National Guard has already been activated prosecutors and lawyers for Michael Flynn say the former trump national security advisers cooperation with the government is complete but N.P.R.'s Ryan Lucas reports the 2 sides disagree on whether the case is ready to proceed to sentencing in a new joint filing the government says Flynn's case is ready for sentencing and that there are no outstanding issues that need to be resolved before hand it proposes dates in October or early November Flynn's new defense team however disagrees his lawyers say they need more time to get up to speed on the case and its voluminous document load they also accuse the government of holding back classified information that Flynn's team claims is relevant to the case the government denies that and says it has provided everything and more than it is required to do under the law Flynn pleaded guilty to lying to the F.B.I. About his contacts with foreign officials and cooperated with the special counsel's Russia investigation and other probes as part of his plea deal the presiding judge in the case has scheduled a court hearing for September 10th Ryan look at N.P.R. Welcome thank you now I want to talk about the debate coming up there's going to be only 10 candidates on stage and that has brought some attention to Elizabeth Warren David can you talk about why things are shaking out that way well the campaign looked sick and dying about 3 or 4 months ago but it is now surging she's got the highest favor billeted ratings of all the candidates she's I've read in N.P.R. Piece that she's taken $45000.00 selfies Thanks for the plug so she's doing you welcome So she's doing retail politics and the thing that seems to be the key to her rise from the plans and wanting this is the thing people said was her weakness which is likability people actually do like her and I've always found her perfectly extremely warm person and when you ask people in their heart of hearts who would you really like to vote for they'd like to vote for Warren and they have the doubt about her is electability but the more the better you do the more you overcome that really can we talk about that more that David talked about it being a rocky start so to speak but also this idea of electability has anyone nail down what they mean by that well I think you've seen different definitions depending on who you ask if you're looking at Supporters of Joe Biden they see it as the candidate who is most likely to defeat Donald Trump and who is best positioned to take on the president I think there are supporters of Elizabeth Warren who are coming at it from a prism of big ideas and trying to capitalize on this grassroots movie. It's of progressives and really identify where the energy is within the Democratic Party what's been interesting about Elizabeth Warren is that this isn't a post-debate bump like the one you saw for Senator Kamel Harris which is temporary she has steadily risen in the polls over the past few months by really introducing herself to voters one policy proposal at a time her big identifying I think Factor trait as a candidate is that she has a plan for everything now the flip side of that is because she was kind of flying under the radar she hasn't been held to much scrutiny in recent weeks and I think what you're going to see on that debate stage is perhaps the war and why there are some attacks for the 1st time from some of her opponents who now recognize that she really is at least for now this that the runner up to Joe Biden who still holds a commanding lead in the polls so I have to say that I think electability is more a function of pundits than it is the way people vote when people come out on a cold night in Iowa they're going to vote for who's in their heart they're not going to vote for who they think other people will like and I think I think when we hear so many Democrat voters and in stories saying well I like so and so but I think so and so's more electable yet or they're guessing what other people who think are getting him that's not in their heart they're probably guessing badly if you think that's a perk that's your takeaway from the last few years 103101 votes I want to come back to Joe Biden for a 2nd the latest issue he's had is that he appears to have told a story about traveling to a war zone as vice president and saying that he was meeting up with the general while he was there now the problem is that according to The Washington Post it seems that he got some of the main details wrong maybe conflated them with other events either way here's some of what he told to an audience New Hampshire this week General want to be dipped in the Silver Star. I got up their standards to God's truth my words abide. Tension I want to turn my sister I don't want to dance . DOCTOR The only sure thing you sure do not do that. Jar. Jar now as I said the Post is saying he's gotten some serious E. Tales wrong conflated it with other events David how much does this matter people seem to be on a sort of gaffe watch so to speak when it comes about and if it keeps happening people will should monitor but it has been home as you suggest it's now the only story for buying so if one does 9 really good things in a day but can it's a gaffe that's going to be the story of the day for Joe Biden so he's going to stuck with that I would say if you talk to memory experts our memories are much more malleable and much worse than we think they are and the only thing I have comparable to politics is going on book tours to try to talk about the books and I can tell you if you're traveling every day giving a 1000 speeches you really can't remember if he said this I might go to this audience before but you're not trying to run for president so soon I mean what does this mean I'll give you time but yeah it reinforces this narrative that perhaps Joe Biden isn't prepared for what is going to be a very grueling national campaign and it also draws scrutiny over his age and some of these recent gaffes that have become