last night in washington, biden said that women who had been abused are afraid to file a police report. >> why do you think women who get raped, so many don't report it. they don't want to get raped again by the system. they want to be put through what they have to be put through. >> incredibly strong words. biden says women are afraid to leave abusers because they would have to leave behind their children. he's touting the recently re-authorized violence against women act as critical to help women escape violent situations. >> these remarks came at a benefit for the d.c. volunteer lawyers project, an organization for which his daughter-in-law, kathleen biden, wife of hunter biden serves as vice president. >> it's just great that finally something is getting done. gruesome new evidence this morning that the early settlers at jamestown were cannibals. scientists at the smithsonian revealed the discovery of the bones of a 14-year-old girl that show clear signs she was cannibalized. evidence indicates clumsy chops to the body and head of the girl who appeared to have already been dead at the time. >> fans of the chicago cubs considering the unthinkable. the possibility of their team moving out of chicago. the team is prosing a $500,000 renovation of wrigley field. to help pay for it, the cubs want to install a large screen in left field for advertising. for the first time publicly, cubs' brass threw down the gauntlet. >> i am not sure how any body is going to stop signs in the outfield. if it comes to the point that we don't have the ability to do what we need to do in our outfield, we will have to consider moving. without the proposed signage, the cubs are losing out on $20 million a year in ad revenue. the team filed a renovation plan with the city. the chicago city council and city planners are now considering it. you know every single park in baseball has the advertising i suppose hurting the economy. new jobs numbers seem to prove their point. in april, private employers added just 119,000 jobs. that's the fewest in seven months. the march numbers were revised lower. >> but there is one really bright spot in the economy. americans are buying cars and they're buying american. the big three u.s. automakers, gm, ford, chrysler are having their best spring in five years. dealerships across the country from denver, colorado to buford, georgia, to here, old bridge, new jersey, all said the same thing -- americans are buying. >> consumer confidence. chance of losing their job is less. they know they have the paycheck they're more willing to come in to purchase a big item like an automobile. >> reporter: today's best-sellers, ford fusion and honda accord. what is really driving all of this -- trucks. the ram pickup, chevy silverado and ford f series. thanks to the housing and corn instruction construction and small business owners like eric aripino who bought 12 trucks in the past year. >> our business is up. basically just replacing. growing and replacing older vehicles that are less fuel efficient and less reliable. >> reporter: also helping car loans have never been cheaper. beware you pay less each month but over a longer term which means you can end up as paying $4,000 more for your car. at this ford dealership, they're selling between five and ten of these f series trucks a week. that is up 74% from last year. but in order for business to keep booming both here and at dealerships around the country, they'll need to see the economy, housing diana and john, good morning. some very serious charges authorities allege that three individuals all 19-year-olds saw their friend's image on television and went to his dorm room before authorities could search it. the three new suspects appeared in federal court, charges against them say that before the fbi searched dzhokhar tsarnaev's room at umass dartmouth, two of his friends, dias kadyrbayev and azamat tazhayakov, had already thrown out his laptop computer and a backpack containing fireworks. the two men are charged with obstruction of justice. >> a broad charge. anything to do with impeding, aiding or destroying evidence. >> the third suspect, robel phillipos is charged with lying to federal agents. the government alleges one of the friends sent dzhokhar a text message after seeing pictures identifying him as a bombing suspect. dzhokhar, responded with an lol laughing out loud, text. >> depending on severity and involvement of somebody will clearly depend -- ultimately determine the sentence they will end up with. >> the two, both from kazakhstan, had been detained for two weeks on visa violations since they were first questioned about the marathon bombings. >> part of the responsibility of investigators is to explore all possible associations or connections. >> reporter: catherine russell, the widow of tamerlan tsarnaev, remains under intense federal scrutiny for her possible role. her attorney denies she had any knowledge of the bomb plot. john and