National security correspondent, jennifer griffin, live for us from the pentagon with all the details. Hi, jennifer. Reporter hi, gretchen. A senior u. S. Official with close knowledge of the secretarys decision to tender his resignation this morning tells us, make no mistake, secretary hagel was fired. Last month, chuck came to me to discuss the final quarter of my presidency and determine that having guided the department through this transition, it was an appropriate time for him to complete his service. Reporter senator john mccain said hagel visited him on capitol hill recently and expressed frustration with the white house, which former defense secretaries have accused of micromanaging the pentagon. A senior u. S. Official said the white house had been planning hagels exit for weeks. I believe we have set not only this department, the department of defense, but the nation on a stronger course toward security, stability and prosperity. If i didnt believe that, i would not have done this job. Reporter there were the reports that began in october about hagel being disengaged in nfc meetings, not speaking up. Then just two days after the midterm elections, there was a column by Longtime National security columnist, david ignatius, suggesting that hagel be fired. Thats when hagel reached out to the president , members of his staff suggest he met three times with the president since october to discuss whether it was time for him to move on. He was asked just last week in an interview with charlie rose about the rumors. Then there are these stories that the president wants to change his National Security team. Is that true . Well, youd have to ask the president. But do you concern yourself with it . No. First of all, i serve at the pleasure of the president. I dont get up in the morning worried about my job. Reporter there had been concern at the white house that hagel was not up to the task since he fumbled his confirmation hearings in january of 2013. He will remain on the job until a replacement is announce and confirmed by congress. Gretchen . Jennifer, thank you so much. More on the political impact of secretary of defense chuck hagels resignation, time to bring in chris stirewalt, fox news digital politics editor. All right. What is the real story going on here, chris . You mean you dont think that its just exactly as transparent as that press conference . No, not necessarily, no. Look,s here the deal. The president , whether he wants to admit it or not just suffered a really debilitating midterm reversal. An historic reversal for his party. So, democrats are really focused on now whats the way forward. And i think, given the am of pressure that the pentagon, under secretary hagel, applied to the administration to get tougher on isis, to get tougher on iraq and syria and pushing back against the no bats on the ground approach that we constantly heard from the white house, i would say that was a point of friction that the president s Political Base didnt exactly appreciate and when the president looked back, remember, the twothirds of the people who didnt vote, the unifying thing, whether its on immigration or this, from this administration, from this president , seems to be got to do more to please the liberal base to try to get those folks back behind his agenda and not have people like chuck hagel or other mildly hawkish individuals around. Wow. Okay. Very interesting. Another controversial topic that had a lot to do with the midterm, there after, new development in the president s executive action on immigration and concerns the white houses assertion that the president s agos are roughly equivalent to a step president george h. W. Bush took in 1990 when it claimed he shielded 1. 5 million Illegal Immigrants but turns out, chris, thats not true, is it . Nope. Four pinocchios today from the Washington Post for a claim that has been a center piece of all of the arguments coming from the president and the administration about this executive action for a temporary amnesty saying, well, as a percentage of those in the country illegally, this is just normal and its like what george h. W. Bush did. Remember, what george h. W. Bush was they passed an amnesty under Ronald Reagan and they were they were filling in some gaps that the legislation hadnt covered. So the president said im doing just what hes doing, im doing what george h. W. Bush did, this is not controversial. In fact, it was controversial and thats been part of an overall bad rollout for this executive action that, fen, outside of the president , the base of the president s base, here talking maybe 20 of the country, this has not played very well. Okay. Now, there was another thing that the president said on this week on abc yesterday. And he was asked very direct lit question about whether or not his executive action on immigration, you know, the next president coming down the line, if he or she might do something similar with, say, changing tax law. Listen to this. Mmhmm. Well, the truth of the matter is, george, that the reason that we have to do prosecutorial discretion in immigration is that we know that we are not even close to being able to deal with the folks who have been here a long time. You dont think legitimate for a future president to make that argument . With respect to taxes . Absolutely not. What do you make of that . I make of it that if president willard m. Romney were decreeing that certain individuals, because of prosecutorial discretion, that the irs wouldnt be prosecuting certain kinds of or collecting certain kinds of taxes from certain individual, i think that washington would be pretty well up in arms and rightfully some the reality here and what washingtons really concerned about is not this executive action, its into the new precedent that it sets for the way the president conducts himself and what that brings in the future. Not. Doubt about any of that. Chris stirewalt, lots of topics to throw at you today, thanks for the analysis. You bet. Now that president obama is lacking for a new leader at the pentagon, what kind of leadership is actually needed . Retired u. S. Marine Staff SergeantJohnny Joey Jones is executive director of boot campaign. Com. He fought and sacrificed for this great nation. And we thank you for your to see you in person. Great to be here. Welcome to the real story. Thank you. What kind of lerd do we need . You have been there, you have fought. What do we need . I think the most important thing that the troops on the ground need right now is someone that says we have your back, if we send one of you or a thousand of you, send enough with you to bring you home safely and i think thats question right now a lot of people are asking, especially those still in afghanistan. And especially here at home with the downsize of the military. The culture right now is the marine corps is not a happy place. What they mean by that is if youre a sergeant is it cheaper to get rid of you and bring in ae 1s, eight privates . That is kind of mentality they are using to crunch numbers and i dont know that troops understand why that is and they take it as, well, youre not worth the money anymore. And there have been several secretaries of defense in the last couple of years. What kind of message did that send to troops on the ground . Well, it just says, you know, that wasnt successful today so we are going to try Something Different tomorrow. Which leads to you think what thought did you put into what you decided to do today . We come back, when we go to afghanistan or iraq, people think we are coming in guns ablazing, cross the country or the world thats what people think. That 22yearold sergeant in afghanistan right now knows how to talk to a local, what to say, their language, when to sit, how to sit, they are diplomats to begin with. And we want our secretary of defense to understand that counterinsurgency that psychological warfare, and to put something in place that sends the right posture and advice the president to not say we are going to go to war when its convenient, or we are gonna attack with whatever means are least dangerous to our own well being. Thats interesting. Because some folks are saying hagel was let again for those very reasons because he didnt agree with the president s strategy. Meantime, another prisoner released over this weekend from gitmo, seventh in two weeks much the former al qaeda terrorist is now in saudi arabia taking part in a militant rehab program, whatever that is. The string of releases sparking heated protests from the chair of the House Armed Services committee. A congressman saying if just one u. S. Soldier loses their life over these transfers, we will have failed. What the Obama Administration is doing is dangerous and, frankly, reckless. They have chosen many tames to put politics above National Security. Its time they stop playing with fire and start doing whats right. Until we can assure the terrorics stay off the battlefield, they must stay behind bars. Do you agree with chairman mckeon . I think he has a very valid point. For me, the issue, even before you get there, will these men go back and fight us more and it comes down to the president s one man. The administration is one group of people. When do they have time to put lawyers together to find out if we can release people from Guantanamo Bay when we have got isis over here . You want to talk about rehab . What about the veteran in oklahoma whos addicted to painkillers cause the va throws him that . Great point. We are roar ied about rehabilitating someone to have known killed, tried kill or have killing. No ones there because they accidentally were in the wrong place at the wrong time. They are not getting due process because war doesnt allow for proper evidence transfer. All of the studies show that a huge proportion of them go back to becoming al qaeda fighters. Exactly. Joey jones, great to see you in person. All the best. Thank you. Time for my take with the firing of secretary of defense chuck hagel, all right Foreign Policy become Crystal Clear in the administration is claiming that the two men, obama and hagel mutually agreed it was time for the only republican in owe bam ins cabinet to step down but it coit be the president didnt want to hear the growing calls and concerns that his Foreign Policy decisions were being second guessed . Especially when it comes to isis. Does the move of dumping hagel now mean the president will rely even more on the white house insiders, who by many accounts, have given him bad advice on other issues, or does hagels ouster show that the president will now seek to take