Seconds. The longest 20 seconds of a lot of peoples lives up here. This waning was a rolling earthquake, relatively shallow at seven miles. Some 9 Million People felt this thing. The usgs says 6. 0 magnitude. The city of napa says 6. 1 but the usgs is leaning toward that 6. 0 number but it doesnt matter because the damage is significant. 3 30 in the morning, look at bricks that fell off. Can you imagine if this happened at 3 30 in the afternoon . Just amazing. Colors are bad after an earthquake. See the yellow tape . It means can you not go inside the building at all. A lot of these buildings have red tags. That means are you not allowed to go inside the building because the damage is so significant inside. Down here past the satellite trucks, yellow tape, red tape goes on for blocks and blocks here in downtown napa. A lot of the businesses are still shut down. Theyre concerned because this is one of their biggest weekends of the year coming up, labor day. Theyre concerned that a lot of people wont come. A lot of this town in fact most of the town is still open. You can hear sirens still going off. Theyre putting fencing up and down. This quake was a magnitude 6. 0. 3 00 in the morning. A number of businesses here say if they had this thing at 3 00 in the afternoon, the death toll and significant injuries would be a lot higher. Right now 200 peopleplus have been seen at local hospitals. Mostly bumps and bruises. 17 people were hospitalized. One in serious condition. No quake related deaths so far. But we are still in the early stages here of going through to make sure that the hospitals are all checking in with those who were injured. Shannon, again, the News Conference will begin here. There may been 100 people still without power but power crews have done a terrific job getting us back on track. Trace, thank you very much. Homeowners and businesses are counting their losses in the aftermath of the quake. Were only starting to see the scope of the damage. Initial estimates from the u. S. Geological survey are already at more than 1 billion and say that could go even higher. City officials redtagging about 100 homes, meaning they are unsafe to enter. Utility crews searching for possible gas leaks say it is going to take days to respond to hundreds of calls reporting the smell of gas. New developments now on the investigation into the brutal execution of american journalist james foley. Federal investigators now one step closer to unmasking his killer after saying theyve identified the social media account used to post that horrifying video of foleys beheading. Chief intelligence correspondent Katherine Harris is live in washington. What do we know about the pool of potential suspects here . Shannon, thank you. A former rapper who left his wealthy west london neighborhood last year for syria is among a small pool of suspects as investigators intensify their efforts to identify the killer of the american journalist james foley. Earlier this month the man posted a graphic photo of himself on Twitter Holding a severed head. Investigators are analyzing voice recordings, the skin tone and executioners left handedness, as well as the pattern of veins on his left hand which can be as unique as a fingerprint. If you can get two pictures where the veins and any markings on the skin match up, i mean theres just very few people who have moles an veins that are the same in their hands. It is pretty good in a court of law. Investigators want a high degree of confidence as the attorney general said last week, all options are on the table. Privately u. S. Officials say that does include the use of legal we might. Losing katherine there. If you can still hear us, can you tell us anything about the forensic trail thats been developed . Lets see if shes still there. Im still here. All right. With a can you tell us about the forensic trail or what theyre discovering at this point . Thank you. Federal investigators have been able to identify the social media account used to post the foley execution video and it is described to fox news as a key part of the forensic trail of evidence. A counterterrorism source says there are a dozen social media accounts that are linked to the isis Senior Leadership and the data suggests that the isis leader you see there provided his blessing or tacit approval for foleys murder. Analysts say isis is winning the social media war and theyre putting the leader of al qaeda in pakistan al zawahiri under pressure. Now both have to be at the top of their game in order to gain the financial support, the recruiting and what the other items that they need to continue the jihad. I think the competition, just like any marketplace, will be good in the long run for the global jihad. It is worth noting that the british rapper really has what amounts to a terrorist pedigree. His father was extradited to this country about two years ago for terrorism charges for his alleged role if whats considered one of the seminole plots before 9 11 which was the east Africa Embassy bombings in 1998. We know you are on it, thank you so of. Were learning more about james foleys last words to his family. The 40yearold recited a lengthy message to a fellow hostage who mem morized