The negotiations between bart Union Workers and management resumed this morning with help from a state mediator. This morning is the last time theyll meet before the contract expires at 11 59 tonight. No word when talks resume this morning, but the two unions are beforehand. They will meet in half an hour at 9 a. M. A. Etu meets at 11. About 2600 workers say they will go on strike if they dont have a deal. We have that threat hanging over our head for some time, and Union Leaders spent more than 13 hours at the table yesterday and went home without a deal just after 11 30 last night. The message from both sides, the talks are moving in the right direction. Theres a lot at stake here. The whole idea for the taxpayers having to pay more to cover something, a lot of stuff going on. Id say that weve exchanged proposals. Theyve given us some, weve given them a couple. Well see where it goes. Reporter both sides are still trying to hammer out a deal on the same issues, including pay, health benefit, pension contributions and safety concerns. I would say we made some incremental progress. I will tell you that both unions are trying very hard to avert a strike. And we hope that district matches our efforts. Reporter thats the goal for both sides but theyre running out of time. The. The contract extension ends tonight at 11 59. Were trying to make sure that the people when they wake up monday morning are going to have service. Again, no one wants to see the service stopped. We do not, we did not, we dont want a Service Disruption in the bay area. We want the district to bargain as hard as we are. And get this if the strike happens, officials predict the roads will be ten percent more congested this time around as opposed to the last strike. That is because the last one happened during a holiday week. Meanwhile, while we one city is stepping up to ease the pain. The Public Library is he go aside part of this room. Everybody is planning for the worst Case Scenario right now. One option is to take a ferry across the bay. Extra service is planned if there is a strike. The ferrys in San Francisco will be devoting an additional dock. There was no sign of an agreement. What are the other agencies doing to prepare for a potential bart shut down in the morning. I talked to the public awe fairs director to. So what are the other agencies going to do to step in . Theres a call today at two oclock with all of the operators across the bay area. But the most important thing is bart is not replaceable. The 400,000 rides that they provide every day is something that we can mid gate but you simply cannot get rid of the inconvenience. We are going to beep up Ferry Service and instead of 50 buses theyre going to have 95. Thats a significant increase. This bay bridge corridor, the ferrys, all putting in buses and extra seat. Just as a matter of logistics we wont know until midnight tonight if this is going to 7 had a. What do you do between midnight and tomorrow morning . Does everybody just go out go to work early . Stand around and wait in. Well, part of it is for example on the highway system, the car pools hours will be extended all day long from 5 00 in the morning till seven at night. Theres some additional carpool lanes along the west bay bridge. And also extending it down interstate80 by the cypress. So theres a lot of signage and things going on out there for potential stoppage. Tomorrow morning or tonight if you have to get up really early to get to work in San Francisco or up and down the east side corridor, it is pretty much the same as last time and thats hours and hours of people waiting for buses and bus connections. It was taking three to four hours to get home. Why cant we put more buses out there to try to ease up for people. Look, i think the question is this. Can we replace the capacity of bart. The answer is no. Can we put more bus service in . We could do that. We looked into it. There are reasons why weve decided no the to do it. I think the real issue is we need bart to settle this subject i mean, when i say bart, i mean both the labor side and the management side. You say you looked into the idea of putting out more buses. I was at a meeting last week when that was discussed. Why dont we . We do have the money. We do have the money. One issue is this, in order for us to be prepared for a bart strike, we need to put lets say a Million Dollars on the table and that strike may or may not happen and that Million Dollars would go away. The other issue is this, while we can put more buses out there, the number one question is how much would that affect people. And the answer is, look, its going to be a little bit of practice your honor now, a little built would help and we know that. But weve decided at this point not to get engaged in putting hundreds more buses on the street. Theres also a political angle to this. I was at that meeting when this was discussed and when one or two members of your commission brought up the idea that this is the equivalent of an earthquake emergency, and under get in there and hire your own buses and start it, you could almost see the other politicians in room looking away, saying i dont want to get involved in this. Is there a feeling that too much service would look like you were strike breaking. Politics always takes into effect. I dont know what all of the motivations are of the commission i serve on. But there are some folks that think witness stand go all out to avoid any kind of inconvenience to the public. There are others who say the only way to get this thing settled is to have this inconvenience so that body sides will finally settle this dispute. And the riders are caught in the middle of that thought. They are. They are. Theres no doubt. Were going to have you back in the next hour, because i want to talk about more of the longer term implications and what is going on a bit behind the scenes. But if you had a nickel advice for people who plan to go to sleep tonight at their regular time, what should they be planning for. I this your website had it on there. Find what why you are options are. Look at your objections. Make sure you know what youre going to do tomorrow morning. That could be getting up early and could be tele communicating. That is why it is so stressful for people. Because you dont know whether you have to plan to get up several hours early or have a normal day. And that sort of uncertainty could last all week long. It right and also a lot of people out there. So youre planning on going with two or three people tomorrow morning so everybody has to hook up. Its going to be tough. A committee has already voted to recommend it. In the past the city has tried to get people who sleep in their cars to stay off public streets and instead spend the night in parking lots. Bart managers and Union Leaders will be back at the table in a couple of hours. They have less than 24 hours to hammer out an agreement. Commuters dreading a possible shut down tomorrow