Cairo, is a longterm deal reachable . We will speak to author norman finkelstein. Then president obama signs a bill to send 225 million in emergency funding to israel for its iron dome defense system. But does the iron dome system work . I would not spe money on an intersector that has near zero chance of intercepting artillery rocket. The interceptor probably costs in excess of 100,000 per interceptor and it is maybe achieving a 5 rate, maybe. Could be lower, against rockets the cost may 1000 or 500 thousand dollars each. A federal court has ruled an alabama law requiring abortion providers to obtain admitting privileges at a nearby hospital is unconstitutional. The law would have closed three of five abortion clinics in the state. While abortion opponents claim such requirements make patients safer, u. S. District judge Myron Thompson ruled the law would actually undermine patient care and place an undue burden on access. The ruling comes just days after an Appeals Court struck down a similar law in mississippi which threatened to close the states lone abortion clinic. In texas, more than half of abortion providers have closed under a similar rule. Texas providers have launched a new legal challenge to the restrictions passed in the face of mass protests last summer. The laws next phase, which imposes hospitalstyle building standards, could leave texas with fewer than 10 abortion clinics if takes effect september 1. And those are some of the headlines this is democracy now, democracynow. Org, the war and peace report. Im amy goodman. Welcome to our listeners and viewers around the country and the world. Israel has pulled its Ground Forces out of the gaza strip as a proposed 72hour ceasefire enters its seventh hour. In addition israeli and palestinian factions have agreed to attend talks in cairo to negotiate a longerterm agreement. Gaza Officials Say at least 1,865 palestinians, most of them civilians, died during israels offensive which began on july 8. Israel says 64 of its soldiers and three civilians have been killed. Nearly a quarter of gazas 1. 8 million resident were displaced during the fighting which destroyed more than 3,000 homes. Earlier today the Israeli Military sent out a message Reading Mission accomplished we have destroyed hamas tunnels leading from gaza into israel. All of israel is now safer. Palestinians returning to their neighborhoods report massive amounts of destruction. I am destroyed. Shock. I had heart problems. Then i saw our house. We dont know what to do. Everything is destroyed. For apartments. All of my children are stranded in the schools. Where are we supposed to go . In other developments, a prominent Foreign Office minister in britain Sayeeda Warsi has resigned saying britains policy on the crisis in gaza is quote morally indefensible. In an interview with the huffington post, warsi criticized britain for pressuring palestinian leadership not to see justice at the International Criminal court. On monday Human Rights Watch urged palestinian president Mahmoud Abbas to seek icc jurisdiction over crimes committed on and from palestinian territory. The Group Detailed multiple examples of Israeli Soldiers shooting and killing fleeing civilians in gaza. To talk more about gaza we are joined now by norman finkelstein, author and scholar. His most recent books are old wine, broken bottle ari shavits Promised Land and knowing too much why the American Jewish romance with israel is coming to an end. So, the ceasefire has been. It is holding after a few hours into it. If it holds, there will be negotiations taking place. Talk about what has happened. The first thing is to have clarity about why there is a ceasefire. Last time i was on the program i Prime Minister netanyahu basically operates under to constraints, the international constraint, mainly , with all the death and the structure that he can inflict, and then domestic constraint, which is that Israeli Society does not tolerate a large number of combatants thats. Reasons of it for which there are no to go into now. He and his spokesperson have the right to defend itself. It went on for day after day, schools, mosques, hospitals. Then you reach the limit. The limit was when israel started to target the u. N. Shelter, targeting one shelter, outraged. The pressure began to build up in the united nations. U. N. Shelters. The pressure began to build up. The boiling point with the third shelter. A u. S. Puppet. Even the u. N. Secretary general was now calling it a criminal act. Deplorable, which is exactly what happened in 1999. That the terror bombing has to stop. Then yahoo had reached the with thetolerance domestic issue. Israel had launched us tentatively to start stop the socalled rocket attacks. The tunnels have nothing to do with israel. Israel claims that there were 12 tunnels that had passed through the border. There were many more tunnels between gaza and egypt. The first thing that he did when he came into power in egypt was seal the tunnels. Did he have to destroy gaza to seal the tunnels . Israel had could not have done the same thing . Seal the tunnels on its side of the border . What did hamas have . Shovels. You are telling me that israel didnt not have the earth moving equipment to build a wall that ran deeper than the tunnels . It has nothing to do with tunnels entering israel. Out they have created a fairly Sophisticated Network of tunnels. I know we are not allowed to make these comparisons. Not unlike the bunkers built in the warsaw ghettos. Primitive but effective. Hamas fighters were able to come out of the tunnels and they have inflict it a significant number of casualties on israel during operation cast lead in 2009. 