that is the subject of this evening's talking points memo. as you know, if you watch us often, we are not in the business to small ball barack obama. we don't nitpick, we don't play gotcha with the president. of course we are critical when his policies don't work. we have given him credit in the war on terror but we have hammered him on the economy. all and all the economy has been fair to mr. obama. now, something has arisen that is very disturbing it directly involves the president and his lee leaguered attorney general eric holder. no question that someone in the obama administration is leaking national security secrets to the "new york times." the best example was the "times" article on how the u.s. is conducting espionage against iranian nuclear facilities. that leak was extremely damaging to the united states of america and whoever did it should go to prison for a long time. under pressure, the obama administration has announced it will investigate the leaks and they appointed two u.s. attorneys. rod rosen stein who was nominated by president bush the younger and serves in maryland. and ronald machin an obama guy who serves in washington, d.c. the problem with machen is that he has given money to barack obama worked on his campaign and owes the career to the man. come on, if the fix isn't in on that appointment, there is no such thing as a fix. are you telling me with hundreds of u.s. attorneys machen is the guy to do this? it's unbelievable and arrogant. do the obama people think i wasn't going to report this and other honest press people wasn't going to mention it? >> this is shades of richard nixon who tried to get away with watergate by having his krohns like john mitchell investigate it talking points is is not equating today's national security leaks with watergate. the investigation blueprint is the same as nixon's. president obama has to realize that he is in trouble. that his re-election might not happen. the economy is bad and the president's policies in that arena haven't worked. americans know it. so mr. obama can't afford a scandal of any kind. that's why attorney general holder isn't giving up the fast and furious documents. and that's why the investigation into the national security leaks is being handled in an unprofessional way. every fair minded person knows that independent council needs to be appointed to look at the leaks. that person should come from outside the government. and that's the memo. now for the top story tonight. reaction with us attorney and fox news anchor megyn kelly covered the story on her program "america live" this afternoon. what say you. >> there is a question whether is he objective when it comes to president obama who he has described as a legend. weighs one of the very first donors to his senatorial campaign and presidential campaign and his wife, too. >> they all went to harvard together. the other guy is a republic appointee but also in the past declined to pursue charges when he did a special investigation under the clinton administration so, and he has got bipartisan support there is a question about whether both of these guys are the right guys to perform a truly independent. >> bill: really not a question. they are not the right guys. >> they both report to eric holder. that's the other thing. >> bill: let me stop you. there is no question. they are not the right guys. if you want an aggressive, fair investigation. they are not. >> but there is a strong argument that this is all a distraction and that you are buying into the distraction right now. >> bill: distraction from what? >> because these u.s. attorneys are not going it find anything and if they do it's going to be years. >> bill: wait, i don't understand. >> and an independent council would take years to get to the bottom of this, bill. >> bill: and we all know that. >> long after the next presidential election. that really meets the goals of the people you say are compromised here. >> bill: the only person in the country who could get this done before the election is me. i'm not going to be appointed, all right? >> i do believe congress could make some headway trying to get to the bottom of this. >> they have really done well on fast and furious, haven't they? they are really moving along quickly on that baby. >> they have exposed a lot. >> >> bill: how long did it take them. >> they have the power to bring people in and ask questions. here is the argument, the argument both sides of the i'll are making. these leaks probably did come from the administration, right. >> bill: whoa, a headline. it's a political matter. you look at this and you decide for yourselves whether you think that these leaks should have been disclosed and you decide when you go to the ballot box in november whether that's the administration you want. >> it's virtually impossible to prosecute somebody under the leak statutes the whole legal maneuvering is a waste of time. >> bill: in your opinion it is but in my opinion it isn't. i want transparency. >> you want transparency six years down the road. >> bill: if it's six years down the road, it's six years down the road. it sends a word to other weasels yeah they might get away with it for a couple of years but in the long run they are not. >> there is a question whether you are right about that. classified information is up to president obama to declassify. if he wants to declassify that information and release it to the "new york times," he is totally allowed to do that. >> bill: he didn't do that. >> you don't know whether he did that or not. >> yes i do he said he didn't do it. >> no we don't -- if you look at his denial he says that his white house would have released classified