Its been a busy day outside federal court and inside as well. As youve reported and as weve talked about on fox, Michael Cohen was ordered to be here by a judge because she wanted to know who hes clients were and how many of them he had. And last week when his attorneys were asked that question, they couldnt answer it. So she said Michael Cohen needs to be in court today. Here we go. Heres how it went down. Cohens attorney turned over two of the three names early this morning in writing. That would be President Trump and gop fund raiser elliot brody and a third that asked not to be named. The judge in court told cohens attorney that they could not keep it under wraps and forced their hand to reveal the name in court, which is sean hannity. The fox news host responded live on his radio show saying of his relationship with cohen, we have been friends a long time. I have sought legal advice from micha michael. Hes denying that he was cohens client, saying michael never represented me in any matter. I never retained him in the traditional lawyer sense. Now, the issue of who cohen plays into the way the court views Attorney Client privilege. The judge will use the list of names to determine whether or not the records seized should be protected by Attorney Client privilege. Theres been a lot of filings over this. Lawyers asked the judge if their teams could review the evidence been prosecutors do. Earlier this morning, cohen adjusted his request to ask for a third party or what is known as a special master to be appointed by the court to review the records seized. Mr. Trumps team still wants their own people to review the documents themselves. The woman cohen paid 130,000 to in 2016, the porn star, Stormy Daniels, is in fact here. She was chased by photographers on her way in. Our producer, who is in the courtroom, i asked her what it was like when she came in there. She said she didnt have any eye contact with cohen or any members of his legal team. Her attorney said shes here today to make sure all of the information regarding her dealings with cohen are made public and that she can view basically everything that is happening in court. Once again, the proceedings are still underway. Well let you know how the rest of the day goes once it is over. Neil . Neil thanks. Sean is still doing his radio show. He tweeted out a number of comments on this matter. Laura echoed the first one, there was no legal representation going on. Michael cohen has never represented me in any matter, i never retained him or paid any legal fees. When you heard that i assume these conversations were confidenti confidential. Earlier sean said its weird seeing my own name on my own network. He said i had no idea these media people like me so much and now they have to listen to the program. Maybe i should pay it off in the last minute of tv tonight. I think its pretty funny. Presumably he will address that on his show tonight. In the meantime, exploring this relationship he might or might not have and the extend with Michael Cohen with judge Andrew Napolitano. Andrew napolitano, you know the law. You know what is interesting or where you make a connection. Is there anything significant to the fact that the president and sean hannity share an attorney . I dont think so. It was surprising that seans name came out just because we know him and neil why did it come out . Well, one of the reasons it came out is because the government has argued in its briefs that Michael Cohen is not a lawyer in the practice additional sense that he only has one client, its the president of the United States and much of what he does is not legal work. If that is true, if they can demonstrate it as true, then none of these documents are privileged. Michael cohen says i do have two other clients but i cant tell you the name of one of them. The judge said i wont believe you. Okay. Ill tell you who it is. Its sean hannity. Im not so sure that sean was his client in light of the statement that you just read that sean gave. There was no bill, there was no fee, there was no Attorney Client relationship. He didnt do any legal work for him. So that leaves donald trump and this fellow in los angeles whose last name is brody. I forget his first name. Neil why when that comes to light and people are talking about it, why would that even be germane . Why would the judge push it to get it out there if all of this is about, you know, protecting confidentialities and cohens lawyer concerned that that was sort of blown out . She actually maybe not intentionally but incidentally helped cohen by forcing him to articulate the names of other people about whom there might be records in the evidence that were seized. That would defeat or help to defeat the governments argument that hes not a real lawyer. Hes using the Attorney Client privilege to mask his nonlegal work for the president. If he did serious work for this fellow in l. A. And if he did serious legal work for sean, which seems like he didnt in which sean said on the radio and which you read allowed but brody was a gop fund raiser. Sean could have a different relationship, not even being a lawyer per se but whom he bounced off ideas. Any time youre talking to a lawyer, how is that described . Hes your lawyer. Seek legal advice from you on any matter, are you then acting as my lawyer, friend, colleague . What . Im acting as your friend. If you see me in the hallway and say i got a parking ticket. Not a big team. Neil how many times have i tried that. I say heres what you need to do. The conversation is not privileged. In new york, in new jersey, our home state, in most states in the union, it must be reduced to writing and that commences the relationship. Not all communications are subject to the privilege. Only ones that are confidential. So if you say i got the parking ticket, but lets blame it on one of my kids, that is probably confidential. But the fact that you got the parking ticket, the fact that you have hired me, the fact that you want me to represent you is not protected by the privilege. Neil cant you say by that, judge, that this proves theres great risk to raiding someones home and getting stuff because a lot of stuff comes out i dont the original intent of those raiding the home and the offices . That assumes that the original intent was to find damning evidence about Michael Cohen. The original intent might have been the original intent was to embarrass, humiliate or dug up dirt about the president. Neil who has access to that stuff . A lot of stuff was taken. Obviously Michael Cohens lawyer was concerned this would end up in the prosecutors hands and they might