critically wounded just after midnight. the club is on indiana street in the city's neighborhood. the police chief says he is working with city lull hall and entertainment district to talk about the problem. >> we have a problem. shootings are down still nightclubs we continue to have difficulties and it continues to illustrate why it is important for us to find a better solution. >> police are searching for the suspect and still investigating the motive behind the shootings. in july a man was shot and killed outside of the nightclub south of at and t park. they prompted therm to terminate their lease a man was killed four others wounded on base street. the owners voluntarily closed their club after that shooting. >> they narrowly escaped the man who tried to kidnap him. this happened yesterday where a 10-year-old girl and 5-year-old sister were walking their dog around 4:00 p.m. that's when they say a man threatened to kill their family members and tried to grab the 5-year-old little girl. he's described as a white male with a gray goatee and he was missing a tooth on the upper left side of his mouth. driving an older model jeep four-door with tinted windows and possible damage to the left headlight headlight. >> meg whitman's campaign is calling on democratic rival jerry brown to apologize personally for an offense ivory mark made by one of his campaign aids. the camp wants brown to identify the aid who called whitman a whore. the comment was recorded on the voice mail of the los angeles police union after brown failed to hang up the phone. brown and whitman were competing for the endorsement. he issued a public apology for the remark but whitman's camp wants more. >> a spokesman issued a statement that says after spending months avoiding his 40 year political record now jerry brown is continuing to insult the voters of california by avoiding taking responsible for his own actions and the actions of his campaign staff. california just approved budget already looks like trouble. that's because so much of the budget governor schwarzenegger just signed into law is based on deaf stit spending and wishful thinking. it is built on assumptions the assistance there may still be dark days ahead. a man who's son has been stuck in a chilean mine for more than 2 months says family members can now smile. cheers erupted after a drill broke through in their cavern more than 2,000 feet under ground creating a shaft wide enough for a specially designed escape elevator to pass through. the story from diane alviar. >> this drill rig completed the tunnel that will become a lifeline for 33 chilean miners. they have been trapped half a mile down since august 5th. that's 623 days they have been buried alive. next comes the hardest part. >> they authorities say they have put out a fire on a ferry carrying hundreds of people. an explosion on the upper deck triggered that fire. the ferry was in the bull tick sea between germany and denmark. half a dozen rescue ships helped rescue the 249 people on board. police say 3 people were flown to hospitals by by helicoptershelicopters. they are trying to keep the ferry from spilling 170 tons of fuel. hungary's premiere says a wall of a reservoir that burst flooded several towns with toxic waste is showing larger cracks than is very likely to collapse. he described that situation as dramatic. the town which sits next to the reservoir and was badly damaged in monday's flood was evacuated early today. at least 7 people died in more than 120 people were injured when a corner of the metals traffic jam, allen. the show just ended. we are hearing it's taking an hour to get out of the marina. it is definitely jammed. but the blue angels have a lot of happy customers. and if you stayed home today to watch football and you missed the show lucky you we have video of the impressive show and all of their exciting moves. the show was especially appreciated this year. if you remember it was canceled last year because of fog they had perfect weather today. there are people in san francisco who don't like the blue angels who complain their too loud or people aren't fond of the military but we heard no complaints. >> so excited about the blue angels my heart is racing. it's just the best. >> something good for the kids to bring the kids to see our military put on a show. >> something different, you know. you don't see in regular days. quite interesting and amazing. >> my first time seeing him so it's exciting. my boyfriend drug me down here and the tricks are amazing how close very friendly town. so friendly they never have to buy a drink. they will be performing again tomorrow at 3:00. they are estimating a million people are going to be in the city through out the whole for more foot patrols. short sarah shourd gathered with close friends and family in oakland today to talk about what steps they need to take to help win the freedom of her fiancee shane bauer and friend josh vital. they were arrested while hiking near the iraq iran border and accused of spying. she spent nearly 14 months in solitary confinement and was released for health and humanitarian against her boss says a date has been set for a hearing october 20th in san jose. that's just two weeks before the elections. diaz says whitman owes her more than $6,200 in back pay and millage costs. south bay college students says the fbi spied on him and he found a gps tracking device under his car to prove it. this is a picture of the device attached to his car. he wondered what it was until a do you know any one affiliated with anything extreme or abnormal that they shouldn't be? where is the device that you located? did you put it there? >> an fbi spokesperson refused to discuss the discovery but said court decisions have upheld that there is no warrant necessary for gps tracking of a vehicle when the vehicle is in public space. oo i would argue it's an ageeing gus violation of anybody's rights. >> they reassure the government's ability to provide gps on people's cars. he insists civil rights were violated and he was intimidated and harassed. >> they can try but federal officers are protected by robust communities. >> agents spoke and he is cooperating fully. abc 7 news. >> a new report from the california department of public health shows there have been 5,1270 -- 5,270 cases of whooping cough this year. that's the highest in 60 years. the state declared a whooping cough epidemic this year. extended vaccinations and widened the range of people who should get the shot. >> some indication perhaps in one of the regions we are seeing less cases but other regions of the state are still reporting very high activity and some steady activity. it's really a little
