His family said they paid back the value of the alleged gift and that is why his longer says he should now be released. He will not walk free from prison today. There is still legal wrangling going on. The prosecution wants to appeal the decision and under egyptian law has 48 hours to do so. We are now hearing that the judges may not allow any appeal to happen. If and when he is released, Hosni Mubarak will not be able to leave the country and he is subject to a travel ban. He is still under charges of having to the reason he does not have to remain in prison while the retrial goes ahead is that he has already served out the maximum amount of pretrial detention permitted in that case, which is two years in prison without a final conviction. One thing is clear, he will not be released today but he could very well be free by the end of the week every you were saying how the courts could decide not even to hear an appeal, but could the authorities overrule the courts . That could turn the protest against the military and more could side with the alliance. We are seeing mass murder among those who are opposing this coup detat. We are seeing oppression of the freedom of expression. We are seeing a clampdown on Free International media. We are seeing a return of the mubarak regime. The only thing remaining is the return of mubarak himself, which we are seeing today. The International Community has backed off backed up the dictatorship for decades. We are seeing them being very neutral now. They did not does support the democracy as they should. Mubarak now is completely irrelevant politically and as a person. No one really cares. You understand it is a bit of a shock for people who do not live in egypt. It is more of a shock than for people who live in egypt who really have forgotten about the whole mubarak thing. I would have loved if she had been talking about freedom and the political process and the route toward democracy in october and november when the constitution was being drafted. That is where it all went wrong, really. Egypt had left the path to democracy at this particular point. Which brings us back again to the timing. Back to november, according to the associated press, in the last week we have had nearly 1000 killed. It had been a brutal crackdown and it is a fault by the military. It is a political and moral fault, but it could have been avoided if they had just let them go and let them be. The other thing i wanted to say is that the 30th of june when we had tens of millions of people in the street. This happened, this is a fact. The army would not have been able to go in the streets if there were not that many people in the streets. She was talking about january 2011, but it happened in a bigger scale in june 2013. What do you make of the timing of all of this that go the timing of all this . This train really ran off the rails due to Mohamed Morsis decision, due to the way the Muslim Brotherhood tried to consolidate power for itself. I want to push back against the claim that the International Community is backing a coup. What the International Community is trying to do is work with the new government after the previous government under the Muslim Brotherhood completely lost control of the state. I was in egypt on july 2 and three, the tail end of the new uprising. I go to egypt and a lot. What i saw in the Muslim Brotherhood and morsi had just totally lost control of the state. So his presidency was untenable, and that is ultimately why he was removed. Yet almost he has almost no one but himself and the Muslim Brotherhood to blame. It could have been averted had the brotherhood manage the country in a better, more inclusive, more democratic way. By the way, that is not at all to endorse the current. It does boil down to at the end of the day, Muhammad Morsi in jail, Hosni Mubarak out of jail. I think victor had it right when he said this is a symbolism that is resonating very much for foreign observers in the west, but that many egyptians are shrugging at. Morsi lost control of the state. Mubarak is not being reinstated coming hes being released on some sort of legal technicality. Im speaking to egyptians all day today. I spoke to a january youth protester who said we are going to back state. It just reflects how much the mindset of egypt has changed over the last 2. 5 years. Let me make a couple of observations. First, unlike in europe, which seems to view society as a post conflict society we do not have wars anymore in europe. The middle east is still subject to what i would call the rules of the jungle. You have a winner and a loser. When you say one guy is in jail and the other guys about to be free, that is part of the rules of the jungle. The army looks at the situation and says if we do all the things that the west wants us to do, and make nice to the Muslim Brotherhood, somehow we will live happily together. I am afraid that is just not th way it works. The other thing i would say is, mubarak is not being freed. He is being released from jail, but as i understand, he is going to be subject to a trial. It is very important for people to understand he is not just being released from all charges. He is just being released from bail, in american terms. He cannot travel from the country, so he is very much has to submit to the judicial process. When you think back to thohoe 18 days back in early 2011, and you hear what are correspondent was saying at the outset of the show, do you think we have come full circle . We have not, because things have moved quite a lot in egypt. The people of egypt have taken to the streets to oust, for a second time, what they saw as a threat to their freedoms, a threat to their way of life. That is very important. Egypt as a country cannot move back to january 24, 2011. Now the egyptian people know that they have that power to oust government. The timing is very powerful, as you said. If you believe in conspiracy theories, it is going to be difficult not to think that the army has used the egyptian people to achieve one of their goals, to be back to the situation before, which was basically an illegal Muslim Brotherhood movement, dismissed of the political life, where as an institution, the army will get back its