That is the subject of this evenings talking points memo 26yearold Kayla Mueller from arizona is dead. Apparently isis contacted her family providing proof they had been killed by them. This makes four americans executed by the jihadists. Kayla was captured by isis on august 4th, 2013 in syria by leaving a hospital staff doctors without borders. She was in syria to help suffering refugees. President obama said quote the United States will find and bring to justice the terrorists who are responsible for kaylas captivity and death. Isil is a hateful and abhorrent terrorist group whose actions stand in stark contrast to the spirited people like kayla, unquote. The fact that these jihadists have been able to continue to murder americans with impunity should trouble the entire world. As talking points mass mentioned president obama has received advice about terrorism from two former secretaries. Advise he has rejected. The reality is they are not going to be able to be successful against isis strictly from the air or strictly defending on the iraqi forces or pers member go. So there will be boots on the ground if there is to be any hope of success in the strategy buy mr. Obama said no to targeting isis on the ground why . Here is what leon panetta says. You have the director of the dia, general flynn. All right. Who recently retired. You have the outgoing defense secretary all saying to the president , its not working. All right. These guys are going to park there. They are going to sit therenned in syria and iraq and continue their atrocities killing civilians, yet the president says if is working. Im not getting that. Do you understand it . Well, i dont think, first of all, we had a lot of people like the people you just described, people who are very respected in our society who made very convincing arguments for the iraq war. Lets not assume that he theyre right. You are willing to give them the assumption that we should follow their lead. And i think where the president is coming from is i dont think he buys into the idea that putting troops on the ground is going to solve this problem. I think its i think its probably true that without troops, its going to be very difficult to grade isis. That said, i dont know that putting troops on the ground would necessarily we wouldnt necessarily have the results that we would want to have. We could end up facing worse like we did in iraq. Estimated 40,000 fighters in isis and you would be able to marshall in the coalition of 60 nations monica. Hundreds of thousands of troops with air power that isis doesnt have and you would think that they would be able to defeat them fairly readily. It wouldnt be easy but they would be able to do it. But, president obama doesnt want to do that. And thats what troubles me. He just doesnt want to do it. He could do it, American People would support it. Particularly with the beheadings and the fire and now this poor young girl, kayla. American people would support it. Not to occupy, just to go in get them, get out. But he doesnt want to do it very troubling situation,. I think there are two reasons he wouldnt do it. He came into office with two firm beliefs. One that he was the antibush. Meaning that he was not going to preside over any major intervention, particularly in the middle east and particularly in iraq. Number two, this is a man who a committed leftist who essentially believes that American Power has been in nefarious tool for global injustice. Therefore, the u. S. Should atone for that by retrenching and apologizing and retreating. He has done all of those things and thats why you see this systematic policy of minimize minimizing the u. S. Footprint around the world, particularly in the middle east and minimizing the nature and scope of the threats coming at us we have a situation now kirsten where you have this group. And he says through his ambassador rice not existential threat. Not like world war ii or the cold war. Do you agree with that by the way . That its not like were world war ii . Yes i agree with that. Not existential threat to this country. At this point its not. No its a threat to the middle east. And i just im sorry, i just have to say, i cant listen to this stuff about how barack obama doesnt understand the threat of terrorism or that he has this tiny little view of the u. S. role in the world when he expanded the drone war. He escalated the war in afghanistan. And, by the way, we have been bombing in iraq every single day. Why are you suggesting. Why would you suggest that the president doesnt care or doesnt use American Power which im just telling you as somebody who opposes a the love the American Power that he uses. So this narrative is just is completely false. Its just completely made up. Let me understand. This you oppose the American Power, okay. You dont want Ground Troops over there you are willing to live with isis group hop is occupying these thousands of miles and killing civilians you are willing to live with it. You are missing my point. No i am understanding it totally. First of all i dont oppose American Power. I think that American Power should be used wisely and smartly and it hasnt been in our recent history. And i think its wreaked a lot of damage and harm with other