To Brian he is director of Fair the Federation of American Immigration Reform hundreds and beach decided to reject sanctuary state law and let's get into what that all means back in the program Welcome thank you. So. Spawn these cities throughout the state of California that seem to be making an effort to stand up to some of the sanctuary laws. Is. Different some of the other states the other cities have done yes so this is interesting under California law. The cities can be organized under the general laws of the state or under a charter that is dusted by local voters and Charter Cities adopt their own procedures for dealing with any matters that are considered municipal affairs and the Charter Cities argument has been the state can't tell us who are police departments can interact with because that's a municipal affair and the City Police Department knows whether what other agencies it needs to interact with. I'm not a follower Viduka using no it's a little confusing sorry sort of put that in plain English and take it out of loyalty is there there are 2 different ways that you can set up a city government in California one is you simply abide by all the laws that the state legislature passes but the 2nd is you set up a charter and what that charter does is it reserves certain things to the municipality in terms of running the city and the state loses the authority to tell the city how to run those things I did I did not realize that much involvement that's interested in Huntington Beach have a charter or there is a pullback and form what they do have a charter and this is actually a fairly common thing throughout the United States New York has something similar called the Home Rule petition which allows bigger municipalities like Yonkers New York City to do some things that are slightly different from the state laws so the general state laws will still apply but things that have specifically to do with running the city belong to the charter city or the city with the Home Rule petition . And so what the heights and beach has done was. Well Huntington Beach said that as a matter of California constitutional law since we are a charter city the state legislature doesn't have any authority to tell our police department who they can interact with in terms of other policing agencies I'm concerned is why that had to go to court seems matter of fact to be right if it's in the charter you would think it better following their own wall. Exactly I'm surprised that it went to court for that reason but I'm surprised that these things ever get to court because as a matter of federal law the supremacy clause right says that when you pass a federal law that federal law supersedes all others and in terms of immigration the Supreme Court has said in United States v Arizona that the federal government has exclusive jurisdiction over immigration and as that states and others subdivisions are not able to make legislation affecting immigration so it's mind boggling to me yeah it so and so Jeff Sessions came out and for a put a lawsuit is an issue to the lawsuit that's going to take I don't know how long to get through what's in mind boggling to me is why this is not insurrection why is just not insurrection Why does the federal government go to the state of California an insurrection we have to do something I wish I could answer that question I agree with you completely I think this is a direct poke in the eye to federal authority if every municipality and every state in the union decides that they can pick and choose what federal laws the rates want to a big thank you at any given time that we're going to descend into anarchy and we're not going to have any order whatsoever and you know it's funny because when you know being in California it just seems like even though it seems to us on just on its face value that it's while they're doing what's legally right for them to do in Huntington Beach but then of course you know other people. California who don't agree with that are going to file these lawsuits put it through 9th Circuit or whatever circuit court that is probably going to agree with them and it's just a way for them to to tie up you know what a city can lawfully do just to because they have their own agenda and they know that people here in California will let them do that in cause all this extra money all this extra time when in the yang You probably think that Huntington Beach is in its right to do this so it's like they're just wasting money and time just delay either prove a point or just you know cause them to have to fight it for years and lose a lot of money in that city it's a bureaucratic revolution these these are people that I love the name the d.c. State but people who aren't interested in the constitution working the way it works and they're basically circumventing all of the checks and balances and just implementing whatever they think is appropriate which we can't do that undermines the whole system. And so if you see what I call California's a military occupation what other remedy the federal government and lawsuit which they've initiated what other remedies that the u.s. Government have well if this were me I mean I work for ice and for u.s. C.i.s. For quite a long time I would increase the ice presence and just simply start arresting all of these people in the cities left and right I would seriously consider prosecutions against police officials who know that these