10 israelis were killed. 65. Time it was about during the lebanon war in 2006 against hezbollah, half of more were killed. View the tunnel system inside of gaza, it is not very effective. Why do you say moe the lawn . That is the israeli perception. Every few years they want to make sure they mow the lawn. All of them are talking about the next war. Every single commentator talking about the next war. They want to make sure that the next time there wont be tunnels. The problem was they had reached the point in gaza where if they went further they would have to end the war in builtup areas. Those are densely populated. Remember, gaza is six times as densely populated as manhattan. It was not for the densely Populated Areas we would be talking about thousands of cap casualties. Netanyahu knew that israel would not accept it. Talking about thousands of thousands of casualties. The other thing was that these were not vulnerable to aerial bombing and artillery shells. The tunnels were still there. They realized it was over, there is no further they can go. The international constraint kicked in when obama said it is over, folks, we have to stop, killing too many u. N. People this time. And then the ceasefire was such. For israel it is for hamas to a sign the lifting of the blockade of gaza. Things being upheld in egypt, what do you expect to play out . What isis pretty clear going to happen. In july i posted something on my website predicting what would happen and exactly what did happen. What will happen now is for domestic reasons then yahoo has to end the projectile attacks on hamas says it wont stop firing its projectile rockets until israel lets up on the blockade. They will bring on the authority , lift the blockade partially and we are talking about huge amounts of International Donor aid. There are so many weirdnesses about this conflict. Nobody talks about israel paying reparations. It is taken as a matter of fact. That they be billed after israel destroys. We destroy, they pay. In any case israel would say that it is the thousands of hamas rockets. Like there were none fire filed in israel. Anyone with common sense knows that it was impossible and has already been documented by people like mark perry. Anyone but a moments common sense knows that they could not have been firing rockets into israel for obvious reasons. After july 2013 there was a coup in egypt. The tunnels were sealed after 2013. On the israeli side there was a blockade. What could get into gaza . No military equipment. They were firing, as someone put scientist. Ic they had a Guidance System with the equivalent of up rated fireworks. Up rated withsay no Guidance System, but they had a payload, and explosive payload on the fireworks. Where is the evidence for it . In a moment we will talk with a physicist about the iron dome. Regard for high theater postal, but i dont accept part of his analysis, because he says that what protected israel from the hamas reject aisles was not iron dome, but a sophisticated bunker and shelter system and warning system. Then why has there not been significant damage to civilian infrastructure . How many schools and hospitals were destroyed . Explained by the civilian shelter system. Do you think the ceasefire at this point, basically what is going to happen is it is over. Obama said its over. The Ground Invasion reached it limit. Problem. Yahoo has the he has to end of the projectile attacks on israel and the only way that he can do that is he is going to have to agree to the lifting of the blockade. At this point there is nothing left that he can do. Destructiond the and mow the lawn. What will probably happen now is they are going to bring in the Palestinian Authority, there will be a rebuilding of gaza and hamas. He will be dusting off his Peace Initiative with hamas neutered the Palestinian Authority will happily agree. There will be a big Peace Agreement signed and all the people will celebrate. Some people will say that it would be great for the blockade to be lifted and the people can stop suffering with rocket attacks being over. Except for one thing. The blockade is illegal and immoral. Why did you have to wait until after to demand International Law . I want to thank you for being with us. This is democracy now when we come back, physicist ted postal on the iron dome. President obama has just signed off on a bill for israel to expand its arsenal of interceptor missiles. Stay