free hand in politics, the economy with rhetoric which is very important , which is you are either with us or against us. It is interesting to see victor, who is very involved in the 2011 uprising, to defend the army, because he has to choose a side between the army and the Muslim Brotherhood. I know his opinions , he knows that the Muslim Brotherhood is more dangerous to his way of life. That is very interesting. We have a tweet saying millions in the country is not an excuse for a bloody coup and mass murder. I want to talk about the timeline not since 2011 but in the last week you read one of the big events of this week has been the arrest of the supreme guide late on monday, scheduled to appear next sunday in court on allegations of incitement to murder. It is the first arrest of the brotherhoods top leader since 1981 before mubarak became president. An interim guide has been named, described as a halt and a conservative. Are we going to have a time where both sides dig in their heels and it becomes more and more radicalized . I think what you are having is the decapitation of the Muslim Brotherhood. It is not like a normal political party. It is a hierarchical vanguard with a pyramid shaped structure in which very top leaders give commands down through a chain to low level activists. If you take out the top, you really disorganize it. That is what the military has done. It is sort of like the mafia. If you take out the don, all you are left with our random operatives. If you want to stop the downward spiral and get people to the bargaining table, who do you bargain with a few are throwing the top leadership in jail . I dont see a good Case Scenario here, but i always thought negotiations was very unlikely. When you have a coup, those that have come to power dont typically negotiate with those they removed from power. They try to destroy it. Again, im not endorsing that at all, but i do think these wheels were set in motion by the basic reality that president morsi had lost control of the state. Whether there was a coup or an uprising or some other scenario, his presidency was not tenable after june 30. X there is a lot more to talk about on this issue. Add to that claims of chemical weapons, gas used by the syrian army. Earlier, one of our citizen journalists spoke to us from the outskirts of the capital. The places in which chemical weapons were allegedly used are currently part of military operations being led by the ground forces. This is it illogical. Something definitely happen today. Since this morning we have seen a lot of videos and documented cases of more than 1193 cases. Our observer was a little bit skeptical, saying the use of chemical weapons in an area a report was sent from the medical point in this area who testified and confirmed the use of gas in intensive quantities. In march, there were claims that chemical weapons were used in Northern Syria near aleppo. Another two sites that were not made public. It is a bit frustrating since we know this is all happening just a few kilometers from where their hotel is right now. What about the bloodshed it self . We heard one of the Syrian Opposition leaders claim there were 1300 killed in the suburbs of damascus in the past 24 hours. What have you heard so far . Pecks on the first day we cannot get the exact numbers because there is a state of chaos. We cannot get exact numbers, but i had to sources near damascus who were receiving some of those who were killed and that were wounded from nearby that allegedly came under attack, and another location adjacent. A doctor and another witness who i interviewed separately both told me that 64 or 65 people in the hospital in duma arrived either already dead or they died in the hospital shortly after they arrived. This is only in duma. There are also hospitals elsewhere in nearby towns that also received the wounded and those who died. So it is very worrying. The pictures that we are seeing and the video footage are all very worrying. That is why we are now at a stage of reviewing the videos and drawing together information about the symptoms of these people that were affected, to know what was done. We are working with and lots of limitations. That is why the serious government should allow unimpeded access to the u. N. Team investigating on the ground. The Syrian Government denies the mass killing of civilians and more specifically, the use of those chemical weapons. Everything that has been said is ridiculous and naive am a unscientific, illogical, and subjective. We mean what we are saying. It has not been any use of them at all. The military operation that has taken place on the ground is a successful one. Forces are making progress on all sides. What has forced them to fabricate this was there knowing that it was the first day of the mission. This fabrication was prepared in advance. Conspiracy theories also seem to be surfacing on twitter. Is assad dumb enough to use chemical weapons while the u. N. In specters are in damascus, or is it another dirty trick by the sunnis . What is your reaction when you hear comments like that . Just how difficult it is to piece together what has happened, less than 24 hours after the shelling has begun. The broader picture we are seeing as a result of the syrian civil war, there is a very disturbing rise of sectarianism, that is sunni versus shia. Just categorizing the other as illegitimate, you cannot exist. Dehumanizing them. That ties into this very serious charge of alleged use of a weapon of mass distraction, sarah andgas to kill the sunnis sarin gas to kill the sunnis. I think we will get enough videos and pictures that the International Public will be very outraged. Lets step back and think, what does this mean e we have rising secretary and is him and then we have the breaking of a taboo, of one side, the regime allegedly using a weapon of mass distraction against the other side. What does this mean to the future of war . This is so serious. I hate to compare it to what has happened in egypt for the last two weeks, but even if the numbers are not as high as 1300, just to see those Young Children with no injuries just lying there dead or motionless is a really scary proposition. I really do concur with the