Its important to listen to her choice of language. She commended House Democrats for pursuing issues of impeachment but then she said if they proceeded, they need to make such a solid case that republicans would have buyin. Heres the speaker. Nothing is off the table. We do want to make such a compelling case, an iron clad case that the Republican Senate which at the time seems to be not an objective jury, will be convinced of the path that we have to take as a country. Special Counsel Robert Mueller spoke for almost ten minutes today. I want to emphasize, he did not take questions from reporters that might have clarified some issues and gone to his motivation for making a Public Statement. He talked about Russian Election interference. He talked about that being systematic and broad. The emphasis has been on the obstruction issue. He talked about the olc opinion, the office of legal counsel. Its like the internal lawyer to the executive branch. Its housed in the Justice Department. He said that opinion says you cant indict a sitting president. Mueller said this was a major stumbling block in the investigation. Under Longstanding Department policy, a present president cannot be charged with a federal crime while hes in office. Its unconstitutional. Even if the charge is kept under seal and hidden from public crew, that too is prohibited. The special counsels office is part of the department of justice. By regulation, it was bound by that department policy. Charges the president with a crime was therefore not an option that we could consider. Mueller went on to say, under the regulations, his team gathered information for the future. He didnt reference congress or impeachment but that was the subtext. This does conflict with william barr. He testified that when he had a conversation with mueller and the failure to reach a decision on the obstruction charge, that mueller, according to barr, had put this legal opinion to one side and that theres underlying facts that would not go to a criminal prosecution. Special counsel mueller stated three times to us in that meeting in response to our questioning that he emphatically was not saying but for the olc opinion he would have found obstruction. He said that in the future, the facts of the case against the president might be such that a special counsel would recommend abandoning the olc opinion, but this is not such a case. Two final points. The special counsel gave the strongest indicator that he does not plan to testify publicly or privately to congress and there was another development that kind of flew under the radar. Weve got something from the Inspector General at the Justice Department. They have confirmed now a second former senior fbi executive was guilty of unauthorized leaks to the media and more importantly accepting gifts from the media. This goes to the ongoing probe of what people like to call the investigation of the investigators. Those involved at the genesis of the whole russia case, neil. Neil i keep forgeteding that, what the Inspector General will release. Thank you. Case closed. Thats what the president is saying of mr. Muellers remarks. To kevin corke with the very latest. Kevin . Neil, good to be with you. The president s opinion about this is clear. No obstruction, no conspiracy, no collusion. For the first time today since the genesis of the russia probe, we got a chance to hear from the special counsel himself who was dare i say decidedly less clear about those very topics. Let me share a bit of what the president had to say today online. He didnt say a whole lot, which may have surprised some people. He tweeted this. Nothing changes from the Mueller Report. There was insufficient evidence and there for in our country, a person is innocent. The case is closed. Thank you. All right. Case closed because they argued mueller said as much in his report and did again today. He didnt have the goods to accuse the president s of anything specific. Even though he had evidence that make it impossible to exonerate him. Still, mueller said today, its over. Sarah sanders agreed. We consider this case closed. He completed his investigation. Now hes closed his office and its time for everybody to move on. Hes going back to his private life and we think everybody else should, too. I think Catherine Herridge gave you a really good nugget a moment ago. Mueller seemed to throw the democrats an olive branch saying the man reason he could go forward with an allegation of obstruction is because of the long established rule against it. The president s lawyer, rudy guliani, isnt buying that. When a prosecutor cant reach a decision, thats the decision. Theres no case on obstruction, no case on collusion. I did it for eyes. I never exonerated anyone. I found is there enough evidence to bring a charge or isnt there. If theres not enough evidence, end of case. End of case says rudy guliani. Not so fast says jerry nadler. He says given that special counsel mueller was unable to pursue charges, it falls to congress to respond to the crimes, lies and other wrongdoing of President Trump and well do so. No one, not even the president of the United States is above the law. For mueller, doesnt look like he will testify short of a subpoena. I doubt that will happen. Back to you. Neil thanks, kevin. Heres the line from the special counsel mueller. The president s critics are having a field day with it. Take a look. If we had had confidence that the president did not commit a crime, we would have said so. We did not