it, the relaid it to his parents. I feel you all especially when i pray. I pray for you to stay strong and to believe. Foally went on to say, grammy, please take your medicine, take walks and keep dancing. I plan to take you out to margaritas when i get home. Stay strong because i am going to need your help to reclaim my life. Foley was abducted in syria in 2012. Were learning more about another american journalist who had been held captive by islamic militants. He was released yesterday after nearly two years in captivity in syria. He was handed over to u. N. Peacekeepers in the Golan Heights area following an extension of mediation by u. S. And ka t qatari officials. Some u. S. Terrorism experts say qatar moved for quickly to secure his freedom. We are told curtis will be debriefed by the fbi before returning home to massachusetts. Controversy developing now over the threat posed by isis with the chairman of the joint chiefs, general Martin Dempsey, saying he will not for now recommend air strikes in syria until he determines that the group has become a direct threat to the u. S. Homeland. He explained over the weekend that there is no sign that isis is engaged in active plo iviveh against the homeland so it is different than what we sea in yemen. I can tell you that if that threat existed inside syria, it would be my strong recommendation that we deal with it. But thats a little bit different than what he said about the Terror Group Just last week. Listen to this. This is an organization that has an apocalyptic end of days Strategic Vision and which will eventually have to be defeated. To your question, can they be defeated without addressing that part of their organization which resides in syria . The answer is no. That will have to be addressed on both sides of what is essentially at this point a nonexistent border. Joining me now, the former u. S. Army helicopter pilot, iraq war vet and spokeswoman for concerned veterans for america. Amber, always good to see you. Thank you for joining us today. It is great to be here. So we have what seem to be some mixed messages from different members of the administration talking about what kind of threat is or isnt currently posed to the u. S. Homeland by isis. We all remember the video just a couple weeks ago of the one leader who was vowing that the flag of allah would be raised over the white house. Weve seen other threats on social media that seem aimed directly at u. S. Cities. What are we to make of the messages were getting from the top . This is the White House Communications offices attempt to get in the way of policymakers and leadership within the administration who are telling the truth about the threats of isis. So this is the administrations attempt to rein everybody back in and really downplay the threat that isis poses to the u. S. But in doing so, theyre confusing the American People. We need the white house to stop micromanaging these experts in their field that are letting the American People know whats going on and really be honest and let us know whats going on instead of attempting to control all of the information. I want to read a little bit of a quote. This is from former cia director general michael hayden. About whether there will be an attack or threats here in the u. S. , he says, this is a question of timing, not of inevitability, not of intent. Isis is a very powerful local organization and probably a reasonably powerful regional terrorist organization but it is one that has global ambitions and it has the tools it has expressed the intent. Clearly there are those maybe not currently part of the administration but certainly those who would understand the intelligence, the threats and what were really facing who seem pretty bold in their predictions. They think theyre accurate that there is a threat right here right now. The threat that isis poses to the u. S. It real and it is imminent. White house advisor ben rhodes himself said the beheading of james foley by isis was a terrorist attack against the United States. We do not have the time when it comes to isis. We can fight them in iraq. We can fight them in cira or anywhere else they attempt to take up safe haven or they will make their way to u. S. Soil. Its not a matter of if. Its a matter of when. You mentioned this. It may be confusing to the arch american. Folks see the persecution of the religious minorities and see people begging for their lives, yazidis. It seemed like the administration would have the tools it needs to make the case that we have to be more directly involved, yet it seems theyre very hesitant to do that. We have to remember here that the threat were seeing in 2014 in iraq is much different than the insurgency that was attempting to blend in with the civilian population in iraq in 2005. Isis is not attempting to do that. They are operating in plain sight. Theyre using american vehicles, american equipment. Were seeing them drive around in u. S. Military humvees and that makes it that much easier for the u. S. Military with the equipment and the technology and optics we have today to find, fix and destroy them. Amber, thank you for your service to our country. Thank you for joining us today as well. A peaceful