breaking news in walnut creek. fire crews on the scene of a house fire that involved several burning cars. terry mcsweeney is live at the scene. he joins us from greenway drive. >> reporter: i see a house that is smoldering right now. this is a story that could have been much worse. look at what remains of the garage. fully engulfed by the time firefighters got here, there's a car inside that garage and there three in the driveway, all of the cars are damaged. the one in the garage, i'm thinking is destroyed because that garage is toast. a few minutes ago we had a flare-up on the roof of the garage. you can see firefighters still spraeulg. the good news is this -- white smoke meaning the fire has been doused. starting 5:00 this morning. crews got out here as fast as they could. a family of four, husband, wife, two children live inside with a couple of dogs. the silver lining is that everybody got out okay. a little bit more of a silver lining, talking to the battalion chief he's telling me they confined this fire not garage. the garage is gone. but the house suffered only smoke damage. according to one firefighter it was minimal. hard to believe their garage could burn so fully and still firefighters able to save the main structure of the house, four cars damaged one completely lost. the cause of the fire nobody lows. they have no idea how it started. got a moment to talk to the homeowner he didn't want to talk a lot. he and his family did get out safe, so did the pets. in walnut creek, terry mcsweeney, abc7 news. we are coming up on 6:03. new information this morning on the domestic violence charges against san francisco sheriff ross mirkarimi. stunning claims in his arrest warrant that may strengthen the case against the sheriff. amy hollyfield is live at city hall. >> reporter: according to the affidavit ross mirkarimi went ballistic and was pushing and grabbing and shoving his wife on new year's eve. according to the affidavit, his wife iliana lopez went to a neighbor's house and said she wanted to document everything that happened including using videotape so she would have evidence in case mirkarimi ever tried to get custody of the couple's son. a key piece of evidence is a videotape of lopes showing a bruise on her arm where she says mirkarimi grabbed her. according to records, mirkarimi told lopez he could take theo away because he's a powerful man in the court documents, another neighbor backs up the story and legal analysts say this is important. it makes the case stronger. especially if mirkarimi's wife refuses to testify. >> the victim, the spouse cannot be compelled to testify. but other witnesses can. if they come forward and they are sworn as witnesses and refuse to answer questions, they can be held in contempt of court until such time as they decide to testify. >> reporter: according to the affidavit here's how the fight started. the family was on the way to a restaurant when lopez asked to visit her native venezuela. the victim stated ross mirkarimi started to scream, f-you, f-you, you are trying to take theo away. the victim stated ross mirkarimi stated something to the effect she didn't dessert to have eat. one final note, mirkarimi's wife says, this has happened before. ross mirkarimi denies the charges against him, denies these allegations. he says he plans to fight them in court. he's due in court tomorrow. he has no plans to step down as sheriff. his wife is staying by his side saying she has no complain against his husband, that this is a private matter. amy hollyfield, abc7 news. today 1500 oakland city workers will begin receiving pink slips as the city looks to balance its books after losing millions in state funds. 1500 notices will go out only 200 employees will be let go. city workers do not know who will be laid off because of seniority rules. oakland is trying to make up for the loss of 26 million dollars in redevelopment funding which takes effect february 1st. richmond city council passed new guidelines last night allowing the police department to be more reluctant or choosing in the future before responding to mutual aid requests like the ones that involved occupy oakland. the new guidelines asked the chief to consider whether police will be dealing with protest -- the mayor brought the resolution forward after richmond police were called to help break up an occupy oakland camp in october. the resolution does not technically give the police chief any new authority. opponents of the new 49er stadium say they will submit the needed signatures to call for any awe referendum to try to block the proposed stadium today they must do so before noon. the group says they will deliver more than 4500 signatures. pushing for a new ballot measure that could previously the loan approved last month by the stadium authority. city officials say even if the group has the necessary signatures no ballot measure is coming because the city believes the ref -- referendum is illegal since vote areas proved the stadium when they passed measure j in 2010. the group is saying voters passed that measure without knowing about the 850 million dollar loan that was like more rain in the forecast. let's try to time this out. this morning into the afternoon you can see a few radar returns around the extreme northern parts of the north bay higher elevations in the mountains you may get a few sprinkles. tomorrow morning we start to see the rain slide down through the north bay moving through the heart of the bay by noon all the way out of the bay, heaviest rain by 