make a determination as to whether the president did commit a crime. Neil we should be clear here. Robert mueller didnt say anything today that wasnt already in his report. So what are we to make of this . Former whitewater independent counsel, robert wray. What is interesting, neither did the final report say if we had confidence that the president did commit a crime, we would have said so as well. So they couldnt conclude either way. What do you think of that . Well, what has gotten the white house and white house lawyers and the president s own lawyers appaplectic about that is what rudy guliani said. To once again throw that out there by a prosecutor in a situation in which how was the president supposed to respond to that. The only thing that you can say, look, a prosecutors job is to decide whether you have sufficient evidence to bring a case. Something that bob mueller could have done in a recommendation to the attorney general. Ultimately its the attorney generals call to decide whether or not to change neil do we know i thought we were 2 3s through this process even though barr was appointed attorney general. We had a headsup not only any indictments, any prosecutions, anything to suggest the word guilty of any of this, wouldnt people have said, all right, why are we doing this . Exactly. Thats what the president s lawyers have said. Are you kidding me . You have a special counsel appointed. Everybody understands that neil how did you handle yours . Other people come within the sights of the special counsel. Nobody should be under the illusion or delusion that this was the appointment of a special counsel to investigate conduct of the president. So it would be natural for someone to assume and for the public to come to expect that the special counsel was going to resolve that question, all questions. Neil he didnt. How did you resolve these issues . And to answer your prior question, you know, again, i think special counsel mueller suggested that if he felt strongly about the fact that the olc prior opinion should be revisited, he could have recommended that to the attorney general. Neil he didnt. The attorney general said in his testimony, that issue came up and that bob mueller said that this was not the appropriate case on which neil could he have used different words . Could he have said i cant indict a sitting president whatever but i can find this behavior he seems guilty look, he was mindful of exactly what got james comey into trouble. Youre not going to charge somebody. On the way out the door, youre going to say the conduct was careless. Neil that can be worse. Exactly. With regard to the Mueller Report, i never criticized anything about it except that one sentence. I dont think that sentence ought to be in the report. I dont think that even if you felt that way, i dont think neil that sentence being we couldnt exonerate him. Neil but you also couldnt indict him. There wasnt enough material there for you its fine neil its okay with the indicting. It fine to say that but its not fine to say if youre not going to recommend the charges be brought at the same time in a report to say that we didnt find the ability to be able to say that we could exclude the possibility that, you know neil but you also didnt find the possibility that he was guilty. Right. Neil so to emphasize the one without the other isnt fair. Again, my takeaway from today is did you learn anything new from this press conference that wasnt otherwise in the report . No. The only thing we learned is that the office is closing and hes returning to public life. Theres nothing that was already disclosed in the report. The other piece of news is that he has no intention of testifying. I agree with that. I thought for the longest time that the country and the nations best interests should accept bob muellers determination that its not appropriate for him to testify. He shouldnt have anything further to say other than what is already in the report. Neil robert ray, thanks very much. Now, stocks were already down on china concerns. That didnt help matters any. Had a sparticus moment. Theyre trying to do the same thing again. Theres no collusion. Theres no obstruction. Mueller didnt produce anything new today and we need to move on. Neil getting a lot of attention, muellers lines again that if we had confidence the president clearly did not commit a crime, we would have said so. Now you can just as easily argue said if we had confidence the president did commit a crime, they would have said so as well. That is what is getting the attention. It was essentially an inability to come to a conclusion either way. So normally that means that you cant take action against someone because you dont have enough proof. That is not how its being presented. That is exactly right. A judiciary hearing when attorney general barr came before us, i asked him was it common for the conclusion of an investigation to actually seek to exonerate somebody. He said no. He found those paths just very odd. What the department of justice was tasked to do is determine if a crime was committed. They found inserve sent evidence to prove that there was a crime that was committed. The underlying crime that had to do with the election meddling and the other, the allegation that somehow justice had been obstructed. Neither of them rose to a level to where they felt like they had an indictable offense, which is exactly why the impeachment process is pure theater. The fact of the matter is, we a almost 450 page report