For the New York State Rifle and Pistol Association versus the city of New York what a case is this this really is this was when the city of New York decided come up with a law that you can transport your gun out of out of the city right you can't if you wanted to go shooting you couldn't take your gun outside of the city to go shooting right if you had a 2nd home side of the city you couldn't take your gun there so when they when they passed this law of course. You had people file suit. That were damaged by the law. Right assuming that means they were caught or whatever and or they viewed that they would be damaged by the law or were being damaged by the law because they couldn't carry their guns right where they wish to carry their guns outside of New York City so this got all the way up to the Court of Appeals Federal Court of Appeals and. They agreed to uphold the ban. So. They claimants petition to the Supreme Court and got a review Well the left believing where this was going this is the 1st quarter the 1st caissons Heller that's been heard on the 2nd Amendment Yeah understood where this law would go and the president that it would set so the city reversed course on the law and the state of New York also passed a law and then restrict restricting any state from or any city from having any restrictions like that right even though there are restrictions for example you can still take it to your home your 2nd home or to the home so a driving range. Of golf in the mine shooting range but it has to be a continuous trip you can't stop for anything and that became a debate where women under the current law under the law are how you will follow the law years saying that they can stop for coffee well they can stop for coffee What if they stop at their mothers house well that's not clear they actually had this argument and because the whole point is that the case is moot and shouldn't be heard by the Supreme Court that they should just drop it well that's the that was the question by Ginsburg you know if you if it's been repealed if the ordinance the city ordinance has been repealed and the state law is in place now that prohibits such an ordinance is there still a case that was her question. Asking the attorney actually if your client still have a case what's left of this case so that started to become in the analysis of the hearings on Monday or the hearing on Monday. It was whether or not they actually will go forward I mean by that whether or not they believe a case is still here if the city claims because the city is claiming well wait a minute we did everything that they're asking we did away with the ordinance and saying that and we're further we're even further risk directed from creating such a new ordinance by state law so does this do we need to even be here right now is it is it necessary to be here and the case on one side of the saying yes because you need to and the editorial board. At the Wall Street Journal is pointing out that wait a minute you need to go through and you need to show that this type of ordinance had a did. Have. Inflict damage on those that are here claiming it did and you need to claim this ordinance unconstitutional that really that's the only option here but this ordinance needs to be claimed unconstitutional because otherwise the thought is that the city could come in and have because an ordinance is much easier to pass especially in New York City on a gun ordinance. Then a state law is on a wider scale but even still you could have a state law that comes in with the next set of legislators and they could change that and say no those restrictions on those cities are gone and then the city could come back and say you know Ok now we have a new restriction and then that would leave essentially the next person that is harmed by such a restriction to start the process in the courts all over all over again right to get to right the Supreme Court so what they're saying is that look during this time these gun owners were harmed you need to to go through this process and we need to the court needs to this according to the editorial board of The Wall Street Journal the the Supreme Court needs to find this on constitute this type of ordinance this ordinance unconstitutional. And we'll see if that actually happens if they if were goes from here well because and because the revised law that they ended up with is as it must be you know a continuous trip that when they asked the coffee question that made it legitimate that no this is a case that has to be heard because if somebody is now traveling they have to prove to the state that it was continuous right if they get caught you know every well you had a coffee break but then you stopped at a store right now and when you had the the city attorney that could explain whether they would be prosecuted or not did know whether violated the law as when Alito jumped in and said well wait a minute you that shows right you know right there and Gorsuch was saying you know the the exact same thing the other problem is the Supreme Court has as they only only one Supreme Court decided to review this case is when the city and state changed their mind and why did they change their mind because they were being told look we don't want to give this Supreme Court a nother chance to make the 2nd Amendment stronger you need to drop this case. So the Supreme Court we can call it moot and they don't hear this case and a lot of the justices on the Supreme Court don't like that when they realize oh the only Rica's it in change it when they were getting support of every single court up to the court of appeals they didn't change the law then they only changed dead when the Supreme Court said it will hear this case in January after so after January they repealed the ordinance and then the state came in and said Well Ok we'll help you out here and will