diana, a prominent death penalty lawyer is joining dzhokhar tsarnaev's defense team and represented unabomber, ted kaczynski, and tucson shooter jared loughner. diana and john? >> tahman bradley, thank you. >> i don't think any one out there would say that was smart of them. what were was attacked by a passenger who called him a terrorist. he caught some of what happened there on this cell phone. the cabbie was an army reservist and iraq war veteran. says the passenger compared him to the boston bombers and threatened to kill him. the incident is under investigation. a serious situation going on right now in southern california. a brush fire there has already scorched about 3,000 acres along with at least one house and several vehicles. strong winds are expected to continue today. what's not helping is that hundreds of firefighters are battling this blaze. officials aren't saying when they expect to have it fully contained. close call at one of the nation's busiest airports. two jets preparing for takeoff at newark liberty international airport clipped each other. no one was hurt when the left wing clipped the tail of the united airlines plane while they were both taxiing. both planes returned to the terminal. passengers were put on other flights. frontier airlines trying to find a happy medium for passengers trying to avoid the baggage fees, then not finding space in the overhead bin. the airline will charge economy customers who book through third party website for carry on bags. won't be cheap. $25 in advance. $100 at the gate. frontier will charge $2 for soda and coffee. >> i guess, you know what, everybody is slowed down. the people who come with a gigantic bag and have this fantasy it's going to somehow fit in the overhead. it can be annoying. >> sure. i agree. a lot of people save on baggage fees by bringing in the carry-on. applies to the plan b one step brand of morning after pill and requires customers to provide proof of age at the checkout counter prompting more concerns from advocates and doctors. >> i think it is a positive step that the age was lowered to age 15. but there are still major barriers. how many 15-year-olds truly have proof that they're 15. >> and the decision to lower the age limit from 17 to 15 falls short of a court order set to take effect monday requiring that all brands of emergency contraception be available over the counter to all ages. >> it is frustrating because this case has been going on for over ten years. one of the things that the federal judge said was that -- the fda had delayed and dragged its feet for years and years and years. and so unfortunately, this is another >> i think we know that women clear the drug from their system more slowly than men. and in fact the fda recommended we use a lower dose in women. >> reporter: this sleeping pill has been in the news for a very dangerous side effect. >> i hit something with your car. >> reporter: sleep driving. i tried a driving simulator on ambien and found out how scary this is. 30 minutes after taking the drug. am i on the wrong side of the road? >> also this morning, 3,000 acres burning in southern california. how firefighters are trying to get the upper hand on this intense blaze. >> he had two vehicles, two ice cream trucks, they were both engaged in the course of conduct. then a softie smackdown on the streets of upstate new york. how fondness for frozen treats became a cold war. details on the frosty fight between mr. dingaling versus say that on television without cracking up. >> pretty much. we'll get to that in a little bit, and it's pretty good. we're at day four, as we like to say. almost friday eve. is that what we call it? should we get to it. >> get to it. serious stuff. >> the latest on the boston bombing investigation. three college friends of bombing suspect dzhokhar tsarnaev have been arrested. >> the men are charged with helping tsarnaev get rid of evidence. with more, here is our chief investigative correspondent, brian ross. >> reporter: the fbi has been suspicious of the friends since the day of the man hunt when s.w.a.t. teams raided the college campus, and agents took two of them into custody on immigration charges. those two, both from kazakhstan, azanat tazhayakov and dias kadyrbayev, had traveled with dzhokhar tsarnaev to new york last year, proudly posing in this snapshot. the third person, charged, robel phillipos had been a friend since high school. the fbi says dzhokhar's friend recognized him immediately when the surveillance photos of the suspects were made public. >> we consider them to be armed and extremely dangerous. >> reporter: and decided to help him by getting rid of potential evidence. a lawyer for one of the teens denied that after a court hearing. >> immediately we dispute and will be looking forward to proving our case in court. >> reporter: the fbi says one of the teens texted dzhokhar asked if he was the bomber. lol, laugh out loud, dzhokhar responded. and