New poll from the Associated Press says that americans do not trust congress or the Major Political parties. First question what is your confidence level as far as congress is concerned . 4 , that would be 4 a great deal of confidence. 48 only some. 46 hardly any. Confidence in the Republican Party 8 a great deal. 40 only some. 51 hardly any. Confidence in the Democratic Party. 15 a great deal. 41 only some. 43 hardly any. Confidence in the president and executive branch . 15 a great deal. 50 only some. 43 hardly any. Finally confidence in the military. 68 a great deal. 37 only some. Just 7 hardly any. So you can see that the biggest loser in this poll is congress. Only 4 of we, the people, having a great deal of confidence in it and heres why. You may remember last july 32yearold kate steinle was murdered in San Francisco. She was out for a walk with her father when an illegal alien felon convicted in the u. S. A. Seven times deported five times shot her in the back. The man Mexican NationalJuan FranciscoLopez Sanchez had been released from jail by the San FranciscoSheriffs Department. That despite the fact that ice, homeland security, had asked San Francisco authorities to keep sanchez incarcerated until they could pick him up. The Sheriffs Department secretary of defense no. Backed by the San Francisco board of supervisors, which actually voted not to cooperate with the feds on illegal alien crime. So, i proposed kates law whereby any convicted aggravated felon who defies deportation, that means comes back, could be immediately taken into custody by authorities and then sentenced to five years state penitentiary. Ten years second. That would give Law Enforcement a powerful tool to sweep dangerous foreign nationals here illegally off the streets of america. Yet, congress would not pass kates law. The despicable harry reid blocked it in the senate. Then republican majority leader senator Mitch Mcconnell did not put the proposed law up for a vote. A stand alone vote. Instead, mcconnell attached it to a sanctuary cities bill that he knew would fail. In the house, there was confusion as well. And kates law stalled. If we, as a country, cannot pass a simple law to protect innocent people like kate steinle from harm, from foreign aggravated felons who defy deportation, if congress cannot do that, it should go out of business. Thats how bad the situation is and thats why most americans have lost confidence in the house and senate. The steinle family broken hearted, of course, and on friday they announced they are suing the federal government, the city and county of San Francisco and the former sheriff there. They are also suing sanchez, the alleged trigger man. In just a few moments, is it legal will have more on the lawsuit. Summing up, i have been practicing journalism for more than 40 years. I have never seen federal, state, and local authorities act so cowardly. Kate steinle is not alone. Other americans have been killed by illegal alien aggravated felons. And congress does nothing. When it easily could. Or am i wrong on this . And thats the memo. Now for the top story. The bigger story with disenchantment with those in power. Joining us from washington charles krauthammer. And you say . And i say that i commend your passion for kates law. I think your connection between kates law and the numbers you cited about the disaffection people have with the parties, with congress, et cetera, its quite unsupportable. I mean, there is no i would support kates law tomorrow but the idea that it has had any effect. You miss the point. Im just giving that as an example. One example. But a vivid one. Of how ineffectual congress is on a number of issues. Not just that. But even in this particular case, the fact that the family is suing authorities, these are executive authorities. Yes. And not legislative authorities. Its the failure of the sheriff. Its the failure of ice. Its the failure of the administration. Its the failure of San Francisco. Yes. Which itself declared itself a san sanctuary city. People get the government they deserve. Wait a minute. The reason i used kates law is because its so simple and as you know im a simple man. That, i know. We have walked this through. And the people who watch this program and read about it on the internet, in the tens of millions, okay . They know that congress did nothing when congress could have. And not difficult to pass this law. They didnt do anything. Both parties. This is a prime, vivid example of how congress does not represent the people of this country any longer. Is it not . Look, i think if youre talking about the effect that congress has had on the standing in which it is in the minds of the american people, there are a lot of large items here that we can consider. Number one, obamacare, affecting tens of millions of americans. Millions of them lost their insurance. Republicans fought that. Im not talking about the party one side or the other. Im just saying congress has an institution thats pass laws that have left people extremely unhappy. Obamacare is the number one exhibit. In fact, i would say its quite remarkable that all these complaints are about congress in the abstract, the parties in the abstract. This is the result of an 8year administration that has lift the economy in the doldrums, growing at 1 . Historically the worst recovery since the second world war. It is responsible for eight years of growing inequality, which ironically, the democrats are the ones who decry. It is responsible for the collapse of americas position abroad. Everywhere you look, every relationship with russia, with china, iran, syria, iraq, our allies dont trust us, our enemies have absolutely no respect for us. This is an eight years of a failed administration. And for the life of me, i mean, i have my theories, but why the blame is so much apportioned on congress in the abstract or republicans in the abstract. I will tell you why. When this is the work of a democratic administration. Im taking this out of the partisan realm here. Promised the moon and delivered nothing. I dont disagree with you that the Obama Administration and democratic congress, all right, is responsible for a lot of bad things. But i will tell you this. You did not hear one, not one let me amend that, senator grassley, senator mccain, few others. Did you not hear any of the Congress People passioned like i am about Kate Steinles murder and others. There are legions of others. They just dont season to care. And thats why 4 of americans have great confidence. 