with us. [ ] this is democracy now democracynow. Org, the war and peace report. Monday president obama signed a bill granting initial 225 the irono replenish dome defense system. Emergency spending was approved unanimously by the senate and by a 395 to eight vote in the house. One of the nations leading missile experts says there is now no evidence that iron dome is actually working. Theater postal is wellknown forin the fence circles exposing the failure of missiles during Operation Desert Storm. We turn now to part two of the conversation we had with the m. I. T. Professor. He recently wrote an article called the evidence that shows iron dome is not working. Postol is well known within defense circles for exposing the failures of the Patriot Missile system during Operation Desert Storm in 1991. These comparisons are tricky. It is the Early Warning and sheltering system. The Early Warning system has the use ofed through telephones. For example, if you are in a city somewhere where the israeli radar determined that artillery rocket is headed in your direction, you will get an audible signal that says you need to take shelter. And then there is a shelter system that has been built in these areas of israel, plus a shelter in your home if you were actually in your home. So, all that you would need is 10 seconds of a warning or less to get a shelter in your home. Get told actually shelters very quickly on the outside, because these shelters are all over the place where the population is dense and the Israeli Government has predicted there will be a likely attack. Let me quote from reuters. The iron dome interceptor has shot down 90 of the rockets engaged during the fighting, up from 85 in the previous miniature war. Your response . First of all, i am sorry to that the press needs to engage in more Due Diligence on these matters. This number come from . An israeli spokesperson. Now, if i give a number incidentally, i have a long record of being correct on these matters you dont hear the press coming to me and asking me if i believe that number is correct. If i dont believe the number is correct, why would i not . This is really you can really put this back on the Due Diligence of the press with regards to this matter. They are just accepting information from an interested party. Can you further explain how this works . How the iron dome built this . The iron dome is mostly an israeli development, although is involved. The iron dome interceptor has to approach and incoming artillery rocket headon. So, if you saw an iron dome interceptor flying and near vertical trajectory, that would indicate the iron dome interceptor is in the near headon engagement. Coming at the artillery rocket. At that geometry it has some chance of destroying the warhead. Iron dome the interceptor engaging the rocket from the side or from the back by chasing it, then it has essentially zero chance of destroying the artillery rocket warhead. Up into the sky and look at the hundreds of videos we now have of the contrails, the smoke trails around the iron dome , there ares exceptions but you can see that almost all the time the iron dome interceptors are traveling parallel to the ground, meaning that a following artillery rocket is engaged from the side. Are diving tomes the ground, meaning theyre trying to chase artillery rockets from behind. All of those engagements had zero probability of intercept. So, we are guessing, guessing based on what we have, that maybe 10 , 15 , or 20 of the engagements are headon. It is closer to 10 . See so few of the engagements headon, your conclusion is the system is not irking the vast majority of the time. Of the goes to the issue proportionality of the attack. Often when the issue is raised, every death is horrific on either side, but when this issue is raised israel just says that we have an extremely effective iron dome system. , if it isot iron dome simply saying that it is these rockets that these groups are firing off, that they are not working if their intention is to kill, that they are not lethal weapons. If so few people have died, then iron dome isnt working. One has to realize and understand some simple technical fax. Artilleryll, most rockets are carrying warheads in the 10 pound to 20 pound range. If you are sinning in a room and a rocket comes through the roof and explodes in the room, it will kill you and kill everyone else in the room. If you have 10 seconds or 20 seconds of warning and you go into the shelter that is by law else in your home and the rocket happens to hit your home, you wont be killed. It could even hit the shelter and you wont be killed. So, sheltering and Early Warning are extremely critical to keeping the death toll down. Odds of a artillery rocket going through the roof and into your room are very low. They are high enough that if i were in israel, i would advise you, and to do so myself, i thed take shelter, because inconvenience is small relative to being killed or injured, but most of these rockets are landing in open areas. Landing between buildings. Landing