then another exchange. come to my room and take whatever you want. the fbi says the three went to dzhokhar's dormitory that night, down this hall to his third floor room, number 7341. according to the complaint they took a backpack containing fireworks with the powder removed and dzhokhar's laptop computer. that night, there was the violent confrontation with authorities in watertown. and the manhunt for dzhokhar began. it was then the fbi says that one of the friends went behind their apartment in new bedford and dumped the backpack and fireworks in this dumpster. the dumpster's contents ended up at a landfill where the fbi searched for three days and found what it says were these fireworks that the fbi now alleges the friends tried to hide. the fbi believes the powder from the fireworks in the backpack was used to make the bombs. there is no indication so far that the friends knew about the plot in advance, but in a footnote in the criminal complaint, one of the friends is quoted as saying that dzhokhar told him a month before the bombing that he knew how to make a bomb. brian ross, abc news, new york. a seemingly confident syrian president assad made a rare public appearance. assad toured an electrical plant, easily mingling with the workers, and he also appeared on tv, defiantly vowing to stay in power despite accusations he used chemical weapons on his own people. senior white house officials say the u.s. is considering sending weapons to rebel fighters. a move seen as a serious escalation and one that president obama rejected last year. all right. now to the legal battle over the morning after pill. the justice department says a new york judge overstepped his bounds when he ordered all age restrictions on the pill lifted. now the government is appealing the judge's order and arguing his decision should be suspended for now. >> many of us are finally enjoying some ideal springtime weather. others are digging out their cars from deep snow. take a look at fort collins, colorado. the snow is so heavy and wet, it is snapping tree branches. as much as 20 inches fell in some spots. extending from the rockies well into the midwest. meanwhile in southern california, strong winds are pushing a wildfire that forced some people from their homes. it has burned some 3,000 acres already along with at least one home and several vehicles. one firefighter has been injured battling this blaze. it is unclear how it started and officials are not saying whether they expect to have it fully contained. >> close call at one of the nation's busiest airports. two jets preparing for takeoff at newarteational airport clipped each other. no one was hurt when the scandinavian airlines plane left wing clipped the tail of a united airlines plane when they were on the taxi way. both planes returned to the terminal. the passengers were put on other flights. >> mayday protests turn ugly in seattle. protesters smashed windows and tossed metal pipes at police cars. the event a simple protest with a handful of people but became disruptive as the day went on. by afternoon, thousands of marchers had joined in. several of these skirmishes had broken out, and officers had to use pepper spray and flash bang grenades to control the crowd. in berlin, germany, a mayday rally turned violent. demonstrators seen smashing the windows of a bank. police officers were prepared. they deployed hundreds of officers and got the situation under control before serious damage could be done. a central pennsylvania woman who disappeared more than ten years ago has turned up alive and well in florida. brenda heist says she left home on a whim, traveled to florida where and don't fight me, okay? move your hands. >> please. >> move your hands. >> reporter: police enter a california home and take the baby boy out of the arms of his mother. they leave with baby sammy. and, his mother says, refuse to say where they took him. >> i can't tell you right now because you're not -- i don't think you're acting rationally right now. >> they just took my baby from my arms and just walked out the door. he was crying. that was the hardest moment just to let go. >> reporter: 5-month-old sammy was diagnosed with a heart murmur as a newborn. his parents had been taking him to a cardiologist regularly. when sammy was admitted in sacramento last tuesday for flu symptoms, the couple said they did not like the hospital's care so they left, admittedly walking out without a proper discharge. >> they told us we need to do surgery right away. we want to have a second opinion from a second doctor from a different hospital. i took my son. >> reporter: they took sammy to kaiser permanente where records show the doctor who examined him said the baby was safe to go home with his parents. in a statement, sutter memorial tells abc news, "our nurses and physicians are bound by duty to call authorities if they believe a pediatric patient's health is in danger." but these parents