Bergdahl. More on the swap thats causing quite a stir. At this hour, theres confusion on the jihadi forums about the swap and whether the japanese hostage is alive. A wellknown isis linked twitter account has posted this image. The countdown clock there on the right with only seconds remaining, and on the left, a screen grab from a recent isis propaganda video that showcased the mass execution of Syrian Military officers. Jordans information minister says they will swap this woman, a failed suicide bomber who was part of a 2005 attack on three hotels that killed 60 people for the jordanian pilot who was captured on december 24th after his plane was shot down. But the jordanians want proof of life first. These street demonstrations show the considerable pressure the jordanian government is under to secure the pilots release. Today the administration is being pushed to explain an apparent double standard. How is jordans proposed swap for its pilot any different than the administrations decision to swap Bowe Bergdahl for five taliban prisoners at Guantanamo Bay . The president s bedrock commitment as commander in chief is to leave no man or woman behind. Thats the principle he was operating under. Isnt that what the jordanians are offering . The taliban is an armed insurgency. Isil is a terrorist group. So we dont make concessions to terrorist groups. But based on this paperwork back in 2002, the Treasury Department designated the taliban as a terrorist organization, so despite whatever label the white house wants to apply, it was a swap with terrorists. Theres really universal consensus among terrorism analysts that this incident with the japanese and also the jordanian pilot. This is really a way to intimidate other countries from joining the antiisis coalition. Neil . Thank you very much. Now to mike baker, who says the white house set a dangerous precedent with that bergdahl swap. A case of do as i say, not as i do . What do you make of this . Yeah, it is. Another example of the administration spinning this for all they can and getting lost in the semantics. Theyre saying you cant compare the potential swap here that jordan is attempting to do with the Bowe Bergdahl five Taliban Prisoner Exchange because that was essentially in the white houses words an issue to end of conflict. So because we were ending our conflict apparently with the taliban, that that was part of the deal and that theyre an armed insurgency as opposed to a terrorist group. Theyre getting lost in the words of this. Nobody in the rest of the world cares. Everybody believes, and, you know, perception is all that counts, that we swapped five taliban, including two very senior members, for Bowe Bergdahl. And so thats opened the door in a sense, because for all these years, weve had sort of a no concession policy. No ransoms, no swaps. The fact that weve done this with bergdahl has given us the inability to hold the stage and say look, we believe you cant do this. We dont have any leverage. And to your point, a lot of these countries have been agreeing to ransoms in the past anyway and swaps of their own. But this jordanian pilot, who would be part of the swap agreement, his father was speaking in jordan and saying that theres greater danger in not complying with the terrorists demands. This is from the pilots dad. From the head of the regime to everybody else that the safety of his son and the stability of jordan and the death means chaos in jordan. So the switch that you actually beget more trouble. What do you make of that . Part of this is the fact that jordans participation in the air Campaign Alliance against the Islamic State that weve been engaged in for the past few months is very unpopular at home. And so when youve already got the jordanian public against their participation in the alliance, and now with the capture of this 26yearold pilot, very emotional situation for them. They are facing growing protests to do something about it and underlying that is the desire to just get out of the alliance. So yes the Islamic State theyre not overly sophisticated, but theyre smart enough to know what theyre doing. As katherine pointed out this is part and parcel of their effort to try to dissuade others in the region to join in the fight. What do you make though, of the fact that this time and with for example switching to the japanese hostage, that theyre not asking for money, that is isis isnt asking for money, that its part of a swap thing. Is it that they feel they have the better shot exchanging than leveraging, or what . What do you think is going on . I think part of it is its not necessarily a very strict coordinated effort within iz Islamic State. Part of the problem any time youre dealing with kidnap and ransom is getting the hostile element. Whether its a terrorist organization, a cartel group, a criminal gang to stick to certain protocols. Theres steps that you walk through in a kidnap and ransom situation. Its very difficult when youre talking about unclear reporting lines, who you should even be negotiating with within theIslamic State. And so i suspect theres probably not a real strict command and control over how