The chief of police says he sees no further reason to hold on to. The theyve given their testimony. They could face theoretically three years in jail for filing a false Police Report, but he said thats not likely to happen. What he really wants is an apology to the city. One point he could not get away from and that is at one point during the event at the gas station, an offduty policeman, a Security Guard at the gas station, pointed a gun at the swimmers. So we have an incident of man with a badge, an offduty policeman in uniform, point ang gun at the swimmers thats correct receive money and the swimmers leave. Reporter we know the american swimmers left the party at 5 50 sunday morning because there is Surveillance Video to support that. They arrived at the gas station in a taxi about 15 minutes later, which is where we pick up that gas station Surveillance Video. You can see one of the swimmers runs into the bathroom. Theres no audio so we cant hear but this is where police say the swimmers vandalized the place, breaking a mirror, maybe cause ago damages and then you can see the employee and all four swimmers come out of the bathroom, followed by another gas station employee who kind of appears to be rushing them out the door. Right . You can see all the employees watching to see what head. Then hesitant a minute later the americans walk toward the gas pumps where the taxis are. You can see three of them go the wrong taxi and then the know its the wrong taxi. Then the get the their cab. The cab driver gets into the cab and and you seek the employees are coming over and watching and talking and that appears to be a Security Guard going up to the car and starts speaking to one of the swimmers. You can see him. He points at the guard and reaches inside the window but then right there after that, the video jumps ahead three minutes. From 6 09 to 6 12, showing the swimmers get out of the car. One appears to be holding either his wallet or phone. Police did say they offered to pay for the damage. You can also see one of the swimmers put his hands kind of on his chest like my hands are up. Remember the Security Guard does have gun. We just cant see it or see if its being pointed at them. Ryan lochte claims it what. For the last have iow we jump ahead two minutes to 6 14 and the imswerves one by one start sitting down, one of them putts his hands in the air. Police have now confirmed that a Security Guard did point a gun at that least one of the swimmers because they say one of the americans was upset. Now, after three of the swimmers sit down, man who is standing in front of them kind of walks away. Ryan lochte says that the whole thing he admitted he was intoxicated but he says those three minute wes told earlier, theyre important because thats when the Security Guard pointed a gun at hem. Thats what he told tmz. It is in those three minutes he says are very important. Whether or not the rest of his story corroborates what he said initially, police say it does not. The only thy thing they said accurate was they had been drinking and were intoxicated. All right, trace gallagher. Thank you. You first of all take issue with the judge who ordinary them taken off the plane and the seizure of the two swimmers passports. I dont like that. The judge went so far as toard a search and seizure warrant for the passports. This is probably the most overreaching example of Judicial Authority i have ever seen. None of those swimmers committed any crime. The judge actually cited in her reasoning why she did that is because she looked at the videotape of the swimmers returning to the Olympic Village after the robbery occurred, and im saying that the robbery did occur and she said they were too jocular and happy to have been victims of a crime. Hold on, staysy. Brazil has been embarrassed. The olympics took a black eye. There were discrepancies in the story of the swimmers, amongst them. I think is it not legitimate for a judge to say, we want to keep these swimmers here because we want the full story, so get them off the plane and bring them back and lets talk to. For an inconsistency to warrant police action, of holding a person or seizing a person, it has to be about a material fact and it has to be an intentional misleading thats legalistic. I think the situation thats been so confusing and so overhyped because of the situation going on in rio prior to the olympics. You had a situation where people were concerned about zika, concerned about crime. So its perhaps a circumstance where the police overreacted as a result of that sensitivity and perhaps the swimmers felt like they needed to get away given those circumstances. Christy, you are a lawyer. These were young men out on the town. They were drunk, Everybody Knows it. They did something stupid and then lied about it. I mean, do you think were overreacting to that . I think its the brazilian authorities. I think they are absolutely overreacting. I think coming from an american legal stand point, their american rights are being violate, which the brazilian authorities arent going to care about. The fact that there was no crime committed, yet theyre still being detained. Dont we have to consider the impact of the charges that the swimmers made about security in brazil . It was a huge impact on brazil, the olympics and rio, they got a real black eye from this. Shouldnt we take that into consideration . I think we should. I think there has been an overreaction. Rio has taken a lot of flak for the condition. I think when our star swimmers come out and Say Something like this, theyre going to get hot and bothered about this. But they should probably back off, because if there wasnt if there was no Police Report field, and thats the only thing that they could be charged for, filing a false Police Report.