restrict you from creating such an ordinance but again that leaves it open to again the the next legislative body to come in and change that state law which right open for New York State and the change here that's given is with these you know weird restrictions that they're not even sure about that the lawyer for the city is not even sure about on continuous travel. They're going to if the court says no this is moot because the ordinance the the particular ordinance that was being challenged no longer exists then you're just saying that the next person who was harmed by the current ordinance as it was changed you know the continuous travel warrants it's up to them to get their attorneys and get back to the Supreme Court and and that's according to the editorial board not a that is not that's not proper That's not fair there was damage during that time and the Supreme Court needs to recognize the actions by the state and by the city of New York and in affording this for what it was I wonder if they'll do that I don't know if they'll do that. And we'll see I guess where it goes from here the monetary damages was something that was brought up for these people that have been affected by the law and the federal government actually brought that up as part of their case and look these people they may want money damages and then that's when the last when. The judges said well wait a minute but they didn't ask for money damages already they didn't ask for money damages already you can't you know what you can assume what they want because they didn't ask for money and then the point was brought up well wait a minute they would ask for money after it was found unconstitutional right if it's because that gives them a great right ending in the Civil Right yeah so that really is a I swear to you the Supreme Court is just like regular society at times yeah where the legal arguments go right out the window and it's a whole we think we've got something here well no you don't have anything here but you know that's that's what you're you're you're dealing with but it will be interesting to see I wouldn't be surprised if they just didn't want to hear it or they didn't have the votes yet I could see it being 54 not to continue it from I guess I may be taking huge liberties here by like everybody else does when when the supreme court here has oral arguments and you try to read into what they're thinking well because especially with the sometimes the nature of the court itself they don't make the broad. They don't always choose to make or they often choose not to make the broad's vision. Because here the 2nd Amendment the the I mean if you look at it the other 2 cases and the fact that it's been really it's been a decade since the last one. The court often just kind of. Bows very quietly not quietly but just very faintly yeah will will not make the broader decision on the 2nd Amendment will not be so them deciding not to go forward with it won't surprise me here given the nature of it and especially with New York State and New York City and how tight their gun laws are it wouldn't shock me if if that if they did they don't go forward well the the goal is to stretch it out where the Supreme Court doesn't rule in any of these things but still make it more restrictive for example will make that plea will say yeah you can travel to your 2nd home or you can travel to your gun range but you can't make any stops right which is you can't you can't stop Ok well let's stop for coffee What if I want to stop and to a friend's house no you can't do it well clearly that's unconstitutional right now and the it would be natural for someone to check on and in law or an elderly parent wrong the route if you know if that is the case and wait no you can't do that well wait a minute what do you mean well they're trying to make it is inconvenient as possible value to do that right which is still restricting your 2nd amendment right at that point what they're saying as well that's the new law that we created and that's not what they're complaining about and therefore the whole the whole goal of the left is to keep playing this game and as soon as it starts to get to the High Court back off and change yes. It's what I Radio a he is or Carly and I'm Gary McNamara 8690 right guys so that's what I'm sure the Supreme Court in that some of the justices are worried about is obviously in this case that this is where the state of New York and the City of New York only changed the law because they knew the Supreme Court was going to reverse that and they didn't want a precedent set making the Heller decision even stronger in the individual right even stronger that's the one thing that they don't want to do right so what do they do they change the law still put on restrictions that are completely and totally unreasonable that still have huge questions about how the law would be enforced and and just hope that the Supreme Court says well it's moot and then you've got to start the process all over again with the unfairness of the new law Yeah it's it is an interesting I guess technical question about standing. But you can go back and say Ok the nature of it and also Was there damage at that time did that ordinance create that damage during that time and restrict them because there is if you look at it a fairly quick or fast route to recreating such a restrictive ordinance right by the way I said unfairness I meant unconstitutional law right unfairness has nothing to do with it it's whether it's constitutional or not yeah you're my definition or anybody's definition of fair doesn't matter whether it's constitutional and I'm sure of it so. It'll be interesting to see if they do I mean if they move on it. Won't shock me if they don't if they decide not to but. But if they do if they go forward on it that will be a big deal because I believe with the