During the campaign, as i traveled all across this great country, i met with Many American families whose loved ones, sons and daughters, husbands and wives, were viciously killed by illegal immigrants. Incredible. These amazing american lives were stolen because our government refused to enforce our already existing laws. These american victims and their families were ignored by the media. To the media doesnt want to talk about it. They dont want to talk about i it. They were ignored by the consultants, they were ignored by washington. Up at these americans were not ignored by me. They were not ignored by you. You showed that on november 8th. They were not ignored by you and they will never be ignored by any of us. As we speak tonight, we are finding the drug dealers, robbers, thieves, gang members, predators, killers, and criminals of all types preying on our citizens. You have been seeing it, you have been reading about it, and you have been seeing it. One by one, they are being tracked down and thrown the hill out of our country and we will not let them back in. We are also working to protect our citizens from terrorism. We have seen the devastation at home from 9 11 to boston to San Bernardino and many, many other places. We have seen attacks overseas in france, and germany, and belgiu belgium. It is time for intelligence and common sense to be used. The single best way to protect, and you have to do this, you have to do this, and to keep Foreign Terrorists from attacking our country, is to keep these Foreign Terrorists from entering our country in the first place. Finally, we want a very big tax cut but cannot do that until we keep our promise to repeal and replace the disaster known as obamacare. The seventh anniversary of obamacare is very painful passage, this is our longawaited chance to finally get rid of obamacare. The longawaited chance. We are going to do it. We are going to do it. What is the alternative . The alternative is what you have. What you have is nothing. The worst. It is the big lie. Remember this, so true, i happen to like, a lot, senator rand paul. I do. I do. I like him. He is good. A good guy. I look forward to working with him so we can get this bill passed, and some form, so that we can pass massive tax reform which we cant do until this happens. So, we got to get this done before we can do the other. In other words, we have to do what this is before we can do the big tax cuts. We have got to get it done for a lot of reasons but that is one of them. And its important to realize how we got to obamacare in the first place. Back in 2009 or 2010, house and Senate Democrats fought through a 2,700 page Health Care Bill that no one read and no one understood. By the way, today it is thousands of pages more. Its not even understandable. They ignored to the public, they ignored to the voters, and they jammed a massive, failed Health Care Takeover right through congress. And this is what we have it. It is time for democrat leaders in washington to take responsibility for the disaster they and they alone created. Remember when president obama said, if you like your plan, you can keep your plan, if you like your doctor, you can keep your doctor . Nobody brings that stuff up, do they . Do they ever bring it up . Matt, i dont think so. They dont bring it up. Notice how they forget all the over the architect of obamacare said the law was passed because of the stupidity of the american voter. Or the democratic governor of minnesota, who said the Affordable Care act is no longer affordable. It has been one broken promise after another. People have been kicked off their plans and their premiums have increased by double and triple digits. Arizona, up 116 . By the way, Insurance Companies and a great state known as kentucky, have you ever heard of it . Are in tremendous trouble, will be fleeing, and we are going to save it all. We are going to save it all. A tremendous trouble. It is a disaster. In fact, to counter my speech, two weeks ago and congress, did anybody see that speech . They used the former governor of kentucky. And the plan doesnt work in kentucky. But matt will save us. Many of our best and brightest are leaving the medical profession entirely because of obamacare. Obamacare has been a complete and total catastrophe and its getting worse and worse by the day and yet, you watch the fake media, the fake news, and they tried to both of that. It is a disaster. It is a disaster. It would be great if they told the truth about obamacare, it would be so wonderful for the people of this country week, because it would just sail right through. Our plan but sailed right through. Onethird of the countries in the United States now have only have one obamacare insurer left. Some have none. And in your state, it is worse. In a recent interview, your governor, matt bevin, who is right here, so, i better be careful, said that obamacare was a disaster in kentucky. Is that right . I am quoting it so accurately. And it is. It has been an absolute disaster. Half of our counties all me have a single provider right now. It is a financial disaster waiting to happen right here in your own stage. Thursday is our chance to end obamacare and the obamacare catastrophe, and begin delivering the reforms our people deserve. Big thing. Then, we get to tax cuts. A good thing. And remember, we will it will go to the senate come back and forth, the end result will be wonderful and it is going to wok great. Once this is done, we are also going to work on bringing down the cost of