Things better, but likely will not solve every problem. Listen. As i said last week in the wake of the grand jury decision, i think ferguson laid their problem that is not unique and that is a simmering distrust that exists between too Many Police Departments and too many communities of color too many individuals, particularly young people of color do not feel as if they are being treated fairly. We also heard from Law Enforcement and were reminded of what a tough job it is to be in Law Enforcement. As eric holder put it, Police Officers have the right to come home. Secondly, one of the issues that came up during the response to ferguson back in august was the issue of military equipment being utilized in the face of protests i will be signing an executive order that specifies how were going to make sure were not building a militarized culture inside our local Law Enforcement. And finally as i mentioned, eric holder is going to be working in parallel with the task force to convene a series of these meetings all across the country. And part of the reason this time will be different is because the president of the United States is deeply invested in making sure that this time is different. When i hear the young people around this table talk about their experiences, it violates my belief in what america can be. To hear young people feeling marginalized and distrustful even after theyve done everything right. Thats not who we are. Thank you very much, jonathan. The president acknowledging abc news Jonathan Carl but not answering the question about whether he believes justice was done in ferguson, missouri. To be fair perhaps he didnt hear it over all the shouting but he did acknowledge the reporter by name. Chris stirewalt our digital news editor. Good to see you tonight. So the president has a meeting at the white house with al sharpton among others a week after the ferguson grand jury decision on a case that is a local case but has taken on national prominence. And his decision to do that, to cast a president ial spotlight on ferguson, missouri telling us what . Well, it tells us he is under pressure from his base, he is under pressure from those who believes the president needs to be more aggressive and go to ferguson and give a speech, and more heartily embrace the cause of the protesters. However, it also telling us that thats not a very tenable position for him, so he is trying to walk this tight rope in which he says to the protesters, you are right, keep coming, i understand you, keep making your point, youre being heard. But at the same time knowing that for the Law Enforcement community and for most americans the answer from the grand jury and the greater detail that came out in the case makes that position untenable too so hes trying to have it both ways. He chooses to highlight how in this country too many people of color feel as if they are not being treated fairly. That is one perspective on ferguson. Another perspective is this particular person of color, Michael Brown, committed a crime, a strong arm robbery. And then committed another crime by assaulting a Police Officer. And then committed another crime by fleeing and evading arrest. And then committed another crime by threatening said Police Officer and coming back at him according to the witness testimony. In nowhere in the president s remarks was that possibility apparently believed by the grand jury or at least endorsed to the point where they didnt think a criminal case could be brought, acknowledged by him. It was not acknowledged by the president. Nor was any even hat tip to this other possibility offered. Well, politicians when theyre trying to copout like to say they want to have a discussion or dialogue or we need to keep the conversation going. Reality here is that two points on the spectrum of communication are at one young man, innocent, was killed in cold blood, murdered in the street, gunned down like a dog by a Police Officer. At the other end of the spectrum is a peace officer in exercise of his lawful duty rightly shot a suspect in a robbery who was who had attacked him. Those two things arent a discussion. You cant have a discussion between these two points of view. But the president obviously wanting to encourage sharpton and others who are pushing the issue but not have to publicly be seen as embracing that problematic cause is asking for the dialogue to continue. And thats not a dialogue that will be helpful to the people on the other side. Uhhuh. So much for the postrational president and, you know, the healing we were supposed to see under this administration i suppose. Yeah, thats exactly right. The promise that he made and other people put in him is still true for a small minority of americans who think he can deliver, thats just not the case anymore. Chris, good to see you. You bet. My next guest was at that white house meeting. He says its unlike anything he ever participated in. The ceo of the National Urban league, the nations largest Civil Rights Organization founded in 1910. He has traveled to ferguson and hes met with the brown family. And hes live for us tonight in new york. Good to see you, sir. Thank you for being here. Megyn, thank you. What if any responsibility do you believe that the community, the community, will take for the distrust that exists between Law Enforcement and the community in places like qhferguson . Todays conversation was and i might add the president of the International Association of chiefs of police was there, the police chief, the great city of baltimore was there, a number of mayors, de blasio were there. Of course a number of civil rights leaders were there. And many of the young people who were engaged in peaceful protest were there. This is a good conversation that took place. The conversation itself is not going to solve anything. But the context of it was of course the announcement of the task force that will be headed by commissioner ramsey. I get that. But the focus from the