Charles, good afternoon, this is a 15minute vote so should wrap up quickly. The big question all day is would President Trump sign this deal. Mitch mcconnell cleared that up last hour. Ive just had an opportunity to speak with President Trump. I would say to all my colleagues, hes said he is prepared to sign the bill. He will also be issuing a National Emergency declaration at the same time. I indicated that im going to support the National Emergency declaration. That National Emergency declaration didnt go over well with Senate Democratic leader Chuck Schumer. Theres word that the president will declare a National Emergency. I hope he wont. That would be a very wrong thing to do. And leader pelosi and i will be responding to that in short order. This bill is more than 1,100 pages long. Lawmakers are saying theres plenty to like in it, plenty to dislike. Heres North Carolina senator tom tillis. I intend to support it today. Its not a vote that ill enjoy. Sometimes we have to do things here to make progress. To compromise. And to move on. We owe it to the American People to keep the government open. We owe it to Border Security to listen to recommendations to fund people, technology and infrastructure. This is a step in the right direction. Once the senate is done, it will get kicked over to the house. Nancy pelosi says they will have the votes and they can fight about the National Emergency another day. The president is doing an end run around that. We will review our options and be prepared to respond appropriately to it. I know republicans have some unease about it no matter what they say. Because if the president can declare an emergency on something that hes created as an emergency, an illusion that he wants to convey, just think of what a president with different values can present to the American People. To recap, the Senate Voting this area to prevent another partial shut down. Charles . What is your sense on a potential declaration of a National Emergency . What are you feeling there on the floor . Some lawmakers dont like it. As Speaker Pelosi said, its going around congress. If a president , whoever the president is, does this going around congress, Congress Loses some of its clout. Some people are uncomfortable with that. Republicans are uncomfortable with that thinking the next president could be a joe biden. One of 25 democrats running against President Trump. What if they say Climate Change or healthcare is a National Emergency . The president promising to declare a National Emergency. John roberts is at the white house with the very latest. John . A bit of a surprise that after this afternoon because the last thing weve been told by white house officials was that there was no read on which way the president was going on this bill. They were still sifting through the 1,159 pages. A lot in it they didnt like. Things like the fact that the National Butterfly center in texas just went of mccowan had the authority to say you cant build a wall on our property. Dhs was making preparations to do that. There is a provision to allow local officials in four texas border towns as well as one census area to veto the wall if they didnt want it in their area. So the president saw that there was no other choice here, particularly given the amount of money that was in the wall. He wanted 5. 7 billion and getting 3. 75 and he was going to declare a National Emergency. Sarah sanders said President Trump will sign the bill and as he stated before, he will take other executive action including a National Emergency to ensure we stop the National Security and the humanitarian crisis at the border. The president is delivering on his promise to build the wall, protect the border and secure our great country. The president does have support from several members of congress. You heard Mitch Mcconnell said hes behind it. Senator Lindsey Graham floated this exact idea more than a month ago. He said the president should take a couple of weeks to try to negotiate a deal. If he doesnt get what he wants, declare a National Emergency. Thats what happened. Jim jordan introducing a continuing resolution that would have allowed another week for more negotiations and said the president should declare an emergency. The white house knows full well that theyll end up in court on this and theyre prepared to fight this fight. Heres the way they could avoid a court fight at the beginning. The office of management and budget has identified more than 5. 7 billion that they could put to ward, move around and govern, put towards construction of a border wall. Each basket of money that they pull from affect that sort of increases the chances. The president was looking to get 2. 6 billion as say the million of january. So if you can get the 1. 375 to declare an emergency, get that bill or so that they think they can get without a legal challenge, hes most of the way to where he wanted to be for fiscal year 2019 and fight this fight in september. Well see how it goes. Probably be enjoined by the aclu in a San Francisco or Los Angeles Court in the ninth Circuit Court of appeals quickly. May be that the initial legal challenge the white house may win. So well have to see how this played out. Were just at the starting gate here, charles. Thanks, john. The question now of course is it a National Emergency and the way to go . Lets ask mark morgan, the former boarder chief under president obama. You think this is the the right move. Absolutely. Congress has failed to do their job. They have left the president with no option. He has to do this to safeguard the security of this country this bill with all due respect, this is not a step in the right direction. John mentioned a couple of the sections in this bill that actually goes backwards and in essence, i predict very little new barrier will be built because of this bill. Even if we went with the announced 55 miles, thats nowhere near what President Trump was asking for. The 5. 