somewhat of a problem at the same time I think that Donald Trump is very much changed the standards for standards for what's acceptable given the president's propensity for false hoods I think The Washington Post which reported on this Biden issue put Trump's falsehoods at 12000 since taking office people are a little bit more forgiving when it comes to some of these other candidates and the fact of the matter is that Joe Biden isn't new to the public eye people already have an opinion of Biden whether it's good or it's bad and I think that that familiarity that he has with the public is part of why he still is leading in the polls despite a lot of the conversation here in Washington about whether or not he's up for the task the last 2 minutes we're going to go to Joe Walsh this is the kind of conservative talk show type has a history of racist and contrite controversial statements and he is wants to run for president against Donald Trump and people have been pointing out some of his past ugly tweets and he has said quote. Well look it's made me consider that Trump is the ugliest version of what people like me were doing the past 9 years but at least I admit it that's basically his argument David does that words like mini me running against Dr Evil from Austin Powers they come out of the same tradition the same sort of demagogic showbiz tradition and it will not work for the people who like Trump. Will not will detest Walsh the people are never trampers to test Trump because he comes out of this tradition they're not going to take somebody comes out of this this crazy wing of the party and then embrace him so I see this as pretty much a nothing Sgrena Well look the fact of the matter is Donald Trump has the support of close to 90 percent of the Republican electorate and so I don't think that there is any serious potential for someone to challenge him from the right where it sounds well seriously about Reva's Chelios where they can mount an independent candidacy and try to siphon off some of those votes and play spoiler it looks more like Joe Walsh is in it for the public city not because he's earnestly trying to limit the presidency to one term That's David Brooks of The New York Times and Sabrina's city he of the Guardian and C.N.N. Have a good holiday weekend thank you to you the Electronic Frontier Foundation which is a civil rights organization for the digital era is suing the Department of Homeland Security it wants to find out how D.H. Has used his tracking devices on vehicles that come into the U.S. As N.P.R.'s Martin costly reports it's part of a broader effort by privacy activists to shed more light on government searches at the border this lawsuit was inspired by a criminal case and 2017 when federal authorities say they caught 2 men driving a truck into the United States from Canada on a dry run for an alleged cocaine smuggling operation the feds are been watching for them so they served to slee attach tracking devices to the truck at the border crossing in Michigan Maryland represented one of the defendants they tracked the truck and trailer throughout the United. It's virtually the longest distance you could go all the way to Southern California and the data like 50 pages each Yeah I mean minute by minute but there was just one problem the feds never got a warrant for those trackers back in 2012 the Supreme Court had ruled that police need to get warrants to use these devices which means showing probable cause but in this case investigator said they didn't think they needed a warrant because the trackers were attached to the truck at the border where heightened security concerns mean Homeland Security feels less bound by warrant requirements they tried to skirt around those 4th Amendment protections by relying on this policy that Homeland Security had to not have to get a warrant and I don't think the judge like that because the truck had been tracked for thousands of miles into the United States the judge called file and threw out the G.P.S. Evidence the case was dismissed but for privacy activists it left a lingering question just how common is it for the government to attach these G.P.S. Trackers to cars in the border zones that definitely was the 1st time that we had heard of something like that happening so we want to find out more information about how they do it that Sire Hussein a staff attorney with the Electronic Frontier Foundation the courts to give border agents more leeway for warrantless searches but she says the effect wants to know how far they're taking that it's suing to find out what the actual practices are for instance how much suspicion to agents need before the attack to track or to a vehicle how far into the country do they usually follow a tracker when there's no warrant and would they attach trackers to cars that belong to U.S. Citizens what we would hope to uncover is exactly who this applies to I think that the major defining feature for them is that that car is entering the United States and so they're allowed to do it or at least that's what their policies where at the time of this criminal case last year Customs and Border Protection told N.P.R. That it doesn't comment on lawsuits such as this one and this is just the latest round in an on. Going effort by privacy groups to suss out exactly what the search rules are at the border if F. Has another lawsuit for instance to find out what the guidelines are for searching phones and laptops when you come into the country the C.B.P. Did put out a fact sheet about that last year but it left a lot of gray area and this vagueness shouldn't really be that surprising says Berkeley law professor or incur there's a complicated dynamic where if they make up policy and have to disclose that they may not want to make the policy in the 1st place because it can tip off people who might want to circumvent the policy so there's a little bit of a complicated dynamic in terms of whether you want the government to be disclosing everything that they're doing but by