more control over his weak Foreign Policy . Remember, president obama said he wanted to degrade and ultimately devoy isis. With more calls for boots on the ground to be able to actually do that, will he put in place someone who tells him what he wants to hear or someone who will actually get the job done . Coming up on the real story today, developments from a potential grand jury decision in ferguson. There you have it the protests already ramping up ahead of the highly anticipated ruling, as we are getting word that promises of transparency may not be kept. Plus, flood watches and warnings now in effect for parts of upstate new york. All that snow, guess what happens when the degrees are high. It melts. Thats not the only concern as people dig out from last weeks record breaking storm. And a suspected drunken driver brought to justice thanks to some bold bystanders and its all caught on cam. What made you say im not letting this guy get away . Well, you know, it was just, you know, people got to man up to their mistakes. Right here, jumping on his back and tackling him. Avo new delicious ensure active heart Health Supports your heart and body, so you stay active and strong. Ensure. Take life in. Witnesses chase a suspected drunken driver after they say he crashed into several cars. Bystanders capturing that suspect, holding him on the ground before police arrive. And he can be heard saying he is going through a tough time. Well, that after a chase on foot after the crash outside a phoenix area bar. One of the men falling on the ground almost being hit by another car during that chase. The suspect taken into custody. No injuries reported during this whole ordeal. Time for some real talk now, because tennings rising fast in ferguson, missouri, as we await a grand jury decision on whether Police OfficerDarren Wilson will be charged in the Fatal Shooting of michael brown. The protests growing overnight ahead of that decision and now getting word evidence in the case may not be released to the public if the officer is not charged. The prosecutor had claimed for months that those grand jury documents would be unsealed but now, the court says no decision has been made on that. Joining me now, a civil rights attorney along with Charlie Brennan, host of the Charlie Brennan show on kmox st. Louis. Charlie, let me start with you, because you are on the ground there. Whats the latest . Well, i think the latest is some sources are reporting that the grand jury has reached a decision and there could be press conferences by both the Governors Office as well as the county Prosecutors Office some time later this afternoon or possibly early this evening, maybe 7 00 or so. Yesterday, there was a big bombshell announcement by the courts, one administrator said that even though the county prosecutor for at least two months indicated that all the evidence the grand jury has been privy to, like the reports and the testimony would be made public as soon as the grand jury makes its decision, that is they dont vote to indict, turns out the court said, wait a moment, we may not be releasing that information just yet. Very interesting. Paul, civil rights attorney, why . Whats going on here . I understand why they might say they want to do it because people dont trust the proceeding. Why thats the case, im not quite sure, other than their biases. The fact is historically, grand jury proceedings have been secret and not the prosecutors a all. The judge has to agree to it. He has to be provided good cause to do this and quite frankly, i dont see it under these circumstances, other than the fact its a controversial case, theres a lot of controversial case. The interesting thing is we would hear all the evidence in this case if theres an indictment because then, of course, it would go to trial. All the witnesses and all the testimony and whatever was presented in terms of documents, autopsy reports, balance listishes would all be presented at the trial. The reason for keeping these proceedings secret is important. The witnesses know that they can testify truthfully. Sometimes in these controversial cases, theres some fear as to some backlash, one way or the other. Also, the officer himself what about his right it is he is not charged . Why should all this information and material be let out . What is the feel october ground there, chargerly . You just heard the attorney, for 200 years, the system has worked where we havent rae leased in most cases, almost all, grand jury testimony if theres no indictment. Whats the feeling there in ferguson . Well, you know, that is true, but in a lot of grand jury situations, nobody knows when whos being investigate, but this is so public right now with Darren Wilson at the center of this and i think a lot of people would like to see the justification of the grand jury if the grand jury decides not to indict Darren Wilson. What was the evidence that led that group of people to make that decision . People complaining the whole process is not transparent enough. I cant imagine whats gonna happen if theres no evidence presented to the public because that vacuum will be filled with speculation and rumor and innuendo and thiss going to be a disaster. Another great point from somebody right there i guess the witnesses, real quickly, paul, they do come forward