History. I want to start with something deeper and that is our humanity. Humanity is this. How can we friends given our disagreement on so many things and justice glia says i attract ideas, i dont attract people. We sought from a president in an unforgettable moment friday night. She led an amazing life. What else can you say. She was an amazing woman. She was an amazing woman who led an amazing life. But im really worried that we are losing our humanity. This was the reaction from a former cnn host. We are going to burn this thing thing down. This, from a columnist at the new york times, people have to take to the streets, just in case you thought he was talking about peaceful protests, this Washington Post writer clarified, there will be riots, more bigger riots and theres plenty more where that came from. What has happened to us . Even before the new pressures of the Supreme Court, there was an assumption, not a fear, but an assumption that there will be violent conflict after the election. Academics have just calculated the ductal from this summers protests death toll from this summers protests, over 700 killed mostly black sand hispanics just over protest and that number is likely higher. Most are fuming that there will be more over this court fight. Summer speculating about a second civil war. Senators like Richard Blumenthal throwing out wild threats. We are descending into barbarism. Remember Justice Ginsburg quoting justice kolya i attack ideas, i dont attack people. Now its out of control. People wont talk to those they disagree with. Theyre abusive. They call them fascists. Theyre frightened to say what they think. Friendships breakup, politics breakup. This is madness. Where is our humanity. I say to my friends on the left who are driving this rage, renewed this weekend, trump is ending wars and bringing peace over George W Bush a thousand times worse lying to get us in a war that killed millions. Yes we need to fight Racial Injustice but trumps the only one who ever did anything on police reform. Improve the lives of black people in the most vulnerable more than any recent president. Whats. [inaudible] retreating from the neighborhood for fear of causing a riot. What is it about trump thats worth destroying the Small Business or friendship or family. This is crazy. I know multiple people who agree with trump on the issues. They know hed be better for the country, but they want biden to win because they are frightened of the violence if he doesnt. The left say trump is a threat to democracy, but isnt that the death of democracy right there when the fear of Political Violence stops people voting. This doesnt come from nowhere. This madness is manufactured. People have been riled up by ridiculous, irresponsible rhetoric like this. If the president had done his job, had done his job from the beginning, all the people would still be alive. Im not making this up. Theyve been riled up by every toxic ad from the lincoln project, every inflammatory rant by instagram and facebook and msnbc and cnn. All of them one cynical machine hyping hate for profit. What kind of example are we setting for our children . Dial it down. Calm it down. Back it up. All of us, i say it to my friends and colleagues that this network to, everyone with the public platform has a responsibility right now to lower the temperature, not raise it and we can see now that the social media platforms are a huge part of this disaster. The Tech Companies say theyre just a mirror reflecting the best and worst of us. Its not a mirror, its a mega fund and their systems are specifically designed to amplify the worst because thats what gets attention. No ones going to come off social media, unless everybody else does so if you really care about protecting democracy, jack dorsey and all the rest, turn off your platforms until the next president is inaugurated. Lower the temperature, attack ideas, not people. You can disagree with someone without questioning their motives or their character. There are big issues at stake in this election and in this court process. Get engaged, argument out, but lower the temperature. Thats what we will try to do tonight on our main focus, the court issue and everything else. Lets start with the facts. Since 1900, there have been Nine Supreme Court justices nominated in the president ial Election Year end six of them were confirmed by the senate. Of those six the average time between the confirmation vote in the election was 221 days. The shortest gap was in 1916 with justice. [inaudible] who was confirmed 106 days before the president ial election, but, remember, bet 70 of all nominees since 1900 were confirmed in 45 days were under, and in fact 13 of them were confirmed in a week or less. For the same day they were nominated. But, everyones out with their claims and counterclaims, accusations and flipflops and hypocrisy but the truth is we know perfectly well that either side will do what is in its own political interest within the constitution. The constitution is clear, President Trump has every right to nominate someone now and Mitch Mcconnell has every right to hold the vote either before or after the election. It was also within Mitch Mcconnells constitutional right not to have a vote in 2016. That didnt seem fair or reasonable. Thats