News this is All Things Considered I'm Audie Cornish and I'm Mary Louise Kelly we are a few weeks into the new Trump administration policy of 0 tolerance for illegal border crossings in that timeframe thousands of migrant children have been separated from their families we wondered how that policy is playing out for those on the frontline those in the Border Patrol so we invited Brandon Judd to the studio he is a 20 year veteran of the Border Patrol and president of a union that represents some $15000.00 Border Patrol agents what we're doing is we're prosecuting these individuals and we do separate them for a very very short amount of time it's not the separation that people are thinking weeks months even years that be clear when people just cross the border border patrol you're talking about a period of her hours they might then go into the custody of other federal agencies and then or and then for a term yes if they go into detention to federal of other federal agencies there could be a separation that a little bit longer but that percentage is so small because we just don't have the facilities to hold very many people so this era tolerance when people hear the 0 tolerance you would think that we're prosecuting 100 percent of the people who are crossing the border and that's not true in fact we're prosecuting between 10 and 20 percent of the people to cross borders will take but hang on that's the whole point of the 0 tolerance crackdown is that everybody crossing the border illegally is supposed to be getting prosecuted you're saying that's not happening that's not even close to happening what you're hoping to do is you're hoping that with that small number of prosecutions you're hoping to drive the numbers back down and if you drive numbers back down then we'll have the resources to prosecute 100 percent but help me help me square 2 facts Attorney General Jeff Sessions homeland security secretary cares to Nelson have said u.s. Policy going forward is anyone who crosses the border illegally will be prosecuted you're telling me that's not happening that's a tiny fraction that you know it has years and it is a tiny fraction they're hoping why what's what's. Just don't have the resources just in one station one station alone we're arresting about $200.00 people to cross the border illegally per day per day that's one station we've got over $150.00 stations in the United States just don't have the resources to let me ask you about the direct consequence of this Trump administration policy which is families being separated at the border have you heard from any members who are uncomfortable with that policy now because again the border patrol agents were not separating families and we have been called the Gestapo We've been called Nazis I mean we've been called everything in the media the fact of the matter is is Border Patrol agents we are not separating families except for a few hours for them to go see a magistrate or in extreme cases and when we hand them over to the federal government statistics that are out or something like 2000 children are being held separate from their parents it is happening and that could happen with ice raids h.s. But that's not happening in the Border Patrol's hands what when we turn morning for troll isn't operating in a vacuum they know what the situation is at the border Well of course we do but but again we're going to go back we're going to look back at what we've always done our agents are looking at this and they're saying why is there this huge outcry when we did the exact same thing in twice that really that's what you're hearing from the original I don't understand the outcry that's that's not out of it's I mean it's lawmakers it's evangelical Christian Good's it's Catholic or what it's every living former 1st lady it's members are either saying what are aces are saying is Where was the outcry in 2014 but in 2014 the administration that Obama administration was not separating families it was not sending children to separate shelters which is what's happening today from the Border Patrol's perspective there is no difference what happened in 2014 to 2800 I can't speak to ice the Border Patrol we do not separate them what happens when they go to ice I can't speak to that. But are you saying nothing has changed for the Border Patrol under the day in June 28000 from where we were a year ago from the only thing that's changed is that we're prosecuting more people if we would have prosecuted you a year ago we would have separated you from your children the same way we would do it today the only thing that's different today from 2014 is the number of people that we're prosecuting Can I ask you just of central question of the heart of the certainly the basic one is this cruel. If they were being separated for if if it was the way the media was portraying it yes I was the way it is as you see it is it cruel to. Their parents we're not we're not for a couple hours for a couple hours for one day and I just have to keep injecting there's 2000 kids who are being kept separately from their parents sometimes in different states that's the government federal government statistics Ok I I can speak to what I say does. The Border Patrol agents are not separating families from children when we do it's for a couple hours what happens with ice after that I don't know I don't see it or if Office of Refugee Resettlement are from friends or all of those but they have to go to ice 1st and what happens from there I don't see it that was Brandon Judd he is president of the National Border Patrol Council and for context on what we just heard from him I want to bring in N.P.R.'s John Burnett who has covered immigration policy for years had John Henry Louise So what