theyre going to orchestrate this. Look they didnt even say that they would be willing to release the jordanian pilot if the woman the iraqi woman being held by the jordanians is released. Initially they were saying we will spare the life and release the japanese journalist, but now youve got this mashing together that doesnt necessarily mean that if we release her, that were going to get both the japanese journalist and the jordanian pilot back. Thats very unclear. What is clear, the jordanian climt made no assurances. Thank you. Now to the other threat, and this one is from Mother Nature because in two hours high tide is coming to marshfield massachusetts, where some homes were knocked right off their foundations. To molly on how bad things could get. Reporter absolutely. Incredible storm really. Some record snowfalls. And while the sea looks calm and beautiful tonight it was really raging last night. You mentioned marshfield. Thats where the ocean came taking a chunk out of the sea wall. At least five to seven homes will be condemned. Millions of dollars worth of damage done. And for one resident tim mannix really an incredible night for him. The storm just reached right in and got him. Take a listen. The damage started happening around 4 00 a. M. Right at the high tide. A quarter past 4 00 the windows came in. I went to put a table in front ofof the next wow, pow it blew in and hit me in the face. So then i had to escape. Reporter utilities are working hard to get the power turned on by evening for most of the residents. Of course, not those that were so severely damaged. On the island of nantucket, there were still about 3000 people without power. At this hour utility is working to get the power on there. But the numbers without power have really dropped significantly. Over 30,000 during the height of the storm. Now were right around 5,000. So things are progressing at this point in time as the big digout is well under way. Thank you very much. Meanwhile, take a look at what happened at wall and broad. The federal reserve, every six weeks, releases a statement on the lay of the land, how they see things going. And everyone interpreted that to mean that because the fed seems to be optimistic about the pace of this recovery theyre still inclined to raise Interest Rates later this flvil is understanding when. But there were fears that maybe things are going too well. It is twisted logic, i grant you. But the last thing these guys want to see is Interest Rates starting to move up even if just a tiny bit and even if seven years after the fact many argue too late. Doesnt matter. These guys selling off by about 1995 points today. Good news, bad news. I told you these guys were nuts. Meanwhile, an illegal immigrant with a criminal past put back on the street. In fact, its overall revenue sales, if you will soaring about 49 in the latest quarter. When you look at adjusted earnings, the 52 cents a share that it made 54 cents i should say considerably better than wall street thought. This continues a theme that has been happening with the likes of apple and some of the names out with numbers that handily beat the street. That doesnt mean that all follows suit, but it tells you that all is good. Facebook nominally up in after hours trading. To arizona now where this illegal immigrant is finally behind bars, but not before he a allegedly killed a 21yearold store clerk for a pack of cigarettes. He was out on bond. Officials let him back on the street. And then this sheriff wants to know if the federal government is going to finally wake up. Sheriff, they said they were just following what was procedure prior to this prior to this incident and that because he had posted bond and there was nothing more damaging in his background, they did all the right things. You say what . They did all the wrong things. You know, neil, i did a survey for a whole year. I think i talked to you about it. Nobody will publicize it. But we had 4,500 people in jail, illegal aliens charged with many crimes. A lot of felonies. Turn them over to i. C. E. , 36 keep coming back. One guy 26 times. So either theyre allowing these guys to be put on the streets or theyre deporting them and they keep coming back. And this is another sad situation where a young person was gunned down over cigarettes. When i was looking at the case of this man he was awaiting deportation after being convicted of a felony. He was supposed to go to jail posted 10,000 bond. He took a plea deal for seconddegree murder and kidnapping charges. I guess that were ratcheted down. Wouldnt that alone, sheriff, even if youve been convicted of anything be enough for anything to be shipped back . Well first of all, he was convicted, turned over to i. C. E. , and he should be deported immediately. Whether they let him back out on bond what is the standard for that . I always thought if you were convicted of anything even a traffic offense, that was good enough to get you deported. This is a lot more extreme. The president has his own policies you know the 5 million that get out of jail free card. But this has been going on. Im very frustrated. I am suing the president and the