The case involves interim Public Safety director david visin. The incident happened in june when vin allegedly tried to cover fohis stepson in a drunk drivivg tandrun incident. Incident. According to records, visin took 33yearold sean crane from the scene before he could benterviewed. And he repeatedly refused requests fr a county deputy t tpull over so his stepson could be questioned. Visin blamed his actions on low blood sugar levels from diabetes. Diabetes. In a Statement Released by a spokesrson for the university. Visin released information involving the incident to senior vp of finance and operation. As of now, the university is not him. Crane pleaded guilty to a owi charge in december. He paid a fine and completed Court Ordered classes. Classes. Fox 28 news rerter kevin barry has a special report tonight explaining at least part of the rereon the governor is focusing his efforts in that direction. This all starts with one of the most recognizable parts of iowa its farm land. s millions of acres of row crops wouldnt be possible if nono for sometimes complicated drainage systems keeping Iowa Farmland from becoming swamps. But run off from the farms carry harmful chemicals like nitrate to the states rivers and a Des Moines Water Works lawsuit is trying to make a handful of small pieces of land in rural iowa responsible for taking that nitrate out. Out. This is the origination of the main open ditch of drainage water in calhoun and sac counties in rural northwest iowa they eventually run into the racoon river and district 2 and 51 are partially ground zero for the des moines water work lawsuit ying districts just like these are polluting iowas water way too much. Much. Their whole message is that agricultural drainage is a public nuisance. Thats w wt the law suit alleges. Kristine tidgren at the Iowa State Center for agriculture law and taxation says these specific districts artargeted because theres nothing else around that could be putting nitrate into the water except agriculture. Run off created by farmland is e of the only discharge methods exempt from clean water act permits regulating what gets put into Water Supplies and charging a fee for it. Bill stowe at Des Moines Water Works ss its time for that to change. Ange. Des moines waterworks has experienced high nitrate we built the worlds rgest denitrification facility now abt 25 years ago so that has been a long and persistent problem for us. Stowe says in 2015 des moines water had to take nitrates out for a record 177 days. Days. This is a denitrification facility built about 25 years ago. Its an expensive process that cost 1 and a half Million Dollars in 201 and needs to be replaced nono cause saltbased process corrodes the equipment and its getting older. Stowe says the price tag would be around 80 Million Dollars and with the highest nitrate concentrations ever being found in the des moines and racoon rivers stowe says its not right to keep pushing that cost on to consumers. Consumers. We think the producers upstream who are pushing that pollution down to us should either stop popouting or payayo remediate it. In any other part of the law that would happen outside the courts. But not for the rural agricultural drainage districts. Districts. You cannot sue a drainage theyre not that type of entity. Kristine says the Iowa Supreme Court has upheld this idea of unqualified immunity becuase drdrnage districts are not corporations and dont turn a profit theyre just pieces of land. The people responsible for them in this case the county board of supervisors can be sued and ordered to fix them if theyre damaged. She says since they dont produce any revenue they havent been considered financially responsible for anything outside their own upkeep. Upkeep. We believe that its very clear in the iowa code and or constitution that our responsibilities as supervisors or trustees is for infrastructure of tse facilities. We have no ability to regualte in take our responsiblitiy is soley on the infrastructure and maintainence of those structures. The supervisors say having to apply for permits for agriculture runoff would be like suddenly having to go to the dmv to get a licence to ride a bike its just never been done. Done. Farming is a very sympathetic and admirable theres no other business that can take a pipe and discharge into the waters of the state without being regulated. Agriculture needs to catch up with the rest of the world d d be accountable for its production. He says a simple permitting process would do that. That. Permitting does not mean that you cant discharge, it means that theres regulating and control process thats important for environmental protection. Its exactly what des moines water does. After they take n nrates out of the water r they have a salt and nitrate mixture they put back into the river downstream and the cost of the permit to do it legally is just a cost of doing business. Stowe says if famers dont want to do that they should get better at keeping nitrates out of the water supply. Supply. This is an example of a buffer strip. Rick says this rip is shows that farmers are already being responsible stewards of their land. In des moines state senator rob through legislation have been underfunded. Underfunded. Its going to take money, its going to take monitoring and its going to take a cooperative structure to get there and im not sure the legislature is ready to go that route and im not sure some people arent going to just roll the dice the hope that the lawsuit goes their way. The county supervisors for buena vista, calhoun and sac county say the nitrate they put in is just a drop in the bucket by e time it travels more than 150 miles past thousands of other farms to des moines. But since this case would be precedent setting des moines water says the amount of nitrates they put in isnt the point. Its that agricultural runoff hasnt been regulated maybe until now.
