We go out there and the doors busted open to, people coming and going. Some people are tiding up from target but a lot of people taking advantage of the opportunity. I should know nearby st. Paul people with the riot gear and tear and gas because in st. Paul at the target as well the looters are out there trying to be up to her opportunistic at a tough time. What you are looking at is a standoff going on for hours. That is the third precinct and relate the flash point in all of this. This is the precinct which the four officers dispatched in this incident. What you are looking at his demonstrators trying to get into the third precinct. It is hard to see through the crowd, but a line of Police Officers in riot gear preventing them from getting in. It is unusual taunting, jeering and every once in a while something will fly over the crowd but the standoff has been going on for hours now, neil. Neil might come thank you very, very much. In the meantime the president doing a lot of cracking down on china and threatening regulatory measures to counter with a chinese doing in hong kong to crackdown on protesters. Well, it gets social media involved in targeted for conservative and so the president issuing an executive order that will be much more aggressively. This has been bubbling up for some time but reached a roaring boil after twitter put out a factcheck on the president s tweet for potential of massive fraud with mailin voting voting. The president this afternoon declared such actions to be political and under social media platform specifically, section 230 of the Communications Decency act of 1996 which shielded the social media platforms from liability when they either censor or remove material from their website to basically allow them to do whatever they wanted to do under the guise of police and the website. There was a growing idea particularly among conservative voices that this impinges on free speech. The president signed an executive order this afternoon and we dont know exactly what it will do yet because we dont have the content of it but Kayleigh Mcenany gave a preview of what the president wants to do. Listen here. There are shields in place that essentially shields some of the social Media Companies and allow them to censor conservative users. We are not able to see what happens behind the shields. That section was one of the shields you mentioned. We are looking at ways to remove those shields to shed light what is happening in the decisionmaking behind the scenes. Neil for the American Civil Liberties and weighed in on the president s action in a statement provided to fox news as much as he might wish otherwise, the president is not the president of twitter. This order would be blatant, and constant emotional to punish social media that displeases the president. The idea drawing fire from the president s own party, Paul Mitchell from michigan. You dont like the platform come i dont use platform. But t decide whether to censor r labeling something truthful or not, it is cornered control communications. And analyzing all of this, judge napolitano, judge, should the president be concerned with what he is unleashing here, that if he takes away Liability Protection for google, twitter and facebook, then they would have to be extra cautious running a lot of his tweets, wouldnt they . You are exactly right, neil. To back up a little bit, he, the president is not in a position to remove their immunities from liability as john roberts so nicely explained. It is a statute enacted in congress in 1996 would have to be amended by the congress. That is not going to happen at least during the president s term if the president is reelected and republicans controlled the house, that might be a different likelihood of that occurring. But the president should be careful what he asks for because if you impose liability on the part of the entity that posts it were erroneous statements in the content of it, they will be very, very scrutinizing of what they post. Look for him it could his account this afternoon if they want. They have no obligation to run anything they dont want to. The government has absolutely no right whatsoever to censor what they run or as our former colleague press secretary Kayleigh Mcenany joe suggested to get inside the inner workings of twitter. That is quite simply immunized from government scrutiny and the first amendment. Neil if memory serves me right, judge, i dont think twitter even though a factchecked on the president s comments with rampant abuse, fraud and all of that, revolting and all of that and leaving aside the rage he said about and be see that he murdered a woman who worked with him 20 years ago, leaving all of that aside, twitter never took those tweets down. So there would be more reason under this type of executive action for them to do so, right . Yes. Listen, one of the Supreme Court opinions that the president loves, i love, is the citizens united. It stands for a lot of things, one of which is corporations have freedom of speech, even if twitter was interfering with the president s tweets in order and even if he runs for reelection, they would be absolutely permitted to do so and there is nothing the government can do about it. The president can condemn it and use other means to communicate, but he cannot use the powers of the government to interfere with the free speech of the people who own or operate twitter. If he does or if he attempts to do so, it is very easy for me to say, course, we will interfere with it. At the present day and history right now, in may 2020, we have the most profirst amendment Supreme Court we have ever had in 231 years. It will strike us down in the interference with free speech, politically political speech it will strike it down. Neil do you think the president would be making as much of potential legal thoughts of this if this involved factchecking liberal commentary or democrats tweets . I dont think the president makes any bones about the fact that he is roping his own vote here. And he is bruised because he has the largest twitter following in the united