white house tonight seemed to be on how are we going to address whats happening with Law Enforcement . And i think a lot of people who watch what happened in ferguson and you cite some other examples some much more compelling than others certainly that case in new york with the choke hold and africanamerican is going to go to trial and probably wont end well for the officers there. But the Trayvon Martin case, i think all the viewers are familiar with that and so on. I think a lot of people are asking this isnt a clear cut case, many think Michael Brown was committing a crime. And if you dont want to get shot by a cop, dont grab for his gun, dont mess with him in his police car and dont charge him when hes telling you to surrender, which is what the grand jury apparently believe happened. But the issue, megyn, and you know this as a lawyer, is not the guilt or innocence of Darren Wilson. The only issue before the grand jury was whether there was probable cause to indict, which struck me as a very unusual grand jury process carried out by Robert Mccullough including the release of secret grand jury testimony to the public. I do not believe justice was done and thats why im supportive of the fact of the two different investigations i get that. But this has really shined the spotlight, on the cops s what he seemed to be saying. No, thats not the point, megyn. The spotlight should be on the problem. And the problem is is that statistics show that there were more People Killed by Police Officers than at any time in the last 20 years. The fact of the matter is youve got this confluence no. Of events thats taken place. In the past 50 years i just want to correct you on that. Oreilly just put this on the board and we checked it with our brain room, in the past 50 years the rate of blacks being killed by cops has gone down 70 . You miss my point. Megyn, you miss my point. 300 i didnt say blacks, i said citizens shot by police over the last in the past year was higher than its been in 20 years. I didnt say blacks. 99plus percent of Police Arrests go down without anyone being killed. Lets talk about the point. The point is that there are problems i ran a city. I understand the challenges sometimes between police and communities. And we made a lot of progress with the use of Community Policing when i was mayor of new orleans. This is a Problem Solved as a nation. But we cant solve it if we pretend it isnt an issue. If you talk to many cops on the beat around cities in the nation, youll find many who say, yes, we need to improve relationships between police on the beat and people in communities particularly the communities of color. How is that i dont think anybodys going to give you a hard the relationship needs improving. But the question is where will the focus be . Will it be solely on the cops and their militarization and lack of body cameras . Or will it also be on the communities to find out why is it the police in some instances dont trust these community sns or why dont they get more credit for protecting and patrolling the communities as Charles Barkley put it in his own words today. Let me play the sound bite from him in our radio show. [ bleep ] who are looting, those arent real black people. Those are scum bags. We have to be really careful with the cops, man. Because if it wasnt for the cops, wed be living in the wild wild west in our neighborhoods. I think we cant pick out certain incidents that dont go our way and act like the cops are all bad. Do you know how bad some of these neighborhoods would be if it wasnt for the cops . Your thoughts on that . Whats the point . The point is that theres no doubt the number one duty of police is to provide for public safety. And no doubt that across america there are many good Law Enforcement officers. Were focusing on practices. Were focusing on incidents when there are problems. So this is not a suggestion of condemnation of Law Enforcement or Police Officers. This is about whether we acknowledge that there are problems that have to be addressed in this nation and whether we are going to take the steps necessary to do it. The meeting i participated in, what i hope is at the community level, at the city level there will be dialogue between Law Enforcement, elected officials and Community Leaders to try to improve those relationships so that the ultimate mission of police to provide for Safe Community is always going to be the focus. Louis rams players taking the field last night raising their arms in whats become known as the hands updont shoot symbol, a reference to what happened in ferguson, missouri where a Police Officer was just not indicted after he killed an 18yearold Michael Brown. The players saying they wanted to come out and show their respects to the protests over the grand jurys decision not to indict that Police OfficerDarren Wilson in connection with that shooting because they apparently believe there was enough evidence that he did it in selfdefense. Police say that gesture is inflammatory and they want the players punished. And police, the nfl is refusing to act. Host of the mcgraw show in st. Louis, mcgraw, good to see you. How is this going down in st. Louis . Do people believe it was appropriate . This is not going over very well, as you can imagine, megyn. This town has been beat up. And weve gone through the gris mill. All people wanted to do was go and celebrate their home Football Team on a thanksgiving weekend and sort of forget ferguson for three hours. And it came right into our living rooms and right into the stream when the players held up the hands updont shoot. They also added insult to injury, kenny brit had on his arm, he had white tape and written with a black magic marker mike brown. Right. He said he was asked what was that all about and he said im not choosing sides. I just support ferguson, which doesnt make any sense because if you support ferguson, theres a whole bunch of iheartferguson signs going around town. So he took a side which