Also keep in mind that the forces that are supporting the generals and by extension Nicholas Maduro are the same forces that i mentioned earlier that are not intending on leaving that country. And still stirring up a crisis in that country. You might remember yesterday we talked to florida senator rick scott that say maybe american troops have to get involved. Others are not so sure of that saying it would be unwise move without help in the region including countries like brazil and neighboring columbia. Again, easier said than done. This has all escalated within the last hour amid signs we are told that Nicholas Maduro isnt going anywhere and has communicated to his generals that he expects loyalty to him. Most have stayed very loyal to him. Separate reports coming out of the venezuelan president. We are relying on english interpretations of this that assurances that generals even at this late stage if they switch sides they will not be punished. But the issue now becomes very are very suspicious of any agreement that would have them going to guaido. So here we are stuck in the middle of quite literally a revolution and what to do about it. Isnt this really going to be a test of within the military community who stayed with whom. We are told the lower ranking soldiers are pretty much with the people on this and by extension with guaido on this and that those at the top, the generals who benefited as Nicholas Maduro from things that the population doesnt have like food and medical supplies, that will not change. And thats where the real schism is between branches of the military and here we are wondering how to intervene and on whose behalf. Right . Listen, i can tell you right now that when you look at just the privileged few, which could be maduro, the generals that have plenty of food, plenty of condiments to go with that and yet the vast majority of the venezuelan people are suffering not only with inflation but just a real desperate time of potential starvation. And so it is key that we have humanitarian relief there. But its also key that they get a clear message from the United States of america that is those freedom loving individuals will have our support and have it unconditionally. Neil when you say our support does that mean our troop support . We need to send troops there . I understand his passion and his concern but you talk about a slippery slope. I think this will hopefully reach a diplomatic solution. I dont know that there is a real appetite for us to send troops from the United States of america there. That being said, there is a Real International coalition that sees whats going on here with the exception of a few countries that you mentioned. But if you are going to side on the side of iran and russia, and cuba, and not with other freedomloving countries, we know that wherever there is the greatest freedom there is the greatest prosperity. Yet, we have venezuela with some of the greatest Natural Resources and their people are starving. Did you buy that that he misrepresented that . Come on, neil, how can nibby that . He was given a chance, actually right and four page sum refresh his recollection he declined to do it. He wants to criticize because the narrative is not to his liking . Last time i checked bob mueller shouldnt be concerned about a narrative this is all about the democrats looking for a political consolation prize because mueller didnt give them what they wanted. Neil i see what you are saying, chairman, i understand that. But it was originally viewed as mueller upset with the way the press was representing. Sure. Neil the findings of his report but the letter seems to speak otherwise quoting from it while we understand that the department is reviewing the full report to determine what is appropriate for public release, a process that our office is working with you to complete process need not delay supportive materials. I think he was complaining about the press saying there was no obstruction no, collusion, and i think he had a number of his people that were on the investigation. And indeed we know that bill barr did that within two weeks. That being said there is no doubt in my minoing to go to one narrative. Democrats to another. I would not recommend tomorrow i would recommend and fully expect he will be before the house it needs to be before the same conditions that everybody else comes here to suggest that you are going to have counsel come in. The Judiciary Committee is uniquely populated in that we have more attorneys, members of congress that are attorneys on that committee you know, than any other committee that is out there. What are you hearing that the committee would be open the House Judiciary Committee Keep Congress men and women asking the questions . Well, what we understood from Justice Department officials is that if the democratic chairman jerry nadler made the call and got the votes to have the hearing with this extended time for staff questioning that that was really off the table for the Justice Department as far as they were concerned because they felt that if you have someone who is senateconfirmed, cabinet secretary like the attorney general that it was appropriate for him to take questions from lawmakers and not staff. So as far as they were concerned, this was a nonstarter and that we should expect a very strong statement from the Justice Department. Earlier today, during barrs testimony to the senate joshua areJudiciary Committee it seemed to be a case of the democrats trying to relitigate the conclusion on obstruction. They focused on this critical issue episode with White House Counsel Don Mcgahn and the president. The president , according to the special counsel telling mcgahn to go to the Deputy Attorney general Rod Rosenstein because he perceived conflicts for Robert Mueller and that he should go. Bill barr has a very unique interpretation of the obstruction statute, which is a minority view in the Law Enforcement community. Most Law Enforcement people, including prosecutors in his own doj have a different view. His view is its impossible to obstruct justice if you are being investigated for a crime you didnt commit. So if you throw a road block in the Justice Departments way if they are investigating you, big deal, you were innocent any way. The road block is not a crime. The doj the statute, the obstruction of justice statute says whoever, for a corrupt purpose, impedes or attempts to impede an investigation or a judicial proceeding shall be guilty of obstruction. It doesnt matter if you committed the underlying crime. Richard nixon was charged by the house of representatives with obstructing justice by having holderman fly authorities. He didnt commit the underlying crime which was the burglary. Neil easier if mueller one way or the other had made the decision on this matter rather than punting in this case as it turns out. I know he knows full well the attorney generals views and some maybe thought that would be a lost cause and why not do and this feed all these black helicopter. I dont know the answer why. My guess is because he would have been shot down by the attorney general who simply would have said you do not have permission to present this to a grand jury because, in my opinion, as a matter of law, its not obstruction of justice. Neil, we have really seen a dramatic shift in tone over the past two days here. Yesterdays Opposition Leader juan guaido called for military uprising. It got violent yesterday with water canons and gunshots. 