>> sandy bullock is saying she's adopting this baby as a single parent. they originally planned to adopt the baby together. she said she's seen jesse as a father and she's a good father and maybe one day he will be a part of his baby's life in some fashion. >> that's certainly leaving the door just cracked. to david kaplan, special guest joining us, senior editor "people" magazine. that's some cover you got, david kaplan >> it's a show stopper. i got to admit. it was difficult to keep it under tight wrap. >> how "people" magazine kept that a secret. go ahead, hit me, david, tell me everything. i want to start with the divorce. >> all right. there's two things here. sandra has filed for divorce. she filed on april 23rd in austin, texas, where she is a resident. and she actually filed under her initials backward. sandra annette bullock. b.a.s. she has said, though, unfortunately, in the thing the reason they are splitting is it's "unsupportable." document, they say there are no children under the age of 18 who require support or anything nor do they expect it to. that closes the door a little bit on any custody battles and as well also in the divorce papers they may enter into private agreement to discuss the separation of their estate and so forth. >> we are taking your calls live. out to elizabeth in texas. hi, elizabeth. >> caller: hi, nancy, my mother and i love your show. linda of lake creek loves you. we've been praying for your father. >> thank you. he's home from the hospital and he's alive. that's the breaking news. >> caller: that's great news. that's wonderful. you're covering a story on a new baby. i'd like to know if that baby is going to carry jesse's last name and what parental rights? i wish in the state of texas i wish she would have filed adultery for the basis of her divorce. >> elizabeth, i like the way you think, but i think i already know the answer to one of those questions. and that is the name that she released of the baby is louis after louis armstrong, louis bardo bullock. it seems to me she is adopting alone. let's go back out to david kaplan, senior editor "people" magazine. it sounds like from the legal filings that if jesse james, her soon to be ex-husband, has any right of visitation, any visitation at all it will be through her decision, her kindness, so to speak. not that he has legal claim on seeing little louis. >> absolutely. she holds the cards here and even tells "people" she does want at some point jesse to have a role in louis' life. she tells "people" she wants louis to one day know jesse is the dad, how she became to know jesse. one day, not now, but at some point. she does want him in his life. >> out to the lines. teresa, north carolina. >> caller: hey, nancy. >> hi, dear. >> caller: i've been trying a year to get through. i love the twins, your haircut and you're beautiful. you an angel. >> not true. thank you. all these people are calling in saying, oh, she's gone into hiding, because she's embarrassed. she doesn't want to show her face. you know, i don't know her except on screen, but that never seemed to jive with me. she had nothing to be embarrassed for. now we learn that as soon as she found out about jesse james' womanizing, and i'm putting that euphemistically, teresa, north carolina, she packed up a few things of her's, all the baby's things. she's had the baby in the home since january and she skedaddled. she left and has been living in a life of seclusion to keep the baby away from prying eyes. and also trying to protect jesse james' children. teresa, what was your question? >> caller: did she receive the baby newborn, i mean, as soon as it was born, is what i'm wondering. and another thing, she has nothing to be embarrassed about. she did nothing. >> she certainly didn't. >> caller: she's showing the world she has class. that's the way every woman should treat a situation like this, with class. >> she has epitomized that. i always said from the get-go, teresa, north carolina, it's like a swan marrying a pig. it's just against the laws of nature. david kaplan, how old is the baby boy? louis bardo bullock? >> louis, who she referred to as her little man is 3 1/2 years old. you do the math. he was fresh from the stork when she got him. he was definitely a newborn. >> she's 3 1/2 months old right now? >> yes. >> she's had him since january? >> correct. >> then you're right. you know, you got your degree in mathematics apparently, not journalism. yeah, she got him right when he came into the world. jean casarez, we know a little bit about where baby louis came from. >> we know he's from new orleans, and we also know that she and jesse james had an affinity to new orleans. they'd been there a lot. they'd been working on this adoption for four years. the only thing they said was we want a child from the united states and we would love someone from new orleans. and they got the baby in january. now, she's adopting it as a single parent, so does he even have legal rights to the child? doesn't look like it. >> let's unleash the lawyers. joining us tonight, gloria allred, as you know, high-profile lawyer out of l.a. she has represented several of jesse james' alleged mistresses. also with us, diane reul, a texas family law attorney. as you heard earlier, bullock filing for divorce in her home state of texas. also with us, criminal defense attorney, mickey sherman, author of "how can you defend those people?" and famed attorney out of san francisco, daniel horowitz. first of all to you, gloria allred, what about it? >> well, the question is, is she going to have custody of the baby? yes, if she's the one who finalizes the adoption she will have the baby and good for her. she needs someone in her life she can love and who will love her back