outside buildings. Is that thiser relatively low lethality warhead lands within 10 feet or 20 feet of you. If you just lie on the ground lets say you are caught in the open and cant go to a shelter the Israeli Government themselves will tell you that your chances of being a casualty from a fallen artillery rocket are reduced by 80 , 80 , if you simply lie on the ground. The reason for that is the lethal range of these low weight warheads is not very large. They are blowing out fragments like a shotgun. If you get close to the ground unless you are very unlucky and lands on you or very close to you, you wont be injured by the explosion. Although these artillery rockets are fantastically disrupt it with regard to the functioning of Israeli Society and i and becauses true of that there is a psychological and political leverage associated with these artillery , they are not killing people. Long as people are killing taking shelter and shelter is available. Professor, i am looking at a boston globe piece on the iron dome and raytheon being a key in the plan. It says for raytheon, part of a coproduction deal with the defense system, it presents a potential financial windfall. Much of the work would be done at the tucson, arizona missile plant, as well as by subcontractors across the country. Talk more about exactly what raytheon does and if this iron dome system is now being sold to other countries. I am not aware of sales to other countries at this point. I have not been following that part of the issue. ,n the question of foreign aid in this case to israel, it is it isommon, almost always the United States government requires that foreign aid he largely spent through using american companies. In the case of raytheon, they are the premier company for basically building missiles and interceptors of all kinds. So, it is a natural business arrangement for raytheon to be a big beneficiary of an agreement like that. The money goes to israel in a virtual way, but is basically spent in the United States. Now, this raises the question of the cost of these interceptors. Some israelis are saying that the interceptors cost 20,000 each. The reason for lowballing this because the iron dome interceptors are intercepting rockets that might cost 500 or 1000 each. There is an issue of how much you should each pay, assuming the system is working, for stopping an artillery rocket. Especially if the path of defense and taking shelter saves lives. For example, how many artillery shells cost 20,000 dollars or 100,000 in damage . Donttual cost of an iron iron dome interceptor is almost certainly well over 100,000. Just to give you a sense of how off the cost could be again, we dont know at this point another interesting fact, there is so much we dont know yet people are throwing money at this there is a comparable. Issile in costco beside wonder it is an air to air missile that raytheon manufactures and sells. The iron dome interceptor is very close to an air to air missile. Very small, weighs about 200 pounds. So does this air to air missile. Different design, though. It cost 400,000 each. How is it possible to build an similartor with advanced technology, roughly the same size, and it only cost 20,000 . There is a significant question there about whether the congress the American People are have Accurate Information about what the system is really costing. You are raising serious questions about the effect of ms. Of iron dome. Hundreds of millions of dollars, more than the Obama Administration has asked for, is being discussed in congress to pour into this. Have you been called by anyone in congress to testify . To raise your concerns . Of course not. In interested in information. To discussionsvy with members of congress who have oversight responsibilities who have acknowledged in those discussions that they have no idea whether iron dome is working or not. I can also tell you that the u. S. Government has not been given any information on the performance of iron dome. So, when susan rice, the International Security advisor, makes a statement about how well iron dome is working, someone should ask her what her source is. I can tell you she should have a source. She should be able to tell you we have the following National Laboratory take the data from the israelis who looked at it and, let me tell you, this thing is working well. Instead she gets on television and talks about this working well. Someone in the press corps should do their Due Diligence where did you get this information . It is not just susan rice, it is president obama himself. This is what he said. No country on earth can be expected to live under a daily barrage of rockets. I am proud of the iron dome system that americans help israel develop and fund has saved many israeli lives. That is president obama. Tomr. Obama should be able answer the question of which american Technical Institution has obtained the data from the israelis and verify the accuracy of the data and verify that the performance levels are what they are. That the israelis have the data. They