but emotional day in st. Louis where thousands of people are paying their respects to michael brown. The unarmed teenager shot and killed by a Police Officer more than two weeks ael. Well take you live to missouri. Police officers literally pulling a driver from his car after a wild chase. What started the hoedoshowdown e first place. And could burger king be moving to canada because of Corporate Tax rates . The latest chapter in the war on business. [music] defiance is in our bones. Defiance never grows old. Citracal maximum. Easily absorbed calcium plus d. Beauty is bone deep. A dramatic scene in california after police were forced to physically pull a suspect out of his car following a highspeed chase. It all started after the man sped off in an attempt to Outrun Police who were trying to pull him over for speeding. Ironically after hitting at least one vehicle and blowing through a red light at a major intersection, the suspect was finally cornered by police but he just would not get out of his car. Thats when officers reached through the window and actually dragged him out by his neck and his arms. Hes now under arrest facing several charges. The home of the whopper may be getting a whole new address. Fast food giant said to be looking to buy tim hortons and move to canada. Canadas top tax rate is 15 . Burger king reportedly pays a tax around 27 . The Obama Administrations work on using executive action to stop these socalled tax inversion deals where companies leave the u. S. Lets bring in charles payne, host of making money on the fox business networks. How does this work . If you have a better deal somewhere else, 15 versus 27 , we know burger kings paying here, thats a lot of money. That is sluabsolutely a lot money particularly for a Business Model like burger king where they dont make a lot of money in america to begin with. Their sales in this country are down three of the last four years. In the last quarter they closed 22 stores. Theyre suffering in this country. They have a very thin profit margin to begin with. Talk about raising the minimum wage. Best prospects for burger king are around the world. Theyre doing very well outside this country. If they stay in america and make a gazillion dollars outside this country and when they bring that money back, currently they would be taxed again at 35 . It is a nobrainer, you dont bring the money back. Which is not good news for our economy. Treasury secretary lew has talk about cracking down on companies without having to go to congress. Account white house do something. We keep hearing the threats. If they do something hopefully it would be temporary. Certainly would be outrageous. If they really want to do something, lower Corporate Taxes. They are the highest in the world. Theyre higher than cuba. Canada in 2000 lowered Corporate Taxes an theyre bringing in business. I remember when canada was joke. I used to live in north dakota. We talked about going to canada. The dollar was double the value. No one wanted that canuck money. Their economy was nothing. It was a joke now it is an amazing place. It is robust. It makes us look like paupers. Were still trying to shake down these businesses. How can we have a prosperous country . These companies cant take this money, hire people, build new franchises and new businesses an endure these tax rates. Do you think if the white house takes some executive action, do you think thats going to finally spur congress where there have been numerous false starts on trying to get something done with tax code reform. I dont know. I dont know that executive action is the kind of thing its the wrong way to go about this. It certainly will not answer any questions. If they really want widespread tax reform, this is certainly what we need. But to me the easiest place to do it is in Corporate Taxes. It is a nobrainer. Everyone says it is a mobrainer so lets get it done. Lets see whos listening. Burger king wont be the last story. I love their chicken sandwiches. It was supposed to be the summer treat we all love, but then things went very, very wrong. He tasted something funny. He took a drink of his shake and he said mom, this shake tastes disgusting. What took this dairy queen trip on such a scary turn. And all he wanted was a selfie. But the lengths this tourist went to to get one is raising some serious concerns about security at new york citys famed Brooklyn Bridge. And srirachi opening its hot sauce factory for public tours. That brings us to our question of the day what is your favorite condiment . Not a question we often talk about on tv. Health officials looking into a troubling incident at a denver dairy queen. A customer said her son got a vanilla milkshake. He said it didnt taste quite right. She took a sip of the shake and says it burned her mouth, throat an stomach. She went right back to the store and complained. He said we dont give money back. We cant reimburse you for it. I can make you something else. I said no, then im going to take this to the hospital with my son. Then you can pay for that. He said, do whatever you think you got to do. She says she later talk with the Stores Manager who admitted a bottle of vanilla sur rip had been contaminated with