leak it and say for example, the president s taxes. Anything would be open season, right . Two things. One is right now everything that the fbi seized is in an evidence vault. Neil who has access to that . Only the fbi. The federal prosecutors that dispatched to the fbi that got the search warrant. Do not have access to it until the judge rules. She may well rule that a privileged team, making air quotes here, thats the terminology in the rule, a privileged team can be with herself, a magistrate judge or some u. S. Attorneys notice involved in the case, but u. S. Attorneys nevertheless will go through this and decide what is privileged. The other thing we dont know is what evidence was presented to the federal judge that signed the search warrant such that that judge was persuaded that four raids had to happen at 5 30 a. M. Simultaneous to each other left to this evidence. That we dont know. We wont find out what that is unless and until and if Michael Cohen is indicted. Neil it seems odd to me, judge, if these are essentially, you know, shielded from prosecutors and in an fbi sealed off room somewhere, how do we know that other people arent getting their eyes on them . We assume that people that took an oath to uphold the rules are in fact upholding the rules. Neil we know the past the people are supposed to be fair to all parties in the past, particularly this case, have not been. Im hoping whatever the outcome here, is that the judge would assign this to an outside privileged team, a retired judge, a special master. Because i think there will be the perception that a federal prosecutor will decide what is privileged and whats not will err in a way to help their colleagues rather than to uphold the privilege. Neil but you dont draw a distinction between sean hannity talking to a Michael Cohen on either just bouncing ideas off as a friend versus legal advice . That in my opinion under the law is not privileged. What donald trump has said to Michael Cohen might not be privileged if it pertained to things other than traditional legal representation, which is what the government is arguing. Neil where is this going, judge . I think this is very troubling to donald trump. Bringing the attorneys into the case could be as troublesome for him as bob mueller. He can fire bob mueller. He cant fire this crowd downtown. Theyre Civil Service protected. They are the most aggressive prosecutors with the most successful track record in the country. Neil so the irony worrying about bob mueller, worrying about what is going on here because this seems to be going on its own path. Yes. Neil Florida Republican congressman matt gates is with us. Congressman, fastmoving developments here what do they tell you . They say theres a glaring hypocrisy unfolding and we have the department of justice participating in it. When Hillary Clinton was under investigation for crimes for destroying classified information for having classified information mishandled, her own lawyers and her own team got to selfcurate the documents they produce. When the shoe is on the other foot, you have President Trumps personal lawyer having to ask for the very fbi that is investigating the president to not be the entity that is curating those records. So were just in search of an equal standard that can be applied and defended not based on politics or who is in the cross hairs. Neil as far as i understand, congressman, the idea behind todays hearing is to try to quell all of the other information that might get out there or risk getting out there beyond the scope of the Mueller Investigation or what prosecutors were looking for. Now its gotten to include other clients, Michael Cohen had, god knows what else that can be revealed down the road. This seems to have gone afield from what it was intended to be. It certainly has. The fact that mr. Mueller referred to this to the Southern District of new york shows it has no nexus. Its still that may end up being embarrassed for the president or his lawyer. So this neil forget about embarrassing. Is this more problematic that basketball mueller, what hes getting or not getting that this side show of business relationships and what have you, we dont know as judge wood is trying to discern, is an even bigger deal . When i spoke to the president , it wears on him that as hes trying to do work around the world to promote freedom and inclusion and democracy, that here at home we have these tactics that look more like the second world and the third world than like a Justice System in the United States of america. I think we could be proud of our men and women in uniform that chose to protect this nation in interest of our National Security objectives. It sends a message not only to assad but to iran, to russia and to north korea. This president is committed to protecting our u. S. National security interests. Neil we draw the line at chemical weapons. If you die by conventional means as thousands have, that isnt going to promote ire as much as using chemical weapons, right . Thats correct. Using weapons of mass destruction like assad did against the citizens of douma the primary mission in syria is to defeat isis. Theres other aspects of our efforts to not only do just that but also to send signals to other adversaries, specifically to iran and putin and russia and north korea. So the United States will not allow an evil person like assad to use chemical weapons much less to harm other National Security interests. Not just the military capabilities we have, but we have other capabilities, economic, financial and diplomatic tools to use to not only stabilize the area but also make sure that u. S. National security interests are protected. Neil general, weve gotten mixed messages on how the administration plans to respond against russia itself or we might be holding off, believing that they might make us a better effort to rid syria of these weapons. Hard to tell. Your thoughts . Hard to tell. But again, putin made a comment or someone representing him about the global chaos that ensues. Hes been part of that chaos in syria and elsewhere. Again, i think i the only thing putin understands is power. So thats what the. And the National Security team demonstrated. That goes with, again, iran and kim jongun of north korea and so forth. Again, not only will the United States we will respond but we will respond with lethal and precise measures. Again, to go back to the top of our discussion, theres other options in our playbook. You know, the u. S. Is prepared and weve shown the will and weve shown the capability against assad using these atrocious weapons of mass destruction, the