individuals are here and then turn them loose under the harboring statutes but there's all kinds of things that the federal government can do it could play with funding. It could bring petitions in certain cases to have people directly released into federal custody whenever they are in sneak custody and are an illegal alien I mean there's a there's a ton of tools in the federal Arsenal but I think the trumpet ministration is just so besieged because everything they try and do gets undermined and most of the things that are being argued about are settled issues right or to be with immigration the Supreme Court issued holdings on these things they hundreds and yet they still wind up in court and they're still arguments into like the so-called travel ban case they hit the Supreme Court the reset button gets hit but that's a long expensive and dangerous process for us citizens and taxpayers why why dangerous. Well it's dangerous because this is interfering with the federal government's ability to police our borders and that means that there are criminals who are being released on the streets a United States there are national security threats terrorists foreign intelligence operatives I mean if somebody has snuck into United States and hasn't been vetted we don't know who they are or what they're up to and let's face it there's a lot of people in the world that are very resentful of the United States because of what we have accomplished in our standard of living so the state government of California is in danger ing the public of the United States if I were a terrorist I was trying to get into the United States right now I would head for New York or California. New Yorkers are similar a similar policy of yeah New York has gone completely crazy so I actually worked for ice in New York and back when I was there from but 2003 to 2008 it was fairly reasonable and most of the police department see we worked with on a regular basis where eager to help us my friends who are still at tell me that New York now seems to be competing at the state level with California for the most over the top liberal craziness and they're not getting any cooperation from law enforcement agencies anymore we've talked about places like Newburgh New York Corp to see New York where there are massive gang presences and nearly all of the people the gangs are illegal alien and this creates a huge public safety concern for regular people both u.s. Citizens and immigrants who just want to go about their business and live their lives in peace I don't think that no no I was just thinking about New York when when all of the m.s. 13 stuff was gone on in Jeff Sessions we were talking about that it's it seems like it will come on the radar for a little bit and then it fades from public view and then people go back to business as usual and there there's something else for you know normal taxpaying citizens to focus on you know and it's like I don't think people realize how important this is I mean even out here federally the funding remember when President Trump was like on I'm going to pull back the money for like your high speed rail because it's ridiculous and then you know there was Gavin Newsom saying how dare you you can't that's our money and blah blah blah and it's always like it's everybody else's fault you know not they're liberal crazy left wing nutty policies are just wasting billions of dollars and then how dare the president do you think about taking away money which isn't every you know has every right to and it's like every time you turn around like you said it's like they're fighting every single thing the president does because they hate the orange man not whether these policies could be good for all of us and our safety in our neighborhoods they hate somebody so much that they're just blinded to all of this and what he's allowed to do federally. Well in the public suffers for all this ridiculous signaling you guys were at feet to the fire in the 6 weeks before the feed to the fire radio event in Montgomery County in Maryland they had 8 or 9 different rapes and sexual assaults perpetrated by illegal aliens and the vast majority of the victims were minors and it's tragic to see that because those crimes were all preventable because they were committed by illegal aliens if I do I think in your multiple person fright right as Mr multiple times some of them had been deported and came back in the fact is if we had effective immigration enforcement and those people were not able to come in they wouldn't have suffered hate stylee would still be alive it's just crazy that people will act as if they're somehow being virtuous when they're pursuing these policies that lead to u.s. Citizens being harmed in killed at the hands of foreign nationals who have no connection and no constitutionally arguable position in the United States well I mean we want the immigrants we want people of course not the call coming through the front door not the back door No I know but we don't really the problem we need from immigration reform here and make this you know a process where it's reasonably Clement I mean we let over a 1000000 people in a year I know it I mean so not everybody can come I'm sorry but you if you're going to do it do it the right way don't break our laws you know the thing people point out of the people that hire kicking in California that's a problem to the illegal and why are we not using your verify why do we