people. Now . It the same thing you are saying now was about iraq war, no occupation in and out, were gone. Its not going it happen and then look what happened we went in there. We are seeing it before our own eyes. We are seeing it before our own eyes not like the iraq war. I wish that you had spent as much time on the 4,000 soldiers who died in iraq as you have on these beheadings . Because, if you had, i dont think that we would have been over there as long that we were. Thats one of the cheapest shots that you have ever made. Its not a cheap shot. I went there. Those are 4,000 lives that are gone. We are now supposed to go to war. Its a tragedy that these people were beheaded you are making out that were supposed to go to war because of these four people . The update now on Brian Williams. Nbc news has just issued a statement suspending its lead anchor and managing editor for six months without pay. In a memo that came out just about 20 minutes ago the president of nbc news says the suspension will take effect right away as she put it. This comes after Brian Williams apologized on air after some members of the military called him out for as they put it, exaggerating his experience during the iraq invasion back in 2003. Brian williams had repeatedly over the last decade that he rode in a helicopter that was hit by rocket propelled grenade or other fire. He now admits that was not true. Of the memo says in part, quote brian has a responsibility to be truthful and uphold the high standards of the News Division at all times as im sure you understand this was a very hard decision. Certainly there will be those who disagree but we believe this suspension is appropriate and proportionate action. Memo is from the head of nbc news deborah deb turnness. So you say that at first they were interested in justice pause thats their name right . And now they are not. They are interested in promoting left wing causes. You, i understand, come to that conclusion because you work for or with the let me get the name of it correct. Family Research Council is. Right, which accused back in 2007 the Southern Poverty Law Center of inciting a violence terrorist act against them correct . Correct, bill, in 2010, the Southern Poverty Law Center labeled frc as a hate organization. By 2012, frc was attacked by gunfire, by a person that the fbi has called a domestic terrorist. Yesterday floyd right. And the group, family Research Council says he was motivated by this Southern Poverty Law Center. Its the same subject. Gay marriage, right . The same subject that carson absolutely. Now the Poverty Law Center says carson is an extremist. And how do you feel about that . I think it is ridiculous on its face. Just think about ben carson. He came from a single parent household he and his brother worked himself out of poverty. Got married, has children. Has tremendous career as neurosurgeon and he gives back. He is the prime example of how you break the cycle of dependency and now we have the Southern Poverty Law Center attacking him as being a hater because he defends natural traditional marriage. Last question right. Do you consider the Southern Poverty Law Center a hate group . I consider them to be a group that perpetuates the vision in our country and mislabels folks to the point of having violent acts perpetrated against them and i think that has to stop. Its problem with anchors which come in and out and its trouble on social media and the rest. The ratings whoas with msnbc, change over in management after comcast bought the network and through it all the one stallworth of nightly news was nbc news with Brian Williams. It has enjoyed high atop the ratings and frankly across high credibility ratings across this nation. Abc world news changed to abc world news tonight as diane sawyer left and bill mier came in. Often where nbc might be able to capitalize. And all of a sudden one thank you at one hockey game turns into a spiral that absolutely no one could have predicted. Deborah turnness the relatively new head at nbc has sent out a statement and before we begin some analysis i want to read that statement for you in its entirety. The memo is from nbc news president deborah turnness and its addressed to all. Meaning all within the nbc news and comcast family but it is certainly for all the world now. And i quote we have decided today to suspend Brian Williams as managing editor and anchor of nbc nightly news for six months. The suspension will be without pay and is effective immediately. We let brian know of our decision earlier today. Lester holt will continue to substitute anchor the nbc nightly news. I will pause for a moment. Lester holt as you may know is a longtime weekend anchor of nightly news the long time today show anchor as well and he anchors dateline for nbc in addition. Going on with the statement from deborah turnness at nbc, our review which is being led by richard he is being led by kim harris is ongoing. He works for their Investigative Unit and she goes on but i think it is important to take you through our thought process in coming to this decision. While on nightly news on friday january the 30th, 2015, brian misrepresented events which occurred while he was covering the iraq war in 2003. It then became