medicine by having a fair and Competitive Bidding process. Some people think that is just as important as health care. The cost of medicine in this country is outrageous. Many times, higher than in some countries in europe and elsewhere. Why . Same pill, see manufacturer, identical, and it is many times higher in the United States. You know why . Campaign contributions, who knows. But somebody is getting very rich. We are going to bring it down and we are going to have a great, Competitive Bidding process. Medicine prices will be coming way down, way, way, way down and that is going to happen fast. We are just adding that to the bill. I said, weve got to add that the bill. We are going to do a bill later, we are trying to add it to this bill. And if we cant, we will have it right there. We have some crazy, arcane laws, folks, just in case you havent heard. I am confident that if we empower the American People, we will accomplish incredible things for our country, not just on health care, but all across our government. That did not overshadow what happened today. Lots of news. That is a subject of this evenings talking points memo. The House Intelligence Community spent a few hours talking with fbi chief james comey and nsa boss admiral mike rogers. It was clear from the beginning that there was a political agenda, as there always is. Republican Congress People wanting to know about the leakers, people within government giving classified information to reporters. That was their top concern. On the democratic side, it was the obama tab, the allegation that President Trump tweeted out. At this point, after todays testimony, there is apsley no evidence president obama tapped the trump tower. But today, white house Spokesman Sean Spicer said, there will be more tap information forthcoming. Especially, about general flynns situation. Now, the fair thing here is to be fair, avoid speculation, but skepticism on this issue is warranted. In addition to the tapped business, democrats zeroed in on two former members of the Trump Campaign, hoping to link them with the russians. First was a man named roger stone, who worked for mr. Trump for two months in 2015. He was a consultant. Second was paul manafort, who worked for the Trump Campaign for approximately five months, but did have a powerful position as campaign chairman. Democrats insinuated that both men were involved in some kind of corrupt scheme but the admiral and mr. Cohen we would not take the bait, saying the investigation is ongoing, and what they cannot comment, both men deny any wrongdoing. Talking points will be surprised if anything comes of this russian deal. However, that controversy is what drove President Trump to accuse president obama. Mr. Trump is so infuriated that the media has obsessed on the russian connection that he lashed out, trying to create a firestorm over the Obama Administrations surveillance history. The problem is, there is no evidence that anything happened at the trump tower. There is evidence that the Obama Administration surveilled journalists and even the german chancellor, but that does not go to President Trumps point. The accusation that president obama was actively involved in harming the Trump Campaign has no harm to the president himself. He needs the American People to focus on the economy, the new health care proposal, border security, not alleged conspiracies. In the future, but the president would be wise to embrace only fs in his pronouncements. The issue of leaks, of course, is of vital importance, but both the comey and rogers acknowledge that today. It was instructive to see that no democrat on the House Committee really zeroed in on the leaks. Talking points expects expects the fbi to find out, not only who leaked stuff about general flynn in the russian ambassador, but also who violated the white house protocol of putting out the president s conversations with the Prime Ministers of australia and the Prime Minister of mexico. If the fbi cannot do that, cannot arrest the leakers, this country is in major trouble. Summing up, republicans want to get away from the tapping, democrats continue to peddle the russiaTrump Campaign situation. That is the memo. Now, for the top story reaction, lets first bring in james rosen, chief washington correspondent. What you were listening to the top stuff, and fbi director comey tap dance around that, saying he couldnt confirm an investigation but didnt have any evidence or whatever he said, what was going through your mind, since you werent exactly tapped, but you were surveilled by the Obama Administration . Good evening, bill. Congressman trey gowdy of South Carolina posed a series of questions to the fbi director about whether reporters should enjoy an exemption from the laws that make it a felony to disseminate classified information. I felt at that moment without resort to concede, i think i months that the specter of james rosen hung over the hearing room. But beyond that, what was on display today, bill, with the difficulty that lawmakers have been Holding James comey to a coherent, consistent standard in terms of what he discloses about the fbis investigation and when. In part, this time from the fact that lawmakers are at a big disadvantage as to who holds the information. Director comey seems at times to make up his rules as comey goes along. I will give you an example. He confirmed quite famously today, this is what the headlines are about, the existence of an investigation by the fbi in unusual circumstances and where he says