not do that that's a mystery to me even or Fi is fantastic you have some people like Alex now arrested at the Cato Institute here in d.c. Who argues that because some people can defraud it by using fake documents we should throw the baby out with the bathwater that's silly any kind of security system to be circumvented by people who are determined to do sell high. But the fact is that if we put the verify in place and we actually put in enforcement mechanisms behind it you would have probably 9095 percent of the illegal immigration that is drawn here by people looking for jobs disappear because people would know this is just not going to work any more and I have to find a corrupt employer if I want to find a job now you wouldn't be able to eliminate the corrupt employers but ISIS pretty good at reading them out when it's given the chance to do so as we saw with the Mississippi rainouts and other actions they've taken. Well what's to be done what's what's the road ahead. Well I think the most important thing I mean we talk about immigration reform all the time and that's a part of this but I think when people say the system is broken what they're not understanding is the enforcement is broken we have had an executive branch that for a long time has selectively ignored anything that it disliked in terms of enforcement because it angered certain perceived constituencies so they figured illegal aliens but there still was a lot of efforts made in the cages and things were designed back in those days right. Well it's true we had better enforcement because there were fewer people coming but the numbers are ramping up and while we had border enforcement if you think about this in tildes the September 11th attacks you didn't hear an awful lot about the ins conducting raids and arresting people within the interior of the United States so that's one problem but but I do agree with you in terms of the reform too much of our immigration now is based on nepotism it's family based Chan migration and the only thing you need to have is a relative who somehow happened to make it here lawfully before you did bank and be like cousins and distant cousins and people you've never met that are part of your family right and what we should have is a merit based system that chooses people based on the needs of the United States and that's better for the immigrants because they have a chance to succeed economically which is the biggest predictor of effective assimilation but it's also better for the country because we don't have Americans competing with people whose primary interest is staying in the United States and coming in to live on welfare immediately exactly who are willing to take jobs at much lower wages because they have that safety net from public benefits they weren't supposed to be getting in the 1st rightly. Well I hope we do something about this it's sort of a distressing problem and it's and it has human consequences you know I mean it's not like this is not without real effects on people in you know I feel bad for people that are I don't understand they shouldn't be if they're here illegally but I feel bad for people who are here I feel bad people are having trouble getting getting citizens and getting getting green cards I mean it seems like there should be a better way of doing this and they should have been for so we haven't we have normalised and reasonable in force and like every other country on earth try to go to Canada sometimes it's true I was told people listen I worked for ice in a prison for 5 years and I'm a lot of people in prison who are very nice people but who did something wrong they messed up and I think the same thing is true with illegal aliens you know not every illegal alien is bad because they're an illegal alien but the fact is if we forgive everyone who came here illegally we send a message to people that haven't come here yet that all you have to do is get here and stay here and eventually there will be an end this well we already did that once with Reagan and we never got the back half of it that we were supposed to get so everybody's just going to come here again just hoping if nothing of nothing of us come here and just you know go across the border they're going to have to do another amnesty right it's a huge magnetic problem yes why we have many of the people that we have here now illegally. You know. It's very frustrating it is extremely unpleasant and anybody who sort of wants to build bridges and not walls I urge them to go work in Canada for 2 weeks get a work permit and work for Canada and see what happens to you at the border and all the time you're there they will harass the living hell I harass you oh my God they were just want there to do a movie once and they were up my butt like you cannot believe or just try traveling be a tourist in Australia try doing that sometime or other countries are you know they want to know when you're coming in and when you're going out with there's a bunch of people we're going to you know do it at the right time the right order then sorry you're not coming and that's what other countries do I And I understand we want to bring the you know bring the poor the needy and we you know what whatever the statement is on the on the bottom of this is that your liberty but even that was always done in a systematic way it was never done just in border yeah when it was it was there any time in American history that we had an