made the nfl take a side km made the rams take a side and now youre in a p. R. Nightmare. I think they intended to be uniting. Did they succeed in any way . The players succeeded in dividing. The rams for all of for everything theyve done they have done quite a bit to reach out to ferguson. Theyve been big supporters of backstopers throughout the years. But this issue they have clearly if theyre not going to punish the players, the nfl punishes players for throwing footballs into the stands, they punish players for wearing the wrong chinstrap, they fine players for celebrating too incorrectly during a game. Youre not going to fine these players or have anything for them taking a stand in a very volatile toxic situation. St. Louis rams fans and st. Louisians are fed up. The nfl says we respect and understand the concerns of all individuals who have expressed views on this tragic situation. Thats from the Vice President of communications of the nfl. You know, in the same way that the grand jury has now been heard, its decision has now been rendered, what is inappropriate about people who disagree with the Decision Making their own voices heard . Theres nothing wrong with kenny brit going out and walking in a peaceful protest. Theres nothing wrong with that. People do it all day long. He was in a st. Louis rams uniform, he was in a taxpayer funded stadium, it was just inappropriate. The officers who are protecting the dome and protect the players and walk them to and from the car to make sure theyre safe are not allowed to wear wristbands that say i am Darren Wilson. Theyve been told theyre not allowed to wear that. And yet kenny brit is allowed to wear mike brown and hands up dont shoot . Theres a total double standard going on. And st. Louis rams fans, st. Louisians and ticketholders are really, really angry. There was a meeting tonight as i mentioned where they said it was they made some progress, they said. It was productive but very preliminary. Talking about ferguson, missouri and promising to end racial profiling by Police Departments. Joining me, mayor knowles, suggesting what this issue in ferguson boils down to is racial profiling by police. Well, unfortunately, i mean, i think hes put the cart before the horse a few times already. And i dont think that the facts have bore out so far that its necessarily an issue of racial profiling, at least this Current Issue weve seen. But clearly racial profiling is an issue that we need to talk about across the country, but i dont think we can boil every issue especially this issue here necessarily down to racial profiling. He seems very focused on ferguson, however. As soon as the grand jury decision came out he was sure to remind the nation he still has a civil right investigation going into Darren Wilson as an individual and into the Ferguson Police department as a group. He said in october that he thinks, this is me quoting now, i think its pretty clear that the need for wholesale change in the Ferguson Police department is appropriate. Do you believe that . He seems to be pretty certain that there is racial profiling or racial prejudices or inappropriate constitutional behavior coming out of ferguson. Well, once again, i mean, i think some of the excerpts from his speech alluded to that they have not concluded what they started investigating. That theyre supposed to be open and fair with this rigorous investigation, that they have not prejudged that. But then again theyve made statements hes made statements like this weeks, in fact months ago saying theres an obvious need for wholesale change. That sounds like youve prejudged the situation to me. So that is frustrating. I would like to see the investigation into the Police Department and into the situation might warrant some improvements or some reforms that i think we could maybe all agree that theres always room for improvement. But hes clearly made his mind up that theres need for wholesale change. And that doesnt sound like someone whos open minded in their investigation. Uhhuh. I know one of the areas that you are looking to improve is the racial makeup of the police force since it is very disproportionate to the citizenry of ferguson. I think all sides have applauded that as something that might help bridge the divide between the community and Law Enforcement. Darren wilson is now out. He resigned. Hes not going to get any severance package. Is that fair . I think its unfortunate that his careers over. I mean, its absolutely, you know, a situation where he did his job that the grand jury has said there was no wrongdoing and i know he wants to be a Law Enforcement officer still. He stated that. But of course i think he thought it was best for both himself, his family and for the Law Enforcement officers to continue to serve in the city of ferguson for him to move on. Whats going to happen now with the looters . Over 70 arrests with the looting of the stores and the arsons we saw and so on and so forth. What is the status of those criminal charges . I mean, thats still ongoing. For anybody whos been involved in any of the looting or destruction, anybody whos been caught has been charged. And those people will be prosecuted. There is still information out there, videos, endless, countless hours of video that has been captured and being reviewed. Theres many people out there who think they got away with it, and i think theyre going to find out later oen they didnt. Tlast question, oreilly was on earlier saying the riots he suggested created more bias against africanamericans. Do you agree with that . Unfortunately ive heard some people say that theyve lost some sympathy that they might have once had towards some of the demonstrators. But, you know, were focused on moving forward here in the city of ferguson. Were looking at trying to bring the community together. So we continue to have conversations, we continue to look at ourselves and how we can improve ourselves. And hopefully in the end well all come