9:00. overnight through tomorrow morning, quiet pockets of light rain. heavier rain moving into the north bay at 3:00 friday. exiting quicker by 8:00 friday evening that's the system that will have the gusty winds. we'll get a half inch in the santa clara valley to a couple of inches of rain in our mountains thursday and friday, more rain saturday there the possible break sunday for the game. got out safely as did their two pets. firefighters still on the scene as you can see behind me. they are inside the garage that is a centerpiece of the fire. did it start there or in the cars in the driveway? they don't know yet. the concern is to make sure things don't flare-up. look at video from a short time ago when things did flare-up. the roof of the garage sparking up again. this fire began 5:00 this morning. walnut creek firefighters got out here, the garage the cars they don't know which started first. they were pleased to see the family of four had gotten out, and the pets save too. -- safe too. >> damage was kept to the cars in the garage. some impingement on the interior of the house but we were able to keep it to left side of the building. >> reporter: it is pretty remarkable that they were able to keep this fire which so completely burned the garage, to that side of the house. they are saying as you heard, smoke and water damage perhaps in the living area of this home. as far as flames, they did not get through into the home. back out here looking at the damage to these vehicles pick-up truck, two cars in the driveway. they are damaged seriously. there is 300 miles of its natural gas transmission lines similar to the ones that exploded in san bruno in september of 2010. yesterday the utility filed a document with state regulators admitting it ransom segments at a higher pressure than federal recommendations. regulators ordered to review lines running through densely populated areas after the blast which killed eight and destroyed 38 homes in june the company said it failed to properly classify 172 miles of pipeline. federal monitors say response to protestersers is raising concerns about the department's ability to follow accepted american policing practices. that assessment came as part of a report released yesterday. federal monitors say they've begun an investigation of police activity specifically connected with the department's response to occupy protests. monitors say they are looking at the department's force during the protests and whether officers had been adequately trained in crowd control policies. the report notes the department made very little progress in the last two years in instituting court mandated reforms in the wake of a previous police corruption scandal. >> this morning activists layout more plans for friday's occupy wall street west protest. organizers said they will target financial institutions and attempt to shutdown san francisco's financial district. demonstrators have announced plans to start the day long protest at 6 a.m., ahead of the opening of the stock market at 6:30. protests will end with a mass march and rally at justin herman plaza at 5 p.m.. organizers predict it will be address. voters passed prop in 2010, the government doesn't need lawmaker support of his plan he needs voters to get the initiative on the november pal lot. he is expected to largely ignore the legislature in his speech, especially the republicans who oppose his tax hikes. the plan is a five year, 35 billion dollar tax increase some is sales tax, some is an an income tax increase on the wealthy. he has infrastructure projects on his agenda, including high profile 100 billion dollar high speed rail project. the top education adviser says he will pitch less testing in schools. governor brown has long criticized the current amount of standardized testing. we would like to see more classroom hours spent on instruction. the curriculum expanded beyond math and english to include more history and science. the state of the state address starts at 10 this morning. then he's immediately leaving sacramento to pitch his plan in person in southern california between today and tomorrow he [ unintelligible ] i'm jane king, bloomberg news. more news now, 6:49. wikipedia and several other pop laugh sites are off-line this morning in a pro -- popular sites are off-line this morning. the online encyclopedia will display only this page until midnight tonight. google which also opposes the measures has put a black banner over its low to call attention to the issue. the proposals target websites that allow users to illegally download movies, music and software. critics say the builts are overly and can hurt the tech industry and infringe on free speech. still cold, not as cold as yesterday. >> some areas 10, 15° warmer that would be in the north bay where he had the coldest temperatures yesterday. beautiful sunrise from mount tamalpais as we come up on 6:50. high clouds move in, they are keeping some areas above freezing like santa rosa 33, antioch 37, also concord -- excuse me oakland and half moon bay 41 san francisco 33 fremont and san jose everybody else in upper 20s to lower 30s. no teens like we saw yesterday. we are freezing in monterey, look at that 30°, 33 santa cruz, watsonville salinas gilroy 23. scattered light rain possible in the north bay pockets of drizzle tonight for of us otherwise fairly quiet as we transition from record cold temperatures to a warm core system that will have a lot of soaking rains in our future, starting tomorrow. today, a few scattered light rain in