open immigration policy but no not at all that's a big mistake gets bandied about by the other side on this issue but we had public charge laws since $1645.00 in the mass bake colony and those applied not just people coming from outside of the United Kingdom but they applied to other colonists So if you went from North Carolina to Massachusetts and were destitute they'd send you back to North Carolina and then one of the 1st cases that was handled by the Supreme Court in they think you're getting into somewhere someone take a break you come and tell me about that Ok All right Mark O'Brien he's director of Fair the Federation of Gratian reform of variation for American Immigration Reform you can find out more at fair immigration or fair dot org It's an tweeted Dr amid a lively and someone to Katie. Supreme Court decision on this matter here sure so there's this notion that gets bandied about by the other side that we had a long period of u.s. History where there were no immigration controls that's simply not true one of very 1st cases that the Supreme Court handled when it sat as the only federal court was a deportation matter called free use case which went on in something like $1801.00 So that was one of the very 1st cases that was handled after the passage of the Constitution and it was an immigration matter. We have some questions here I want to try to get that to the if we can Mark go ahead. You know I had a question somebody said legal immigrants come here and get on welfare but that's not direct you can't get welfare when you're an illegal immigrant you can't even get it when you're a legal immigrant I know here if you're important hold on that if you're net net net if you're a if you're a I know for sure if you're under 25 you get free health care you're granted that and that's one of the things I am proud of waking up to that you are going to have a payment. To hold on to hold on to hold on to hold on Ms open your health care to Ok Matt O'Brien with that all about what was I think have a go ahead and the other one was the change my great I had met and separation there there is this mis belief that illegal aliens and indeed recently arrived immigrants can't get any kind of publicly funded benefits that is true of benefits that are funded exclusively and directly through the federal government although there's a huge amount of fraud that goes on however in many of the blue that from the conversation that song which is normal is so any of the federally funded but state disbursed programs the legislation specifically says that the states can give those benefits to anyone they see fit and there is also other legislation that makes exemptions possible for federally funded state benefit programs in a variety of different circumstances so the net effect is more may be thinking about may want this money to anyone they want Ok Matt your other point Well name one of those. Ok name one of the mechanics and they want to Ok I will 1st of all I just said that health care for under age 25 I'm sure that's where that comes from but what else. There's a lot of food assistance programs things like WIC and other programs are available to illegal aliens see radically energy fare it would be it would be unthinkable not offered to them if we're going to house people have people here and be struggling with feeding their children we've got to do that. It's certainly I think there's an argument for that I also think that every time that we give that kind of assistance to an illegal alien there's an American to get for less well that's what I don't remember that that's a people are waking up to I think and that's where people are getting kind of upset but man I got to wrap it up here I'm completely out of time I appreciate your participation and we look for you at Fair dot org Thank you sir thank you I said 802225222 this is midday live on Am 700 k.b. California global area go find Katie at Katie Sachs citizen also call for globe dot com and Katie right to talk to us about rationing and water and power outages. Things to be Are you sure know this is the norm. Yeah this is your new normal member Jerry Brown used to love to tell us to get used to it you know you can't water your lawn we're now going to start again 2020 we are facing a 55 gallons per day per person and I don't know about you but my neighborhood has recently been fitted for water meters and so I think they're taking this very seriously which I've got to tell you makes me insane I live in Sacramento on 2 rivers and we've got the big delta up here we've got the nice big California Aqueduct However Governor Jerry Brown never authorized increasing the state's reservoirs and dams which we desperately need right now we've got enough water storage for 20000000 people but we currently have 40000000 and so his answer was to force us all to ration our water like with 3rd world country and they didn't even trap the water from the last 2 drain we had last year when they could have done that and just trillions of dollars and went right back into the ocean exactly what goes after this logic what are they thinking is what's that what and whatever but what but what are the elements is it we have is this the environmental argument that we have to ration to it that the dams will screw up some fisheries or something but what's going on well yeah that's some of that unfortunately the environmentalist movement has been fueling at least for decades Jerry