Homeland Security guy director to try to do something about this problem. We took it to court in washington. The judge dumped it. Larry clayman and i, were going to the Supreme Court on this issue. Something has to be done. Now, in the case of this alleged attack was found loitering outside the store. He was picked up by cops i think about three weeks ago. So there was a concern that he was trouble even after getting sprung from jail. So does anyone in other words, you get to be a repeated worry. Who keeps track of that . First of all, i. C. E. We allow them to be in our jails since the federal government took away my authority. But theyre supposed to check everyone thats booked into the jail. If theyre here illegally, holes are plasd holds are placed. So thats very simple. After that you turn them over to i. C. E. And they should be deporting these people not letting them back out on the street. So they can do all the excuses. Theres a breakdown. Serious situation facing our country. And everybody can say oh everythings okay. No its not okay. I proved it during the past year with my statistics. Now, they present to me, sheriff, their statistics that say deportations have never been so high as they have been under this administration, and were on top of this unlike any prior administration. At what point did they start that clock, up until very recently or what . No, the last several years. I think they take credit for when these guys come across, dump them right back. They call that a deportation. Never did use those statistics. They come back from mexico. Does each incident count as a deportation in there . No they should be given they should go to jail, federal offense coming back again. Especially the second time. But weve got guys who keep coming into our jails 15, 20 times they keep coming back. That means theyre back on the streets, violating the law, coming back, charging many different types of violations of the law. So it seems like on a federal level, sheriff, versus what youre trying to do locally, right at the scene theres a preponderance to not throw these guys back. But is it the understanding youre getting from the i. C. E. Officials you talked to, or those who speak off the record to you that their hands are tied . What did they tell you . Well im sure theyre not happy, but from the president to the Homeland Security secretary, who happens to be in phoenix today. I wish hed give me a call but i guess since im suing him and the president , he doesnt want to talk to me. But its a big problem. We have to do something. Congress should do something about it finally and get this problem alleviated. The beef with you sheriff, as far as i understand it is that you take it to extremes. Youre too zealous in going after these guys. That youre racist. What are they saying about you . Well what do you mean extreme . Im doing my job. Im the elected sheriff of this county. And dont forget, you know that i spent all those years as a head of the federal Drug Enforcement in mexico city south america, texas, arizona. So im one guy that know where is the border is. Ive worked it for years and years, plus 22 years as sheriff. So i get frustrated sometimes. Im not against immigration, people coming into our country, neil. But do it right. You know, get something done about it. They want to increase their work permits, okay. But dont come into this country illegally and then also commit these serious crimes. You remember the two deputies that were killed in california . Yeah. That guy served time in my jail years ago. And he was deported twice and released two other times. So im not saying everybody here illegally are killing people, but if theyre here illegally they should be dealt with through the criminal system, not all this civil system that they throw out at you. And certainly if theyre charged, or god forbid any of the lesser crimes, that alone should just youre kicked out, youre kicked out. Well, you know i got all the statistics, how many times they come back, what their crimes are. Cant get anybody to listen to me. Media, or whatever. Which is very strange. In this day and age, its not too strange. It is weird, though. Sheriff, thank you very, very much. Thank you. Incredible. In the meantime, the president listening dropping his push to tax College Savings. On this, he listened. Now some young folks are urging, do not stop there, mr. President. Could something that small make an impact on something as big as your retirement . I dont think so. Well if you start putting that towards your retirement every week and let it grow over time, for twenty to thirty years that retirement challenge might not seem so big after all. Remember this big fire it was in maryland a few weeks ago, right after the christmas holiday. It killed six people grandparents and their four grandchildren. Authorities have finally gotten to the bottom of that. Investigators say it was indeed an electrical fire. As suspected at the time. It originated at a Christmas Tree prompting this big blaze. It reduced this mansion obviously to just tinder here. It killed six people. But again no foul play suspected. It was just all linked to