current makeup of the court they will find that ordinance and unconstitutional and that will I think set that legal precedent and could it could with that precedent could break down a number of very restrictive local regulations and ordinances and in other areas the the the 2 problems with it is what they evolve a lot into which is clearly unconstitutional and then the damages the money afterwards that well the legacy of the liberal justices Well they didn't they they didn't file for money damages Well no but they might have been waiting until after it was found unconstitutional by the Supreme Court then they have a better case while you have a huge civil case if Scotus comes down on yes I exactly and you've got a massive case because that's something that I think would be settled immediately they would even go to court on that. And you're probably going to get close to the ask if your civil court attorney is civil case attorney you know as is worth anything they're probably going to get pretty close to the ask on that one I just but I again I think if if we do if we get into it or if the court does decided keep in mind that would likely mean a decision next summer on this case that they go forward with so sometime what in June. Yeah they start out right right before the big conventions. It would be very interesting I think and because if they do they decide to hear it I suspect it will come down in favor of the 2nd Amendment and they will find that that type of ordinance unconstitutional Yeah and then how does it affect other laws and other localities that have been trying to put trying to to challenge. Heller or pass unconstitutional laws knowing that it will take years before it gets to the Supreme Court and. I level as they've been doing well because I think it is it could set that precedent and really tear down those types of ordinances and local laws in other areas and other states and cities and that would be a good thing because that would again chip away at those ridiculous I believe unconstitutional restrictions on the 2nd Amendment rights of those citizens. Because everybody knows that's why New York City in the state of New York didn't change the law because the Supreme Court agreed to hear right and they said oh this isn't going to go our way we don't want a national precedent set on this law will make it go away then claim that it's right. It is it is time I mean usually it's time management I own that yeah I'm still playing a lot of basketball and I want to do it in my in my forty's and even in my fit just so a couple years ago I spent a lot of basketball so that that was never exercise to me though I really started started working out I had it was in my late forty's or I felt that I had to work out now I have to work out and people say were you find the time and I say I have to find the time. My body just can't if I don't work out my body can't just the. I would be too tired if I didn't work out. I'd be a mystical I'd be a physical rock where you will resistance training which I do like 3 times a week my knees and elbows no more pain I used of water behind the knees and all my friends because I played basketball for such a long time getting their knees replaced I said I'd still want to do that I have water behind my fridge. Ok I'll have that might be a leak Yeah the water behind the I mean the knees I mean that was just that was weird and I was like What am I going to do with this and you know there are all this operation that operation like in let me try resistance training in a work well and at the same time too I had Sadek nerve problems so that's the other thing I went through sad for. About 2 and a half years before I found the solution Yeah. I still do the yoga stretches for it last year I felt it I just not that it hurt but once you have Sadek nerve problems well for example if I don't do resistance training if I don't do it after about 2 to 3 weeks if I don't do anything I can feel it again not that it hurts but you know what's there well the problem is with growing old is that the pain you have from not exercising is greater than the soreness you have after I guess the size exactly so. I just pick your pain. I enjoy running I I always have it it clears the mind funny because I have this I have a niece and. She is with child expecting next spring and she's still exercising and she runs she and her husband run. And they get into the fun runs a lot they'll go to you know this fun run of that fun run and I was asked a few times you know hey hey why don't you come out to a fun run Look I'm happy to donate and support you know any organizations on I don't like being around that many people when I run I mean because the whole point for me is really is mental right and I just love being able to to go out of my own and and be out there and be away I usually don't even check my phone I just go and and it's clearing the mind it's organizing thoughts it's sometimes having no thoughts just going and. I started getting back into it here recently I was surprised how easy well how my muscles responded in terms of form and everything else and I was I was really glad about that because I thought to myself I could never you know get back to where I was and I'm confident I will yeah I haven't played that much basketball at all lately because it's just too tough on the knees and hockey I had to give up a few years ago so it's resistance training that I hate every minute of it by the way you know on those machines and doing it I hate every 2nd of it I've been doing it for about 15 years now and I don't like it any better except when I'm done and when I'm done it's like oh this is great I feel great and then riding the bicycle and then during the summer. Swimming a lot and I do it all I do all of it now there actually is a goal and it's so i can golf I'm just to play at least 9 holes today