Brown's policies I'm glad he's back in the. His 1st 2 terms I was in high school in college and he loved to talk about how small is beautiful at that time he put the kybosh on the increase or actually told filling the number of lanes Interstate 5 was supposed to have up and down the state that was part of it he killed other water projects and you know so here we are today. Really living in Jerry Brown's. You know his to dream apparently but this does not this does not jibe with the fact that we continue to let more and more people into this state so well while we are the sanctuary states of the world we're rationing water we're supposed to be building new houses for all the people who don't have homes but we don't have water so I don't think there's a lot of thinking going into this at all and then let's go to the power issue why not micro-grid why not putting power lines underground why not the small nuclear the 4th generation nuclear what why don't we get at least systematically moving in that direction. Well we should have been and I will tell you that the utility companies they know the bigwigs at the top know that. The other thing that's very interesting about this though is California utilities are probably the most regulated industry in the state so while a lot of people are really poking today at Pacific Gas and Electric and Southern California Edison for you know not managing their infrastructure upgrades. They were governed by the California Public Utilities Commission and so we got to look into that because it sounds like they're corrupt for not making sure that they were doing all of these things to keep us safe Exactly and they are and they have been and I wrote extensively about it during Governor Jerry Brown's reign of terror on the state and frankly that was at a time when the when the Public Utilities Commission was never more corrupt and unfortunately it had been a revolving door of top people from the utility energy companies in and out of the team you see and then see you see through you see President Michael Peavy. Was also you know he made some sort of dirty deal that he actually had to do in the country of Poland away from prying eyes and open records act of California to shut down the Santa no free Nuclear Generating Station so there was all kinds of Haiti stuff going on at the time but there's no way to avoid it seems to me this this flow from the private sector into the regulatory system because these are such you're right but Kate industries know what else is in a position to understand how to do it oh I totally agree you need the experts and I don't really have a problem with industry experts as part of the regulatory board I just have a problem with corrupt ones doing it right so again that's the the legislature should have been you know it's they're in charge of a lot of this stuff of you know they're the ones and. Part of the California Air Resources Board which they refused to govern they're in charge of the California Public Utilities Commission which they have refused to you know governance dead these agencies like little fiefdoms So just curious that with all of the sets happening now and it seems like every year now that California is on fire I mean look at us now member all on fire around us right now at the Getty fire and top and that was probably set by by one of the utility companies up north so how with all the money we're we as ratepayers we pay so much my Republique pay more money than anybody else and electric utilities what I why are we are do you think we're going to get to the point where we're going to force these companies to have to pay the money to put their wires underground and to have safety checks and better better Very says there is bankruptcy they don't have the money it's a. Good they're only a bankruptcy because I don't want to pay out the billions of dollars that they owe from last year No no no I want to do that no no no it's far more that's more sophisticated than that really I think we're artfully p.g. And e. Is an bankruptcy. Mainly because of the renewables mandates that have been foisted on them and Southern California Edison as well the state of California continues the legislature and the governors continue to pass these absurd renewable energy mandates 1st it was 33 percent of the energy electricity mix had to be renewables that was bumped to 50 percent then Jerry Brown signed a bill saying a 100 percent by 2045 minutes just ridiculous and so frankly I think we have a huge opportunity bankruptcy judge I hope you're listening to parse out the renewables division from Pacific Gas and Electric in this bankruptcy and allow them to do what they're good at and that I'm wrong they're pretty Harang gas business and great get micro micro grids going but regs underground. The problem we've got to separate the renewable energy part. Or any of the utility companies and they get it right we have everyone here they have billions of dollars they're in. You don't got your eye and you can't be accepted into bankruptcy unless you are in bankruptcy and at that point you're right turning it over to the judge and know what. The judge makes the determination and going back to us is rate payers we're going to have to not a few so not out of fairly Yeah operate out this piece we got to go to break 802-225-2220 extension 0 Dr Drew it's made their lives of NY to keep the same. Can be found at California globe dot com your porter and