and tell their story after the fact, right . They could, under the circumstances. I dont know if they will. The judicial system should not be held hostage for those who will protest if they dont get what they want. Charlie, paul, waiting for that whole decision, probably going to come down today. Thanks much for your time. Well, much milder weather for buffalo, new york. Thats change. Many people there forced to spend this warm fall day preparing for potential evacuations, because all that melting snow posing a serious risk now for mass flooding and roof collapses, like this one. Its a case of weather whiplash for folks in the buffalo area as a wild shift is now going to spark flooding fears after the human storm last week dumped some seven feet of snow on parts of the area. Rick leventhal has been dispatched up there, live from south i guess it was a good thing that you got to spend this week rather than last week, right, rick . Reporter yeah, one would think, although the weather is taking another turn for the worse here, gretchen and things have changed pretty dramatically, in just the last 20 minutes or so. Cass november ya creek was up to the bottom spores on the stevenson bridge here. There was an ice jam, there was a lot of snow and ice and ah, well, we just lost rick, i think i jinxed him by saying he should have gone up there last week. Whether or not the ferguson, missouri, Police Officer, will be charged in the shooting death of unarmed teen, michael brown, last august. We saw protests ramping up ahead of the highly anticipated rule bug demonstrations remain peaceful, thats the good news, for the most part. Of course, the killing sparked racial unrest and violence from which many say the city has yet to recover. Police and some Business Owners now preparing for the worst in case protests there get out of hand once again. Mike tobin is live for us there outside the courthouse. This is in clayton, missouri. What are you hearing, mike . Reporter we are hearing, gretchen, from an overwhelming number of sources really that the grand jury has indeed reached a decision about whether officer Darren Wilson should be charged in the shooting death of mike brown. And we are hearing that an announcement is forthcoming, it should be here at the justice center. That being said, this is one of those stories which a lot of Bad Information has gotten out there caution the information we are laying now the official channels, specifically the county Prosecutors Office is remaining silent. The family attorneys, parks crump media representing the family of michael brown, they are supposed to get a heads up if an announcement is forthcoming. Their office now says that they have not been notified about anything. So to recap, youre really talking about a number of different sources that are saying that an announcement is forthcoming, the grand jury has finally reached some kind of decision. We know that governor jay nixon is headed to st. Louis right now. His office will not say why he is coming to st. Louis, only thats coming for an event. So, a lot of smoke indicating that something is happening out here, but still, no confirmation through the official channels, gretchen. All right, mike tom brokawson on the scene for us there. He will bring us any breaking news as it happens. Thank you so much, mike. All right, meantime, lets go back to washington, because White House Press secretary josh earnest speaking to reporters now after todays news that secretary of defense chuck hagel is stepping down. Chief white house correspondent, ed henry, join us live. Busy day ed. The white house praising hagel. Why did he have to go then . Reporter very confusing, you are right. The president kept going on and on about secretary hagels credentials and basically made it seem like he was reluctant to see him go. Josh armest saying much the same, when pressed today at his Daily Briefing about how hagel was handling isis strategy. He suggested he was handling it perfectly. So a reporter finally pressed and asked, you know, was he forced out, yes or no . Heres his answer. The decision that was announced today is the result of conversations that the president and the secretary have been having for more than a month now and in the cop text of those conversations, the two of them arrived together at the determination that new leadership should take over at the pentagon. Reporter so, when asked the direct question was he forced out, josh earnest did not answer directly, sort of danced around. The very bottom line is there was some real tension here brewing between secretary of defense chuck hagel and the white house staff, particularly over syria policy. He was pushing for a much more, aggressive approach that the white house was not ready to sign on to, gretchen. You know its all about the real story here on the real story, so, let me ask you. This the critics of the administration say he is being scapegoated for bad policy, not just in syria but possibly are regard to isis as well. What do you know . Reporter certainly, i mean, look, john mccain, the republican senator from arizona has been a frequent critic of this president s Foreign Policy and pushing for much tougher action against isis says just last week, add meeting with secretary hagel and hagel felt like the white house was