it is in the Public Interest. He confirmed today with the authorization of the department of justice that fbi agents are investigating potential coordination between the Trump Campaign and the russian government last year. But when it came to aspects of the story that are of equal Public Interest, but only potentially more damaging to President Trumps opponents, such as whether obama aides improperly accessed the names of americans swept up in Foreign Surveillance or whether they leaked classified material to the press, comeys own criteria of unusual circumstances and Public Interest suddenly didnt apply at the couldnt confirm whether fbi agents are also investigating these things. Bill didnt he do that with the approval of his boss, the attorney general . Did he get permission to say, yeah, we are investigating the russian, the alleged rush of mine, but he didnt get permission on the other side . I think thats what you are saying. He told us that he had the special dispensation of the department of justice to confirm, yes, that they are exploring alleged coordination between the Trump Campaign on the russian government. He did not tell us that he sought any permission to confirm that he is also investigating bill if you were there, it would have been. I didnt hear it asks. I am not a comey fan. I am not. But i dont condemn him for what he did today. I think that he operated within the guidelines that he was given, as we know, attorney general james sessions, i am sorry, jeff sessions, has recused himself, but the secondincommand is income okay, he can do that. I dont know if he did that. Last word. There were other problems with comeys testimony. It was difficult to understand how and when the fbi arrived at the conclusion of the kremlin was motivated by a desire to help donald Trump Campaign when the fbi had also concluded that the russians were convinced, like most everyone else, that Hillary Clinton was going to enact the election. In other words, how and when could the equipment have resolved to help the Trump Campaign, as the fbi director maintained, when the kremlin, by the fbis own account, believe the Trump Campaign was a lost cause. Bill looks, all of this stuff, i dont know if we will ever know about it. You know these things drag on forever. But im glad you are not in prison, rosen, that is the big take away tonight. You are still cooking. Back at you, bill. Bill but i think these leakers have to be arrested. We will deal with whether the press should be arrested with brit hume coming up. Lets bring in catherine herridge, fox news chief intelligence correspondent. So, what did you pick up . With the most important thing you heard today from a testimon testimony . One of the things that jumped out at me, bill, right at the end of the hearing, and the republican chairman, devon nune nunez, seemed to somewhat exasperated, and even castigated the fbi director, saying that by confirming that there is as open counterintelligence investigation and giving no indication whether there is evidence of collusion, these are the congressmans words, he had put a big gray cloud over the current administration. Based on my experience, a ci case or a counterintelligence investigation is not something that is dispensed with in short order. Sometimes, they take two, three, four years before they reach a decision about filing criminal charges. You may have a very long road ahead here. Bill you are not going to know anything, and i dont think the even press even care, people who like to President Trump made up their mind already and people who dont have made up their mind already. So, the other Cable Networks will talk about it tonight. I dont think we will even hear much about it. A late breaking story, i know you are aware of, that some Airlines Flying to the u. S. Now have banned electronic devices. 13 countries. So, if you have a laptop, you cant use it on certain planes flying into the usa. Why . Whats going on . Based on our reporting, bill, there has been a real uptake or a spike in the threat reporting or the chatter in recent days and weeks and this will apply to 13 countries flying into the United States and it will also revise the liquids ban. My bottom line here is that al qaeda is not dead. Al qaeda is a group that has really pioneered liquid explosives and has a singular focus on aviation. Bill hour until people, again, that is probably done by wiretap, picked up a lot of chatter about an impending attack and so, the airlines in 13 countries, countries have not been named. We know jordan is one of them. That is correct read and i think saudi arabia, as well. There may be some that are in the travel ban. But that is just me speculating. Bill we will know shortly. Okay, thank you, catherine. Now, lets bring in mike emanuel, fox news chief Congressional Correspondent who was at the neil gorsuch hearing today. Any headlines coming out of that . Good evening. The highlight seem to be at the end of the day would neil gorsuch made his Opening Statement. He talked about his career as a judge, his family, who bore able to hear his voice and hear his own words. Judge gorsuch talked about some cynics seeing judges as politicians wearing robes. He rejected that. He said that that is not what a life in the law is all about. It seems significant because this is not the end of the day. He got the last word at a time when critics are saying hes a friend of Corporate America and he sounded like someone who is committed to enforcing the constitution following the constitution, and