a chemical cleaner. Employees involved were written up. But good news is, no one was seriously hurt. The family of the teen killed by an officer in ferguson, missouri calling for a day of peace and silence. As hundreds gathered for the funeral of michael brown, the 18yearold shot by an officer during a confrontation earlier this month. The Justice Department continuing its investigation of that shooting which spark looting and protests. Mike tobin is live in ferguson with more. Mike . Reporter shannon, it was very emotional. Two eulogies, one from Michael Browns uncle, reverend charles ewing, but a key note coming from the refb rend al sharpton. He had a sharp rebuke for just about everyone in the process, starting with the vandals, looters, raucous demonstrators distracting parents from their mournin mournings, to the police with riot control techniques and the government that funds them. A man says hes going to have to come to terms but theres something wrong that we have money to give military equipment to Police Forces but we dont have money for training and money for Public Education and money to train our children. Reporter the overall message to the funeral was to maintain the anger but keep the peace. It can really be summed up by sharpton saying we cant have a fit, we got to have a movement. A multiple number of different investigations going on. Whats next, legal steps, for whats going on . Reporter well, the big step thats next is to keep an eye on this grand jury to see if an indictment will be returned and what is contained in that indictment ultimately. Besides that, there is a class action suit coming forward, filed by the black lawyers for justice, on behalf of anyone who was arrested and or injured during the course of the demonstrations. It names as defendants the st. Louis county police, the city of ferguson police, and the mayor of ferguson. Mike tobin, live in ferguson, thank you. Some shocking developments from the irs about lois lerners missing emails. Agency attorneys actually admitting those emails do in fact exist but say its going to be too much work, probably too expensive to actually find them. Were going to talk to the president of the group trying to get to the bottom of those emails. Then we are live at the white house as the president starts his full week back from vacation still facing criticism over his time off as so much was going on in the world. Well, the American Academy of pediatrics now pushing School Districts around the country to delay the start of classes until at least 8 30 a. M. Saying kids respect getting enough sleep. It is jeopardizing their health, as well as their grades. Vacation is over. President obamas back in washington today and this afternoon josh ernest back in the White House PressBriefing Room and so was our chief White House Correspondent ed henry. How does the white house defend the criticism the president got with so much going on while he was on vacation . Reporter they say inside the briefing that the president has been focused on these various National Security crises. One of the problems were dealing with right now though is various senior officials saying various things about how big of a threat isis really is. Defense secretary chuck hagel saying this is bigger than the threat from al qaeda pre9 11. Then general Martin Dempsey who remember last thursday, comments now being clarified by the pentagon but he was basically saying at one point can they be defeated, isis, without addressing that part of the organization that resides in syria, the answer is no. Thats what general dempsey said. I just appreciated josh ernest on whether the president agrees. You suggested we have to go into syria if were going to defeat isis. Does the president agree with that. What i would go back to is the president s stated strategy for dealing with isil which is to remember that there are more tools in the tool box than just brute military force. Hes saying you have to go into syria to defeat them. Does the president agree with that . Again, what i think that he was saying is there are a range of ways to confront this threat that we need to confront this threat in a sustainable way, not just through u. S. Brute military force. You see, not very clear with what whether the president agrees with what general dem said directly half the thursday. Lindsey graham just put out a statement, the white house is trying to minimize the threat we face in order to justify not changing a failed strategy. You can see the heat is still on. To that point, it does seem that there are a number of republicans suggesting that this threat from isis is more immediate than the white house seems willing or comfortable with acknowledging right now. Reporter republican mike rogers, house intelligence chair saying isis is a plane ticket away from reaching americas shores. Trying at least to launch terror attacks. Then you remember the president a few months ago did that interview with the new yorker magazine in which he suggested that al qaeda offshoots like isis are simply the jv squad. Josh earnest was pressed on that. Listen. So the president was not singling out isil. He was talking about the very different threat that is posed by a