a Christmas Tree and faulty wiring. Tragic. Very tragic. Meanwhile, if he wanted to tax it now he is taking it back, because president obama is scrapping his push to tax those popular 529 College Savings plans after a huge public outcry. Now a couple of Young Americans say its time for him to hear the outcry over our 18 trillion debt. They are Katrina Pearson and alexandra smith. Alexandra, you were a chair on the College RepublicanNational Committee and you say the president now is making a good start. This was a good idea to rescind this tax disallowance. You want to see more on the debt. Why . I am happy he is rescinding this. It would have been a terrible loss to those americans who have worked hard to save for their colleges and tuitions. But if you look at what his behavior has been like, its been almost a begrudging sort of retraction of this plan. Nancy pelosi had to fly all the way to saudi arabia with the president just to get him to come onboard with it. Not just for that reason, but she did push it. Do you think katrina, that he realized this was going anywhere fast, or this was just a oneoff and dont expect more . I think he realized that simply because the majority of these accounts have less than 25,000 in them which doesnt even cover one year of college. But its interesting because here we are today not as we were ten years ago or at a debt of 8 trillion to 10 trillion, were looking at doubling that. Not necessarily even a recession anymore, which means cutting and taxing could hurt the economy equally. So we have to get serious about the debt. This is just one piece of the problem. When you hear get serious about the debt, you must have heard the president say its not a big deal anymore. As a percentage of gdp, its small, deficits are coming down and you say what . Id say the millennials disagree with that. I think theres this perception that they think its like monopoly money. They dont. Young independent millennials believe that fixing the debt is a priority. When they know that is the fear among young people that theyre not going to get anything, theyre not going to get social security, not going to get medicare, or the benefits wont be as generous for them . What are they saying . I think its worse than that. Considering we look at the actions of russia and china, what if china decides to switch over from the dollar to the euro . What would that do to americas economy . I think one true way that a lot of young people want to see happen is auditing the federal reserve. The American People have a right to know wait a minute. Youre saying when you look at this, theyre worried about what the future is going to look like for them. Youre paying a bigger chunk of the bill. Theyre absolutely worried. This is the most heavily indebted generation in history. 1 trillion in student debt out there. All the president and Senate Democrats sort of have to propose on it. What do you think of the Free Community college that the president wants to do . I think its a misguided attempt by the president to up and downer to the generation that rejected him in the midterm elections. Our Community Colleges are affordable and accessible. What has government ever downright that we now want them to take over our Community Colleges in this way . Katrina, where is this going . I think that the discussion is going to move forward with the debt issue simply because we are looking at again, what are we going to do . We cant print money into oblivion. Its not working. And again, what if china decides to leave the dollar and go with the euro . Thats instant hardship on every american in this country. And the president is going to have to deal with this issue, particularly going into 2016 when tackling the debt is beginning to be a top priority on the republican side of the ticket. I dont know about that. I hope youre right. But ive been hearing a lot of republicans talking about it. Well see. Thank you both very much. Thank you. Take a look. Ill apologize to the veterans. I havent seen the movie and i think it was wrong. I make no apologies to all the thousands of right wing nut jobs who have been twittering me with nasty language but i do apologize to the veterans. We owe them a lot and i think this movie is much more nuanced than i thought. I think thats an apology. I dont know whether this guy agrees. Nick irving says people like howard dean are just out of touch. Im just thinking before american sniper, you were the guy. You had a book prior to all this. You touched on the same issues. But now these guys, the Michael Moores are saying its guys like you who glorify savagery. What do you say . I dont glorify i dont think any of us glorify killing a man. Theres nothing you can glorify about that. But if i do kill somebody to save a childs life or my brothers life, thats preventing my best friends mom from getting that 3 00 a. M. Phone call saying that your son wont be home. I have no problem doing that. Do you think the critics guys like you say you embolden this type of american targeting. Movies like this. Books like yours. Books like american sniper. Get out there and reach the muslim world. What do you say