why the democrats are so outraged now and we have to understand that. The president has already said he will make a nomination, it will be a woman and he will do it quickly so in practical terms, the only two questions are, who and when. Who to nominate, when to hold a vote. Im not a legal expert so i wont weigh in on the first question, but i do know something about politics and elections. The white house and the senate are also at stake. Lose those and you get not just the Court Packing but the end of the legislative filibuster. Statehood for d. C. And puerto rico. Gerrymandering to then fix congressional districts and of course getting ready of the electoral college. The far left are taking over the Democratic Party and there is a very real, very frightening prospect that they will take over the country and do permanent harm. When it comes to the court, the best chance of preventing that is for the president to nominate someone for confirmation hearings to start as soon as possible, but for the vote to happen after the election and after we push joe biden to tell us who he would nominate to fill the vacancy, but please, lets debate this in a respectful and above all peaceful manner, lower the temperature. Do you support the president s decision to move ahead with the nomination and Mitch Mcconnell statement that he will, there will be a vote on the senate floor. Steve, thank you so much. Yes, i do support that. This is the president s constitutional duty and 29 times president s and the senate of the same party have moved forward and have done the nomination in an Election Year. You would have to go back to 1882 find a time when they decided to leave a seat vacant. So, one thing you can depend on is the senate must do its job and those of us in the Judicial Committee will do our Due Diligence and prepare properly for the hearing. I look forward to voting for a constitutionalist to go on to the Supreme Court, and i think its also important to keep in mind that we are fighting, the party fighting this that does not want to do this, that wants to delay, that is just having a good old Fashion Party if you will. They are the ones that want to attack the Supreme Court. They want to fundamentally change it, and i agree with the things that you were saying in your opening monologue. So, senator, just those two questions i put there, who should we have, when should the vote be, do you have any insights or comments. We know its going to be a woman. Lets put up the list, theres actually a number of women on the president s list. I think theres about 11. The focus seems to be on Amy Comey Barrett and barbara from florida. Those two seem to be the two most are speculating about. Whats your sense of anyone on that list. Yes, you are hearing most about the two of them. Amy Comey Barrett is a tremendous story. She has been on the circuit as had barbara go up. Barbara is a cubanamerican. She would be the first cubanamerican to serve on the Supreme Court. You also have other women that have served while at the circuit level who could elevate and the good thing is, the president has been very thoughtful and how he has approached this, and it is President Trump duty to fill the spot. It is our duty as members of the senate to vote to confirm those that want to vote no will vote no, but we will confirm a constitutionalist judge to the Supreme Court. So on the question of timing this seems to be the crux of it. If Mitch Mcconnell has the votes to confirm someone, would you support holding the vote before the election . That is going to be up to Mitch Mcconnell and also up to chairman graham and the process is that once someone is nominated, it is about 30 days before they can have a hearing, and then it takes about another 30 days. Now it took 89 days for kavanaugh. You had rpg when she was confirmed 42 days, John Paul Stevens 19 days, so the process can go a bit more quickly but appeared talking on averages it is 30 days to the hearing and another 32 the confirmation vot vote. So last question, joe biden doubt theres no way he will release his list of cabinets to fill the seat. Whats your message to him . I have talked with some of my friends who are democrats today, and they think it is imperative that he release his list. They cannot imagine that he would not release releases list because he said he had quite a lengthy list of women and africanamerican women that he wanted to consider and so, i think everyone is waiting for him to reveal his list. I just want to throw you back to what i started with which list some of the language that we are hearing from the left, the way theyre behaving, the extremism, i saw you get inner tangled on twitter with senator blumenthal and i was cheering you on. Could you expand on that and just comment on just how bad their behaving, the violent language that we are hearing from the left these days. Not necessarily tangled and that was in a backandforth but i did respond to a tweet that he put out that mirrored the language of many other elected officials and others on the left that everything was going to be off the table if the president dared to do his constitutional duty which was nominate someone for the Supreme Court. Everything was off the table and i was just reflecting on what weve all been dealing with