4 . That cuts across every ideological line. Every party line. The folks know congress is not looking out for them. Last word. Well, i think that has to do with a broad range of issues. Again, i respect your passion for kates law. But the idea its at the root of any of this i think is nonsense. Its not at the root its just an example of why. To you its a symbol. Its a symbol of what. Also on the vet front this controversy over how the american sniper, chris kyle listed his medals. Joining us from boston. And if the press has any more questions, they can go to the individuals that he published, the individual organizations, because he spelled out their names and dollar list. Right. Now, why do you think, colonel hunt, that this became a controversy . I think first of all, trump created it. Im very glad and thankful he raised the money. He announced it in january. Didnt answer questions and today should have been he buried the lead. It should have been he gave this great amount of money to a great bunch of vets and everyone is thankful. He decide to do do the attack thing. He buried the lead on this. I think part of the problem is how it was announced. And, by the way, the way to do, this bill, and i hate to do this, is the way you give money. People dont understand you give millions of dollars to charity. Im involved in a couple of them with you. And you do it, and you quietly go on your business. Thats not how this was done. Again, the lead is thank you for giving money to the vets. But he created his own controversy. But why would you say that when there was no data, colonel, that said he didnt give the money. It was basically a supposition, fabricated by antitrump people in the press. I mean, there was no data that came out and said trump is stiffing the vets. There was no accounting that said that. So why would you be so hard on trump . Because he did this in january. He skipped the fox debate and made the point. He is the one that brought this up. He brought it up. He didnt quietly do it. I want to do make public of it. He wanted to use it politically. Thats fine. Im glad the vets. Believe me, i think its wonderful they got the money. But then you have got sometimes you are running for president of the United States. You have to account for some stuff. Wouldnt do it. The press kept pushing and he did it today. I think the press kept pushing with insinuation rather than objective. He buried the lead today. I dont think he buried lead. Absolutely buried the lead. The press insinuated something that isnt true and today trump corrected the record. Maybe some great vets got some money. The lead is that the vets got money. Yeah. Thats a big deal. Thats the lead. Not this other stuff. All right. He said everybody got the money. All right. Lets get over. Thats a good thing. Lets get over to chris kyle. All right. He is the navy cereal who was glorified in the movie american sniper in the book. He said that he received medals, let me get this right, okay . In his autobiography keil two silver stars five bronze stars. Again the press, captain nash, is insinuating this is bogus. Comes from website called intercept. I checked it out because i know kyles wife, clinton eastwood, i said is this a problem . On the navy separation papers it says that kyle received two silver stars and six bronze stars. So he under estimated his according to the navy separation papers. And the press is going attacking kyle. Can you explain this to me, captain . Yeah. It seems to be a confusion between what this, as you say, this group came out. The intercept. Greenwald is one of the founders of this. Antimilitary guy. If you look at some of the other stories they have covered, they clearly pick and choose very carefully the stories that they cover. This one, the bigger question to this, bill, for me is why this . Why now . Because there is a discrepancy in the paperwork. As you pointed out his dd 214 which is the paperwork that dave hunt and i got, all people get, it lists very carefully there what medals you received. Two silver stars and six bronze stars according to the dd214. The freedom of information request, that the intercept put in, came back and it said one silver star, three bronze stars. So they have jumped on this discrepancy. Sure. To try to make it something. And we dont know why the discrepancy has taken place. Correct. Try to find out. It would be a terrible black eye for her to come out of the biggest, most important delegates to the Democratic National convention, california, with a loss. Particularly when she was leading by such a margin before. Its a black eye. Its embarrassment. So what. Does it matter . Yeah, it does. It emboldens Bernie Sanders. To do what . Look, heres my theory. I wrote about this in the wall street journal column last week. Its not what i used to think what does bernie want . I dont think thats the case any longer. I think what does bernie want to ask for that he knows he is going to get . I think he wants to create a Political Movement that lasts well beyond this election in order to draw the Democratic Party further