Brandon Judd was saying there that this separating families typically only lasts a few hours and that the percentage of children who are separated for a longer amount of time he said is very small based on your reporting is that true I think it depends on where you look in the Rio Grande Valley in the southern tip of Texas that's the nation's illegal crossing hotspot I talked to a Border Patrol agent last week and he agreed with Mr Judd he said most of the children are left alone in these these chainlink holding cells we've seen for a matter of hours while their parents are in federal court so typically they'll plead guilty to a misdemeanor and they're sentenced for time served and they're reunited with their kids then they can get an electronic ankle monitor and go to the Greyhound station in Mike Allen and continue their journey and hopefully show up in immigration court later but we learn from Homeland Security just this morning that in the 1st 35 days of Trump's 0 tolerance more than 2300 migrant kids were sent to these government contracted use shelters where they stay for nearly 2 months that's because their parents were not released. From federal custody so it's not a small number of kids 2300 Ok what about the other point we heard him make There's nothing new here nothing has changed since 2014 How did you hear that well I think Judge is talking about an earlier 0 tolerance program on the border called Operation Streamline tromps 000 tolerance was actually modeled on this program but there were far fewer adults and children separated under streamline in general only if the adult was not the parent or if they were thought to be a threat to the child or maybe a convicted felon as I understand it now child separation is happening with much greater regularity than it did in streamline Well John was Operation Streamline successful would it be learn from it that might be a pluggable now well I've done some reporting on that and there's really scant evidence that it serves as a deterrent to illegal crossings All right let's hear the story the program was supposed to streamline the process for punishing unauthorized immigrants to scare people into stop sneaking across the border it was begun in late 2005 as a pilot program in the sleepy border town of Del Rio Texas the Border Patrol was frustrated then as now by the impunity of undocumented border crossers So they began referring everybody they caught for prosecution today nearly 60 percent of all prosecutions for all federal crimes in the nation are for immigration violations according to Syracuse University as the strategy worked Operation Streamline has been going on for a number of years and it doesn't seem to be deterring people from coming into the country Joseph court of is a long time federal public defender in the Del Rio office he notes the number of unauthorized crossers apprehended has soared 250004 each of the past 3 months the deterrence of spending a little bit of time in jail doesn't seem to be having an impact on his observation is shared by federal judge Aliya Mozes she's been on the bench in Del Rio since the beginning of Operation Streamline 13 years ago we met outside of a coffee shop in San Antonio I've been down there when they have prosecuted and I've been down there in Manhattan and it's the same. Thank people come for economic reasons why they come because they have a reason to be in the United States Moses says the program was initially successful then it fell off as undocumented immigrants of voided Del Rio under Presidents Bush and Obama the program was expanded to other areas of the border in Texas and Arizona John and fence and as local president of the agents Union and Del Rio. More secure while streamline may have satisfied a hankering for Border Justice No one can say it achieve lasting results in 2015 the inspector general of Homeland Security declared the program made more paperwork for Border Patrol agents and there was no measurable proof it had any effect on illegal border crossings 30 is no credible data indicating that prosecuting people for crossing the border is a deterrent Judy green is director of Justice strategies a pro immigrant policy research group in 2016 she coauthored a highly critical report on streamline it estimated the 1st 10 years of the program cost the federal government $7000000000.00 for everything from more enforcement to detention costs now comes the trumpet ministrations 0 tolerance border agents judges in attorneys interviewed for this report agree this new emphasis on prosecuting illegal crossers requires even more resources than Washington is sending there's a need for more judges more lawyers more court staff more adult attention sells more everything and now more shelter space for children under the road tolerance 70 kids a day are being sent to federal shelters while their parents are prosecuted this for one of the lowest level crimes in the us Criminal Code says Chris Garland a federal public defender in Alpine Texas a petty misdemeanor is the federal quibble and of a parking ticket and the consequences of a parking ticket should not be that you lose your child today the Trump administration insists it has no choice. Kids cannot go with their parents who were jailed but under streamline the Border Patrol used discretion as a rule they did not sin parents to criminal court and break up families again Judge Aliyah Moses we gave the scene and the Border Patrol was letting them go just to the immigration process and they weren't even coming into court so the Border Patrol was not recommending prosecution of those adults with children might that discretion had consequences Moses says Word got back to Latin America that parents could travel with their kids and