The statement saying the government has determined pursuant to the principles of federal prosecution and based on an extensive review in careful consideration of the circumstances, the continued prosecution of this case would not serve the interests of justice. What has happened since then is that the Texas Supreme Court has ordered her release. The Governor Greg Abbott and eliminating jail for people who violate any of the medication orders. A lot of those orders come off tomorrow by the way. Heres what Governor Abbott said about it a short time ago. We should not be taking these people and putting them behind bars. These people who have spent their life building up a business and being told to shut it down i lose every penny they have. And then, if they dont follow every little fine point of all the rules, they suddenly are subject to arrest. That is wrong. The loose and in that particular argument is that luther was not jailed for violating the order. She was jailed for contempt of court after the judge gave her an opportunity to apologize. She basically said no, im not going to apologize. The preponderance of public sentiment at least and maybe the legal evidence as well as coming out on her side. A lot of things are going to change in texas tomorrow. Governor abbott says hes been working 24 7 decry to get this in place. I have been disturbed about this prosecution since i found out that jim comey and annie mccabe sent to fbi agents and snuck them into the white house about an investigation that had no predicate and therefore no lawful basis. I think this is a proud moment to answer your question for the department of justice to have done the right thing. The democrats dont like that, they can stuff it. Ive been around long enough to understand the prosecution that was defective. This prosecution should not have been brought even in a circumstance in which Michael Flynn pleaded guilty, because he pleaded guilty under duress. They threaten his family. It was an investigation without predicate. And they had all kinds of problems including runaway prosecutors in Robert Muellers office. The same cast of characters from jim comey to annie mccabe to peter strzok which suggests that a major housecleaning is still in order. Neil you know, he said the democrats are not going to like this. Were getting comments now from house judiciary chairman who put out a statement quoting here the decision to drop the charges against general flynns outrages. The evidence against flynn overwhelming. He pleaded guilty to lying to investigators and politicized a thoroughly corrupt department of justice is going to let the president s crony walk away. Your thoughts. Is very simple. The agents were in possession of a transcript of a conversation between Michael Flynn and the russian envoy to the United States. They already knew the answers to the questions that they were asking him. And they were there by their own acknowledgment as reflected in their own notes to set this guy up and ask him questions to get him to lie in order to try to fire him for political reasons. Since when does the fbi and the Justice Department act using the levers of prosecutorial power to act on a political basis to remove someone that they for political reasons want to have exit the administration . If this is an orchestrated head job begun by the Obama Administration and continuing on over into the beginning of the Trump Administration that was the deep stage trying to undermine the presidency. So the standard to commence our criminal investigation whether it is for jaywalking or treason is articulable suspicion. You must be able to state what it is you are looking for, and while youre looking for it from this person. There was no articulable suspicion to commence an investigation of general flynn. The doj and the pleadings it filed this afternoon with the judge. Ask him to dismiss the indictment against the general acknowledge this much. Under the law, an indictment isnt dismissed until the judge says so. As a practical matter, the judge is not going to force the doj to prosecute a case which it admits has no basis in the first place. So the generals home free. The devil is in the details here. Not every state is doing this uniformly. Some states are doing more of our relaxation approach where others are doing a total relea release. Certainly when you look around whats shelter in place has done. Some areas say it would be safe if we did it in the right way. He could relax and open up a little bit. Its kind of like we are coming off a peek from our epidemic. You want to do it in a controlled way. Have a gradual approach. Put your toe in the water, see how it feels in the if things go well relax a little bit more. Im a little worried some states are being a little aggressive. Neil it certainly was of some concern, Governor Cuomo in new york, still stubbornly high cases around the new york metropolitan area. Not too surprising but whats rather alarming about the numbers there, little more than 60 of those cases and deaths have been coming via people who were doing all the right things. Sheltering in place, doing everything that local officials, National Officials have been advising. Yet they are still getting sick and they are still dying. What do you make of it . Somewhere in these cases there is an exposure, and thats the tough part. You know, the strategy is, taking the whole nation off quarantine or so to speak, or a whole state then moving them in to identification, testing, contact investigation with aggressive isolation or quarantine, its not an easy thing to do. So if you look at all those cases that are occurring, somewhere there was an exposure, and somewhere the virus got through. When you do these analyses, you can kind of sort it out. I think what we are seeing here in North Carolina for instance is we have a background level of viral activity in our communities. We are having cluster outbreaks, meatpacking plants, other businesses that have been opened. So its like playing whackamole a little bit when you find these clusters and you really have to quickly identify, isolate and quarantine. What we are doing with this opening is w we are sort of shifting the responsibility for containment and mitigation to damp down the curve from government and officials to the individuals. And so as we relax, individuals have to be aware that this isnt just going back to the way it was. Personal distancing is still important, wearing a mask in public places, particularly in doors is important. Theres going to be certain things that may be just too unsafe to open up again. Until we can get a vaccine and get out of this. If the citizenry and everyone does their part, i think its possible for us to do a relaxation without a big surge.