have radar data, they have video data in the visible and the infrared. They have substantial amounts of data that they could make available and should make available to the United States is Technical Institutions to have the data reviewed and certified. Or politician, the president his National Security adviser that makes this claim that the system is performing well should be able to point a finger at the specific agency that has the technical Reef Resources to review this data and has obtained the data from the israelis. This is just an outrage. Postol, cist theodore a professor of science and Technology Policy at the Massachusetts Institute of technology. He recently wrote an article called the evidence showing. At iron dome is not working to see the first part of the interview, you can go to democracynow. Org. When we come back, homicide is the ruling in the death of eric garner. You will find out more after this. [ ] american skin, 41 shots, by bruce springsteen. I am amy goodman. Medicalide is what a examiner ruled in the death of eric garner. Police laced him in a chokehold after they confronted him for selling single cigarettes known as lucys. Graphic video shows the officer ground. Him to the he repeatedly says he cant breathe. I cant breathe. I cant breathe. I cant breathe. I cant breathe. Once again, the police ganging up on people. His family and supporters have called for from all charges against the officer in a federal civil rights investigation. Chokehold like this have been nypdsunder the Excessive Force guidelines for more than two decades. Today the new york city civilian Complaint Review board will meet to address hundreds of chokehold complaints against officers in recent years. One day after his death was ruled a homicide, the man who filmed his death was arrested on homicide charges. He says he has been harassed by police since the video emerged. All of this raise the question what right did they have two film on the job to ensure accountability . Are joined bye two mothers whose sons were killed by the new York City Police department. [no audio] died after an officer place to the chokehold. He was later convicted on federal civil rights charges and sentenced to seven and a half years in prison. Joining us from washington, is kadiatou diallo. Her son amadou diallo was killed in 1999 when police fired 41 bullets at him striking him 19 times as he reached for his wallet outside of his apartment. The officers were acquitted of murder charges. Both diallo and baez have been supporting eric garners family since his death. Were also joined by lawyer, norman siegel. He was director of the new York Civil Liberties Union for 15 years. Now in private practice hes representing debra goodman, a retired legal secretary who filed a lawsuit against the city of new york after she was arrested for filming as Police Officers watched Emergency Medical Technicians speak with a woman in a wheelchair. Welcome all of you to democracy now they had a very different story in the report. They said that they never mentioned chokehold. They said he was in no distress. But this video shows something very different. This young man, ramzi orta, just stood there, filming, and it shows the entire encounter. This is what has led to an outcry across this country. He, after the homicide ruling, is then arrested. Talk about the significance of this. Of being able to see what took place. Is crucial, without the video the eric gardner story would be totally different. The Police Version and the peoples version. The beauty of the video is that and itks to the truth becomes difficult for people in and whenspin the story you see police violating someones civil rights, record and the story will be different. Maybe we can get accountability, finally, over law enforcement. You did this, filmed the police last year. Can you tell us your story . I crossed the steep and saw woman who appeared homeless. You were a legal secretary . I saw three Police Standing by police van. As i was attempting to film, an officer approached me and he held held his smartphone up as if he was going to film me. I tried to explain to him that he did not have that right because he was a Police Officer on duty and i have the right. Then we had some words. He asked me for some identification. I knew i was not doing anything wrong, so i was refused so i refused. He told me i was under arrest, put handcuffs on me, threw me in the police van like a piece of meat and i was detained for approximately 25 hours. Having the handcuffs behind my back caused terrible pain. Mentioned this several times and nothing was done about it. 24 hours later i was arraigned. I had to appear in criminal court five separate times, at which times i was offered the sa thing. I did not want to plead or take any deal. Visits toter five criminal court, charges were dismissed. And how many states is illegal legal to film the police . It is very confusing. In the federal system, trial courts, the court of appeals and the u. S. Supreme court, the first circuit, the northeast, the