for the past three years, and i said you know, my answer back was, or what, youre going to impeach the president or what youre going to defund the police, or what . Youre going to burn the cities down, or what . Youre going to keep schools and churches closed . What else can they do that we havent already experienced . This is when it comes down to, the nature of what we been going through because of their inability, their refusal to accept the results of the 2016 election, and this bizarre desire to run us through this mill of fear and loathing and misery. Americans, that is not in our dna. We are in optimistic people, where romantic people, we do look forward to the future, and it really is not just republicans or conservatives who are tired, not just exhausted physically and emotionally, but we see even with certain poles that democrats, others in blue cities and states are getting tired of the riot. They realize that this is not helping anyone. Its moving from the urban areas to the suburbs so this is the exchange now, this rage that we are of course having to respond to. This threat from the left and violence, how should we respond to that . Its kind of weird, but night that rgb suddenly passed away i was seeing more conservatives on social media taking pause to remember her life than a lot of activist liberals. It was Chuck Schumer whose first tweet was how republicans dare not fill the seat and his next tweet was by the way we should remember her life and mike legacy. We want to wait for the weekend to pass and say this is a human being. Thats a real person. However immediately this turned into a political gladiator match and it was provoked by the left and then i saw on twitter that people were already chasing, already threatening to chase senators to the street. We see Mitch Mcconnells home swarmed by activists. Instantaneously. She just passed away on friday and youre already organizing out side of Mitch Mcconnells home and the same to Lindsay Graham this coming week, not to mention were going to have writing, this is by blue check verified people on twitter. This is not anonymous accounts. These are real people that are saying this and look, the way that we should respond is with decency and clarity and we should not surrender to their extortion threats saying that if you dare fill this seat we are going to pack the courts and impeach the president. Okay, whatever, fine, thats your negotiating position. The negotiating position of republicans are working to fulfill our constitutional duty and the one thing i want to say and im sure will build this out throughout the show is that i think it would be a mistake to read the court with only eight people going into a most contested residential election. Bush versus gore showed us that when elections go to the court you need to be able to have an odd number to break that tie and i think it would be irresponsible constitutionally for Mitch Mcconnell and the republicans to leave this with only a people and possibly having this be a type. We were just talking about the crucial issue of whether we should fill the seat before the election so we dont go into postelection scenario with it tied court subpoena one thing, justices aside, every decision about who will sit on the Supreme Court is made before general election this is one of the benefits of winning the complaints about the timing, even Ruth Bader Ginsburg when asked about it noted that its not appropriate to not come the president is still the president to the last day of the presidency which even goes past the election, but beyond that, when it comes to the nature of the environment which is what we started out speaking about, joe biden had a statement, he made a statement about 12 15 minutes ago or so and he implied that President Trump and his supporters were an infection. When you begin to cast people as less than human, it makes violence easier when you have clearly, for the left choosing violence as one of their, if not the first option that they pat, weve seen that unfold throughout the country, its disturbing when the democratic nominee for president is taking, making that kind of analogy, he also noted that if there is a constitutional crisis we would move further into the abyss and further into darkness so he is essentially threatening us that this will continue if the president does his duty, and that this is an infection in the country brought by donald trump. And of course, just as usual, its the projection, they accuse trump of inflaming things and causing division but its there canada and their media. Charlie, on the question that i put to senator blackburn earlier, do you have any views on who the president should nominate from the list hes put out there for the two favorites were hearing about. I definitely love the entire list the president has put out, but steve, i want to reinforce the point i made earlier which is, when democrats are promising that we will not know the winner on election night, when Hillary Clinton has said to joe biden, do not concede under any circumstances, now that we know we are going to have a record amount of mailin ballots, if you remember all the way back to 2000 it was chaos and this is just one state for 40 days that was contested and went all the way up to the u. S. Supreme