other speaker in london that if the u. N. Team that is only three kilometers away from where these things have happened cannot figure out a way to go and see those big ms, then to go and see those vick adamvictims, thek we have a serious problem. That has to be brought up at the u. N. By america. It happened the same day as the u. N. Chemical weapons inspectors arrived in damascus. What they are calling for is to give them permission to immediately access the site so we can get the fax. The facts. The russians are saying they are for letting those inspector. The russian line has been pretty consistent all along when it comes to chemical weapons. They are saying we have seen this before, we have seen allegations of chemical weapons being used by the regime and everyone using it to hit the regime over the head with. These are words used by officials today, premeditated provocation by the opposition and its foreign backers. A spokesman basically said this was reported by the official state news agency, he said that the warhead came from positions occupied by the rebel fighters. He said it is the same type i am repeating the words that were said during the Russian Ministry press conference. He said the same type of pattern and rocket was used in the march 19 alleged use of chemical weapons. He said it is a deliberate attempt to undermine any attempt to organize a peace conference and to basically use any pretext to turn the u. N. Security counsel against the assad regine to build a more solid block against the regime and more bad blood for assad. What youre describing is diplomatic at one point there seem to be a bit of wavering on the part of moscow. Theres an element within the Foreign Ministry you could say is just cynical, that perhaps does agree with a lot of what is being said in the west and suspicions that the regime really is involved in the use of chemical weapons. Part may be truly convinced by what they are saying. We have seen this before with the west. Go back to iraq on the go back to weapons of mass destruction. They look for any pretext to go after Saddam Hussein at the time. There are people who see it in the same terms without being cynical about it. Right now in russia there is a sense of it being russia against the west. That comes right down to the syria conflict. There have been cases in the past where allegations of use of chemical weapons have been misreported. That is true, but i think the difference here, one or two months ago we were talking about what is the real red line . When the first allegations back in march came of the use of chemical weapons. If these reports are true, and i dont know if they are true if the regime has used sarah and gas, youre not dealing with the war of terror, we are dealing with the war of annihilation. The sectarian war has gone to such a state where one side is trying to eliminate, annihilate the other side. This is a really sad day. Why this attack now at this particular place, the eastern and Southern Suburbs of the capital . You had the u. N. Delegation in homs where he attacked the people. He is challenging the world to see how far he can go. Obviously there is no red line. I would like to comment on the sectarian war that was initially in initiated by a side and then followed by the western media. It was never a secretary and more. It was a revolution. It was never a secretary in war sectarian war. We have proof over years and years just a plot to polarize people. I can see he has succeeded with the strategy, judging by what the western media is saying today. We dont know who to trust or what is going on. It is also the media. We have been calling the international media, calling everyone to come and investigate themselves. If it was us with a chemical weapon like russia says, why would we call the u n inspectors to come in and inspect the case . We are still investigating the allegations. There are reports in Northern Syria, in areas or towns that are very close to turkey. There are clashes between kurdish troops and rebel groups believed to be islam is groups, basically. From the reports that we are receiving, and of course the investigation is still ongoing, there are very worrying reports about some killings of civilians, kurdish civilians. That is why we believe that one of the reasons possibly this is one of the reasons why they are fleeing in such large numbers. They are fleeing the areas because in some of the areas, they are finding it difficult to cross into turkey because the islam is armed groups are in control of the main exit areas to turkey. As we ask what the outside world is going to do about all of this, that brings us to the point that it is becoming more polarized, and throwing the cat in amongst the pigeons, a letter was leaked to a new york congressman on monday that was written by general martin dempsey. He said syria today is not about choosing between two sides, but rather about choosing one amongst many size. It is my belief that the site we choose must be ready to promote their interest and ours when the balance shifts in their favor. Jonathan paris, there is really no won that general dempsey trust for the time being to really back militarily. I have tremendous respect for general dempsey. He is one of the most intellectual joint chiefs we have ever had. But i just dont agree with the logic that we are dealing with all these bad choices. There are degrees of badness here, and the regime is the worst of the choices. What we are doing by holding back is allowing the iranians, has the law, and the russians to actively aid and assist militarily, diplomatically, politically you name it. Who do you give the weapons to . We have the units that are not under control of the jihad east. We know who they are. They are mainly in southern syria on the jordan border. Saudi weapons are getting through to them. I dont understand the logic that just because it would be dangerous to go all in with boots on the ground, or nofly zones, we cannot do a lot of the Little Things to help get this war over. The longer the war goes, the better the bad guys that mr. Dempsey is worried about, the stronger they get, especially in the north and northeast. I say lets not look at it as a black and white ink.