states. And here he was, more or less injured or corrected by them and it has hurt him and he wants to strike back. I dont think hes looking at fairness. Neil but i ask you this then, maybe that is the strategy, judge caminos this would legally go nowhere and a court would bring this down to your fine point, but the message is to put a chill on twitter, facebook, google, be careful what you say about me. Be careful what you are implying about me. They are and his victory. His victory would be come in my opinion, tuning up his base. If he is using government powers to chill speech and deter the speaker, to cause the thinker to speak twice about inking for fear of retaliation from the government, not from donald trump, he can say whatever he wants but using the leverage of government to chill speech is absolutely unconstitutional in the Supreme Court inconsistent on that. You look at what has happened and you look at where they are going, where they are coming from. I think you will see it. Just censorship and violates freedom itself. Imagine if your phone, or silenced or edited your conversations. Social Media Companies are vastly with more power than any punk company in the united states. Your newspapers, by far, more reach than your traditional forms of communication. Therefore, today i mixed signing an executive order to protect freespeech rights rights of the American People currently social media giants like twitter received unprecedented viability shield based on the theory that they are a neutral platform, which they are not. Not an editor with a viewpoint. My executive order calls for new regulations under section 230 of the Communications Decency act to make it that social Media Companies that engage in censoring or any political conduct will not be able to keep their liability shield. That is a big deal. They have a shield, they can do what they want, they have a shield, they will not have that shield. My executive order instructs the federal trade commission ftc to prohibit social Media Companies to engage in any deceptive acts or practices affecting commerce. And this resides section 5 of the federal trade Commission Act and as you know pretty well, most of you know very well, i would think you know it quite well, right . Additionally, my directing the attorney general to work cooperatively with the states. He will do and work closely in cooperation with the states to enforce their own laws against deceptive business practices. The states have broader power or authority to in this arena meant they will be doing it and we encourage them to do it if they see exactly as what we have been seeing. What they are doing is tantamount to monopoly my tantamount to taking over your waves. We cant let it happen, otherwise we will not have a democracy. We will not have anything to do with a republic. Finally im directing my administration to develop policies and procedures to ensure taxpayer dollars are not going in any social Media Company that represses free speech. Billions of dollars on giving them money. They are rich enough. So we will be doing none of it or very little of it. As president , im not allowing the people to bully and many of these month is to be done by president s for a long time. And now, we are doing it, and im sure there will be a lawsuit. Im sure we will be going for legislation in addition to this end the legislation will start immediately. I tell you, ive been called by democrats that want to do this. So i think you could possibly have a bipartisan situation, but we are fed up with it. It is unfair, and its been very unfair. We will see what happens. Any questions . Reporter mr. President given your concern of twitter, have you given consideration to deleting your account and walking away from the platform youve been so critical of . President trump if you werent fake, i would think about it and do that in a heartbeat. The news is fake. If you look at what is printed in the papers. If only the public could understand, that they are reading a story and they think it is real and its not real and so many cases. Im not saying every case. You have some great journalist and some journalists i have respect for, but largely come i find at least in a political sense, they were so much fake news it is disgraceful. I would do that in a heartbeat. If we had a fair press in this country come i would do that in a heartbeat. There is nothing i would rather do than get rid of my whole twitter account, but im able to get to i guess 186 million people. When you add up all the different accounts and add facebook, instagram, that is a lot of people. And that is more than the Media Companies have frankly by a lot. So if i have a story that is wrong, i can put a social media i dont usually use the word put but i say social media, but i put something out and the next day or the next hour or the next minute, everybody is reading about it. So im ready to refute fake news and that is important. I would like to ask the attorney general to say a couple of words. Hes very strongly behind it and backing it powerfully. Again, we will be doing this we will also g go to congress. You mentioned, mr. President , one of the things that i found the broadest bipartisan support these days is the feeling that this provision section 230 has been scratched way beyond its original intention. People feel that on both sides of the aisle. This was adopted 25 years ago to protect the industry. And its purpose was to allow websites that were serving as essentially Bulletin Boards for diverse, thirdparty content coming on to say that you are not responsible for the content of that third party information. And also, it tried to encourage these companies to take down things like child pornography or Human Trafficking advertising and things by saying if you act to remove this kind of objectionable material, you will not be liable for taking it down. Now its been completely scratched to allow it to become behemoths who control a lot of the information in our society to engage in censorship of that information and to act as editors and publishers of the material. So when