say, there was no imminent danger. >> it's like people taking your baby away, stealing your baby, and you don't know what is going to go on. >> the parties in the case can't comment because of privacy. baby sammy is still in the hospital and will be transferred to a different one. then he heads home. a judge ruled that cps will make home visits. his parents had to agree to never again take him from a hospital against doctor's orders. cecelia vega, abc news, los angeles. >> pretty outrageous, right? >> really is. i love there are these laws out there that protect the children. and that's understandable because they need protection. they can't protect themselves. but i do also believe that this story -- missing a little bit of common sense. >> how about a little common sense? that's exactly what i was going to say. by the way, when they took sammy away, they didn't tell those parents where they could find him or how they could follow up on it. >> then the police officers in there ripping the child out of the mom's hands, saying, i can't talk to you right now because loud music of snowcone joe. police say the operators of snowcone joe, 34-year-old josh malatino, and his girlfriend, 21-year-old amanda scott, were stalking mr. dingaling on several different occasions along multiple city streets. >> one of our officers actually witnessed one of the ice cream trucks following the other ice cream truck. >> reporter: police say an attempt to steal away customers from mr. dingaling, malatino and scott shouted that snowcone joe ice cream was free. >> he had two vehicles, two ice cream trucks, and they were both engaged in that course of conduct. >> reporter: i called josh malatino. when asked about the incidents, he said his girlfriend was the owner and that his attorney could answer my questions, but calls to his attorney were not returned. police say last summer malatino was warned for using similar tactics. >> we have addressed issues similar to this with mr. malatino and his legal counsel, cautioning him against this type of behavior in the past. >> can you believe that one? >> i cannot believe that one. mr. dingaling, poor guy. >> snowcone joe. the names alone are great. officers charge the operator of snowcone joe, malatino and diana perez. we begin this half-hour with record snowfall and bitterly cold temperatures. it is really a bizarre headline for may 2nd isn't it? >> it is. you can't argue with the numbers. 20 inches of snow from cheyenne, wyoming. how about denver, 80 degrees monday. bitterly cold 30s on tuesday. getting around has been very tough. the spring snow is welcome in colorado and wyoming. two states plagued by drought however. it is beefing up the snow pack that also feeds the area's water supply. so i guess that's a good thing. in southern california, strong winds are pushing a wildfire that's forced some people out of their homes. it's already burned 3,000 acres, along with one house and several vehicles. one firefighter was injured battling this blaze. it is unclear how it started and officials aren't saying when they expect to fully have it under control. >> so there is more snow on today's weather menu. >> let's find out what is out there, accuweather meteorologist jim dickey has inside information. >> good morning, john, diana. a map here this morning looking more like something out of march or even february. a band of snow stretching from the great lakes all the way down the front range of the rockies. thankfully, the snow ending in the denver area. this will continue through the day, this snowfall, unprecedented stuff. cold arctic air diving in, out of canada, meeting moist air drawn out of the gulf of mexico. that band of heavy snow will stay in place through the day. a wide area picking up three to six inches of snow through friday. does include omaha and minneapolis as well, locally as much as 10 inches of snow. this system will stall out more or less. it's going to keep heavy rain along the mississippi river through saturday. start looking for flooding, and already soaking rainfall with a slow moving system still overhead today. john and diana, back to you. >> jim, thank you. >> three college friends of boston bombing suspect, dzhokhar tsarnaev, are now facing federal charges in connection with the crime. federal officials say the three helped tsarnaev get rid of his backpack and laptop after the bombing. agents say text messages proves their involvement. but their defense attorneys say it is not true. >> we dispute and we will be looking forward to proving our case in a court. >> two of the 19-year-old suspects are from kazakhstan. the other is an american citizen. >> with no end in sight for syr syria's boody civil war, the white house is under growing pressure to take some kind of action. so far president obama has been reluctant to get involved, but as abc's jonathan karl reports that may be changing. >> reporter: embattled syrian president bashar al assad, the man