clear that the other occasions on other occasions brian had done the same while telling the story in other venues. This was wrong and completely inappropriate for someone in brians position. In addition, we have concerns about comments that occurred outside nbc news while brian was talking about his experiences in the field. As managing editor and anchor of nightly news brian has a responsibility to be truthful and to uphold the high standards of the News Division at all times. We thought it would have been wrong to disregard the good work brian has done and the special relationship he has forged with our viewers for over 22 years. Millions of americans have turned to him every day. And he has been an important and wellrespected part of our organization. Deborah turnness goes on as im sure you understand this was a very hard decision. Certainly there will be those that disagree, but we believe the suspension is the appropriate and proportionate action. It goes on this has been a difficult time but nbc news is bigger than this moment. You can work so hard and dedicate yourself each day and every day to the important work of bringing trusted, credible news to our audience. Well, you know he, everybody in our business suffers when somebody is high profile as a network news anchor has to go on television and admit that he lied. Unfortunately he botched the apology. Told further inaccuracies and that was a set back as well. This will hurt nbc nightly news in the shortterm. What steve burke and the other executives are looking at in the longer term is how do they salvage this situation without losing Brian Williams all together. They had so much invested in this man and so this would be an attempt to have things cool off some point he will come out with a more full throated apology than he managed at first. And maybe we will all have scandal, the next outrage. But on balance i think this makes sense for nbc news because there was no way they could let this stand with a mere slap on the wrist. Brian williams, the managing editor and anchor of nbc nightly news has been suspended tonight by the nbc news president deborah turnness for six months without pay it. It came with a lengthy statement. The first apology for Brian Williams misremembers came last wednesday on nightly news. And it seemed to begin all of this. And here it is. I made a mistake is recalling the events of 12 years ago. It did not take long to hear from some brave men and women and the air crews who were also in that deserted. I want to apologize. I said i was traveling in an aircraft that was hit by rpg fire. I was, instead in a following aircraft. Well, there is evidence to indicate that he wasnt that isnt exactly what happened. That, instead, according to the stars and stripes newspaper as you may have heard on megyn kellys program on friday night according to megyn kellys reporting and that of stars and stripes, Brian Williams was actually in a chopper going opposite correction. Had a head set reported these problems that did occur. A number of brave americans were certainly in a lot of trouble. Brian williams, as the fax seem to indicate now as it turns out was not there. Anchor of Fox News Sunday Chris Wallace is with us. He joining is from washington. Chris, you worked at meet the press, and know the nbc family well. This is a really stunning turn of events. Well, absolutely. I mean look, Brian Williams is the most popular, the most watched news man in america just this last week 10 million americans watched his show on average for the last five nights. I dont think anybody is ever going to recreate the trust, the credibility that Walter Cronkite had, but Brian Williams was the lead anchor and in, what, in the course of about a week and a half, he has had a stunning fall from grace and this is a stiff penalty six months suspension. Think he will ever be back chris . I think it depends what we find out. I think it depends on if what we know is about whats there. There are certainly already questions about some of the stories he told if not on nbc, in other venues about katrina. Dont seem to bear out, you know, you could hit a Critical Mass where people just say we dont trust him anymore. But even if it is this, even if he does come back, its six months. There is a lot of public disgrace to it. There is a lot of money involved according to reports he had signed a contract for 10 million a year, so its a Million Dollars penalty. So and, also im looking at the memo that debra turnness the president of nbc news sent, and whats particularly interesting is steve burke, the ceo of comcast, the company, the Parent Company of nbc hasnt an even tougher message. He says brian has jeopardized the trust millions of americans place in nbc news. His actions are inexcusable. The suspension is severe and appropriate. Brians life work is delivering the news. He deserves a second is chance and we are rooting for him. Thats pretty tough. Inexcusable, and that the suspension is severe and appropriate. I mean, you know to take the face of your News Division in some ways the face of your network and not to say he didnt deserve it, but this is a pretty stiff penalty. I have to say personally, the idea that they are going to give him a Second Chance see