unconditionally. >> to diane reul, texas family law attorney, joining us out of houston, why do you believe -- clr how are you doing tonight? >> hi, dear. why do you believe she filed for divorce in texas? clr well, i believe this venue is a lot more advantageous to her, number some one. the property division laws in our state are much better for her than those in california. although we're both community property states we look at it differently and it's not an automatic 50/50 split, as well as the fact that the waiting period to finalize a divorce is much shorter. you only have to wait 60 days from the date of filing -- >> wow. >> -- in texas to get a divorce. >> with us, diane reul, texas law attorney, specialize in family practice out of houston. we're taking your calls live. welcome home baby louis bullock. >> sandra bullock says she brought louis home in january, but wanted to keep the news private until after the oscars. just days before sandra bullock and jesse james separated. >> you know, it's sort of a metaphor for what happens. what do we lose as we become an adult? i know that there's a time period between when you get the baby and when the adoption actually becomes official. and could this divorce actually hurt the adoption process? >> excellent questions. let's throw those to diane reul, who is a texas family law attorney. joining us from houston. what about it, diane reul? >> no, i don't think it will affect her. single parents adopt children all the time in our state. but my guess is if this adoption has actually taken place in new orleans the lawyer that filed the petition for sandy, he is actually -- their main offices are in new orleans. so my thinking is that the adoption's perhaps going to take place in louisiana and not here in texas. >> good point, diane reul. >> we're probably dealing with a multi-jurisdictional issue. >> diane reul joining us out of houston. to jean casarez, why new orleans? and don't get me wrong. i was one of the people that dragged down to try to rebuild after katrina. it's still -- everything's still not rebuilt, by the way. people just forgot about it. what is their affinity with new orleans? because now you see celebrities going all over the world to find babies to adopt. which you know, power to them. the babies need love. but why did they pick new orleans, jean casarez? >> i think it's similar to your affection to new orleans. i think that she and jesse helped rebuild an auditorium there that was taken from hurricane katrina. they gave other moneys and devoted themselves to the efforts of rebuilding new orleans. and remember, texas is neighbors with louisiana. you know, nancy, i used to live in texas, and it's probably about an eight-hour drive from austin to the border of louisiana. fairly close. >> and to david caplan, "people" magazine. didn't they help found -- i'm talking about sandra bullock and jesse james, soon to be ex-husband. didn't they found some kind of a clinic for children in new orleans? >> yeah. their main project, actually, which we talk about in the article, was a charter high school actually in new orleans. and sandra really spoke to "people" a lot saying how she was just really touched by many of the students she met at this charter high school. she became very active in the community. so in fact in speaking with "people" she said one of the things she wanted was a child from the united states. and sort of in the back of her head she also was interested in having a child from new orleans. in no means was it a definitive thing. it's really a strong connection between her and the charter school and the baby. >> and to marc malkin, "e!" online columnist, jesse james already out of sex rehab? that was quick. >> yeah, it was pretty quick. he went into some sort of rehab. and then apparently bolted because he thought his privacy was being violated, that there were leaks from the clinic. now you see him every day taking his kids to school, going to work, and of course running around from the paparazzi. >> to michael sapraicone, nypd detective, president of squad security inc. she had to go through so much to keep this secret. to what lengths did sandra bullock have to go to keep the world from finding out since january she has had a brand new secret baby? and remember, all of this hit regarding jesse james' infidelities, all the affairs, the fetish model, the porn models, blah, blah, this all hit after she brought the baby home. and nobody still knew about the baby. >> i think she did a great job and had a great team working with her. and it's a very difficult thing to do, especially after all the publicity she got in hollywood. so i think she had an excellent team, they did a great job, and she should be very proud of what she'd done to keep that baby apart from everything. >> apparently, they even used a decoy when getting the baby, marc malkin. to what lengths did they go? >> i mean, they went to great lengths. you did not see this baby, we did not hear a peep about this baby. you know, you had cars going in, out. you didn't know who was in those cars, who did they belong to, where was bullock going, where was jesse going. no one knew about this baby. >> to dr. evelyn minaya, women's health expert, what needs, if you could explain them to us, everything with me bringing the twins home from the hospital is a big blur. what needs has sandra bullock addressed for this child, bringing home a newborn? >> well, i think that like we have reiterated before, it is amazing that she's kept it a secret because remember, if you remember correctly, how many times did you have to go to the doctor? how many times did you have to go out to get formula? how many times did you have to go out to get pampers and everything else like this? those