the north bay otherwise increasing clouds and temperatures pretty much in the mid 50s down around the monterey bay clouds take longer to get to your neighborhoods more sun and warmer weather, mid to upper 50s tonight clouds keep us all above the freezing mark, mid 30s to possibly mid 40s. again, the best cans of rain to our north. you can see why right now this ridge is holding strong and keeping all of the wet weather to our north up around crescent city and eureka. series of storms will punch through that high later today and tonight then the waves of rain coming in. storms coming in even a little farther south than we are further south than us that's why they are going to be warm and have so much moisture we are talking green an inch in many areas, half inch in santa clara valley up to two to three inches in the north bay mountains. seven day forecast, heaviest rain will come in about 2:00 in the north bay tomorrow and slide south through 7:00. then we get a break and the heaviest rain friday comes into the north bay 3:00, exits the south bay 6:00. friday's rain will move faster, heavier and it will be breezy. if we have any problems it will be friday. saturday rain once again. right now, it looks like the skies just stop for the game sunday before more rain begins monday and tuesday. have a great day here's sue. >> nice of the skies to stop in time for the game, appreciate that. pretty light traffic problems. one issue the hot spot right now is in sunnyvale southbound 101 matilda accident blocking two right lanes not a lot of slowing in the area, hopefully they get that out of there as quickly as possible. bay link ferry out of vallejo this morning, engine trouble. there's a bus for the 7:30 departure. vallejo ferry, no other mass transit delays or problems. 101 live shot in san jose, looks good, that earlier accident at matilda, toll plaza metering lights turned on traffic backing up towards the west ground overcrossing. our new community-based traffic app you can follow your fellow drivers you can see that accident on 101 southbound in san jose thanks to apple jacks. if you would to get involved it is free go to the itunes app store android market or sign up at abc7news.com/waze has all the information. recapping our top stories: firefighters remain on the scene of an early morning house fire in walnut creek that has left a family in the cold and destroyed four vehicles. >> terry mcsweeney is live at the scene on greenway dry >> reporter: a family of four out in the cold this morning. husband and wife and two children, their two dogs also got out okay. you can see behind me what is left of this portion of the house, the garage just burned into blackness. up on the roof you see a couple of firefighters digging through the roof looking for further hot spots three damaged cars, inside that garage, a vehicle i couldn't tell what it is, it is that badly burned. pictures from earlier, flames coming from the roof. firefighters got a call of a home on fire, they came out, the garage engulfed in flames. the car inside burning. the three outside smoldering. they thought they had it knocked down in half hour. the good news is everyone got out okay no injuries to firefighters that we've heard of to this point. the cause of this fire, did it start in the garage, with the vehicles in the driveway? they don't know. the cause under investigation. that's the story from here. for our other stop story of the morning we go to amy hollyfield in san francisco >> reporter: getting worse here for sheriff ross mirkarimi. the court documents for the case against him have opinion released. they give a lot of details about the -- case against him so many many that some analysts say the case appears to be stronger than first thought. according to the court documents iliana lopez says her husband went ballistic on the night in question he pushed, pulled and grabbed her and threatened to take custody of the couple's 2-year-old son saying he could pause he's a powerful man. his wife has said this has happened before. another point that legal experts say is important, investigators say they have found another neighbor who backs up the story. there are now two neighbors who could be witnesses in the case. ross mirkarimi denies the allegations, says he will fight the three charges against him. scheduled to be in court told. he does plan to continue to work at city hall as the sheriff. his wife says she stands by him. that she has no complaints against her husband. amy hollyfield, abc7 news. now time for our final check on weather and traffic. bracing for the cold and the rain. >> let's talk about the rain. this morning into the afternoon you can see a few radar returns around northern sonoma even overnight that would be the best area for rain still a little drizzle here and there. 12:00 rain moving into the heart of the bay heaviest from 2 to overnight drizzle through tomorrow -- 2 to 7 overnight drizzle through time morning. heavier rain and stronger winds 3 to 7:00 tomorrow. hot spot remains 101 in sunnyvale san jose area accident southbound 101 at matilda blocking two right lanes. so far no major slowing past the scene hopefully they will get that cleared out. final shot bay bridge toll my tering lights on and traffic backed to the west ground overcrossing. thank you for joining us for this edition of the abc7 news. >> we'll be back with a update at 7:24. keep track on twitter and talk about it at facebook.com/abc7news. have a great day enjoy this beautiful morning. see you back here tomorrow.