7 billion was a down payment on what many would say a 25 billion project. Now it looks like theres no other recourse with the National Emergency route. Everyone is saying, this could be a double edged sword. One hand it could be a legal nightmare. The other hand, it opens the door for future democratic president s to in their minds abuse the system. What would you say to that . Id say look what we have. I started to read the 1,600 pages of this bill. John alluded to it. Theres two section theres that talk about it. Section 231 and 232 a. That is where the 55 miles, the only 55 miles theyre giving. But they put so many limitations on that 55 miles like local governments have to agree and theres five areas where they cant build the wall, or put any funding whatsoever. That pretty much erases the 55 miles included. So were not going to get probably a single mile of wall there. This bill is absurd. The president has no choice but to declare a National Emergency. So according to the National Emergency act, this will have to adjudicate with programs or ultimately fund this wall, the idea of seizure of property, who could be harmed by this, who would have the right to sue. Of course, probably most importantly, which court would this be argued in. Yeah, so charles, just this week, i stood next to angel family for so many of them there. Representing over 4,000 angel families that are there that loved ones have been killed by illegal aliens. Right there alone to me is the National Emergency. Read the indictment of chapo that was just convicted in new york. That should lay out what the cartels do and the devastation in this country and the drugs pouring in and we can go on and on which the Political Party wants to disregard. One other thing to talk about this bill that is very important. Section 224. It actually creates a new level of amnesty. If you sponsor a child, this build tells ice, you cant do anything to a sponsor. You cant go after a sponsor, you cant go after the family of a sponsor of a child that gives them 100 amnesty. We know the majority of sponsors are held illegally. Its amnesty without calling it amnesty. I do want to remind the viewers, the senate is voting on this bill as we speak. Mark, you had this job. You held this position under president obama. Were you ever did any democrats come to you for counsels and for questions about this at all . No. Ever since i have broken my silence, i can not get anyone to talk to me. Trust me, charles, ive tried multiple times to get an audience. They refuse. Considering that two weeks ago the wall was immoral and now even to your point, even if its not going to happen, they publicly said 55 miles, then is it all politics that 55 miles couldnt have been more . Was it about a political victory for the Democratic Party with this . Look, this is not easy for me to say, charles, but yes. If you look at what is in the bill, again, the 55 miles and the limitations they put. Theyre going to result in zero being done. I can draw no other conclusion. That i rejected all of the experts, what they need to safeguard the southwest border. They rejected and say time and time again, its immoral and i believe effective. The data and facts reject that. The wall is part of a multilayer strategy and works and the facts are there. Theyre rejecting it. Its all identity politics 100 and this country is suffering because of that. Mark, who in the Democratic Party have you tried to reach out to . So ive tried to reach out to several different committees where i wanted to say, hey, look, im here. I want to talk to you on both sides of the aisle. Ive been met well, very representative on the republican side. Not the democratic side. Thats a fact. Mark, thank you. I appreciate it. Thanks so much. Going to chad pergram with more on all of this. Chad . Right now, the senate is taking this final vote on this appropriations bill. Keep in mind this is what we call a mini bus. Its not an omnibus. Where they glom together seven of the Appropriations Bills that were not finished. The seven is the department of Homeland Security. Looking at this vote right now, look at the screen, theres more than 80 yeses on this bill that is a big deal. What that mean is that was so much support for this between republicans and democrats the president was about to be abandoned by this. Mitch mcconnell did not put this piece of legislation on the floor until he got assurances from the president of the United States that he was in fact going to sign it. That was an issue in december. You might remember that Mitch Mcconnell felt he was burned when they put a bill on the floor to avoid a shut down for five or six weeks and the president said im not going to sign it. One of the other issues here, is what is going to be the cons constitutional issue in the president goes ahead and declares a National Emergency. Im going to look here at article 1, section 9 of the constitution. It says no money shall be drawn from the treasury with exceptions. You can program around and individuals can go around a spending bill and go in between spending bills and say were not going to get a blessing from congress but were going to move the money and but you have to get a signoff from the house and the senate. One wonders if democrats will go for that. Thats why this declaration of a National Emergency is so important. Heres the other key things to note. I asked nancy pelosi if the announcement about the president signing a ball would that affect the vote matrix in the house tonight. She said we have the votes. So its going to pass in the house of representatives. We dont think theyre going to be able to pass this alone with just democratic votes. They need republicans to come on board here. Democrats could lose 18 votes if everybody is voting on their side. So we expect a bipartisan vote in the house of representatives probably later tonight. Chad with the focus on the border wall, a lot of people overlook the size of this bill. Not senator sasse. We just got a release from his office. Hes a no vote on the 300 billion spending bill. He says its a monster. 