refusing to disclose those internal guidelines the government is making it harder in practice for the courts to test whether the searches and tracking that's happening at the border are in fact constitutional. U.S. Officials think China is investing in Israeli infrastructure as a stepping stone to the Western European market so China can say to Europe we've met Israel's high quality standards we can meet your standards too the other thing the U.S. Is worried about is China and its security services getting in on Israel's high tech Pentagon official route again the Chinese have shown interest in Israeli technology in some areas where China has made investments or pursued activities around the world the security services have followed or been a part of those dealings Chinese investments in Israeli tech start ups shot up a few years ago in fields like cyber security digital health and automated car technology Simon Weintraub a tell of evil oyur representing Israeli tech firms has an office full of gifts from Chinese business colleagues like a cute panda picture we were getting you know requests of a couple times a lot of new investment deals most of which went through but U.S. Officials think Chinese access to cutting edge technologies can help China's economy and military compete directly with the U.S. The U.S. Is coming up with rules to block Chinese investment in sensitive U.S. Technologies the U.S. Has asked Israel to come up with its own screening system but U.S. Officials accuse Israel of dragging its feet a software reality of the Israeli Institute for National Security Studies says Israel sees China differently Israel and the U. WHERE have different threat perceptions with China because Israelis do well against it's true there's no. Enemies and China is not one of our enemies the Chinese ambassador wrote in an Israeli paper that China has no ulterior motives and its role in Israel is being blown out of proportion Israel wants access to the world's 2nd largest economy so for now it's not restricting its companies from accepting Chinese investments but some Israeli companies are deciding on their own . To refuse Chinese money according to Weintraub the lawyer in Tel Aviv I get calls all the time from Israeli companies who have either taken money previously from China or considering to take new investments in China they are very nervous about taking money from China and somehow being under scrutiny in the United States for activities because of China $1.00 Israeli company he represents recently turned down a multimillion dollar offer from a major Chinese venture capitalist the company works in sensitive medical records and it's worried that it could be cut off from business with U.S. Hospitals if it has Chinese investors but Weintraub says this company and others might get creative setting up new corporate structures to work with China anyway I know that China isn't going anywhere China is a superpower in a rising superpower Israel cannot ignore China and has to find a way to be part of a balancing act the balancing act will be tapping into China without upsetting the U.S. Daniel Estrin N.P.R. Iowa caucus goers will make their voices heard in person next year the way they always have the Democratic National Committee shot down a plan today that would have allowed Iowa Democrats to participate in the caucus remotely They cited security concerns N.P.R.'s Myles park's covers voting and election security he's here to tell us more welcome to the studio Hi there can you explain this plan what was being proposed and why did the D.N.C. Respond weighted shirt so to start with caucusing is really different than voting right in a caucus state like Iowa you have to go out in person and take take part in this process that can take hours so voting voting rights advocates have said for years that this disenfranchise people who have in flexible hours people who can't take time off work at night time people who can't get childcare and it means turnout slow in 2016 to turn out right in the Iowa primaries was less than 16 percent so Iowa Democrats and Nevada Democrats who also proposed a plan they caucus there to they proposed this plan to remotely caucus not a lot of technical details were made public but it seemed like it was a phone based call in system the D.N.C. Takes a look at this plan they have their security folks look at it and they say no go this is not secure enough to be used in 2020 at the same time we bank and raid and we do all kinds of things on the phone and virtually So why would it be a problem yes so cyber security experts basically just say voting is a much more complex action than anything else we do online or over the phone I talk to Joseph Lorenzo Hall who's the chief technologist at the Center for Democracy and Technology imagine banking where everyone only has $1.00 and you never get a receipt and no one can ever know anyone paid for anything doing accounting in that kind of a system becomes really really difficult hole also said that in all these other transactional situations there's room for a tiny bit of error or even a tiny bit of fraud it's kind of baked into the process where is voting we get. One shot at this thing and it has to be right so you can't take a chance even if there's this only a remote possibility that something could go wrong you can't take that chance what are the implications of this for the Democratic Party going forward in this primary season as you said these are people in key states who are asking for this Yes So Iowa Democrats say they're still going to brainstorm ways to make this more excess will they know that's only a few months away that that their caucus is happening more broadly we're seeing this kind of biting of heads in the Democratic Party the Democratic Party wants to be the party of accessible voting rights while at the same time being the party that takes election interference seriously and what we're going to see over the next year year and a half is that those 2 ideas kind of come