to that . When it reaches the muslim world, i dont really care what they think. I didnt care about what the muslim world thought about me when i was over there. I dont care what they think now. Im here to tell the story to the American People of the sacrifices that guys like me and benjamin cot make every day. He paid the ultimate sacrifice at 21. Do you as a sniper keep count . I personally did keep count because i think it was more of a it was an intimate very intimate at the time. And i went through a lot and i saw a lot of things. Prior to that, i never kept count. But being the fact that it was me against the target you know, type of situation, i felt that i would keep count. And people forget, prior to the hoopla over this book and certainly this movie you were dealing with the same thing. I mean a woman or a child with a grenade, something else, and you had to make a gut call. Typically for me, it would be overwatching the rangers on the ground. If at any point in time, i saw a target pop up and shoot at us it was my job to eliminate that threat so we can continue on and capture or kill who we have to kill. But it does lead to all sorts of problems right . Post Traumatic Stress syndrome. Did you deal with that . Definitely. When i first got out and stopped my private military contracting, i became a im not ashamed to admit. A raging alcoholic. From 6 00 a. M. To 4 00 a. M. It was beer and jack daniels for that entire amount of time. Didnt have water. It was getting really bad, and i had a dream of santiago the father figure of sniper section. In that dream, he told me to stop drinking. Really slowed down from the chop. I was slipping into that state where the 22 veterans a day kill themselves every single day. What was gnawing at you . The guy i couldnt save benjamin cop. Not the lives that i took or people i shot. It was benjamin cop. I wish i could have saved him. He saved my life. You saved quite a few lives, sergeant. Yeah. Im thinking of what people said what howard dean said about the people who have seen this movie. Essentially hes saying theyre all nut cases. I disagree. I think that thats just the disconnect that some of the politicians have in this country with the veteran community and guys like us. I dont think the American People are crazy. I think theyre showing support, and a support that guys need like us. Were not asking for us but its something that i think the veteran community does need. You know, everyone made a big deal about american sniper and how violent snipers are. Losing sight of the fact that the guys you were targeting are a lot more violent. Does that ever reconcile itself to you . Its very confusing, how someone can were savages and murderers, but the guy im taking out you know kills kids and chops their head off. So i dont see how im a crazy person. Do you think that we appreciate the magnitude of that and how dangerous these guys are . Whether its isis or now were talking about negotiating with them and swapping prisoners and all of that. How bad is it . I think its pretty bad. I would never suggest trading a bergdahl i dont want to say his name. But for five known terrorists. Those guys are savages. And if people were to see what guys like the ranger battalion and navy seals and the regular guys on the ground, what they see. People would start to realize you know, how big the situation is. These guys are crazy, savages. Do you think theres this problem we have, islamic extremists. Why do you think were having such difficulty saying those words . I think it started somewhere up top. In d. C. We cant take that name islamic out of it. They want it to be called the Islamic State. Let it be that. The second we stop trying to understand our enemy is where we screw up. We have to understand our enemy, and isis or the Islamic State. Thats their name. Let it be that. Sergeant, Michael Flynn was speaking recently about sweeping changes in our attitude against terrorists, saying right now that we have got to treat this like we do, a cold war. A multidecadelong attack on these guys, because its going to take that long to deal with it. Do we have the will for that . Do you agree with that . I dont think it would take that long. The rules of engagement when i was first overseas in iraq were different. And it slowly started to change over a short period of time. If you put a team of my guys in an area where theres known terrorists, give us a day, give us two days and that problem is now gone. But the second we stop, you know supporting the troops and we start tying their hands behind their back and you cant shoot this guy until youre shot at, you know i dont believe in that. We have to what about the cockroach theory, sergeant, that you shoot one, you kill one, five more come out. I do believe in that but i also think that over the course of time a man can only watch his best friend die so many times. If i shoot that guy and another one rises up ill shoot him, too. Eventually, three or four more. I dont think that guys going to want that responsibility of dying. Michael moore says he has saved more soldiers, looked out for soldiers by his opposition to the iraq war. What