70 people wounded. And now this afternoon after peaceful morning of protest its getting violent again. You can harr are the pop pop pop of small arms fire all across caracas. At least 20 people shot so far and a real shift in tone. Juan guaido the Opposition Leader said he was going to bring in humanitarian aid. He failed to do that. He said he was going to lead a military uprising against a dictator maduro. He failed to do that. So after four months of marching, four months of protests there is some real dissatisfaction and some anger setting in. And we are seeing some violence on both sides today here in caracas, neil. Neil as you brightly have been reporting the allot depends on the military particularly the generals aligned with maduro. Do we know whether the original offer that guaido and his forces had would not be punished or even reprimanded for the special breaks, allowances and all the other stuff that kept them in power and kept them loyal to maduro . Do we know whether that deal still stands . It really depends on how listen. To say the u. S. Said that deal was in place. Venezuela officials are denying it. But there are Different Military forces here in venezuela. Well havent seen the army out in the front lines against these protesters. There is a real fear that especially in the rank and philoer ranks of the army they are sympathetic with the opposition, with guaido. They wouldnt fire on their own people. But there are certainly other groups like the collectivoss, cuban militia who would fire on the venezuelan people. Thats where that firing is coming from today. More to the point the leak of the letter itself bob muellers letter to the attorney general, do you interpret that leaked letter as a sign barr were and are at odds on the findings of this report . First very good question. There are very few coincidences in politics and i dont think its a coincidence that mr. Muellers letter leaked the day before mr. Barrs testimony a lot of people got their bowl bowels in an uproar over it. It turned out to be much adieu about nothing. My issue was very simple. Okay, mr. Mueller was unhappy. It turned out he was unhappy about the press coverage it turned out he was unhappy because he didnt like the way that mr. Barr wrote his letter. All that is academic now because we have a final copy of the report. So my question was real simple has mr. Mueller changed his mind . Has he changed his conclusions . Prosecutors either indict or they dont indict. Now, mr. Mueller said no indictment on conspiracy. No indictment on collusion. No indictment on obstruction of justice if he has changed his mind i want to know. He has not changed his mind. Neil do you think the fact he did not obstruction and im not a lawyer was built on the idea that you cant indict a sitting president . No, no. Mr. Barr testified clearly. He said i met with mr. Mueller. There were a number of people in the room. He said mr. Mueller was asked is the reason you are not not recommending indictment on obstruction of justice because of the doj policy that you cant indict a sitting president . Mr. Barr said mr. Miller said absolutely not. Absolutely not. So thats a very false narrative. If you are bob mueller and im trying to play devils advocate the attorney general to whom you are submitting this report has a certain view on obstruction what is allowed and whats not that essentially mueller pulled his punches because that was kind of the impression of the letter from mueller in which he said that barr confusion about critical aspects of the results of our investigation . I saw that and i asked mr. Barr about that. Heres what i and, look i dont know, neil but here is what i think i think mr. Mueller thought mr. Barrs letter was not nuanced enough. Okay. Thats academic because now we have the report. Mr. Barrs letter doesnt matter anymore. I think mr. Mueller was upset about the news coverage. I dont know what he expected mr. Barr about it. Thats up to the news media to cover it like they want. Seems like he is blaming barr and i am making this leap here i want to stress that is he blaming barr for providing the juice for that coverage . I think they are trying to make mr. Barr look bad, yeah. I think thats i dont want to paint with too broad a brush. Some of my Democrat Friends good faith they have red the report its done and ready to move on. Neil some of them cory booker and a host of others are saying barr should resign. How do you feel about that. I know. Thats patently absurd. Many of my democratic friends, not all but many of them are not in good faith. Could come out tomorrow in favor of children and prosperity and they would say he is wrong. This is the theory of the case now for some of my democratic friends. Trump covered up a crime that nobody committed. Now, thats but thats what they are down to. This thing is over. Its over. Its a 488 page report. They threw everything they had at the witness. 500 witnesses. 500 subpoenas. No, 3,000 subpoenas 500 search warrants. 20 lawyers. 25 million. I think its an insult to the members of the houses did the chairman think his house members are arent competent enough to rely on thretoquestion the attorney general they have to rely on staff . Neil are you surprised those in the region, the 100 or so generals and colonels who fled to places like colombia and were still, i could be wrong about the breakdown, that they are not responding more forcefully, that they are not doing more. Mightve had a key role preventing Nicolas Maduro from leaving the country in the first place. Is it a bigger worry for our country . Should they succeed keeping him in power and having an influence in that region to the degree that they would . Let me say i think some of the latin American Allies have been engaged in this process. Colombia has been absorbing the number of displaced people, as well as peru and other countries in the region are receiving the venezuelan people as they flee famine and shortages and the violence of the crisis in venezuela. But as far as external interference that you outlined, this is why this issue is so important to america. We cannot afford to have a failed state in our hemisphere, in our backyard. Failed states open themselves up for people who are adversaries of the United States neil its a tough tight rope to be on, i understand it.