information. it's not -- he ♪ saying that he didn't declassify any information and provide that. >> bill: you are losing me now. >> i'm saying if the president wants' to give a leak to the "new york times" and he wants to do it by declassifying classified information he is allowed to do it. >> bill: you see, this is what is wrong with law school right here. put her on -- that's what's wrong with law school. >> you start to understand stuff. >> bill: here is the story, ready? back on me. no law school. here is the story. some weasel leaked information about the u.s.a.'s program about iran. putting us all in jeopardy. all right? the president of the united states knows the leak came within the white house. somebody in there, okay? he doesn't want to find it, the president doesn't want to find it because he wants to get reelected he doesn't want to be embarrassed. he appoints a guy he knows isn't going to find it i'm mad about it and you should be too. >> what i'm telling is you if you were right about all of that then that is a matter for the voters to take into account in november and an independent council or u.s. attorneys are not going to be the answer. >> bill: okay. all right, now, lance armstrong, he says he isn't doping. and he actually got cleared, right, -- >> . no. >> he didn't get cleared? >>. no. >> bill: wasn't our investigation -- >> -- they declined to prosecuted him criminally. that's not the same as being cleared. yeah, this anti-doping agency now says that he did dope. and they are preventing him from come peelgt in this triathlon in france and threatening to take away his seven tour de france titles. >> bill: 10 guys. >> witnesses seen him dope and enhance his red blood cells. >> bill: he says he didn't do it? >> he says he didn't do it and he says all of his witnesses are admitted dorps unlike him. he said look at my performance you have never seen a spike. he he says, lack, the prosecutors did look into this and decided not to charge me and now this is just another go at t for an agency that has it in for me. >> bill: why does the agency have it in for him. >> i don't know the motivation behind that. >> bill: you and me can't solve this here. we don't know whether lance armstrong took dope, we don't know. >> we don't know. >> bill: this agency says he did and won't let him compete. >> he says he might sue that agency, right? >> he says is he evaluating all his options but the standard of proof they are operating under is much lower than a criminal prosecutor would. and they are sort of judge, jury, and executioner. he will be given a chance to have a hearing. they will have the final say. so, you know, if they have got it in for lance armstrong that's not so great for lance armstrong. >> edwards razzle dazzle. gets away with it he is not going to be retried, right? >> well, i consider myself tremendously fortunate because not only were there the verbal instances that happened and then schedule changes when he wouldn't comply with coming in on military weekends and not putting the weather channel over the military, which they have never denied but i also have emails which a lot of people do not have in these cases even when i was told my contract was not renewed it was right after i had come back from military service. you kind of look at that overall picture of timing and emails and everything else, and that builds the picture. >> bill: okay. >> that my renewal was biased. >> bill: i don't really understand this so you have to walk me through it. so you are there at the weather channel and who owned it before nbc? who owned it? >> it was privately owned. >> bill: okay. privately owned. you were on cable television. you were doing the weather. and you know, the weather channel is not competing for ratings. it's a service. all right. it's a service. you are there, you get paid a salary, you tell people what the weather is. they tune, in they tune out. you know the game. so you they're for quite some time. you are not having any trouble with your military obligation. when you need to go, they let you go, correct? >> there is always going to be scheduling challenges. but i had never felt like my job was in jeopardy to cover that. >> bill: they never gave you a hard time as far as threatening you or anything like that, the old management? >> right. correct. >> bill: so then nbc takes it over and then you are subject to scrutiny? did your superiors say hey, listen, captain, we don't like the fact that you are going off on your weekends or you have got this obligation you can't be in the studio they actually say that to you. >> i was asked a lot of questions about how much time off do we have to give you? what are we required to do? i was asked to come in on weekends they knew i had one of my military weekends. >> bill: so they set you up? you are saying they set you up they knew had you a schedule. the military is not something you say look i can't go i have go got to give the weather in kansas. i can't be there. you have got to go when you have got to go. >> right. >> bill: you are saying that nbc -- not nbc. i don't think it goes up to the top of the nbc but the management of the weather channel was actually setting you up making it more difficult for you to fulfill both obligations, your job obligation and your military obligation, correct? >> correct. and especially, you know, some of those things were one weekend it was over a hair consultation. and when you have known for months that i have a military weekend, why would you even ask a person to be coming in for something as frivolous as that the way my lawyer puts it, and i think this is well-stated is it's a little test. part of the reason that we came