nitpicking and going over every decision he made. Listen. Already, the white house people are leaking, well, he wasnt up to the job. Believe me, he was up to the job. It was the job that he was given where he really was never really brought in to that real tight circle inside the white house that makes all the decisions, which has put us into the incredible debacle that we are in today throughout the world. Reporter now, mccain went on to say that hagel confided to him just last week that he was deeply frustrated, suggesting that he was about to go and that this was not as happy as the white house is portraying it, josh earnest pushing back by that saying john mccain is not exactly an independent voice when it comes to this administrations decision, gretchen. Politics. All right. Ed henry, thanks so much. For more on this, julie rag begin ski, former adviser to the late senator Frank Lautenberg and fox news contributor, david avella, president of gopac, republican training center. All right. No spin, julie, what happened here . He got pushed out. Yay she tells the truth. Not even a question he got record out. Poor guy. Only need to take a look at his face at the press conference to know he wasnt thrilled about this decision. Look, the problem is this, i dont know that this Administration Knows what its Foreign Policy is, the other result is scapegoating one of the architects of its Foreign Policy but seems to me the white house has a tightly i cant believe im agreeing with john mccain, who voted against chuck hagel before saying he is up to the job, which is ironic. So much for the Straight Talk express center mccain. But he also has this the white house has this problem of having such a tight inner circle and people like chuck hagel coming in are never allowed to really quite do their jobs so i feel horribly for chuck hagel, i think he got a raw deal here. I did that in my take, all right president , david, now, make the decision of bringing somebody in who will get the job done. He wants to degrade and destroy isis. Really . This administration is more clueless than we thought if they think the midterm leighs were the result of bad policy by chuck hagel. What this is schizophrenic governing. Three days ago, wed white house decide to increase forces in afghanistan with what everybody has said was a win by the pentagon. Three days later, we fire the secretary of defense who arguably advocated for that policy as the one supposed to implement it this is the fourth defense secretary in six years for this president. He finally needs to go get a dove be the defense secretary, that is what he wants, he wants someone that wants to pull us out of everywhere. What do you think of that, julie, obviously, isis airport going away. I have to go back to partially agree with what david just said, i have to go back to the concept im not sure so sure what the Foreign Policy has been, in the second term. To blame senator hagel for that doesnt make sense to me. What we should really have is an articulate strategy or vision from this administration. He, i believe, should expand his circle, not contract it especially the second term and think doing quite the opposite, got people he is very comfortable with from the campaign, known all these years and coming in, instead of bringing people like chuck hagel, agree or disagree with senator hagel, i should say secretary hagel, given a job, i dont know if he knew what the definition of that job was. Arm great point. All right. Lets move on to this now a look at the top potential Republican White House contenders for 2016 a New Hampshire poll of pry vary voters show senator rand paul and new Jersey Governor Chris Christie tied at 16 . Thats when you take mitt romney out of the mix. Former Florida Governor jeb bush close behind. I think what im most surprised at, david, that was mitt romney still whips this New Hampshire thing far and away, even though he did not win the presidency, he has actually runways to. What do you make of it . Polls like this, name minding means a lot, not indifferent than when rand pauls father ran a few times. Early polls, they always do very well. Rand needs to make sure that this is his floor, not his ceiling. And he needs to communicate a message that helps broaden the spectrum of the coalition so he can get the nomination, which he hasnt been always able to do. Guys, i got to go, we have breaking news right now, thanks to the two of you. We have a fox news alert to tell you about now, we have been waiting for this the last 25 minutes or so live look now at the east room of the white house for the president ial medal of freedom ceremony. Made this one handed catch during last nights game against the dallas cowboys, unfortunately, didnt turn out so well for the giants because they lost, but what an amazing catch. Fraternity activity at the university of virginia, uva suspended after allegations of a gang rape at a fraternity just coming to life. The alleged Sexual Assault took place in 2012 but was only just reported by Rolling Stone magazine. Uv as president is now asking the Charlottesville Police to investigate. Heres the head of the student council. Last wednesday, Rolling Stone magazine delivered this university a wakeup call, all of us were hurting. Many this week have called for a solution, for an end