left. He has already done that. But he has had Great Success at it so why not keep at it. He has already done it and i think he wants to do more of it. Thats why he is doing things like endorsing democrats in contested primaries. Thats why he is talking about a platform where he is going to have a bunch of fights set up that he is not going to win so he can sort of create some resentment and targets for future campaigns and future. What you are saying is in a fairly verbose way is that it really doesnt matter. All of this is just show but there could be images at stake for both bernie and hillary. See, for me, i just think its just boring now. She has got it. I know everybody has to vote. But, it doesnt matter. The fix is in. I think these super delegates are corrupt. I think Bernie Sanders might have beat her without the super did he goes. And if i were Bernie Sanders, i would be furious. And, look, thats one of the demands that i think is he going to make and the democrats are going to turn him down and that creates resentment. In the is it legal segment tonight. Two very hot topics, how could a 4yearold boy fall into a zoo cage housing 450pound gorilla. We told you in the talking points memo the family of the murdered kate steinle suing the government and San Francisco authorities. Here now Kimberly Guilfoyle and lis wiehl. What is the heart of the steinle lawsuit . The heart of the lawsuit is that the government incompetence of the government is the heart of it. That they did everything wrong from the San Francisco sheriff all the way through ice, all the way through the brewer of Land Management and that caused kates death. We are talking about negligence at every level, incompetence at every level and that caused kates death. The sheriff, the famous march. Sanctuary city there. You are not sanctuary cities, you dont have to speak to ice about immigrants, illegal immigrants. He wept so far to say no, you will not speak to ice about illegal immigrants. So that let this defendant go. Not getting any justice in the congress as we pointed out. Now turns to the court system. But its not easy to sue officials. No. Its very difficult. Very difficult in this country to do so. However, as wiehl points out, this former sheriff made statements that are against practice and settled law. Right. So he himself is a law violater. You could say. You could say. And, they would try to seek damages by attaching liability that he is an agent of the city, therefore, any judgment against him, the city would have to pay. There is four specific causes of action. The general ledges, wrongful death against San Francisco, you know, the sheriff, Lopez Sanchez and the u. S. Government. This will be very tough to prevail on any of these. Public entity negligence wrongful death against ice as well, which is going to be tough. Because ice is going to say, listen, we told them what to do and they didnt communicate back to us and deprivation of federal civil rights as well. So they are suing on the civil rights basis to say that their daughters civil rights were violated because america would not enforce the law. Correct. Federal law. Exactly. Wasnt enforced. Deprived her of life and liberty without due process. If im on a jury, this would probably be a jury trial, right . If im on a jury im going to favor the family. Hugely sympathetic plaintiff here. Right. But the federal law was not adhered to by the San Francisco authorities. I dont think she is going to get a federal federal is not the but the local could absolutely work against the city and county of San Francisco. And also the proulx of Land Management for failing to secure the weapon that, in fact, killed kate steinle was stolen from a car. Thats small ball. I think what they call exposure lies in the city of San Francisco. But, either way,. They should settle it. The lawyers are going to do this on pro bono, im sure. They are going to make it a National Cause to embarrass all of these people. Because, as i said, its not just kate steinle. They cant risk in going to trial because sympathetic plaintiff. Thats in the liability going forward. City may settle. I think that they have to. The stakes are too high. They settle only if kates parents want to settle. I dont think this is about money for kate. The settlement itself would get an enormous headline and send a message to sanctuary cities. True. Im not going to try the case on tv but damn well going to follow it the boy at the cincinnati zoo. Right. Somehow he gets over 3foot barrier. He himself is just about 3foot tall. Crawls through foliage and falls into a pit, 15 feet, falls down into a foot of water. And he meets harambe, 450pound gorilla. Roll the tape. [screams] oh my god. [screms] everybody back up. Mommy loves you. So the boy is with harambe for about 10 minutes. Yeah. 10 minutes. And then the zoo authorities shoot the gorilla dead, provoking an outcry. Right. For our purposes here, do the parents have any legal deficit . Well, there is an investigation and there could, in fact, be negligence and failure to care for a child properly. Reckless parenting. How did this child was able to get through like some kind of houdini. Paying attention to a 4yearold. You have got to pay attention, especially if you are in a situation like this and gorilla exhibit 450pound animal with a moat dropped. And the child kept saying i want to go in the water with the gorilla. Do i think anyone can be ultimately successful suing against the zoo because they have had a really great safety record. I think the parents should be held accountable. The parents are in a little bit of trouble here. Yeah. Ultimately are they going to say thats intended. The parents also had a kid that could have been killed. So people are going to be a little bit sympathetic. Sympathetic to the parents.