are really just the basic needs of this child. and also the amount of time you that also put to the child as well. >> dr. minaya, you're bringing back such memories. the twins in new york, brand new. i came back to work. they were about 7 weeks old. it was freezing in new york. i get home from the show and go out on the sidewalk back and forth to cvs to get whatever it was way into the night. i don't know how she kept this a secret. >> that's what i'm saying. i think that -- once again, we should reiterate the fact that her team did an excellent job. and you as well as i do know that it is so hard, sometimes you go out there and you just forget something, it's like oh, my god, i have to go back out. it's amazing. it really is. she's done a wonderful job. i'm very happy for her. >> the actress told "people" magazine, "i really don't know how our paths will intersect in the future, but the father i've known jesse to be is the one i hope louis can experience one day, no matter how jesse and i go on with our lives." >> i think it makes a great inspirational story when you can see it work, when you see what someone can rise to the occasion and do. ok, maybe it was my fault. she told me to kill the weeds. and you did. along with the grass. i used the wrong stuff. there were dead spots everywhere. this is the right stuff. ortho weed b gon max. it kills weeds down to the root. even the tough ones like dandelion and crabgrass. but unlike that other stuff, it won't kill the grass. ortho guarantees it. kill the weeds, not the lawn. weeds, not lawn. got it? >> sheeba, illinois, as we can see already, i think god has a plan, but note to sandra bullock, sheeba in illinois says no visitation to jesse james. carmella, texas, hi, carmella. >> caller: yes, hi, nancy? >> yes, dear, what's your question. >> caller: okay. listen, first of all i want to tell you your twins are adorable and john david wears his personality all over his face. >> he does. he does. and now instead of saying yes, he goes nee-yes. nee-yeah. he starts it like a no/yes. you should see lucy. she insists on wearing two barrettes in the middle of her head. what's your question, my love? >> caller: you know, in the beginning all this talk about jesse james being associated with supremacists and he's the hitler thing and all of that kind of stuff. why would she want to expose this child of color to that kind of atmosphere? i don't understand -- >> you know, they kind of address that in the "people" magazine article. she said that the person she fell in love with, she had no idea about any of that and that they shared the same values. in other words, there you go, that's not the man she married. i have a very strong feeling sandra bullock is doing not what is best for her but what is best for this little baby. excellent point, carmella. we're going to see how this unfolds. as you see, her filings did all the talking. the baby's name is bullock, not james. there is no visitation rights for him. he'll get to see the baby as she deems fit. everybody, switching gears. i want to tell you about a brand new nursing grad, absolutely beautiful, that goes missing from the local barnes & noble's bookstore. take a listen. >> the search intensifies for a 24-year-old california woman who was last seen at a barnes & noble bookstore. >> friends and family members handed out flyers with a picture of 24-year-old phuong le to everyone that could today. >> police say phuong le has been missing since sunday night. >> the woman they described as quiet and timid. >> where she was spotted by a witness around 8:30 p.m. inside the coffee shop of the barnes & noble in fairfield, california. >> this is just really odd. this is not right. something's wrong. >> she had a minor disagreement with her older sister earlier that day, but family members insist it was nothing serious for le, who is the youngest of seven -- >> straight out to stacey newman, our producer on the story. stacey, what happened? >> well, 24-year-old nursing student phuong le left home about 4:00 on sunday. hours and hours and hours had passed. her family became concerned. her brother then tried -- >> whoa, whoa, whoa. stacey, stacey, stacey. who, what, where, why, when? when? when did they report her missing? what time did she go missing? >> she left her home at about 4:00 p.m. on sunday. this is out of fairfield, california. >> yeah. >> last sighting, 8:30 p.m. at a local barnes & noble, just as you have said. now, her family became concerned. her brother then went to go look for her, found her car abandoned in the parking lot, then reported her missing monday in about the wee hours. >> monday, you mean -- okay. so she goes missing on sunday, last seen around 8:30 barnes & noble, fairfield, california. and she gets reported missing what time? >> i believe this is 3:30 actually in the morning. so it was the wee hours. >> okay. got it. thank you, stacey newman. and to you, henry k. lee, reporter with "san francisco chronicle," author of "presumed dead: a true-life murder mystery." henry, thank you for being with us. what more do you know about the case? >> well, on tuesday, nancy, the suisun city police department, which is where phuong le lives, got together with the fairfield police department, where this bookstore is located, and they are collaborating with this case. what is interesting, nancy, is phuong le's own brother found her sister's car in the parking lot, her cell phone and backpack were found in the trunk. no sign of the sister. but you can bet you, nancy, they're going to be looking into the cell phone to see what calls or any text messages she received or made before her disappearance. >> and a local barnes & noble's. how much people go there for a cup of coffee, to buy books?