in anticipate to Sexual Assault. We tonight have that adont hav. I find it startling that im reading in the introduction that now the schools gonna go to the authorities. Right. How did this all play out . Well, Rolling Stone wrote this report and the girl came forward but she, at that time, she did go to the administration, but she then deci decided not to go to police, wrote an email that is the right thing to do really . If she had wanted to go to the police but she didnt want to go, apparently because she was worried about what future employers might say if they googled her or Something Like that, gretchen, its incredible, when you think about the context, the horrible stat to tell folks, but one in five, mostly girls, will be a victim of Sexual Assault on a college campus. One in five. 20 . One in five. We all know that there are a lot of circumstances that lend itself to being easier to alcohol. Alcohol. Big time. The drugs. Et cetera. Lots of parties and all that right. But still inexcusable that stat is that high. I think more inexcusable they have a special misconduct board there but they did nothing. They found him inspect. They found basically acquitted this guy. This was not a criminal court. She still could go have gone ahead. Imagine youre that girl that 20something girl, this avenues freshman at the time, right . Youre that girl, they go through a process where the person is you know, the person you allegedly raped you being acquit and the president of the university is, thats fine, dont go forward and youre worried about future employer. Youre in that mind of not going and not reporting it. This is such a human deal for women or you and i, been here a while, for privacy reasons she didnt want to press the charges that way, because of the internet able we live in, she would be marked. Even if she is right, dont with a to go to hr. You think about the context of this girl, the administration not pushing her to go forward. I was doing the research, doesnt the administration have a duty to report and they dont really, but it depends on the states. They dont really. Will is a statute of limitations, there he to ten years, depending on the state but she would still be covered under the statute of limitations, less than years in. What do we do, lis, the problem seems to be rampant across the country, not just uva. What do we do . Certain things implemented, california, for example, has this very controversial yes means yes policy. It looks good at least on the books, it says, you know, no means no is not enough. You actually have to get a yes. Now, of course, say how do you actually enforce that, two people have been drinking, all that, pull out a contract and have them sign it . Even though it was released Bay Committee controlled by members of their own party. Chief intelligence correspondent Catherine Herridge is live in washington. Nowow every detail about this. What were the committees findings . The Committee Found the administrations initial explanation that blamed the video and a protest for the attack were, quote, not fully accurate, with republicans on the committee stating that then cia act can director took on a policy and Public Affairs roll for the administration, quote, it is unfathomable the white houses policy preference or concerns of state Department Senior officials did not factor into his calculation about what was fair. For these reasons we believe the testimony was at times inconsistent and incomplete. The administration was telling a story about the demonstrations and the video, when it was clearly a terrori attack, and talking points. All of that in the report and additional views. Testified he edited the talking points based on his 30 years as a cia analyst. We know now from the Committee Report is that the very First Executive update within hours of the attack on september 12th september 12th was the right analysis, that it was terrorist attack and not a protest that spun out of control. Very interesting. Into, what does the Committee Report say about weapons moving from libya to syria . Well, the Committee Reports include that the cia was not moving weapons from libya to syria, but buried in the report is newly declassified item from more real and james clapper, director of national intelligence, the cia was tracking weapons from syria to libya but when the questioning was raised, it was then shut down by chairman rogers, citing a high level of classification. In this case mike rogers stopped testimony at the top secret level and said not everyone who was in the room who had top seen credit clearances what let into the deeper, darker secret. We dont know what is in the testimony but schaffer and other analysts said it would suggest this was a closely held program what they call a readon program, where only a specific limited number of individuals would have that kind of clearance. Could that is one of the most interesting elements of this entire report, gretchen. What about the Senate Select committee . There was no comment from the commit ore oar trey gowdy except to save they had the house report since july and were factoring that into their ongoing investigation. We expect some movement with the select committee in december, possibly hearing at that time. Thank you so much. Heres a whole new spin on the term fowl.