range of extremists around the globe. Many of them do not have designs on attacking the west or attacking the United States. And that is what puts them in stark contrast to the goals and capability of the previously existing al qaeda core network that was led by osama bin laden. Reporter bottom line, republicans suggesting this is the clarification of what the president said to try and suggest he was not minimizing just how big of a threat isis was only a few months ago. Bottom line, president s vacation is over. Right back into the fire now. How did it feel to be back in the briefing . Reporter its good to be back. Great to be in new york. Even better to be here. Always glad to have you on the front lines. Ill see you in a couple days. A new change to obamacare. Nonprofits who object to provide a full range of contraceptives with now opt out by notifying the department of health and Human Services about their objections. Hhs will arrange for a third party insurer to pay for and mr the coverage. Planned parenthood not happy saying once again we are reminded of the Great Lengths opponents are willing to go through to put barriers between women and their Birth Control. While the Obama Administration is working hard to protect womens access to Birth Control, in the face of harmful Supreme Court decisions, todays notice also serves as a stark reminder of whats at stake for women when it comes to affordable basic health care. Lets talk about it with Fox News Contributor and former political advisor to senator frank lautenberg, and david a l avella, president of go pac. I think there have been eight changes with the administration trying to keep everybody happy. A lot of people are saying, talk about the first rule change which instead of filling out a form saying i dont want to provide these things, you notify hhs and say i dont want to do it, and they take care of it. People say it is just the sleight of hand. It is just same thing all over again. Now hflt hs is providing it. I dont know what other accommodation the white house can provide to people. More than that, im not sure what the white house can do. Theyve gone above and beyond. I guess the alternative would be for nobody to just provide a mandate for Birth Control coverage. I guess thats whats people would ultimately want who are opposed to this. This is as far as you can possibly go. For the landmark ruling in the hobby lobby case in the Supreme Court, just four specific things out of the 20 methods they objected to, four methods they viewed as abortions or something that could end a pregnancy. It was very specific ruling and it dealt with these closely Held Corporations, that are forprofit, not religious organizations per se. But the second part of these hhs modifications or proposals that ruled that last week would now have those companies which the Supreme Court said they dont have to comply with the mandate, now they have to fill out paperwork to combine with the mandate. Those argue on the right this mandate is putting a bigger burden on businesses than they had before the hobby lobby ruling. Also keep in mind we are now at 43 significant changes to obamacare since it passed. If you dont like this law, give it time. Either the president will u. N. Lat laterally change it. When it comes to this particular ruling, as long as religious groups are willing to practice their freedom of religion as the government says so and have them fill out forms that government says it is approved, then you can do what you want as a religion. I dont think thats what the founders meant when they said freedom of religion. I just want to read the very basic holding. The end of the majority opinion in the hobby lobby decision, the conceptive mandate violates the religious freedom restoration act. They said basically were not saying these people have to fill out forms or do anything else, just saying this mandate cannot apply to this company. It was statutory interpretation. It was not a constitutional interpretation. So congress can easily pass a law overturning that statute theres been a lot of talk about that. Right. Look, again, i have to go back to the following. If you as a closely Held Corporation by the way, 71 , including a majority of republicans, of women, dont support the hobby lobby view that corporations have the right to force their religious views on their employees. And so from a purely political standpoint, if im a democrat, id love to keep talking about this between now and election day because this probably would help. Maybe wont help us hold the senate next year definitely help the next president ial. Republicans are making a huge mistake by continuing to harp on this because women in their own party dont agree. Democrats did very well in turning around and immediately raising a lot of money off this. Is there that danger for the gop quickly . It is an election about motivating the base. Certainly Republican Base seems much more motivated. Our base seems much more motivated than julies base this election. Just a matter of weeks to go and well find out. Thank you, both. Coming up, a russian tourist now facing charges in new york city after police say he climbed to the top of the Brooklyn Bridge while snapping