do you think of him . What do you think of that . I disagree 100 . If that were the case, i wouldnt wear these bracelets and have the tattoos that i have. If he truly did save american lives overseas. I didnt see him over there. I can name quite a few people i consider brothers and family who died. So he didnt save anybody in my book. The attacks that hes had. At first he said they were not about the movie american sniper, then they were about the movie american sniper. Seth rogen came in, dialed it back. What do you think . They dont deserve the air comes out of my body at this point. I think right now theyre desperate because their career is looking really sad right now so theyre looking a hot topic and a very sensitive topic in order to stay in the limelight. Thats what i believe. Do you think this country has the will to carry on this fight . It could take a why. It could cost a lot. I dont think at this point we do have the will as an american whole. I think we lost way too many children over there. But in that same light i signed up for this job. We know what were getting into. The guys who volunteer for this know what were getting into. Let us do our job. Do you think we pulled out too soon . I do. I think the rules of engagement changed way too soon. We should have been allowed to do our job. How do you feel about minorities in particular who feel that they specifically have gotten nothing out of this, and that its disproportionate with the minorities who have been caught up in the war, injured and war dead. Disagree. I was the only africanamerican guy in my entire platoon of 40 50 men. And i watched a lot of my brothers die who were not, you know, africanamerican. So when you hear many on the left say that, what goes through your mind . Im really color blind, so i dont really i dont see color. I think theyre trying to pull race into it. I dont look at people and say oh, youre white youre black, youre this or that. I really am color blind. I dont pay too much mind about that. How are you doing now . Doing pretty good. I have two german shepherds that pretty much take care of me and i take care of them. I had a german shepherd. You dont mess with them. They keep me very well protected at night and keep my days busy. All right, Sergeant Nick irving, thank you for your service. Thank you for having me on. Such a gutsy guy. The reaper, before american sniper, this was the statement. And one good thing if anything good can come of all this is people are reappreciating the sergeant and allor this country. More after this. You know, just because your bladder is changing, it doesnt mean you have to. With tena, let yourself go. Be the one with the crazy laugh. And keep being their favorite playmate. With. Be you. Hi, tom. Hey, hows the College Visit . You remembered. Its good. Does it make the short list . You remembered that too. Yea, im afraid so. Knowing our clients personally is what we do. Its okay. This is what weve been planning for. Thanks, bye. And with over 13,000 Financial Advisors we do it a lot. Its why edward jones is the big company that doesnt act that way. Immigration agents under orders to ask illegals why they think they should stay in this country. Now, thats like asking me why i shouldnt be allowed to jump to the front of the buffet line. Its happening. David vitter wants to know why its happening. Senator, good to have you. Thank you, neil. Why is that going on . Because we have this crazy policy of this president changing the law unilaterally. I think going well beyond his legal constitutional authority. And this has got to stop. This is a serious issue. Its bad immigration policy, but more importantly, its shredding our constitution. You were at Loretta Lynchs hearing today for attorney general, correct . Correct. And she brought up over the legality of the president S Immigration actions. I think im quoting correctly here. I dont see any reason to doubt the reasonableness of those views. What do you think about that . I delved into that and i thought her answers to my more specific questions were really inadequate. I pulled the primary Statutory Authority on which theyre basing all this, which says youve got to look at in terms of granting someone parole in other words, a sort of status for three years at a time staying in the country. The attorney general does that on a case by case basis. I said is it really a case by case basis when you make this pronouncement about five Million People . She never answered that question directly. She talked all the way around it. I think youre talking about a class of five Million People, thats not case by case. That doesnt pass the smell test. Switching gears, what did you think of her answer on enemy combatants . You asked under no circumstance should enemy combatants receive the protection of our constitutional federal court but Loretta Lynch seemed to disagree with that notion as part of the theme to shut down gitmo. Whats your worry there . My worry is this is a huge fundamental shift from all of previous American History when were at war. Thats my worry about the policy of the obama administration, and shes obviously carrying the water