Jenna the orange city woman sentenced to prison time for the death of a 3 yearold in her care. Is getting a break. And now, word that the sioux county attorney will not chalalnge the decision. Sapp is serving two 50 year sentences for the death of 3year old autumn elgersma, who she admitted to throwing on the ground while at her inhome daycare. Last year, she made a plea deal. And then last month, judge edward jacobson, changed her sentence citing Good Behavior while in prison. Now, sapp will serve her sentences at the same time, effectively, cutting them in half. Autumns mother, jen, didnt see that coming. Jenna under iowa law, the judge is allowed to reconsider sentences within a year of the sentencing date, without notifying the county attorney or the victims family. Tim on cam just 5 weeks from when iowas Medicaid Program is scheduled to change from state run to privately managed, an Administrative Law judge is asking the state to make changes. An Administrative Law judge today asked the state to throw out one of four agreements reached with forprofit companys to run the program. Tim according to the Des Moines Register the judge is asking that the contract awarded to wellcare be thrown out. The company has been accused of mismanagement in other states. Governor branstads communications director, acknowledge the judges ruling. But did not comment on the request. Instead ben hammes said the ruling allows the program to move forward the complete re vamp of the states medicaid system has some voicing concerns. Ououconcern is we get to january firstand we have a train wreck on our hands that we dont know how to manage, said Greg Boattenhamer of the iowa hospital association. Tim the federal government has to give its approval before the state can move forward with the change over. So far the feds have not given their okay to do so. Jenna if youre a parent, you know how hard it is to be away from your kids. Two elk point havent had their kids under their roof the entire time theyve been a family of four. Their 2yearold, jack, has spent his entire life in the hospital. But, now it looks like, he could come home soon. And while thats exciting, it means theyll need more support than ever. There story is tonights your health matters. As the miltenbergers go through their normal evening routine, a piece of thmily is missing. If fact, theyve never been quite whole. Erin says, we have two boys. Cale is 6 and jack is 2. In bens younger son, jack, has never been to the familys elk point home. He was born 16 weeks premature, weighing only a pound and a half. The early delivery meant jacks lungs werent fully formed and hes struggled with severe breathing problems ever since. At their lowest point, when erin and ben feared they would lose their baby, the decision was made to move him to a special Childrens Hospital in ohio. Erin says, there was a lot of deliberating about whether or not that would be the best choice, but we determined and decided as a family that transferring him would be the best choice. Its a decision that likely saved jacks life, and now it looks like the day his parents have dreamed about may be in reach. Jack can come home once his doctors see success with a new home ventilator. If all goes as planned, the miltenbergers could celebrate the new year as a family of four. But with that excitement comes the familys newest challenge. Theyll in elk point, and nurses are in high demand. Erin hopes by sharing their story. Somone out there will be the answer to their prayers. Erin says, the more people that can share jacks story and let them know that we need nurses. Its something weve been waiting for for over two years now. Ben says, itll happen, and i really hope its this time. Bringing jack home, and making their family complete. Jenna if you know a nurse who might be interested in caring for jack once he gets home, the miltenbergers are working through universal pediatrics. Jack does qualify for care 24 7, so insurance helps them out and the company is able to offer benefits and even a signon bonus. I have the link to their application on this story at siouxland matters dot com. Tim if you need some help getting in the Christmas Spirit after thanksgiving, you can take your family to downtown sioux city for the festival of trees. Proceeds this year will go to the siouxland autism support group. Tim still to come. Well take a look at two of the heros that will be honored during the heros game on friday fred ice and snow are coming tomorrow, and that will bring travel headaches. Cooler weather will follow. Your forecast is next fridays game and the players its called the hyvee heroes game for a hereos will be honored at halftime on friday, including two iowans. Without an iowa state trooper and a local nurse, an oklahoma man may have lost his life back in april. Theyre being hailed as hereos. Clair powell brings us more the engine is revving high, it takes off tires squeal this is not good somethings going on inside this truck seven months ago, iowa state Patrol Trooper tracy bohlen spotted a truck with oklahoma plates, stopping and going in the middle of 70 mile per hour interstate traffic. It was right where the pylons are first time i saw him pat roark, an out ofstate driver, was having a seizure in the middle of interstate 35 his 15 year old son, eli, grabbed the wheel. Took his dads foot off the gas, bohlen ran over starting cpr right then and there. A lot of things played out the correct way two cars behind bohlen was nurse jane mccurdy. I worked quite a few days it was my day to relax relaxing went out the window instincts kicked in. Thought that someone needs help and this is what we do as a nurse, this scene was nothing new. So, as pat fought for his life on the pavement, mccurdy took sobbing eli under her wing and didnt let go. Ill take you to the hospital i wont leave you, ill stay with you after gettng him a hotel, food and days of waiting. The roarks went home to oklahoma. Now months later, in true heroic fashion, neither bohlen nor mccurdy will say they are what everyone is hailing them as. Its humbling and its a big word i dont look at myself as a hero, just right place right time doing my job eli is truly the hero, hes the one that got the truck stopped. They say the highlight of that april day isnt saving pat or elis lives. Or becoming quote on quote hereos. The best part was becoming their friends and in turn, part of their family. Hear from the huskers on their legacy. Tim plus sbls cole croston has followed his dads foot steps to iowa city. Find out what both of them have to say on the family legacy up five of those players are in their first year with the program, but the remaining two are a pair of walkons who have worked their way onto the depth chart. Brandon snyder from west lyon is the backup safety and a special teams standout and sbls cole croston has moved up from walkon to starting right tackle for the hawkeyes, following in his dad daves foot steps 30 years ago. Cole crostonhe was a fantastic player and i dont think im necessarily in his shadow by any means. Im just trying to be my own player. He was a great player. If i could even be half as good as he was it would be a fantastic career for me. Dave crostonthe fact that i played down there, you know, my names on the wall in the oline room, i think he maybe caught a little grief from the other guys, but i dont think there was ever really pressure. We dont talk about technique, we dont talk about his kick step or we dont talk about a whole lot football wise. Just a little bit every now and then, but the big thing has just been when you get an opportunityou have to make the most of it and thats what hes done. Chris well hear more from cole and dave coming up tomorrow in our heroes game preview special. On the other side of the missouri, its been a tumultuous four years for the nebraska seniors, but they have a chance to go out on a high note on friday. The senior class has gone through a coaching change, an Athletic Director change, and is on the verge of possibly missing out on a bowl game for just the third time since 1968. But they also have a chance to play spoiler on friday, ruining iowas undefeated season and possibly knocking them out of the College Football playoff. They say the challenges theyve faced though have made them stronger as a group. Jack gangwishthere isnt a lot of romance in College Football, you know . Its resultsdriven, you know, youve gotta perform. Youve gotta go out there and do well, especially at a place like nebraska. Andy janovichwhen the last Coaching Staff was gone, we all just came together and realized that we can only really count on ourselves and i think everybodys got great chemistry because of it. Mike rileyi really appreciate them for who theyve been and how they have gone through this year. Theyre good representatives of this program, of this scho. Kick off friday is at 2 30 right here on abc9. And dont forget well have much more heroes game coverage leading up to kickoff.