photos with his iphone. Theres plenty of evidence there when you do that. It is the second Security Breach on that bridge in less than a month. Laura ingle joins us live with the story. What is going on . Hi, shannon. The suspect just made his first appearance in brooklyn criminal court. Prosecutors asked for 25,000 bail due to the severity and danger of this Security Breach. In the end, the judge set bail at 5,000. The 24yearold russian citizen surrendered his passport and was ordered back to court this friday. He came into the courtroom with his head hung low looking serious. He listened intently to the charges against him with the help of an interpreter. We learned today that he is here in new york as part of a russian tour group and that he climbed the bridge for fun. Well, that fun that he claimed to be having was a perilous walk up one of Brooklyn Bridges cable beams around 12 15 p. M. Yesterday. An nypd sergeant first spotted him making his way up to the top of the bridges platform which by the way is 276 feet tall. Russian tourist was taken into custody as he descended the tower. And you know he is facing multiple charges. We want to mention them, including reckless endangerment, criminal trespass and disorderly conduct, just to name a few. Singer beyonce put on what has been called an epic show closing performance at last nights mtv video music awards. As for the rumors after divorce with her husband, rapper jayz, he late came on stage with their daughter blue ivy to present their mommy with the video vanguard award. We are learning that the irs may actually have those missing lois lerner emails after all. Agency attorneys apparently telling Judicial Watch, the group trying to get to the bottom of this whole thing, that they back up everything. Just in case. Now that may be a different story than youve been hearing since those records disappeared. The actual hard drive, after it was determine that it was s dysfunctional and that with experts no emails could be reveefd was recycled and destroyed in the normal process. Was it physically destroyed. Thats my understanding. Because there was a computer crash. 67,000 emails have been provided to congress. 24,000 of them come from this period during which her hard drive crashed in which those emails were lost. In april determined that in emails may have n a hard drive been lost. Our next step was to in fact investigate how many emails did we actually have and could we find. The president of Judicial Watch has been on the front lines of this entire thing. Tell us what you found out and were you surprised to now hear somebody with the agency saying these emails may never have been missing at all. Right. The department of justice attorney told the Judicial Watch attorney on friday that it turns out the federal government backs up all computer records in case something terrible happens in washington and there is a catastrophe. So the government can continue operating. They say it would be too hard to go get lois lerners emails from that backup system. Everything weve been hearing about scratched hard drives, missing emails of lois lerner, other irs officials, other officials in the Obama Administration, its all been a pack of malarkey. They could get these records but they dont want to and they havent told anyone about it, frankly, until we were able to get it out of them on friday. Theres no such thing as lois lerners missing emails. Its all been a big lie. Theyve been lying to the courts, to the American People and to congress. It is really outrageous. That is stunning. If what youre saying is the Justice Department attorney has told attorneys with your group that these emails exist and theyve always existed, we are talking about subpoenas, talking about sworn congressional testimony, talking about court hearings, we are talking about an order from the judge there in d. C. , the federal judge who said i want everybody to have sworn affidavits and tell me exactly what happened to these. I read those affidavits when they came in a week or two ago and there was no mention of this. How is that possible . Weve asked the department of justice that same thing. We want to know why they hadnt told the court about this backup system. In this backup system is working, lois lerners emails are there. There are halfadozen other irs officials whose emails have supposedly disappeared as well and weve heard from other agencies like over in the hhs over obamacare, emails disappearing there. Weve been led to believe that once they disappear they cant be found again, when in fact they back up everything, as most people suspected. Now the government has confirmed. Were going to ask the judge in this case for relief. Were already in a hearing and mediation session as we speak with magistrate judge overseeing this discovery issue. But we got to get these emails. Now we know where they are, where theyre likely to be. The obama needs to get on the ball and start retrieving them as opposed to stonewaulling and continuing to obstruct justice. This is a very important piece of information. I got the impression judge sullivan was not very happy with the response he got from those affidavits. Please keep up updated party ove weekend.