they put on their own content, factcheck content onto other peoples content and when their collection, they start censoring particular content, including in many cases the direction of fine governments like communist china, they become publishers. They shouldnt be entitled to the same kind of shield that was set up earlier. Now, this executive order is a very strong step towards addressing this problem. It sets up a rule making procedure that will eventually before the fcc to try to get back to the original interpretation and understanding of section 230. It will also empower of the attorney shower adamic general to work with the state to come up with a model that legislatios with the state. We are preparing federal legislation. We will be sending over shortly to the office of management and budget. So this is an important step to get back to the original understanding and there is a little bit of bait and switch that has occurred in our society. These companies grew because they hold themselves out as Public Forums. And as free Public Forums come a variety of voices and Diverse Voices could come on and be heard. That is how they grew. That is how and why people joined them. Now that they have to come with these powerful networks with eyeballs and now that they have grown as holding themselves as free Public Forums, they have switched. They are using that market power with particular viewpoints. That is wrong. It has to be addressed, not only to this executive order, but i think litigation going forward. I think further action on capitol hill, thank you, mr. President. President trump do you have any questions . Reporter yes, i do not only have you been against section 230 and the president has been against section 230, the Vice President is against section 230. Do you believe the executive order that the president is about to sign in any way repeals or amends section 230 . No, it doesnt repeal section 230. And im not against section 230 if properly interpreted and properly applied, but its been scratched and i dont know anyone on capitol hill that doesnt agree its been stretched beyond its intention. I think this will help get back to the right balance. Reporter mr. Attorney general can you give us the legislation yo you d the president referred to in what you want to do and that legislation . We are dealing with possibilities and its too premature. President trump it will totally change 230. What i think we can say, we will regulate it. It is a provision and we will regulate it. When he sends out 28 million and all of the mailboxes and kids raid the mailboxes and handing to people signing the ballots down the street, which is happening, they grab the ballots. You dont think that happens . If there is ballot harvesting. We have seven elections for congress and they were like tied and they lost every one of them because they came and dropped a whole pile of ballots on the table. But you dont think they rip them out of mailboxes . You read about it all the time. Take a look. They do worse than that. In some cases, they will sell them to a republican community, a conservative community. They dont have to sent the ballots to those communities. There is no weight of checking. You have to vote. They get the same paper, same machine, nothing is special. They get the same paper, the same machine, they print ballots, and bill would have to do a great job to catch them doing it. But the news, we will go to minneapolis shortly when they have a press conference featuring the mayor and others who think the officers involved should not have only lost their jobs but will be going to jail. But the real Big Development on the part of the president was this crackdown on social Media Companies. Now, the president is saying some of their Liability Protection should be weighed when they do things that are not there and in this case, something he said online on twitter. But what was shocking, the comments, he was open to shutting down twitter. Whatever your opinions on the left or right, a huge, huge social networking site among the largest on the planet. And since factchecking him, that is good enough to crackdown and maybe look at shutting down twitter. Now, the issues that came to mind, one of them that prompted a quick factcheck thing on mailin ballots got the president and he said he would be policed on that. And being policed on that because he was wrong. He was being policed on that because he said millions of illegals were getting ballots. That simply was not the case. So this is not a left right issue. That was not the case. That was a wrong fact. That was in the statement. Some said it was an outright lie. Having said that, what twitter was doing was clarifying. Now, you can check the sources and the factcheckers because they should be scrutinized but the question, dont pull your tweets down, that is another matter. Now the president was called on some outrageous comments he made about msnbc general scarborough who had a young woman die in his congressional Florida Office 20 years ago. Never mind general scarborough was not there at the time 800 or 900 miles away, the president was strongly implying come outright accusing maybe something was fishy that was up and maybe this was a case of murder. That was something also will so that it had to be factchecked. It wasnt just right left here. That was incumbent upon anyone to check comments that were outrageous. Now, part of this investigation and the crackdown on social Media Companies that claim legal liability or protection of that is that if people say outrageous things on a site, you know, viewer reader beware. When it was done to him. So that is really the genesis of all of this. But he might be careful what he wishes for on this because if you are limiting their protection from any legal action because of something users are saying that presumably could include no less than the united states, the biggest users on the entire planet come if they feel uncomfortable about something hes saying, next ti time, factchecking him, they might have to take him down. That is what the president has set in