for that already, even though shes not confirmed yet. It does seem that she supports essentially what the present attorney general supports, that she would support and continue deportation program, executive order program. So would you support her . Would you reject her . I said weeks ago im going to oppose her nomination based primarily on president obamas illegal executive amnesty and the fact that shes trying to justify it. But let me give you another quick gem from the hearing. Senator sessions asked her if illegal aliens in the country and american citizens have the same right to work in the country, or do american citizens have a greater right. She basically said everybody should have equal right and she wants everybody to work. I mean, thats crazy. Its shocking. And certainly has no basis. She said that everybody including those who are not even legally here. Correct. Her answer suggested illegal aliens american citizens, same standing in terms of a right to and ability to work in this country. The understanding is your opposition notwithstanding that she will get confirmed. What do you think . Thats probably a good prediction. Obviously i hope not for all of these reasons. And we havent voted yet. So i think we have a long way to go. But as it stands now i certainly agree thats the conventional wisdom. Senator, thank you again for seeing us. Thank you, neil. David vitter. Imagine a teacher thrown to the ground by his own student. Now, the video you see after the break doesnt shock you, the reason it happened will. Right . Wrong. Because youre not you youre a Cancer Hospital and your daughter. Shes a team of leading researchers. And that brilliant idea is a breakthrough in patient treatment that could save thousands of lives. Which means you need a diverse team of advisors helping you. From Research Data analytics all the way to transformation of clinical care. So you call pwc. The right people to get the extraordinary done. Somebody help us [ bleep ]. A teacher was thrown to the ground by a ninth Grade Student all because he took the kids cell phone. That student has since been charged with assault but it got us thinking it happens sometimes. An Attorney Says it really doesnt go far enough and she is we need tougher laws protecting our children. Mercedes disagrees saying that laws are already in place. Well obviously something slipped. Something slipped because they havent done anything with this child. Hes already been charged criminally. Now its the turn for the prosecutor to step forward. Were going to charge him as an adult. The laws are on the books to protect society. Weve got the criminal statutes. We have the disciplinary regulations at the school. Hes going probably to be expelled. So there are things already in place. Legislators dont have to step in. What more do you want to see . A lot more. First i dont think theyll be able to charge him as an adult. It has to be an aggravated felony to charge him as an adult. He looked pretty aggravated there. He did look aggravate. And the fact that a student could actually carry out this behavior, i think what the legislatures need to do is enact aggravated assault where any type of assault on a teacher just like on a police officer, on a bus driver, train operator becomes an aggravated crime with higher penalties. But there are rules in effect. The principal, when he was asked about this in patterson, new jersey, the principal said the students are allowed to cell phones but they will be taken and returned at the end of the day if theyre used for other reasons. He took this from another student who had it. First of all, such volatile behavior should not happen anywhere. But an increase in security. Wheres the security . You hear the teacher screaming for security. Its nowhere to be found. What i like is the kid taking video of this and not helping the guy out. How ridiculous. Doesnt that say a lot about society . But where does it go though . Stacy, if we had laws on the books right now to deal with this sort of thing, we should stress that these are exceptions. Because theyre exceptions. Right. Why make blanket new layer rules to address something thats already on the books . Because assaulting a teacher should never come into a students mind. Its a sacred a job. He had to know but any time look, someone commits a crime, they all know. Theres an impulsive reaction. What would another layer of rules and regulations do . Because then every student across the country knows that if you lay one finger on your teacher, youre going to be charged with a crime. Everyone should know that. Its not going to stop anything. Every student knows i cant beat the face in of my teachers. They know that. But why is it happening . Youve got to go back and see whats happening in that childs life, go back and see the relationship that teacher had with those students go back and see the security. Theres so many layers. Get another law on the book thats not going to do it. I dont think social working all these issues in schools with kids who are allegedly assaulting teachers speaking of the parents, the cessation of the devices. But thats a whole another issue.