court in a very narrow decision. I think it would be very dangerous, in fact i would advise against it completely if the Senate Republicans did not fill, if the senate in general did not fill the seat because with this unpredictable year that we have lived through steve, talking about a multiple of mailin ballots that were going through, this will be tied up in the courts. Joe biden had 600 people that are lawyered on his payroll ready to sue this election. The Supreme Court is the third branch of government that should be able to make clarity of this contested election. I believe you should fill the seat before the election. Very interesting. All right, theres some speculation about how this massive issue thats been rushed to the middle of the Election Campaign will affect the campaign for the presidency, the senate. I see it affecting the president ial race. Little. In part because if the court is achieved motivating issue for you, you know who you are voting for at the top of the ticket. You know whether you want biden or trump making these appointments for the next four years and you also have very high turnout very likely for this election. It was a midterm you can imagine this would be very motivational and midterm but i think were already going half voters turning out in november even before the seat came open. Interesting. Lets talk about control of the senate. Theres a lot of tight races there. Whats your view . This is the sort of issue that will further weld candidates to the top of the ticket so if you are republican whose running for senate in a red state, this might be good for you. If youre someone say tom in North Carolina who took a little heat from Trump Supporters over the turn because he i has been critical on a handful of things, this is the sort of thing if youre voting for President Trump you say i want a republican like tom sennett voting to confirm these but if youre cory gardner someone who represents a blues state youre relying on voters to vote for you on the next line down and an issue like this might make it so that you are just, your fortunes are tied so much more strongly to what people do at the top of the ticket. Its really interesting, that makes me think that Mitch Mcconnell whose priority, youve got these twin priorities, Mitch Mcconnell will be inclined to go along with a candidate like cory gardner and he might say let them say were not, like Susan Collins and say we dont want to do this and how we fall with that. You agree. Thats why hes so far come out and say nobody make any statements locking yourself into a position. We need to have a conversation about how were going to handle this. But this is one of the things that Mitch Mcconnell has done most and done best is confirm conservative judges. This is what he does day in and day out so whatevers going to make sure that he can appoint more conservative judges, thats what he will do. And if the next few weeks are taken up with confirmation hearings and were not talking about the virus and all the other election issues, does that help republicans or democrats. Whether you and i are talking about confirmation hearings or any other topic, the virus in the economy i think that are affecting peoples lives in a very real way so i still expect those to be top of the list for what is driving peoples voting attitude. One reason Mitch Mcconnell expanded his majorities because trump voters turned out especially in red states like indiana and clipped democrat seats to the republican seats. One of the premises that was made to give Mitch Mcconnell even bigger majority which were historical expansion considering it was the first year after president ial election, very hard to do that. It was around judges in the Supreme Court. If President Trump can say he had three, thats right three constitutional justices in four years, that will motivate midwestern voters in particular to show up in record numbers. On the other side too, if Senate Republicans do not confirm President Trumps appointment, i believe it will be detrimental. I believe conservatives are very weary of republicans that say one thing and do another. This is a chance that i believe, if the Senate Republicans play their cards right, they will win senate races. North carolina, flip alabama and possibly be able to flip a state like michigan. I think thats conventional wisdom that could hurt republicans if they do it is wrong. If you lean in and confirm injustice it helps republicans. Tammy, we have everything that we need to talk about so final thoughts on the whole Supreme Court issue for now. I will remind people, what happened after the kavanaugh hearing, we had the democrat who ultimately won the house, they couldve taken the senate. I believe they did not because americans were repulsed by their behavior. If they think weve already got a vigil in front of the Supreme Court, nancy losey saying shes not willing to come and not think of another impeachment, a lot of people are saying you go for that and remind the American People what it is you are really up to, but the democrats think that going full bore like they did with kavanaugh is going to help them in some fashion, they clearly should remember the kavanaugh fight and how americans did not like that. I think the president is going to