the rule of law. I talked to some Senior Republicans after the hearing and they felt like his Opening Statement would make it a lot harder for some democrats to oppose him because he sounded quite reasonable and quite measured. Bill so, he is going to have to stake out his turf as an independent terrorist. When you said at the end of the day, you will literally meant at the end of the day. You werent using the cliche, so, i dont have to find you. That is a good thing. I do believe that the Democratic Party is going to coalesce and most of them will vote against him, simply because he is not a liberal. What i be wrong on that belief . No, you would probably be right. They sounded quite irritated still about the outcome of the 2016 campaign. They also stunted irritating that judge merrick garland, who is president obamas nominee, never even got a hearing. I think if you played a drinking game, taking a drink every time they mentioned the name merrick garland, you would be quite drunk or have passed out of this time. California democratic dianne feinstein, the top of the crowd on the panel, said she saw it has her role, to determine whether he was in the conservative mainstream or not. Speak of the most important think today is that the gorsuch hearings, what should have been a moment for the trump administration, that is the best is the one that has the widest support, and showed really good judgment, got burie buried. Buried in the other hearings. If they were of completely overshadowed. And in part, not entirely, in part because of that tweet that trump had to put out about the wiretap. And i think that is a selfinflicted wound that is symbolic of how, by many of his idiosyncrasies, he has stepped all over his presidency, particularly, the good things he has done, and the program he is now advancing. Also, lost in the shuffle, the fact that we are just a few days away from a crucial vote on Obamacare Repeal that trump brought up at the rally in louisville. But it is almost an affect on mike afterthought. It should be at the forefront. This is a truly historic event, if it goes through. Trump is focused on it, you saw him talk about rand paul as a kind of shot across the bow because rand has been one of the biggest opponents of two trumps revision. It it shows you how the static generated by trumps, shall we say, eccentricities, are getting in the way of what could otherwise be a very forceful and effective president. Bill it will be interesting to see how the rest of the week plays out. Number one, gorsuch hearing was buried because nothing really happen. It was just an Opening Statement and there were no questioning. That will come tomorrow, i think. Then, there will be more exposure. Number two, the president didnt mention any of the surveillance stuff tonight in the speech, that i heard. Write . He stayed away from that, right . He doesnt want to get dragged into this. He already was tweeting in the middle of the hearings, which is an extremely odd event, where a president ejects himself into an ongoing hearing on the hill, which creates all kinds of ricochets that are unintended. If so, he was trying to get into it but the rally was not the place to do it. Bill going to your point that he may be he understands that all of this crazy controvey is hurting his agenda. I was looking for that tonight and it looks like they probably normally, he wouldnt. Normally, he would address something that happened like that, say, oh, these pinheads, they are doing this, fake news, nothing happened. He stayed away from it all and stayed on policy. Maybe he is changing his style a little bit. I doubt it. Bill okay. You are not a fan of his. I am giving him the benefit of the doubt and saying that may be, and that is a key word he is. You know, in order to comment on somebody, you dont really have to be a fan. Bill you spin him negative a lot. When i commented eight years about obama, i never heard him say, but that is because you are not a fan. Bill i told you that you are not a fan a couple times. But you spin trump negative most of the time i do know you do. Im not saying that its a bad thing, you are a commentator come you are paid for your honest opinion. I have never criticized you in that way. But the truth is, he was been trump negative. Do you disagree that what he did with that tweet on the wiretap was a disaster . I think the way that you said it, itll be better if you stuck within the facts, which is a euphemistic way of saying, stop making stuff up, which is how i would put it. And the fact, the one statement he made that people really didnt see is, we have had all this incredible speculation about the crimes and the collusion and all of this, for which there is, as yet, zero evidence, the only crime we know about, the only thing we know for sure, which was a felony, which was is the unmasking of flynn and the leaking of that. That we know actually happen and actually is a very bad thing. Bill i got to run but i want you to make a prediction for us. Do you believe the fbi is going to arrest leakers . I dont know if there are going to arrest leakers. I think they are going to pursue it. They have to. Bill they have to. But if they cant get them, they said, 20. There were 28 people. If they cant get them, it doesnt bode well for the country. We went 40 years before finding out who was at the watergate leaker. It is not that easy. Bill this ones a little easier. Earlier today cap by an Interesting Exchange between congressman trey gowdy and fbi chief james call me about how