into conflict sometimes that's N.P.R.'s miles Parks thanks so much thank you. News this is ALL THINGS CONSIDERED I'm Audie Cornish and I'm the Chang with more tariffs looming in the U.S. China trade war American companies are growing more pessimistic about the outlook for doing business in China but 87 percent of U.S. Firms with operations in China say they still haven't moved production to another country and they have no plans to do so that's according to a new survey from the US China Business Council to find out why most plan to stay put we call that J. Foreman he's the C.E.O. Of basic fund it's the toy company that makes Connex Lincoln Logs to Tito's in Pound Puppies J. Foreman Welcome thank you glad to be here so I understand that currently 90 percent of your products are manufactured in China tell me why what benefits does China offer you to base your manufacturing there. Sure I mean China offers sort of a suite of benefits if you will which is a highly trained labor force a well financed infrastructure a great safety and quality control regiment excellent transportation and communication points and basically a system of production for light industrial that's been set up over a 30 year period I mean how possible would it be to replicate those conditions in say Southeast Asia or India it would be really difficult for example if we went to Vietnam which is a great country with great manufacturing it's only 10 percent of the size of China so if you just move 5 or 10 percent of Chinese production into Vietnam you're going to max out the capacity of their workforce and that's going to increase prices increase rents and make it more difficult for products to be produced there at the same competitive prices as we've been getting from China you can go to India which has got a huge population base but India is infrastructure is really not set up for this you know we've developed a protocols at least in the toy industry in China where we're able to make safe high quality product at a great price there's no system like that set up in India it could take $10.00 or 15 years to set that up it's taken us 30 years to build our production base in China and then bringing production back to the United States is not possible and realistically as we don't have a labor pool here the president is closing the borders to look skilled labor so who's going to make the product now the President Trump does go through with imposing tariffs on toy imports from China after the holiday season I ask you could you afford to maintain most of your production in China still well we really won't have a choice but to find a way to afford it and the one way to afford it is we will have to at some point during the course of 2020 begin to pass the tariffs along to the consumer so how much of a price hike in are we talking for say like a Q Tito I think you're. Try to can't all of them and many people believe that William Tucker the 1st black child born in the Colonies is buried in this cemetery because they say they grew up hearing stories from their elders that William Tucker was their direct ancestor and whether that's true is kind of murky there were very few records about the lives of enslaved Africans especially in the early sixty's 100 historians know that way I'm Tucker was born around 1624 and he was born to some of the 1st Africans who arrived in 619 but they don't know how long he lived or if he even had children this cemetery is well kept now but the cousins were slow to take it over it had been in their family for generations but it wasn't that long ago that this place which was once called the old colored burial ground had become a literal dump not the brush and debris fridge of it is that we found by washing machine. For Randall said the cemetery had been the collected for 50 years it was over one with fallen trees garbage even snakes It was a mess except for a small strip of land where some of the more recent soccer relatives had been buried one of those relatives. This is buried here while the other Tucker cousins heard their family lore they mostly paid it no mind but film was fixated on that history and wanted to learn everything about it She peppered their elders with questions about their parents and their parents' parents the cousin said she was always carrying bags full of notes and documents that she pulled from archives or old photographs she was doing all this hard work and she kept saying these stories you realise I now know what they're talking about she had essentially become the family's unofficial genealogist and historian and a lot of people in our family just can't read letter let her do her thing no order but she was 100 percent passionate about this but film a died suddenly in 2006 taking much of what she'd gathered about the Tigris history with her and the cemetery lot was in such bad shape the city thought it had been abandoned in 2013 Hampton's mayor said in the local paper that she was open to ideas from the public about what to do with the land the tucker cousins many of whom they moved away from the area said they felt called out but it stirred them to action and we had to come together as a family we had to start paying attention we had to start doing our part and it takes a lot of energy it takes a lot of organization and it was something that we learned as a family to do because we wanted to they started holding regular family meetings just how to manage this land they got rid of the old trees the rusted appliances the we they put up an iron fence around the cemetery lot and after a long process with lots of volunteers and local press attention and grant money that on ruly in the collected lot started to look like this quiet solemn garden and it's amazing even though I mean. We're really we have so much cousin Kara Leda says that she wishes Thelma could see it today so. She's not here because I think she will be so proud of what we've done once that some of Terri was cleared though it started to give up some more secrets and X.