so. That would got some good weather going on this we have think Yeah well it's funny because I keep telling people yeah golf this past week and I'm golfing like. It's November December you're golfing all the time but you're not golfing during the winter earlier in the summer so I guess 105 yeah right I'm golfing is between 60 and 70 All right I'm now you know in the in the times I golf in of November was the most I've golf all year and December will probably be because I'll probably get in 3 or 4 rounds in December which I've been normally getting you know around in every month if I'm lucky. So. But yet helps it helps it helps with that yeah. I think too I mean you get back to. Your trying to be a a good student for your doctor when you get you know start getting older too and you go to 3 times a year for regular What. Did I do good did I do good and good you know and it's funny because my doctor told me years ago and he's he's about Miami Beach and you know it's you know everything. We know everything you know pretty much in terms of your behavior we know the story from your blood work like oh what about the Burger King coupons to have a my shirt you really can't lie anymore the blood work is you know expense of Ryan Regan does a great bit about this you know in I walked on the moon you know his his stand up from years ago and I've always thought of that it's like you know you're you go in and you feel sometimes like a a kid talking to their parent is like well so see that's your cholesterol is the highest it's ever been wise that. I don't know let me put down my donut and I couldn't hear you better I mean it is you know you you. Yeah and then you start to get into the mindset hopefully you get into the mindset that all right look it's all for a reason it's not you're not trying to make the doctor smile you're trying to have that confidence that going forward it's not going to get. Considerably worse year after year you know you think about all the different I guess ailments and his eases and everything else that you might deal with and your old age and a lot of it is preventable or at least it is certainly easier to navigate if you do become ill when there is regular exercise involved I mean it's it's shown and and self-control because. As I people know now him because I posted enough and talked about enough but I'm up to making 30 to 40 loaves of banana bread I really don't need it I make it but I can't really eat it with my type 2 and I tried making a low carbon and a bread sorry the consistency of the bread just Zox Yeah you know and you can do it so I do leave myself one loaf and I cut it up into slices and once like a week I'll have it for 2 months because it's in the freezer right but really and people say how can you do that on one it's just you just do it well because you know you've got to make the choice I mean honestly I see it as this. You know everybody loves We all love you know junk food we all love the tasty stuff but but frankly when you do get past well I'll use 41 since we go back to that article and you know that people believe that at 41 that's you know when they start aging out of exercise and all of that but it you know once you hit 40 once you're on the other side of that. It's not that it's downhill it's just that the aging process itself is going to bring a lot of things you know medically speaking to your door and your behavior can change pretty rapidly in a in a short period of time especially like this this time a year you know you're right my appetite had not been there at all here in recent weeks several weeks and I was pleasantly surprised. Over the Thanksgiving break that it was back and then about Saturday when I went to sit down to watch television I realized wait a minute what's in my way oh I gained a couple pounds which by the way I was Ok with my doctor is going to be great with because you don't want to lose too much weight right but the point is is that I realized Ok wait it can't be pumpkin pie and whipped cream that gets you there you really do have to approach it because otherwise I mean it changes fairly rapidly and you get into a series of bad habits we all do. Level of performance whether it was when I played a little bit of hockey or a lot of basketball there was a certain level that I could have on the courts where you start losing that when you get older and the only way that I could keep it in something was golf but in order to be able to do that now because I've really over the last year just worked out so hard to make sure I can be pain free so I can have a consistent and good golf game because sorry I know it's stupid but you hit the ball with the stick and you're 160 yards from the hole and it lands 10 feet from the hole and you've got a birdie I'm sorry the adrenaline is flowing like if I could make a 3 point jump shot with a guy with a head in my face for me that's what it is to that's actually the quality of life for me that it's got to be if there's I'm sure that as I even get older I can let that go when that starts going in and start doing other things of maybe what the brain can still do that the body can't but that is to me was really has always driven me I like that there's a quality of life of being able to perform to at least a certain level which is a level of your own expectations that I did Ok well I mean that's it and I had one fitness expert tell me it really Fitness is about being able to perform daily functions do the things you want to do. Even before you get to competitive sports or any kind of sports activity and and get through that and not you know not have to say to yourself oh man I'm too tired I'm not in good enough shape because you know to these people that say you know and we all do it I'm too tired I'm too tired I'm too tired. It is when you get to that level of fitness and I don't mean. You know where you're.