forward with this isn't because of my case. so many people go through this with management, especially with management changes. >> bill: but there is a tone. >> one company hires you -- >> bill: there is a tone. if you were working for the fox news channel as a weather broadcaster, i can assure you that they wouldn't be giving you a hard time because of your military obligations on fox. yet, nbc has a reputation of being a very liberal network and that's -- its reputation. so do you think that that point of view that is held by some. not all but some at nbc played into this? they didn't like the military and want to get rid of you? >> i think it's more a case because i have had support from people of all political views. that it was a bad management problem and people that were arrogant and didn't think anyone should be putting anything first and they didn't care if it was military. >> bill: just don't like captain mitchell was she is a military. you don't think it was that it's just like you should be putting this above anything else? >> correct. but the military is protected by law. so you can't do that. >> bill: all right. well, you do have the emails and all of that stuff, hope you win your lawsuit. we appreciate you coming on this evening. thank you. >> thank you. >> bill: there are currently problems in both presidential campaigns. carl rove and bob beckel will tell us what they are. later, high school students are now smoking pot more than they are smoking cigarettes. we told you this would happen. those reports after these messages. >> well, it is responding to the obama narrative that he is a vampire capitalist and untrustworthy of being in the oval office. the obama campaign has sort of attacked him a little bit but not a lot. i'm wondering if the obama campaign is trying to sucker the romney campaign into responding to them so that they can get a sense of what their defenses might be and if they launch these attacks in a more full throated way in the fall. but, look, having been in two of these, it's easy to give advice from the outside. i think they are doing most of the things right there. are a couple of things i would be doing a little bit different. one, i think it was a mistake to have their vice presidential prospects like marco rubio campaign with them as rubio did in pennsylvania. >> bill: why was that a mistake? >> look. if you are trying to make a decision about vice president, what are you going to learn from watching a guy on the stump with you for 30 minutes that you can't already come to a decision about. >> bill: what's the downside of having him there? they want hispanic voters and they are showcasing him. >> well, but then you have to showcase everybody, which becomes a big waste of time and it trivializes the process. it makes it all look like how well do you perform in third minutes on the stump with me as opposed to what's the cast in your mind. what's your judgement. how good a partner will you be to me? what kind of a strength will you bring to the ticket? what does he learn by seeing him on the stump for 30 minutes. >> bill: i don't know what the downside is though. i understand what you are saying. >> it trivializes him. it turns him into -- >> bill: trivializes him. >> how many people are we going to have? 8 or 9 or 10 people considered. have kelly and scott walker and paul ryan and marco rubio and mitch daniels and bob mcdonald and chris christie and susanna martinez and everybody else who gets mentioned in this drama go out and campaign with you? you want the focus to be on your message and you. you want to be spending your time talking about how you are going to create jobs, how you are going to go about getting the economy going again, how you are going to put our fiscal house in order. you don't want this to be turned into a process story of oh, look, mitt's -- you know, mitt's auditioning another person for vice president. >> bill: you know more about it than i do. just as a viewer and a voter, i didn't see a downside. >> no, no, no. as an elm presario you like it. impresario you like it. >> i'm back on my perch as a journalist and not a regular voter what i'm getting now is is that the romney strategy is keep them back. let him campaign in states where we think we have a chance, michigan, wisconsin, iowa, nevada, but keep him out of the national media for now. don't overexpose him. let him kind of coast through this summer without really getting into a confrontational situation with anybody because barack obama's economy is so bad that just get him out of the way and then once the convention starts the end of august and you make your vice presidential thing, then pedal to the metal. that's what i think they are doing. >> well, look, part of that is true. you do want to be pedal to the metal in september and october. and you do, after a year and a half of a very brutal primary contest, you want to give the guy a little bit of a lesser schedule to raise money and re-charge his batteries. i disagree with how you depicted a lot of this. you want to go to the battleground states. look, he is engaging obama. obama announces. >> bill: is he not going on abig national shows. he is not shooting it out with people. >> wait a minute, wait a minute, wait a minute. first of all he is doing in a measured way. this sunday is he going on cbs sunday, the sunday morning program. i would suspect you would see that ratchet up. look, you don't want to do that all now and do it all again in the fall. it loses some of the luster. you want to do it methodically and build on this as more and more people pay attention. look, one other thing. i think romney has a good answer to the obama attack on him