to handle journalists who report National Security secrets. Is there an exception in the law for reporters who want to break a story . That is a harder question, as to whether a reporter incurs credible liability by wow publishing classified information. I am not a good a lawyer as mr. Schiff said he used to be. I dont know about that but the statute does use the word published, doesnt it . That is something that the department of justice has struggled with it. I know they have struggled with that, lots of people have struggled with it, but you are not aware of an exception in the current dissemination of classified information to statute carves out an exception for reporters . No, im not aware of anything carved out in a statute. I dont think a reporter has been prosecuted in my lifetime, though. Bill that was wrong. Judith miller went to prison. And we will have judith on this program tomorrow. So, brit, do you believe every reporter violates National Security laws, he or she should be charged . It depends on how the violation occurred. If the report of a leak of classified information and wrote a story about it on the story was published, i doubt very seriously that under the first amendment, a reporter could be or would be successfully prosecuted. If, however, the reporter were to come by the leak by a burglary or otherwise some kind of theft or other crime, that would be a different matter entirely. The mere act of publishing or reporting i think is protected by the first amendment, which is why, as comey said, there hasnt been a prosecution. She wasnt prosecuted for her reporting. Bill it is and it isnt. Thats right. She was prosecuted because she wouldnt say who broke the law. And she knew. So, she wouldnt say who broke the law and she knew. It is an extension. You are right. It is not exactly the same thin thing. Congressman gowdy said, the law, as written, comes up against the first amendment. I think it should be defined in a different way by congress because you basically have two tracks. And if john adams were president , he is going to put you in jail. And if barack obama is president , he isnt. If so, we need to have more definition. Now, bob woodward and i bill, remember, Anything Congress writes about this, any law, would still have to pass and then you have to deal with the question exactly. You can clarify the law all you want bill it is in the law thats true. Bill if you believe, you come up in congress, that the public is served by having journalist to classified information and publish it, as the law now says, without any kind of sanction, then, say it. Now, because we have chaos. But lets advance the story. Bob woodward and i did this last weekend we shot it out. My contention is, there are usually ways you can get around the breach of National Security if you are a journalist. There are usually ways you can do that when you are given certain information. But now, it is like, we know we are not going to get in trouble, we are going to throw it on page one, and the rest be damned. I think that is the attitude, particularly if they dont like the president and they dont like donald trump. I think thats true. I think that was certainly the circumstance in the pentagon papers case, it was all about the vietnam war. Most journalists did not like or support the vietnam war. The newspapers that hire them did not, either. They were only too happy to reveal the secrets of what the pentagon, with a study that was so classified had found about that war. The same was true, when i was working with a syndicated calm down my columnist Jack Anderson and he published a huge trove of classified papers that related to the nixon administrations policy towards india and pakistan about or the administration of clearly lied. Classified information revealed the lie, it was the subject of a Pulitzer Prize for Jack Anderson. While there was tremendous consternation over the leak, i believe the leaker was eventually identified and punishedught that he would ever be prosecuted and he never was. Bill that is another facet of the story. If you are exposing government to lies and corruption, certainly, you cant be prosecuted. I think that should be put in the law, as well. If people get killed one mans malfeasance is not another persons virtuous conduct. At all dispense on where you sit. See what it is intent. If i release classified information about our navy seals in syria and six seals get blown up the next day, i think im responsible for their deaths. Okay, so, there is a difference. Classified information, being leaked to the press, just on any basis at all, i think journalism has to be responsible in some sense. Or held responsible. I think thats right. What normally happens in those cases where there are some kind of secret military operation or other secrets that would place american or other lives at risk, most of the time, when you have a document like this, you will run it by the agency involved, run it by some government official, to get a reaction. That is part of what you do. You may get it appealed to by the government to say, look, this is going to cause all kinds of problems for us in this conflict we are in or the surveillance. Please hold off. To journalists, many times, have done that. That is not codified in the law anywhere. Bill okay, but that is obsolete because of the internet. The internet has made that kind of practice obsolete. He will always find a smear merchants to put it out. And that is the big difference. That is why these laws have to be here.