motion. We walked for that in a moment. We are also exploring what is happening in minnesota in the case of the 46yearold africanamerican who now is galvanized Police Forces of around the country that feel like the Police Officers overdid it. I have never seen use of force or ever been trained to use force in the way that we saw it this way. Ive heard a lot of commentary, well, we have to take a look at what happen before hand. I agree most cases you do but the bottom line who had a compliant subject on the ground and the uses over if it existed prior to that. They should have put him in the back of the car and that should have been the end of discussion. Neil what do you look for . The officer involved but the three others there and the witnesses didnt do anything about it and thought he might have been going a little overboard. But the argument here from protesters and last night, things tried to calm down a little today. Should they all be arrested . What i think the fbi is going to look at, we have two parallel cases, local police, local authorities will look at whether or not there were murder charges to be filed in this matter. The fbi will look at civil rights because the violation of the officer covering a person to lose their life. The fbi will take a look and say how is this officer trained . I can tell you and all my policed training ive never seen a knee applied to the carotid artery and for such a long period of time. My guess is that this is not going to be part of the training and that this was done independently of the official policy and therefore, he will be wrong in facing charges. Neil you know, john, to your point, there is a lot we dont know. Youre the expert here, looking at before, during, after video here, there is a lot you cant necessarily pieced together, but when a number of the Police Chiefs around the country are saying, this does seem excessive. They are worried about the signal it is sending if authorities are not more forceful here. Again, looking at this and the fallout from this, where do you think this entire case goes . They will have to take action. Number one, citizens deserve to have fair and honest policing within their communities. And for the most part, they do. We have 850,000 Law Enforcement officers in this country, and these events as wise as they are in the media, there were only 372 persons killed nationwide by Law Enforcement officers last year. Onethird of which were africanamericans. But when we have a case that on the evidence needs to be investigated to determine if there was criminality, they need to take action and do something about it so that the police can be trusted by the citizens they have to protect. Neal, what i think is they will be two phases of recovery. First, very fast, and the second will be much slower. And the very fast part we will see unemployment rates fall quickly. We will see months with 1 million or more jobs created, but that wont get us close to all the way back to where we needed to go. And we will be at the beginning of a longer, harder slog. That is what i think now. And that is what ive thought. Neil got it. In other words, its not a debate about vote coming from the depths of this, and we do see that in these claims where they are remarkably coming down each week even though eyepopping numbers. And we will probably see unemployment down when it comes out 20 or more unemployment rate. But from there, it improves, are you saying swiftly . I mean if you look at daily Economic Data that tries to track things like consumer spending, you saw that bottom out around april 15th. You have seen a decent amount of growth and that since april 15th. Still really, really deep in the hole. Then forecasting forward, there are two types of ways to create jobs. One is a laidoff worker goes back to their employer because they are employer reopened. The second is somebody gets fired and has to find a new job. That first type is fast and will likely be frontloaded. The second type, the finding the new jobs for the hired worker, that will take some time. Neil so all bets are off but we have a second wave. If we get a second wave of the virus or unusual spike in cases that nobody planned on, then all bets are gone, right . I think all bets are off on a second wave. Im not sure that you would see the synchronized shutdown of economic activity, even in a second wave that we saw back in april. I think we should. I think it was the right thing to have done in april, but not every governor, not every person sees it that way. So im not sure that we would respond in the manner that i think is appropriate. So maybe we would have a little bit of extra gdp and lose a lot of lives as a consequence. Neil it sounds to me, jason, and i dont want to put words in your mouth, again, when you were telling this to, you know, democrats and biden and the rest, i said dont get so, you know, giddy about the possibility of a staggering economy that it could come back smartly and take nothing for granted. But what was the reaction you got . Yeah, i made these comments originally in the bipartisan group. My concern is that there will be an illusion that the problem is being fixed. And so the economy will go from very, very bad to just bad. And we are still going to need Economic Policy. And my worry is that the people would say, oh, 1 million jobs a month, we dont need another round of fiscal stimulus. We dont need to help the state. We dont need to extend unemployment and insurance benefits. And some of the will to take the economic steps that i think we really need for our economy might diminish. That is my biggest warning is even if you are seeing good Economic Data, dont get complacent, be in this for the long haul and do a lot in terms of Economic Policy to speed this recovery as much as we can. Neil so you still think that is needed appeared beyond left or right on this, beyond obama, trump, biden, at the bottom line is more stimulus would be needed. Yeah, a limit to how big the impact on the economy could be which is why the fed jay powell has said effectively that he would like more fiscal support.