together as a community. Good luck to you, mr. Mayor. Some controversial comments from president obama were all but lost in headlines. c sat down with abc for some questions on his executive order on immigration, specifically why the president decided to act on his own after suggesting at least two dozen times on camera not suggesting, explicitly representing repeatedly to the American People that he did not have the authority to do that. Watch this. Several times over the last couple years you were asked can you do more, you said, no, im out of administrative capability. Thats not true. If you look, george, i was oftentimes asked can you just halt deportations. No, but i have right here go ahead. Asked specifically what can you do to prevent families from being broken apart. And you said im not an emperor. Im not the emperor of the United States. My job is to execute laws that are passed. Weve kind of stretched our administrative flexibility as much as we can. George, what is absolutely true is that we couldnt solve the entire problem. And still cant solve the entire problem. That is a dodge. Thats about as big a dodge as you could ever do. Was there a followup by the anchor . No, there was not. He outright denied that he ever said he didnt have the power. What . Thats just not true. Hes on camera two dozen times saying it. In stephanopouloss defense he could have gone on and on and on but were all limited in time for interviews. This is not the first time the president has changed his tune on a major issue to the American People. Of course there was last november when pressed on h repeated representation that if you like your plan you can keep your plan, if you like your doctor you can keep your doctor, as that became a National News story and as the news story reached a new fury, he was finally forced to comment on that representation. And why it was not true. And this is how he tried to handle it. Now, if you had or have had one of these plans before the Affordable Care act came into law, and you really liked that plan, what we said was you could keep it. If it hasnt changed when the law passed. Thats not what he said. So he tried to dodge then what hed magically been representing to the American People for months, for years. And then the National Media jumped in, a bigger fury was created and he was forced to dial that back and say he misstated the facts wen. Judge napolitano, author of the new book suicide pact, the radical expansion of president ial powers and lethal threat to american liberty. He is caught. Its a sad state of affairs when this harvardeducated university of Chicago Law School hired socalled constitutional scholar, which is what he held himself out to be when he first ran in 2008 doesnt understand the basics of the instituticons and the job and the role of the president of the United States. He does not have the authority to change and rewrite a law. But thats your legal opinion and youre entitled to it. And a lot of people share that opinion. What im talking about is fact, he has misstated the facts forget George Stephanopoulos, the American People. He told them no. He actually denied that he had said this. I mean, stephanopoulos asked him, you were asked, could you do more and you said no im out of administrative flexibility. And his answer was, thats not true, george. And hes tried to limit what he was asked. And then he tried to say well what is true. It was a complete misrepresentation and then a dodge. George should have followed up. George should have had his lies there available. Mr. President , lets go to the tape. Heres what you said, heres when you said it. Something strange is going on because some of the president s original statements that he doesnt have the authority were true and accurate statements of the law in the role of our president in the constitutional society. Somewhere in the past few months the president directed lawyers before midterm elections, the president directed lawyers at the department of Homeland Security and department of justice, find me a way, give me a legal opinion that will justify my signing an executive order that will change the effect of the law for 5 million people. So we know what he did. We know what they did. They went to ten left leaning not just law professors but president ial supporters, people who are on record as loving the president s policies, backing him in all he does, so on and so forth. And those people said, yeah, go for it. But thats a different matter. To me you can have a difference of opinion on whether the president has overstepped his bounds here, but you cannot have a difference of opinion on whether the president just misrepresented the facts to the American People. He is on record. As stephanopoulos said, as saying he didnt have the authority. And i have had democrats, folks who support the president s illegal immigration action, they support him, who have admitted, who have been honest brokers to the American People saying he reversed himself. I dont know why. I support the reversal, but he clearly reversed himself. Its up to him to explain that. And the first chance he had to explain it awae he denied he ever did it. Some of his supporters as you pointed out have been honest enough to acknowledge he reversed himself. Where is his honesty . Its not there. My mother always says does this person in your life have an adult relationship with the truth . Does barack obama have an adult relationship with the truth . The president does not have an adult relationship with the truth. He lies about whether he lied. He would be a far less of an outlier, far less of a loner if he told the truth about his own thinking, if he straightened out the record. Just own it and explain to us how you came to the reversal. Thats fine. Correct. But this is disrespectful to the American People, disrespectful to the constitution, disrespectful to the office of the presidency. The American People are entitled to know they have a president who