morning. Irritating. It makes people lives harder when bart is not running. Now that its loominging and i might have to get caught in that next week, its really upsetting. Theyve had plenty of time to negotiate, figure things out. Yet here we are again. This week we saw bart and Union Leaders trying to rally the public for support. Thats right and thats why we turned to the our first question is mayor brown is youve been in past negotiations on bart, in fact, like this. What makes this so different . Theres nobody sitting out there that is a source of power that can extract from all of the participants the responsibility to settle it. Why havent politicians you think both from the governor on down the governor sent his mediators in, but aside from that look i think this is an issue where both sides have been negotiating in the media. Theyre dropping stories to both of you in instead of sitting do you happen and living to each other and politicians are taking a pass. Well, one of the things that weve seen in from bart and the unions are both sides appear to be so far apart that all theyre doing is throwing things at each other in order to cover up the fact that their numbers are so far apart. Theyre not that far apart. If you look really closely as what it being requested and what is being offered, its within close distance of each other. What obviously needs to happen is there need to be a powerful Political Force, powerful Political Force trying to drive a solution. But if in that context, you have a force to drive that solution but it comes with a price tag, the last one you cut wound up costing them a lot of money. I knew youd come around to that at some point during this discussion. I got to tell you, though, in all cases, its ultimately affordable. And you can make sure that it remains affordable by putting in the trigger. The trigger says we will pay if we reach, period. And its over. But the unions dont like that idea. Of course they dont but youre trying to set it. No one will like the final solution. But that means its a good one. Powerful Political Force stepping in and softing this, good luck with that one. Even in terms of dealing with buses and things like that, alternate transportation, nobody wants to do too much. This is this is a weird strike. Its like everybody said, okay okay were going to have a a fight but one hand is going to be behind back. Nobody is thinking about the people lining the system every day, the working people that are going to suffer when this thing goes down. Invariably if youre a participant in this effort, you want to make sure that whatever you advocate in becomes what is ultimately adopted so you dont go too far in bringing that hand from behind you till the front of you until the audience is willing to take it. I dont think state law is going to allow that to take place, Ronald Reagan the president had the authority to do what he did. I dont think that structure exists here in california. Next question i often here is what about no strike laws. For example arent allowed to go on strike. Why not one on for bart and other. The same is true in washington, d. C. They just had a settlement there but they cant strike eater. Its a creature of stob state law. Pickup employees are allowed to unionize and strike. If one wants to change that its going to take an act of the legislature. I spoke he is proposing that and interesting enough he says he gets resistance from both side, both unions and managements. Why . Well, there could be a clause in there that that would require mandatory arbitration and often that doesnt play out well for the management side of cities and counties so they would resist that. Another question that folks ask out there is that why do they keep putting it off or why not just give us another 30 days to negotiate . Maybe its just human nature. We all try to procrastinate trying to get to a decision. I dont think this is good continuing try to ramp up the anxiety and extend it again and again. Also its not going to get better. The more summer goes, the worse the traffic will be. So i suspect getting it setted down would be best option for everybody. Is there something unique about the bay area that makes alternate types of transportation different than say a chicago or washington . Yes. Absolutely. The bridges cross water, the tunnels go through mountains. So our gee 0fee has a lot to do it. Also for many years, 20 years or so, if you take a Public Opinion poll which the Bay Area Council has done for years. Transportation is always on the top of the list of things people are concerned about. I do think this strike captures it also captures the mind of the bay area for many people as well. Now, its nothing like a strike to sort of center your mind on things like transportation. But overall, how is the bay area looking in terms of its transit structure now and where it will be in say say five or ten years. The one thing we do have here is a lot of options. We have a great transit system. Its not just bart. Buses and ferries and cable cashes. Our system works on a maximum basis every single day. The highways are full. The Public Transit is full. So we lose one critical element, bart, its are very difficult for us to find that extra capacity because theres not a whole lot there in the system. If everybody is filled up why dont we just increase it then. Well, one of the reasons in the bay area is we dont have a full consensus on doing that. Its hard to get the money to do so. People dont necessarily want to expand the highway system. They dont want to tax themselves for additional transportation. So were kind of stuck in the space that were in. When you say theres no consensus, considering all of the various agencies that oversee this, is that a plus or a minus . I mean otherwise we get competing interests. One group wants roads, one group wants transit and one group wants bike lines. Thats right. Since the early 1970s there has been this difficult equation is do we want an expanded Transportation System and what comes with that . Often growth comes with that, often suburbanzation comes with that. And so its been a very hard argument in the bay area weve kind of tried to find a balance between having a really good Public Transit system and expanding our highway system but weve always been playing catch up and weve been doing it for decades. Now a question. This is going to be the tough one. Given your history and i know that you have some insight into what is going on behind the scenes at bart. Do we have a strike tonight or do they even if they dont have an agreement, do you think they hold off for a while. Look, i think thats the best option. But i hate to say this, kick the can down the road, but to avoid something tomorrow, theyll probably have to kick the can by themselves a week or two weeks. I dont see them being able to set it today. If they dont settle it, you think theres theyll take an extra couple of days ticket. Im hoping that does take place.