agents would quote catch and release them to await immigration court and that's what caused the recent surge of families illegally crossing the border when asked if she thinks family separation will be at the turn the judge said she has no idea John Burnett n.p.r. News this is All Things Considered I'm Audie Cornish and I'm Mary Louise Kelly Kansas can no longer require people to show citizen ship papers in order to register to vote a federal judge struck down that Kansas law yesterday she also had a message for the law's architect that would be Kansas secretary of state Kris Kobach who helped lead a White House panel on voter fraud last year reporter Celia your piece chips in from the Kansas News Service joins me now to talk about this ruling Syria so what reasoning did this district court judge give the court found Kansas of law unconstitutional and in violation of the National Voter Registration Act Now that federal law says you have to make it convenient for people to register to vote and you prove you're a u.s. Citizen basically by swearing under penalty of perjury you face you know potential fines prison deportation if your line to go beyond that Judge Julie Robinson said that Kansas the secretary of state Kobach would need to prove his claims that that he really has to do this because there's widespread voter fraud that he's trying to stop and the court says that he couldn't do that in fact the judge I gather had quite a pointed message for Secretary Cobar tell us about that that's right I'm Judge Robinson basically slapped him on the wrist and told him you know a former law professor to get extra legal training and evidence rules and she found him in contempt in April for violating a court order related to this case and yesterday she told him personally to get extra legal training on civil procedure during the trial he and his team had been running afoul of evidence rules several times a day now of course the backdrop is that Kansas and everywhere else has elections looming in November what might be the consequences of this ruling Well Kovach is going to appeal but the voter registration deadline is coming up in about a month in Kansas are we have an August primary and he won't be able to enforce his law and in fact he has a tight deadline to show his complying with the court telling voters in Kansas. How to register to vote but they can vote even without those passports and birth certificates He's also on the ballot himself running for governor so it may seem pretty embarrassing but his message to his voters is going to be the same as before I'm the guy fighting against voter fraud and that seems to appeal to his base so he's counting on them to turn out for the primary Now you said he's appealing if this ruling stands and is not overturned are there implications here outside Kansas for other states yeah this really means that Arizona is the only state now that's requiring people to dig up documents like passports to show that they're u.s. Double a about investigating the student athletes in this way or schools for this behavior Well you know the core hypocrisy of the incident that they have to promote a model of amateur ism and they want to talk about protecting the student athlete when in actuality the incidentally is a $1000000000.00 business and they have to justify that business model so when you look at incidents at Baylor where you have a systematic cover up of sexual assaults and you see the inside almost total in action and you compare it to Ole Miss or the University of Miami a couple years ago or Southern California where these things happen when that happens they leap into action because that violates the bylaws that sort of seals their business model together the moment they can't justify their existence and their business structure is when that $1000000000.00 commie falls apart for them that's when the labor force can finally wake up and say we deserve to be compensated as. Had a goal of launching its own community composting program eco actions executive director Heather Knox says that with a motivated populace in a uniquely remote location over was the ideal candidate she applied for a grant from the Colorado Department of Public Health and Environment I think just in general it was a really easy grant to write because over is so compelling and it's such a tight knit community the grant was awarded Eagle action was given $1000.00 money used to purchase the earth cubes and install them and over his waist barn Here's how it works households sign a pledge agreeing to use the system responsibly and are given buckets to collect organic matter and kitchen scraps they bring their buckets to the waste barn weigh a log their waste toss it in the Cuban and brown matter once the units LEDs are closed they cubes collect excess moisture and add additional oxygen which keeps the waste to composing at a rapid clip and once it turns into crumbling black compost it's cured before it's ready for the garden bed the community has embraced it overwhelmingly using it regularly and singing its praises municipal composting services are nothing new in urban populations but the logistics and costs make them rarer in small communities and particularly mountain towns where space is lacking equipment is expensive and barren other wildlife conflicts pose problems Knox says waste audits conducted by eco action show that about 30 percent of regional household ways can be composted in the town of over eco action estimates composting will eliminate 16.5 metric tons of organic waste annually from the landfill and so if we are trucking last. Less of that waste and can use it on site that is the goal so it's basically closing the loop and so full circle that it's putting being put to use.