chemical weapons. What can be shared, what cant, what goes too far, who gets their eyes on them. I dont want to get into the weeds and details because we dont know the weeds and details. What we do know, this seems to run far afield from what was an investigation on the part of bob mueller and the potential russian collusion to business dealings and more. What is going on . Well, you know, its is far afield, neil. Who knows whats going on. Thats why the special special, special counsels, its a big risk having guys do this. They make a life history of it. And in the case of bob mueller, what does this have to do with his initial charge . The problem is that was, the initial charge was too broad. They havent been able to put fences around him. I dont think theres any desire on the part of this Deputy Attorney general to do that, which is really over the top, i believe. Neil and over the top and in the eyes of some of the trump folks, you know, now a multiprong fire that even if you were able to deal with mueller or whatever he has in store, you have now widened this out to business transactions, relationships, years before he became president and et cetera that could turn everything upsidedown. Well, lets hope this federal judge i know her. Shes an outstanding judge in the Southern District actually reins in what i think is a mob scene. The tactics what theyve been using, what they did to paul man for and drug his wife out of bed with the guns drawn and things like that. Over the top. Thats not the kind of stuff the fbi does. Thats what goes on in third world countries. You know, apparently the attorney cohen was passing papers with the different attorneys, different prosecutors. Everything was going fine. All of a sudden they ratcheted up 1,000 and conduct what is something that is very seldom. I cant remember anything like this happening. So i think theyre really out of control. Neil james, do you know how this procedure works . If you seize evidence or material from someones home and or office and theyre put in a locked room that only the fbi could have access to presumably and no prosecutors, but weve learned about leaks. A lot about leaks. Is it fair to say a lot of this stuff that was taken from Michael Cohen has already leaked into prosecutors hands . Neil, i mean youre right. Id like to say theres no chance of that happening. But just look at whats been going on here. Look at the leaks out of what we believe is bob muellers office. He says its not his leaks. But they seem to be very plentiful. Sure, what are the different prying eyes . What are they seeing . What notes have they made . What are they holding for some later date to spring some sort of a surprise on different people . Its not the right way to do this thing. Its not how we operate as a country. I think its way outside the bounds of the law and how Attorney Client privilege is withheld. Too many prying eyes on this. I hope the judge hammers them on it. Neil judge woods. Well see. Neil angela, the argument among a lot of democrats is we think the wind is at our backs. This blue wave is real and this is the stuff that will deliver for us. That and the argument that the tax cuts that the republicans brag about are rigged to the rich and crumbs for everybody else. It was once considered and isolated comment by nancy pelosi, corey booker in new jersey, of course, using the same tactic what do you make of that . I think that the democrats really kind of show what theyre working with when you have Keith Ellison saying we dont have the right to lose a darn election. But hes missing out on what a Representative Democracy is. Of course you, Keith Ellison and the democrats have a right to lose an election. This is how elections work. If we didnt have those, we wouldnt have the country the way that we know it is today. So i think, you know, what the democrats are saying now undercuts bipartisanship and working a cross the aisle. They say theyre desperate for trump and the republicans to work with them and then they say, oh, by the way, youre killing women and youre terrible and we think 1,000 for a working family is crumbs. That message doesnt resonate. The more democrats keep saying that, the less momentum theyre going to have going into the midterms this november. Neil charles, i dont know where all of this is going. What i do know is the president and a lot of republicans seem to think those tax cuts will be a good message, that people are seizing on the extra money they have, theyre spending it, its lifting the economy. Even more so in the months ahead. Do you buy that or is that a hail mary pass . No. Im buying it. I think the republicans should use a message posted on the white house message board by president obama. When they got the payroll taxes extended and they equated it to 40 a month and they had stories from all 50 states, stories of how 40 a week went so far as to improve peoples lives. Id say take the same message, borrow from president obama and put it on the white house message board now. 40 was great back then, i think its a lot more now and would be good today, too. Our number 1 concern was that the documents, the integrity of the documents be maintained during the process. Its clear from the order by judge wood that that is exactly what is going to happen. One thing i will say is this i said last friday and this weekend that Michael Cohen was radioactive and that anybody that was associated with him in the last 20 to 30 years should be very, very concerned. What we witnessed earlier in the hearing with the disclosure relating to sean hannity proves my point exactly. He is radioactive. The headline is that no decision was made today on what is going to be turned over to any team here. Of course, as weve reported all day long, Michael Cohens legal team along with President Trumps legal team has been asking to have some form of view of the documents that were seen. They want to check and see if theres Attorney Client privilege that is in jeopardy with all of this. The bottom line, judge wood has said shes going to let the government put everything together, make copies of the documents, the physical and electronic documents and give the documents to Michael Cohens team that will confer with trumps legal team so they can go over what was seized and they can come back to wort with their own numbers of how much of that information meaning how many pages, how many discs will be considered privileged information. The judge said they need some time, Everybody Needs time to go over all of this information so that they can make a more intelligent choice on exactly what can be viewed by these teams.
