Dave, a lawsuit filed this week claims the city cant legally cite leased vehicles with those automated violations. That is the claim from attorney Jonathan Schmidt who is representing himself to fight one of the i380 speeding citations. And schmidt says he had success with that argument to court over the issue. Schmidt says a magistrate judge ruled the citys ordinance can only be used to Issue Citations to the legal owner of a vehicle, not someone leasing it. And that citation was dismissed. Schmidt says he got another automatic speeding citation recently and thats when he decided to take the city to district court. Hell filed suit to prevent the city from citing anyone who leases, rather than owns a vehicle. Schmidt says the financial corporations tha would probably ignore a local citations. But thats what the city would have to do because thats how the rules are written. The Vehicle Owner is defined as the registered owner, the owner registered with the state, and people that lease vehicles are not registered owners so the city by sending out citations to people that lease vehicles or small companies, Big Companies that lease vehicles theyre exceeding for the city doesnt believe the city has fought a lease argument before in court. The city couldnt estimate what percentage of citations go to leased vehicles. But a National Automotive website estimated 27 percent of all vehicles in the u. S. Were leased in 2014. The city is currently fighting a number of lawsuits over whether automatic camera speed violations are legal. The Biggest Court Case is the one with the city fighting with the iowa dot over an order to remove s the interstate.