nominate the best person for this, we know it will be a woman. It is going to be a person facing horrible accusation, who will be attacked. These women, whoever they are on the list, i think they know this and will be able to handle it that this will be a reminder that the American People, whether or not this person gets confirmed, which they must if we are going to have a country that we can deal with considering as we just discussed the numbers on the court. Hopefully we will have the numbers that give the president and the rest of the people some stability. In september. Welcome back. After President Trumps town hall, the media fixated on hostile questions but much more worthy answers. Theres some real pointers for the debate. Heres a moment from the president s best answer. There is no sadder thing than tooth sit with widow or a mother and watch these big massive cargo planes in the back open up and these incredible marines are walking off a casket and they were killed in the middle east and in many ways no one knows why, going that was the worst decision in the history of our country. The reason that was so good was the president showed empath empathy. He needs to do that a lot in the debate. The president was also pressed hard on the pandemic and you can be sure biden will do exactly the same you chewing that line about downplaying it. The president eventually got to the best answer. Yes, while i didnt downplay it, i actually, in many ways i updated in terms of action. My action was very strong. Of course what i did was with china i put up banner on with europe. Thats his best defense to the attack. Yes i downplayed it with my words so as not to cause panic by a plate it with action. Finally one big thing that was missing, its a huge issue for millions of the votes of the president needs, schools. He never mentioned reopening the schools are getting money directly to parents. That is a vital point to make. Charlie, you caught some of this, what was your reaction . First of all i think its incredible and its noteworthy, the president actually goes up against george stephanopoulos. He served in the Clinton White house, i hate to use that terminology, go up against, joe biden would never do that. He would never go up against someone who served in an Opposition Party white house and go on a network that is not very friendly at all. I think that shows the president is unafraid to confront anyone, anytime, any topic or issue. I completely agree on the 2. 2. 2 mentioned. Number one a winning issue is ending these endless wars overseas. This misadventure abroad that have sent trillions of dollars to go build roads and bridges in lands that we will never visit that do not benefit the American People. That is a winning message for the president and the second of which is the president needs to double and triple down on his Decisive Action early on when it came to this pandemic. Of course in his public communication the president was not going to play into the media panic. We already had discussions over losing toilet paper and food in our country but the president , through his actions whether ventilators or ppe, using his powers to be able to use the war productions act or ppe, i think its actually, he gets no credit on that at all. I think you should lean into it more. Exactly. I downplayed with words but i played with actions. I thought that was very clever. Tammy, whats interesting to me is the performance where he goes into this last stretch of the election, i think just where youd want to see him, his performance and that was measured in common controlled and commanding. A lot of people i think would have been surprised given the kind of portrayals he gets in the media, but you make the point, watching his rally over the weekend that when it comes to bat as well his performance is just, exactly at the level you want to see. Talk about that for little bit. Yes, well, for those of us who have been able to have a conversation with the president and for those who kneknow him extensively, the president is a confident man. He knows what hes doing when he engages in something he knows what the goal is, what its going to take to get that goal accomplished. So naturally, having been, working in new york, building his fortune in new york he already knows what its like. He knows what its like to be attacked and over these last few years, the press going after him constantly has created an environment that has made him a stronger individual, being able to be prepared for anything that is coming up. That is what the campaign is for. Joe biden, even today walked away from any questions. He is unprepared, never really been. [inaudible] even when Kamala Harris went after him on one of the first debates, he was shocked. He didnt know how to come back to the allegation of racism and busing so youve got a big difference here and the president has moved into an environment where he knows what hes been able to do, and i think that we saw in this abc socalled town hall, it was an ambush, but he can handle anything. Nothing surprises him. Yet hes naturally empathetic, but i would love that come through more often and it was like when he 16 again, he was on fire, and this, i think the rallies are important because of the feedback, and i hope they continue.