editor thank you for the break we have to be expensive going back to the concert I was talking about the fund that Newsom is trying to make for these companies that they're all not lifeline to get this fine that would be a surcharge on us as rate payers and that's what I was talking about here you said not necessarily you were talking one though this was for the last year. Yeah Ok so yeah the one that was already passed last year absolutely that that was a pollutant they got out of it which in they told us to put the money to fund into them so they can fund it but it comes from a surcharge on us it's a great player payer force Yeah yeah and it's always that how it's always been done yeah every every single expense frankly that the utility companies have sought to make they go get approval from the Public Utilities Commission and they say yeah or to charging Yeah and they've always said yes. Fortunately there's some there's some Republicans right now who are proposing a plan to to change some of this although I'm afraid it will not be met with any approval by the Democrats. Yeah and again I always every day I'm just asking what are they thinking what is the what there's logic in there somewhere there must be no no no no it's it's it's never let the truth get in the way of the agenda and it was good for them or just the agenda it is you know command and control the people of this state run for the great David Horowitz quote in every leftist there's a totalitarian screaming to get out when we have one party rule like this we are seeing those totalitarian instincts and that's what we're seeing in their legislation as well it's not pretty and it's not to I don't I don't see many Democrats in the legislature with very good intent or logic. It's hard for me to believe as I can't believe that it's just not misguided logic of some type so with all not intended concert here and with all the craziness is going on and fires everywhere and it just seems like every year we know it's fire season but this just seems really out of control and there's a lot of different facets I mean obviously not trimming of the trees and there's so many different things well right we know power lines cause fires and they did just a few yesterday they admitted to that there were blazes that were started by the utilities company and Fawlty Towers out that the electricity wasn't shut down to southern shutting down our electricity all willing l.a. And they're still fires being cause they don't shut him down they're still fires being called so when are they going to put the wires underground ever are they ever going to do what I just yeah well you know what half a California is going to burn every year and that's just a way to suck it up well look I think this is a government created problem which means this can be solved Yes I think I think power lines need to go underground Most definitely and the energy companies do need to carry mediately immediately upgrade the infrastructure that there is there are proposals to do this there are ways to fund it. But again I mean I was reading not many you tell it is some of the infrastructure is like from the 1800s Kono that yeah but yeah it's all 19th century technology that we could we could bring it the 21st century micro-grid things that could respond to the needs of the different areas that it goes through rather hell I'm going to one more Century up above that and I would have a more efficient delivery of the of the energy we have we hear it saves energy would save the environment but I mean can you imagine use an 18th century anything nowadays in any of our of our cars in our homes that are really and they get away with it. Yes it's ironic that even the Department of Motor Vehicles has more updated equipment Thank you sir and the job of d.m.v. Anybody Yeah I thought put it in perspective yeah right not good Katie anything coming I've been hearing about as it pertains to this topic we should look for yeah actually I am I'm finishing an article right now about this proposed plan by a couple of Republicans which has it makes so much sense you're going to love it and maybe with some pressure to the legislature logic and good sense to people will help get it passed again can't they get it because it is pragmatic and it makes sense and it's you know good but you know it'll be fine for the Democratic colleagues to camp in front of Democratic colleagues to sign on to it this is not a partisan issue no it's not and one of the points I make in the article in talking with these lawmakers is you know they hope this is a anon they don't like get nonpartisan support because this would benefit everyone in the state and frankly it's the Democrats who would look like heroes the making it happen but that's just not how things are running today in the Capitol it is probably the most dysfunctional group of people I've ever seen in my life wow I will let it bring you back to Yes What's that statement out there but I want to be more about what that means All right Kate thanks very much and God hating thank you thank you to Greg with the she's the reporter and editor of the California love she sort of has a clear point of view on it though she's investigating this in there at Katie Katie why sack citizen as a c c i t z z n is her Twitter handle however globe dot com of commas where you can find her publications Our number is 80222522 when Dr Drew it's made their lives have not the k.p.c.