what happens, and not immediately, you know impose the Death Penalty also makes sense to me because he has had a very distinguished career. And it, would if they so choose chris thanks give them time to figure out where to go next. Much has been said about who might replace him. Certainly they have a very capable anchor in les are holt who has been working weekends for them for a long time. There have been suggestions of others from the today show. But to say that they are reeling at nbc news this night is to understate the obvious and to our friends at nbc who work very hard every day to get you the news and had nothing to do with any of this all our best. Reporting from california. In the legal segment three hot topics beginning with the state of alabama. Defying the federal government on gay marriage. Just 10 of alabamas 67 counties are issuing same sex marriage licenses. The rest are defying a court order. Joining us now from new york attorneys and fox news analysts Kimberly Guilfoyle and lis wiehl. Please explain this so i can understand it how you can defy the federal government . I will try my very best. What this judge in alabama is saying the state court is saying look that federal judge, they went way past what they should have done. There is nothing in the 14th amendment. There is nothing in the constitution that says that you, the feds, can define state marriage. Can you define what marriage is. So you overstepped. You feds. You overstepped your bounds. There is a another technical argument as there as well. He is saying the attorney general of the state really has no sway over the probate judges, which are state judges and they are the ones actually giving the marriage lcheses out there. Is a big constitutional issue and smaller technical one that this judge is relying on i think wrongly but thats what is he relying on. Guilfoyle, judge moore does not have the authority to tell a federal government its overstepping its bounds. Thats the Supreme Courts job, right. Right. They are going to hear this in april. We will hear what they have to say. I think what the the big take away from this case is we saw a defense by Clarence Thomas and scalia when the Supreme Court refused to hear this. I think the big indicator of how they are going to rule in april when they have the opportunity. They were displeased with this. Of course, believing in states rights. Since marriage is a state right that is afforded to the people who live there but nevertheless, i think we see how this is coming down. All right. Now, final question on this. It is shades of what happened in the civil rights era. And i dont happen to believe that marriage is a civil right. So im not making that comparison. But, the federal government in alabama had to remove governor wallace, George Wallace who wouldnt enforce the desegregation laws is there any difference, wiehl . Yes well, there is no difference. I think this judge will be removed. There is a procedure to go through in alabama where you can be removed. He said dont forget this particular judge was removed back in 2003. This is the 10 commandment judge he then got reelected. I think he will be removed by this process. Removed by whom . Who will remove him. It goes through a process in alabama. The alabama courts and the ethics boards look at this and decides whether or not to eremove him. I dont know if the state of alabama as a conservative state is going to take that action but we will see. Keep your mind he thinks he is upholding the will of the people 18 to 91 . Banning state marriage. The federal court threw that out. Moving against the popular judge. The federal court threw that out and dont forget about the supremacy clause. When you have a clash between a state and federal law, the federal law wins. The federal law trumps. Okay. In missouri, a 6yearold boy, and we feel terribly sorry for him was kidnapped by his own family. Roll the tape. Detectives say 38yearold denise craddle contacted her coworker to kidnap her 6yearold nephew. Apparently the boys mother 2 ayearold Elizabeth Hupp and grandmother 58yearold rose brewer along believe ed he was too friendly with strangers and needed to learn the dangers. After school monday, Authorities Say he lured the youngster into his truck. Wow. What happened after that guilfoyle . He lured the kid into the truck. He lured the little boy into the truck, and then proceeded to scare the boy so bad and show him a gun, told him to stop crying bound his hands and feet put a jacket over his head, took him into his own home into the basement he was still blindfolded and could not see. They took his pants down. His mom said oh you might be taken in as a sex slave. All of this was to teach a lesson and to avoid strangers, right . Stranger danger. Guess what . Charged with felony kidnapping. Take a look at that now. They are looking at significant time behind bars. The boy has been thank god removed from the home because this is not a safe environment for any child to be in. Its a horrific experience. Thank god he told the teachers at school. 6 years of age. Thats how they found out he had to go tell the school. Otherwise, they would have never found out about this. I want to point out no father in the picture right there. Okay.