that found no evidence of wrong doing. Thats what the house would act on. When it comes to the senate, its not going to go anywhere. It would be theater, more fundraising emails from the candidates, politics. At the end of the day, the bookers, the harrises, the warrens are misleading the public and trying to make something out of nothing. Neil as youre speaking, nancy pelosi is being questioned about the need for impeachment proceedings to begin. Shes obviously walking a fine line here. Shes no fan of necessarily diving head first into Something Like this. But shes still made it clear that theres enough to raise this very issue. What do you think democrats end up doing . In the house, is it your sense theyre going to pursue this and what do republicans do . I believe if it was left up to speaker pelosi, she would trust her instincts and know the American People are getting fed up with revisiting the same facts and trying to draw a different conclusion. She made be forced because of the pressure from the president ial candidates and members of her caucus to move forward. But i dont sense that that is something that she wants to do its going to give us more opportunities to point out that there was no collusion, there was no obstruction and this is pure raw politics. Ive seen it played it in Judiciary Committee every week. The American People are fed up with it. We need to move on, let the president i dont to do the good work hes doing and let them find something meaningful on policies to run on versus the politics of personal disruption. Neil do you worry that if the president were the president and this was for all i know a u. S. Senator or just an average citizen that the treatment would not have been as handoff as it was in this report . No, i dont think so, neil. I think if the special counsel and the dozens of people that worked on this full time for two years found evidence of a crime and substantial evidence to indict that they would have brought that up to the attorney general and it would have been left up to the attorney general to decide how to dispose of the case. The one thing i would say that came out of today, i would probably disagree with the white house, i think mueller was clear, he reached no conclusion about whether the president broke the law or not on obstruction. How judiciary will pursue that. He was quite clear that if they felt the president was in the clear, they would have exonerated him. Mueller chose not to do. Neil he could have just as easily made a decision if he had enough compelling evidence to charge him something. He didnt do that either. Neil, i didnt hear it that way. I thought he went out of his way to say that the department of justice rules prohibited the indictment of a sitting president. We can leave that for legal scholars. It would be neil doesnt stop you from saying we think youre guilty of this offense. Might not go anywhere because of the rules and standards set up. But up like the ken starr record that he used the term guilty numbers of times, high crime, misdemeanor, no such terms were used here. Im not here to indicate one or the other. Im curious where you see it going. Because it doesnt seem to have an end game. Well, our committee, the senate Intelligence Committee, we have an end game. Were going to finish our investigation. Were going to put forward ideas and i put forward legislation, most all of it bipartisan, to make sure that our systems are not attacked a again in 2020. The news media did a great job tracking each different tornado. We think theres 15 to 20 counties that were hit in ohio. Montgomery county was hit. It came at night. This is much more terrifying. My wife, fran and i, were in columbus. Were from the dayton area. Were from green county. Fran was texting back and forth with Adult Children that live near us. One daughter does not have a basement. She went over to another daughters house that does have a basement. People were doing whatever they could to make sure that they stayed alive. Thank heavens. Most people did a great job. By definition you can say, if we had confidence the president did commit a crime, we wouldve said so. And he did not. And i think what he did today was he put more pressure on the democratic leadership, he buttressed the argument of the progressives and the liberals who said, bob mueller a special investigator two years, he is saying that this is in the lap of the democrats in congress. Think about nancy pelosi, this is somebody who is a master vote counter, never puts up a vote unless you know she will win. You do not impeach unless you know you do not have bipartisan statement. Just to say, that is outrageous for a prosecutor to say that it is not their job. I dont know what it is about former fbi directors that they feel their job is to look into someones soul. It is not. We are presumed innocent until found guilty and charges. It is an outrageous abuse for him to do that. He pulls a james comey. What james comey did to clinton. Neil and to say that he was limited constitutionally and you are not limited in forcefully stating your opinion, he would be guilty of this or this is prosecutable. Otherwise dont do it. Why would you take the job if you cannot go anywhere . That is an excellent point, who gave him the authority to act as if he is guilty until proven innocent . And the problem is, why the special prosecutor law is written, rewritten after the impeachment of bill clinton and it is a mistake and needs to be rewritten or gotten rid of completely.