accused of using chemical weapons on his own people, made his first public appearance in more than a month, appearing entirely at ease on syrian state tv, touring an electrical plant in damascus. the white house is turning up the heat. >> syria's future cannot include assad. his hands are bathed in blood, the blood of his own people. he has no place in syria's future and no support from the syrian people. >> reporter: senior u.s. officials say the administration is now considering sending weapons to rebel fighters. they have requested anti-aircraft and anti-tank weapons. abc news has learned the first nonmilitary aid to rebel fighters arrived in syria and more is in the pipeline. including body armor, military vehicles, and night vision goggles. sending weapons would be a big escalation, and a move that president obama rejected last year out of fear that the weapons would end up in the hands of anti-american extremists. no decision has yet been made on whether to send weapons to the syrian rebels. one reason the idea is under active consideration is that it may effectively be the best of several bad ideas. a way to put pressure on the syrian government without committing u.s. troops. jonathan karl, abc news, the white house. an investigation is underway this morning into what caused the death of a popular doctor. dr. autumn klein collapsed in her home over the weekend. she was 41 years old and mother of a 6-year-old girl. police say she may have died from cyanide poisoning. klein was a professor of neurology and the chief of the division of women's neurology at pennsylvania hospital. >> vice president joe biden speaking out against violence against women. at a fund raiser last night in washington, biden said that women who had been abused are afraid to file a police report. >> why do you think women who get raped, so many don't report it. they don't want to get raped again by the system. they want to be put through what they have to be put through. >> incredibly strong words. biden says women are afraid to leave abusers because they would have to leave behind their children. he's touting the recently re-authorized violence against women act as critical to help women escape violent situations. >> these remarks came at a benefit for the d.c. volunteer lawyers project, an organization for which his daughter-in-law, kathleen biden, wife of hunter biden serves as vice president. >> it's just great that finally something is getting done. gruesome new evidence this morning that the early settlers at jamestown were cannibals. scientists at the smithsonian revealed the discovery of the bones of a 14-year-old girl that show clear signs she was cannibalized. evidence indicates clumsy chops to the body and head of the girl who appeared to have already been dead at the time. fans of the chicago cubs considering the unthinkable this morning, the possibility of their team moving out of chicago. the team is proposing a $500 million renovation of wrigley field. to help pay for it, the cubs want to install a large video screen in left field and other advertising. for the first time publicly yesterday, cubs' brass through down the gauntlet. >> i am not sure how any body is going to stop signs in the outfield. if it comes to the point that we don't have the ability to do what we need to do in our outfield, we will have to consider moving. >> without the proposes signage, the are hurting the economy. new jobs numbers seem to prove their point. in april, private employers added just 119,000 jobs. that's the fewest in seven months. the march numbers were revised lower. >> but there is one really bright spot in the economy. americans are buying cars and they're buying american. the big three u.s. automakers, gm, ford, chrysler are having their best spring in five years. abc's chief business correspondent rebecca jarvis has the very latest from the showroom. >> i'm smiling from ear to ear. >> reporter: rich savino says he's smiling because his all american ford dealership is having its best year since he opened for business at the height of the great recession in 2008. >> you just feel a volcano about to erupt. we're doing very well. >> reporter: in dealerships across the country from denver, colorado to buford, georgia, to here, old bridge, new jersey, all said the same thing -- americans are buying. >> consumer confidence. chance of losing their job is less. they know they have the paycheck they're more willing to come in to purchase a big item like an automobile. >> reporter: today's best-sellers, ford fusion and honda accord. what is really driving all of this -- trucks. the ram pickup, chevy silverado and the ford "f" series. that's thanks to the housing and construction comeback, and to small business owners like michael aripino, who says he's bought 12 trucks in the past year. >> our business is up. basically just replacing. growing and replacing older vehicles that are less fuel efficient and less reliable. >>