300 billion, 1,100 pages, 270 million per page and no senator is pretending to have read the swamp thing. Any others expecting similar sentiments . Absolutely. I spoke with rand paul. The senator from kentucky. Said how long do you need to go through this . He said probably a couple weeks. I said will you try to hold this up . They just had the procedural vote. He said ill just vote no. Senator john kennedy, a republican from louisiana, he indicated he needed a day or so to go through and look for what he called nuggets in the bill. Everybody said okay, were just going to do this. Charles, the one thing to point out, in the next couple days, people are going to be mining and finding the nuggets that are hidden in this ball. That always happens. It is 1,100 pages. 1,100 pages across seven Appropriations Bills. They had already knocked out five of the spending bills for this fiscal year. So youre glomming together the seven. On the outside, that might seem like a big bill. If youre doing seven of them together, 1,100 pages is not that big. I just want to look off screen here to check where we are on this vote. We would think they would close this soon. Theyre up to 97 members voting. 81 to 16. We know that richard burr, the republican senator from North Carolina, he went to North Carolina for the funeral of the late congressman walter jones. So we might be waiting for one more person to vote. This will pass in the senate in the next five or ten minutes with an overwhelming vote hand should give the house of representatives enough air cover to pass this later tonight. If you can, stay there for us. The white house in the meantime says theyre very prepared for legal challenges. What could the fallout be from this . With me, robert wray. Everybody is guessing but the overarching theme is there could be legal challenges and drag it out for a long time what are the specific challenges . Depends who brings them, whether they have standing to challenge the legislation. I guess its a good thing that we now have a new attorney general. Because the Justice Department obviously will be principally responsible for defending the administrations actions in this regard. At least some progress has been made. Looks like well have legislation and pass both houses. The president is committed to signing it. Hes indicated he will declare a National Emergency. That is a delegation of authority from the congress. They passed, as you noted earlier, the National Emergencies acted in 1976. Theres no question that he can act in that area constitutionally. Theres arguments about whether or not hes done ed. For something to be a National Emergency. Thats not been tested before, has it . Theres no guidance as to what does or doesnt constitute a National Emergency. Again, as i was just about to suggest, im sure there will be opponents of this that will seek to challenge it on the basis that its a pretext to do a goaround, the absence of congressional specific authorization to build the wall. I think the president though has an area where he can act constitutionally. Hes able to move certain funds around. Some of which i think are not open to question as i was indicated by omb. Some would be more likely to be subject to challenge. Yes, there will be litigation. Thats not an unfamiliar place for this administration to be. Its not frankly a place that is unfamiliar to any administration. Whether the challenges have success or merit remains to be seen. The success is enjoin the president ial activity. I imagine that you will have plaintiff is with the backing of the Democratic Party and certain Interest GroupsFile Lawsuits in court and do judge shopping and Forum Shopping to get relief. Something like this with a National Emergency is declared, the court system will move quickly. While you suggested it might ordinarily take years, court are capable of acting quickly, too. We had a guest said aclu, goes to the ninth circuit and a favorable Friendly Court could get all the things done to slow it down and make it a legal nightmare. Maybe. You still have to have plaintiffs to challenge it. Its unclear who they would be until activity until they start expending funds and the president chooses to move around. You mentioned President Trumps constitutional abilities to do this. Could it be argued that hes serving congress keepers role of the purse . Congress has already passed legislation providing the power to the president for actual authorization to declare a National Emergency and certain things flow from that. So the argument that this is going around the appropriations power is an interesting one. Its sort of bumps up against the actual reality, which congresses that already legislated in this area. As the Supreme Court made clear in youngstown in the concurring opinion by justice jackson, when the president acts pursuant to expressed authorization from congress, this will be an example, hes at the height of his power, including fact that hes the commanderinchief. In this bill, i dont know if anyone has finished it yet, we had a guest on that made some good head way into it, he talked about certain provisions in there that a defactor would make it zero miles if you were to interpret this. For instance, the Butterfly Museum says you cant use our property. Wouldnt the legal same maybe they built in safe guards maybe the democrats built in safe guards for themselves to make this something that would have to be adjudicated or never work because of the way its framed . Maybe. You can imagine plaintiffs, which some would be subject to eminent dodo domain, that there would be legal challenges to this. We dont know how that will work out. You know, obviously in a situation in which the commanderinchief, the president of the United States, pursuant to his authority under the