understands the job and will enforce the law whether he agrees with it or not. And will be honest and transparent to steal his word about when theyve had a change of heart and why. On gay marriage he said its been an evolution. He ultimately was forced in that interview with chuck todd to say this is why i said what i said. Here he has been allowed. He has been allowed by the press. And i credit George Stephanopoulos for trying and playing one sound bite, but hes been allowed by the Mainstream Media to get away with this without forcing an explanation. And the denial here which is false and disingenuous. You think hed come on the kelly file . I would love to see you cross examine him. Im going to see him soon for the christmas party. What are your thoughts on that last segment . Because the president clearly said it over and over and over to the American People and virtually any form in which he was ever asked about it and then hes asked by abc news why the reversal and hes tried to deny there was a reversal. Hes misleading the people on the facts and the law. Why should the American People think that congress is going to do anything about this, that is that has teeth . When i say nothing was done the first time around when nothing was done to the dreamers. Did you view that action as extraconstitutional as well . I did, but you have to have consensus to act and nothing has unified the republicans in the house. And i think the republicans in the new senate that will start up in january like this largest this has got to be one of the largest unconstitutional power grabs by any president ever. And leaving aside the immigration policy, which i think is horrific, the actual assault on the article i powers of the congress under the constitution cant go unchallenged. He clearly he has the power to defer deportations. Thats clear. The question is at what extent does that power get completely shirked . If he waved the magic wand and allowed all 12 million illegal immigrants, he could make a strong case he was abdicating his duties. But im letting the families dallasft. Worth and on do it, im going to have to prioritize one way or the other. He does it under a provision in the law called prosecutorial discretion intended to give prosecutors discretion with a really tough case. But now he is using the exception, the discretion, to swallow the law. And that simply cannot be allowed. I did not agree with the congress voted back in august to rescind the action taken by the president with regard to the dreamers. I dont think he had the authority to do that as well. But the more steps hes taking in this direction not just with this but also in other areas of the law like the health care reform, the congress would be coming more and more unified and hopefully were going to find the levers between legislation between cutting off funding and between litigation to bring this to a halt. Because it truly is a major threat. Why have a democracy . Why have elected representatives if a president can at a whim change his mind about something and simply go ahead and act according to his own understanding of his powers not his understanding of the constitution and the law. Joining me now, Benjamin Watson who wrote that powerful post. Benjamin, thank you so much for being here. Im embarrassed because sometimes i feel like its us against them. Isnt that terrible that if we could be really honest i think more people would admit to that. And then we could start a real conversation. Well, i think youre exactly right. And part of what i was trying to do was simply be honest with my feelings. This is an event thats kind of the end of a series of events that have happened over the year or few years that are really emotional, they really bring up a lot of hurt. And i was angry. When i first found out about what happened i was angry, frustrated, i was all those thing. I can relate as a black man to how many black people are feeling. I put my thoughts on paper and i realized theres something deeper here. And the deeper issue we all have is because we all have the propensity to do those things, we have the ability to be racist whether youre black or white, we have the ability to lash out at people, and we all have an issue that we need to get taken care of. And that can only be done by the blood of christ. Its funny how when you start writing your thoughts out initially you have an initial reaction and then as you kind of unpack that and go through different layers, you see how you really feel. I thought it was great you said you dont think it was about skin but sin. You just made reference to that there. You also talked about your perspective growing up as a black man, you say im fearful, among other motions, that though in the back of my mind im a lawabiding citizen, i could still be looked upon as a threat to those who dont know me, so i have to continue to go the extra mile to earn the benefit of the doubt. Its great to see somebody like you giving voice to that as well, somebody not out there looting, who is working and a success and a lover of the lord saying trust me, im a lawabiding citizen, im a regular guy, ive broken some traffic laws and things like that, but take it from me i do at times feel targeted. I do. And the truth of the matter is as humans we see the outside. And we see skin. And because of that we have certain perceptions of people. And the history of this country is one that blacks have really been marginalized. There have been terrible tragedies that happened to black people in this country. But again, as i go through my thoughts and i think about, you know, you come to a hopeless point like this is never going to change, but my hope is that it will change. And theres proof that things will change. But i understand humans we cant change it. No matter how many programs we try and how nice we try to be to people, there has to be a change on the inside so that these type of situations are eradicated. Amen. Thank you for being here.