seventh circuit, the midwest, and the 11th circuit, the southeast, florida, alabama, and georgia, those courts have said there is a constitutional right to do what debra did. The Third Circuit new jersey, pennsylvania, the fourth circuit, that area, they say no. So, states are saying states and legislation are saying that it is not legal unless the Police Consent . A lot of them have not addressed the issue in the absence of law. Saying you have a right is usually not a right. In new york are Second Circuit does not address this issue and therefore debras case could be important, maybe historic, maybe it winds up eventually in the Supreme Court. There is that division between the circuits and usually the Supreme Court gets this area people say that the Supreme Court is conservative. I think that everyone support the right of people to record the police when they are interacting with people. I want to turn to the two mothers of victims of Police Violence in new york. Iris, your son, anthony, it was december 21, 1994. Describe what happened to anthony in the bronx. I was in florida. My husband was in the house. That night they were going to go to florida. They had all the suitcases in the front of the house. They found a foot all. The Four Brothers decided to play your four kids. For boys. They went downstairs and started playing. One of them threw the ball over david and it hit the patrol car. The patrol car was parked along the property. They always park there, they hang out there, they do their stuff there. They do their stuff there. The football hit the patrol car in the bottom. It ricocheted from the floor and hit the patrol car. He is supposed to be driving the sergeant around. He is not supposed to have contact with anyone in the neighborhood. Because . Because he was abusive. Because he was a delegate to becoming a higher up in the pba. The union. He was very protected. When the ball hit the patrol car, he got out. He told him to get away from the block. And then he said we live here, this is the only house in the block. Kept on moved up and throwing the ball. He got out again and told them to get out. In then he put david patrol car, handcuffed david. Your younger son. My 16yearold at the time. David said we are not doing nothing, not bothering nobody. There was a black jeep that my other son had. He pushed him against the jeep and his body ricocheted back. The choker on put him. They were screaming and they called my husband. My husband came down in his underwear. My husband said why are you doing this . He is a sick man. Youre hurting me, he got asthma. Your son, anthony. He had asthma when he was younger. He outgrew it. So, my husband was telling him to stop. He said so, if he had died . What is he so he said if he has that, what the f is he doing playing football . It is ironic. Anthony fell to the floor. At that time there was another patrol car coming that stopped. That patrol car that came last that saidlicewoman nothing went down the way they said it went down. Got 48orget the police hours to fix the story and make it happen the way they want. Before they have to testify. This female Police Officer said that what the police were saying was not true . Yes. At your son had died in this chokehold. Yes. And then there was no cpr. There was no ambulance called. They dragged his body into the car like an animal and threw him in the back to the car. Mind you, my husband was saying hasas a sick man, that he asthma. No one gave him cpr at the time. Kadiatou diallo, you have been to this before. Attended the funeral of eric garner. Your thoughts today . The officers and your son, was killed in that case. [no audio] im sorry. Can you start again . We didnt hear you. I was saying that it is a bittersweet moment for you when i attended the funeral. We had been there many times over and over again. When my son was gunned down in his own vestibule he was doing nothing wrong. That night, no one called 911 saying that any crime is being committed or had been committed that night. They just came out with their guns drawn. Son. Basically executed my my family and the community at large called for changes. It seems to me the call has not been answered. We keep on seeing many victims of the same similar cases. Even different cases. What is different this time . E did not have a video to show but this time, as was just said, we have this video that enlightens so that we can see the aggressive and brutal things that the cops did against eric. I have to say, though, that if the nypd and law enforment at large want to help the communities to reduce crime and to prevent an iendehs from happening, we have to seize this moment and start with this video and use it as a way to make and improve the quality of their work. Even, maybe, to call on Police Officers to have new Technology Equipment that it can carry so that they can document their conduct while apprehending people in the neighborhood. Norman, the chokehold that was used on eric garner is banned under police policy. Have the police done enough . Absolutely not.