as governor of massachusetts that he is not using. look, whifs governor of massachusetts we had 4.2% unemployment. you can criticize our job creation numbers all you like. maybe one of the reasons we were creating the number of jobs we were is we had a low unemployment rate. we were near full employment. we had unemployment rate half the rate of the united states of america. so don't be lecturing me, mr. president on it. >> bill: is that a message that you are sending to the romney campaign now? >> no, i'm sending it -- i'm answering your question and trying to be responsive to your weird question. yeah. >> bill: maybe not smart enough to figure that out and you carl rove have to give that to them so they wise up. >> no. i disagree with your characterization of romney. look, they have been very smart and very -- my hats are off to how well they have been handling. >> bill: how many -- >> -- i have about three dozen ranch hats. >> bill: every hat is off to them? >> yeah. exactly. look, you put it yourself. did you expect at this point the middle of june for in the rasmussen poll to be romney up by 4. >> bill: yeah, i did. >> i didn't. >> bill: do you know why? 23% of american high school students say they have smoked pot in the past 30 days while 18% say they had smoked cigarettes. that's a big number for marijuana. as we have been telling you all this quasilegalization stuff the medical marijuana ruse that kind of thing sending a message that there is nothing wrong with getting stoned even if you are 12 years old. here now the culture warriors gretchen carlson and jeanine pirro. are you surprised by the 23% stat. >> i was stunned but every young person i have spoken with, bill is not surprised at all. they think marijuana is harmless and attributable to two things. one is that we card people and young kids who want to buy cigarettes and number two we as a society have made this impression or set this image out there that it is dangerous, causes cancer, we have ads with tracheotomies. >> bill: you are talking about tobacco. >> young kids think grass is not as dangerous as tobacco. >> that's exactly right. >> the truth ised that the tar that sin hailed, the drugs in marijuana cigarette are just as dangerous and three times greater when you inhale it. >> bill: well, if you have a quarter of the student population, teenage population in the country smoking marijuana, at least and more, a lot of them smoke more than once a month you have a problem. it's intoxicant. >> it's all about messaging. if you look at the stat for smoking cigarettes in the 90's 70% of all kids said they had tried cigarettes. in the 2000s after the major messaging campaign it went down to 45%. there is hope here if we do the same thing that we used to do with drugs. >> bill: glamorizing pot. >> there was that campaign back in the 1980s that -- i don't remember exactly but it was under nancy reagan and there was a drop in drug use then. >> just say no. >> bill: you have got to come to grips with reality. the people who make the messages, the people who are television executives, advertising executives, they like it. they smoke it themselves. >> they do and here's the problem. >> bill: that's what they want. >> we have got 15 states that have decriminalized marijuana. >> bill: message is there is nothing wrong with it. >> 17 states have allowed medical marijuana. that suggests to young people there is a normalization. but it's medical. >> bill: i was walking down the street here in manhattan and i walked it by a junior high school and there were three kids smoking pot outside. right outside the junior high school on the street. they put up the thing and they walk right in. and obviously they don't fear teachers or anything else. kid had red eyes or walking into the locker room i would say come over here, man. you could smell marijuana on people anyway. that's one thing, the school system really isn't jazzed about it you don't see a lot of campaigns in the public school systems. the second thing is that this medical marijuana thing is oh, you know. >> it's good for you. >> you can get it in sphru a headache it is a ruiz. >> you don't even have to have a headache. >> this is why messaging campaigns can work. think about seat belts for a minute. nobody wore seat belts then it became a part of our culture. >> bill: now they put you in jail if you don't. >> now you don't think twice about getting in the car and putting on your seat belt. i'm being an optimist. the same thing happens to this. it makes parenting tougher. this whole thing with medical marijuana makes parenting tougher. >> bill: here is the danger. everybody should understand this. if you are a child ant child goes up to 17 and 18 you are intoxicating yourself on a regular basis your childhood is gone. your whole life changes. you are much more susceptible to other intoxicants because it feels good to be stoned. suburban high school in new york city they have a club called wake and bake. wake and bake meets at 7:30 house the public high school and smokes pot. >> before school. >> the stoners in the high school, you know, there is a lot of the them. every kid in the high school knows about the wake and bake club. and the high school knows about it. and does zero. >> think about it, bill, the fact that our governor came out and said what we want to do, this is just last week, is we want to decriminalize to the point where what may have been allowed in private should be allowed in public. >> bill: mayor cuomo, the mayor and the governor says you can't drink 16-ounce sodas but if you want the dooby. >> if you want to smoke a joint. >> bill: do they still call it a doe. the doobie brothers. come on. >>