National Emergencies act declare as National Emergency and takes action, my guess is courts will bend in the direction of recognizing the president s authority and power to do this. Ive read where carter had two National Emergencies, Ronald Reagan had six, president clinton 17. W bush 12. President obama 13. Why all the hoopla . Why do you think because theres posturing going around and its politics. Theyre saying this is absolutely terrible that the president would declare a National Emergency. On the other hand, theres precedent for, this its pursuant to an act that Congress Passed in 1976 and previous president s have exercised their authority under it. What is the big deal . So what that means is that theres a wide overwhelming margin in the senate. That probably means there will be a wide margin in the house of representatives. Theres one point i want to talk about. If the president goes in, even though some lawmakers might support the wall, that will be a problem for them when they say wait a minute. Youre going to go in and raid peter the pay paul. Watch for those fights. Nancy pelosi kept her powder dry as to what the tactics might be by democrats. She talked about maybe we should declare a National Emergency on firearms. If the president is going to play ball this way and we think we can get a democratic elected in 2020, maybe we like this idea of National Emergencies. We want this agility. I think that declaring a National Emergency strengthens the president s hand when it comes to negotiating other deals. We do have the raise the debt ceiling. Everyone involved in this, for those trying to enter the country without going through the proper process and for those in america. We have to have legal challenges so we can show the American People whether the courts are growing to only side with democrats and democratic president s or the courts going to be fair. Theres definitely in the law this is an emergency on the border. The president has the powers to do it. If you take with president obama, even though im the person that wants to deal with the daca kids, i think they need to be dealt with, but president obama didnt have them Legal Authority to give them status. Thats still being fought over in the court. I think its a good idea. Were paying the price for an administration that went really awry over the last eight years before donald trump became president. Theres a lot of fallout over the 60 minutes interview coming up with Andrew Mccabe also promoting his new book, how the fbi protects america in the age of terror and trump. The most explosive thing so far, an admission of sorts of a potential coup against President Trump. What do you make of that . I had not heard the name of the book until you said it. Its interesting they talk about in an age of terror. What most a republican as agree with that, but the terror came from the fbi and department of justice that used a document, dirt, dug up by the Clinton Campaign to start an investigation. Including, if you have read it, he even talked about the steps he took to ensure the investigation would continue. We know from i looked at this the last two years. We know for a fact the fbi knew at the time of the appointment of the special counsel from the lead investigators that there was no there there. Meaning they had nothing on trump. They had no collusion. They never did. Why . Because it was propaganda from the russians given to the Clinton Campaign, picked up by our fbi. Its an embarrassment and they tried to attempt a coup and should have never been done. This needs to be righted. Its a long that needs to be righted. Its shocking. We have to sit down and pause for a moment. We get hit with so much news that we let things go. The idea that the fbi was doing a nose count so see how many members of the cabinet they needed eight would be okay with the 25th amendment to take away the presidency and overturn the vote of the American People because they thought he would pull the plug on a russian investigation. Its so farfetched and this is real life. This was happening. How is this happening in this country right now . Not only did it happen, but they cast a net so wide without any, any real evidence on anyone. The only evidence they had was this dossier that the Clinton Campaign paid for that came from russians. The irony in this, and i cant say it enough times, the very thing that they investigated trump which was supposed to get dirt from russians, thats what the Clinton Campaign did. So you know, i hope that the new a. G. Gets in there and he starts to clean house and shoe that we can start to put the department of justice and the fbi back together again. I want you to take a listen to the audience to what senator graham had to say earlier today. Were definitely going to speak to Andrew Mccabe and the whole crowd about what happened during the 2016 election. A lot of people believe that Andrew Mccabe should be facing justice himself. He was fired before his retirement more lack of candor, which is euphemism for lying what are your thoughts about bringing him back, digging him further and should he be facing legal challenges himself . All of them that were involved in the development of the fisa, the secret warrant that went after the trump campaign, everybody that was behind that should be held accountable. Whether it was a conspiracy or not, whether it was abuse of power, i dont know. They should be held accountable. The court, the fisa court, should hold them accountables will. The fisa court should step in. They could lose their law licenses or be charged with lying to the court or misleading the court. Those are the types of things that need to happen if were going to keep this process, this fisa process, which is designed to target terrorists, to target bad guys. The American People need to understand, that system that is supposed to target really bad terrorists and foreigners was used against a political campaign. Thats