So it looks like he caused that first strike and it looks like, you know, unless something changes significantly, its where it will be again. Reporter they didnt plan to ask for a cooling off period, but they are suggesting that it might be what will stand between them and the strike as they will be explaning the departure. Its been rumored. Nothing solid at this point, but we do know that workers would like that. But you know what happens, you get more time as they use it up and they dont get the final results. She doesnt want to give them more time. She wants it to stop right now. Well need to wait and see what happens. All right, thank you. So we will focus a lot on the impact that they have on the east bay. But tonight, they have reactions from the Community Leaders relying on the train. Kit . Yeah a lot of people are down here depending on bart to beat the horrendous commute in that tri valley area. Not much to do, but to shake your head and cross your fingers. Reporter at the very least, you can say that you have been there and done that. Im actually going to stay in the house tomorrow. Im working from home tomorrow. Reporter with the Midnight Strike deadline looming, the bay area has been reduced to two groups of people. Those who dont depend on bart and those who were concerned because they do. Those riders have been keeping tabs on the media reports. What can you say . It sucks. Reporter plan b is to adjust the hours and get to work at 11 00. But the 70 mile round trip could take twice or even three times as long. And im hungry for money. Thats what it comes down to. It sucks. But as commuters and customers, they are subject to what will come on the table right now. Nonetheless, youll get the sense that all the rage here is gone. And all that is left is disappointment. You feel like you are being held hostage . Yes, absolutely. Not just me, but everybody. Reporter Union Workers are more sympathetic to the bart employees. They should get what they need and want. Reporter do you think that inconveniencing hundreds of thousands of people will be a good way to do that . Well, thats another issue. Sot last strike happened the week of july 4 as a lot of people were on vacation that the time. With any consolation, theyll have the august ridership for bart. However that is still an extra 200,000 people on the road. And so again theyll take a bus and stay home if you can. All right. Thank you. And well in this dispute between bart and their unions, commuters are caught in the middle. But there were some Lessons Learned the last time around. Weve got a look at your options if bart does stop running at midnight. Reporter officials are getting their backup plans ready, but nothing can replace bart as they grind to a halt. Its driver who paid the price. While theyre caught in the middle, its unfortunate and why they are working so hard to keep them growing far into the future. Reporter so what lessons can they learn from the last bart strike . The usual car pool. During the first strike, sometimes when everything was backed up, the coastal lanes were fine. Theyll have extended hours. You can even park for free at their parking lot to pick up passengers or catch a ride. And another lesson, get to the bart shuttles early. Once again, bart will imply the shuttle buses between the east bay of San Francisco. And last month, some folks learned the hard way. They fill up fast. Its not even 8 00. We need buses to get to work as you promised wed have them. This strike is ridiculous. You should have planned for this. You told me on the phone last night 79. Reporter and lesson number three, change your route. Avoid freeways that parallel the bart corridor, pearly the day bridge, interstate 80 especially the day bridge, interstate 80 and the gorge. At least through the morning commutes during the strike in july. Transportation officials, they had debated on whether or not to ramp up bus Service Since more commuters are expected to hit the roads this time around. But as of now, the approach is the same game plan as before. To put a fleet of buses out there, you could settle the commission loss. Some of them are more hesitant. We want to say that we have been here for the last 24 hours and we only got a very regressive proposal from bart in the last 45 minutes. We are extremely disappointed at their continuedpestering, their bad faith. Their continue wall failure to address a single safety proposal on behalf of the unions. And i want to ask the president to make comments on behalf of that use. We heard from the mayor of San Francisco just a few days ago how it was unnecessary to keep public on pins and needles. And it is absolutely true. There is no reason that we have to continue this drama, continue this stress on the public and the work force that it is so discouraging. But we do appreciate the governors concern and we will unfortunately take our attention away from the bargaining table because now we need to put together a case to present to the board of inquiries. So i dont know how much of those were the bargaining table, but perhaps this will shed the light on just exactly what we have been trying to tell you the press and the public that this employer has bargained without good faith. Creating the first strike and there was eminently creating the second one. Thank you. What does it mean . We want to have everybody to be able to make a statement please. If the district would come to the table and bargain with us in good faith for the full andic table contract, none of this would be necessary. The government wouldnt have to get involved and the publics worry wouldnt have been necessary. We are very disappointed that at this Congress Jury we do not have a contract. Of course, were going to go into the board with everything that we have to prove that we have come with fullic table listenable proposals that should have been agreed to on june 30. Not today. But its disappointing that they will be representing the rest of the workers. Here to let the public know that were going to continue to do what we need to do to get a fair contract. But its disappointing that this had to happen as it could have been resolved 35 days ago. Do we have a strike . No, we have a cooling off that the governor called today. We have mixed feelings. I share both opinions that this should have been resolved long ago. Weve got the public on pins and needles for another who knows how long. Weve got the board of inquiry as we went through this, for example, in 2001 where we had the board of inquiry and then the long cooling off period and we had the drum beat strike blooms. People dont deserve that. We are happy that they will not be disruptive tomorrow. But the anxiety of whats going to happen next and they put it back into even more of a difficult period of time for the people. It is also regrettable that there is no settlement. How long will the trains run . Until the cooling off period. It is not a cooling off period. We need to make it very clear. This is only sevenday board of inquiry. At that time there will be a review of all relevant facts remaining to the contract situation and everything that has gone on. And after that sevenday Board Meeting convenes, there will be a determination made that the time and then well know whats going on. Right now were looking at seven days once the panel is convened. What is the determination though . We have no way knowing. We will go there and present the facts of what we will represent as were going to be bargaining. Yes, we have a bargaining table. Were going to be asking for the controllers help to come in and do an audit. And anybody that could come over here and help and prevent the kind of conflict that we have seen that will be so unnecessary. And there for the next seven days, no negotiations between you and bart . There can be, but unfortunately that all partieses must present their case as you can see we will be involved in getting our case ready to vote. And all trains will be running normally . Yes, sir. Thats the only good thing out of this. And you will not be coming back for that . It will be here. So i imagine that either the questions for the Governors Office, but i imagine that he will move on immediately . Did this happen at your request then . At our request, it has been that the employers will come to the table and bargain fairly and get a contract going and that has not happened. And i think that, you know i dont want to speak on behalf of the governor, but they have seen that this is going nowhere that we have waited 22 hours since last night at 10 00 to get a county proposal on our economic proposals. 22 hours on the eve of the strikeout as the governor saw that they are not the leadership on the employer side to reach an agreement. We think that the governor also recognized the serious imposition on the public if it were to transpire. So it shows that he has the leadership and he has a vested interest in the riders as we go. Was the lieutenant here . Yes, yes he was. Was leapting the Governors Office . I dont want to say on behalf of the governor. But what i do know is that the Lieutenant Governor has a very deep concern for what will be going on here with bart and a very deep concern with the impact on the community and the riding public. And i think that he showed his concern by coming down here today. And i know that him and the governor will be working on this together. And i appreciate everything up to this point. I think that the public, they could say at least the trains will be running, but as they say they remain on pins and needles. Thats very unfortunate. Is there a source of action . In terms of the board of inquiries, yes, in their discretion of the governor. In 2001, they will have the same identical situation. And i believe it was 60 days. Yeah. Can you explain what it means . That there will be a board of inquiry to determine whether or not there will be a cooling off period. And that it has to be the next governor so we dont miss that determination. You need to explain it to viewers. And that the board, it will be established for them on the contract to see what will be going on as they could hear it and make a determination for them. Its not like a hearing though, right . Yes. And we dont know what they are going to find as we need to present that. And what they find is whether or not they are looking for it. And to extend this and make it a longer cooling off period. And whether or not that the parties will have an ability for them to reach the agreement. And as they said, i mean the evidence that they experienced as they did it today that it was just a waste of time and the eve of the strike. This is when we should have been locked in and got things resolved, but thats not the issue. They need to determine how long it will take for bart to get serious. Do you know when you will first make the experience . Within seven days now. And how would you characterize this decision . I think they said it best, it was regressive. Our chief negotiator explained to you it was a progressive proposal. Meaning that there were components worse than the last proposal, which is the unfair labor practice. Which is what it amounts to. So you say it again. And that this included the provisions that were worse than their prior. That is correct. Tell me a little bit about that. And the details of that, the public will be more concerned about it and the fact is that for the next seven days that they will need to run with no lockout or strikes. And the governor, they have asked for a board of inquiries to look at whether or not the 60day cooling off period will be necessary. And we have asked the Lieutenant Governor along with the governor and the controller to look into this matter. Thank you. Thank you. Thank you. Okay what you have just heard was that there will be no strike tonight. Thats because there will be a board of inquiry convened to look at fair or unfair labor practices in this strike. Apparently thats what the union is saying at least. At the end of the sevenday period, they will decide whether or not theres a reason to have a 60day cooling off period. At this point it looks like for tomorrow, as far as riders are concerned the trains will be running. In seven days well know what happens then. Back to you. I know it is hard for you to hear me as they are getting loud there. Do you expect to hear from others tonight . Reporter we have not heard from the bart negotiators tonight. The only thing is what we heard earlier from thomas hawk saying he was taking proposals to have them consider it. And as i have said all along, we dont know exactly what is going on inside the meeting. And often that will be in terms to make us think of certain things as they were making pro tonight, we saw everything fall apart as it looks like they reached an impact and that there might be a strike without the intervention for the governor. At this point that strike is off and the trains will run and they will decide whether or not that will be a cooling off period. All right, thank you very much. And again to reiterate for the commuters, thats the news that the trains are running as scheduled, but back to the bargaining table at some point for them. And that there is no resolution for them. What does that mean for the commuters . All we know is that for tomorrow and the next week there will be no work stoppage on the bart line. All right thats the good news. The governor intervened. Asking for a sevenday inquiry. Basically both sides are being told now that they can do nothing for seven days except to collect all their facts and information. Weve also heard that it will be something that took place in 2001 and so there is a presence for this and hopefully itll ease some of the tensions. A lot of tension tonight though.