where this went wrong. Somebody has to fix it. Every day that goes by that its not fixed, theres fewer and fewer republicans that will support the continuation of thinks programs which are extremely important to protecting americans. Sir, when you have a joint statement that just came in on the possibility of President Trump declaring a National Emergency from Chuck Schumer and speaker nancy pelosi. I want to share it with you. Its a joint statement. Declaring a National Emergency would be a lawless act. A gross abuse of power of the presidency and a desperate attempt to say that the president broke his core promise to have mexico pay for his wall. Another demonstration of the president s naked contempt for the rule of law. This is not an emergency and the president is fear mongering does not make it one. He couldnt convince mexico, the American People or their elected representatives to pay for his expensive wall, so now hes trying an end run around congress in a desperate attempt to put taxpayers on the hook for it. Congress will defend or constitutional authorities. Your thoughts. For those people to talk about lawlessness after president obama set a record for executive orders and executive actions without any authority is hysterical. So they probably just ought to look in the mirror. Normally whatever they accuse you of doing, theyre doing themselves. Like i said earlier, this is an important step to take because this needs to get into the courts. We need to deal with all of the executive actions that have taken place over the last decades or so. Well, i made a lot of progress because i took a different path than Mainstream Media and the liberal politicians. I went and looked at the facts and what led up to february 14, we looked at it and we addressed the problems and we made a lot of changes at a federal level with the president and at a state level now with our new governor and our last for, rick scott. They certainly have have been very instrumental. What are the key changes that have been made that you feel should have been made a long time ago . One of the key changes that i worked on that meant so much to me is the obama era leniency policies brought to Broward County and snuck to parents throughout the whole country is leniency policies of not holding kids accountable for committing crimes throughout the school year. My daughter was subjected to a kid that wore swastikas to school, brought a dead animal to school, bullets to school and never being arrested. Other addressed now. Were looking into diversion programs. The president ended the obama era leniency policy. Every kid will have a safer environment throughout the school. Also, what we looked on was arming the right personnel in schools through their research, through the Marjory Stoneman douglas commission, they came to the conclusion that armed personnel in schools would make a big difference. So now in florida we have one armed guards for 1,000 students. Many are following our foot steps. Usually a mass shooting takes four minutes. Average Response Time is seven. We need people to act then and there at a situation if we want our kids safe. Thats something that we worked on in florida and more mental healthcare. What about the role of the security dogs . Security dogs. Yeah, theyre awesome. People working with dogs, training them to go towards gun fire. Everything is habit being a deterre deterrent. It all adds up. If someone knows theyre going to a school that doesnt have a sign on it that says gunfree zone or a k9 on patrol, theyre not going to the school. Andrew, theres still pushback against perhaps arming certain teachers, teachers that may be qualified that is military, expolice officers, creating that element of the unknown element of deterring a person this is an easy target. Thats lot of push back on it. Where are you on this . They didnt have the daughter on the third floor shot nine times praying for someone to save them. Thats first. Thats what im going to tell them. When my daughter was waiting, if there would have been a teacher on that third floor, a janitor, a lunch lady that had been trained, they could have saved my daughter. I know how extensive the training is. Its about 150 hours of training. Theyre held to a higher accuracy. Gun retention. Theyre trained so extensive that it would be an asset for any school to have someone to go through that Guardian Program and be armed at a school. Im all for it. Any parent that says theyre against it, let them tell that to me if it was their daughter on the third floor waiting for someone to save them. Of course, a lot of your frustration aimed at the prior sheriff. Are you happy with the new sheriff so far . The new sheriff really hes not a political guy. He will put the communitys safety first. We had a sheriff before that politicized the whole department. So sheriff tony, hes going to bring law and order to Broward County. Hes going to train, hes highly trained in active shooter. Were looking forward to him enacting his policies and bringing and going towards danger and risking their lives for the public good, id imagine. Yeah, well, hes trained in active shooter drills. Hes going to bring that training to his deputies. And already throughout the community, the morale is coming back to the broward sheriffs office. And you are the state board of education. I understand theres a reappointment in the process for you . Yes. Im looking forward to helping Different School districts and bringing my knowledge of School Safety to other communities and making every environment safer for our kids and teachers. Like i said, the president didnt get much acknowledgement for putting together a commission of all of the secretaries with over 100 recommendations on School Safety. So it is getting done. What i urge parents have, get involved with their schools. See what type of programs. Go see what kind of safety is at the school, if they have single point of entries.
