Theres a lot of commentary, some people saying its a win for congress and the prosecutors, some for trump, what do you think . Well, it is a split decision and frankly it was john roberts finest day, a lot of controversy, here he managed to hold together two 72 coalitions, alito and thomas were sort of with him in general, they meanted even more basically. The cases will now continue. Its not a slam dunk that we are going to see the tax returns tomorrow or anything like that, and effectively pushes it past the election, but the really thread of the needle in min takenning the balance among separation of powers between legislative and executive branches as well as federalism with state inquiries into the federal executive. Paul i think i disagree with you. What i worry about is what alito talked about, 2200 local prosecutors, a lot of them politically motivated. The courts did set up standards but i wonder how strict they are going to be and how strict local strict federal judges and other judges will be in policing partisan who is want to harass a president . Well, remember, the courts still left it open to the lower courts and state courts to evaluate other defenses that the president s lawyers will be raising such as responding to these or having to deal with, detract from his ability, and that sort of thing. Hes facing hundreds of subpoenas at the same time that will end up being blocked because its a true intrusion in federal office. Paul is it fair to say its chief roberts court, but on the controversial cases, hes a decisive vote . Well, its definitively the roberts court. He was in the majority but two cases, 12 of 13 cases that went 5 to 4 and hes not turned to the left, hes not become a squish of some sort but absolutely, he is trying to navigate in his own way a way to preserve the courts legitimacy, thats his goal, to depoliticize it. It is his court. Hes not a swing justice, per se, but the median vote. Paul lets talk about his juries prudence because Anthony Kennedy who was the swing vote previously, there are a couple of things that animated him, one was individual rights and liberties. Another was federalism. You could really identify those with Anthony Kennedy, what animates in legal terms, what animates, what philosophy animates roberts . You cant describe it in legal terms. Thats part of the problem. [laughter] strategy animates him or trying to make moves and make votes that will make the court look good that will preserve institutional reputation, those are the sorts of factors that hes attuned to, any judicial philosophy, minimalism or any broad theories like that. Its never getting too far from public opinion. Taking good account of whats taking out and if joe biden is elected in the fall he will vote more conservatively than if trump is reelected, for example, its all of that kind of strategy and tactics to shape as the chief justice the courts perception in body of politics. Paul what youre saying and, correct me if im wrong, hes highly political, that in terms he is without being partisan, without being ideological, hes political in maneuvering the court and trying his best to position it and extricate from toxic political cloud which Public Discourse lives. Paul a lot of democrats on capitol hill, prominent senators basically threatened the court that if you rule the wrong way in certain cases the gun case in new york was a good example, theyd threatened the court with restructuring. Do you think some of the threats are influencing the chief in how he maneuvers the court . I dont know. Its hard to know whats going on inside his head, but it looks that way to a lot of people in the sense that it looks like just as in the obamacare case 8 years ago, whether he changed his vote and used the power, construction because of pressure he felt from president obama and other politicians and whatever, or just because he thought thats the way to preserve the courts institutional role. At the end of the day it doesnt really matter. Hes seen as tacking back and forth for nonlegal grounds. You can debate whether you agree or disagree with the legal theories of different justices. With roberts, he is your right acting in a very political way and ironically its when the court, roberts specifically are trying to think about the courts legitimacy that they act least legitimately. Paul yeah, well, thats the question that comes up, is that good for the court, is that kind of positioning, if the public begins to perceive, ruling for political reasons, that cant be healthy for the court. I dont think it is. I dont think that john roberts is succeeding on his own terms. At the end of the day, respect for the court, if you measure it by public polling, well, republicans will like opinions that are more conservatives and democrats with results more liberal. Theyre not really looking at, you know, what those of us who follow the court closely are looking at in terms of legal theories and what have you. In perceiving principle, not principle to theories of laws i think hes detracting from from the courts Public Perception of legitimacy. Paul thank you very much. When we come back as both sides declare victory in high courts ruling on President Trump tax returns our panel looks at the political fallout from the pair of decisions as well as the other big cases of the term. What has been underscored him after all of the rulings is that, you know, we need more conservative justices on the court. The House Speaker calling the high courts decision a victory for the constitution and vowing that congress will continue to press its case in the lower court. Lets bring in our panel, wall street journal columnist and Deputy Editor dan henninger, columnist kim strassel and Editorial Board member kyle peterson. Kim, you wrote this week disagreeing with the House Speaker on her take and you say it was a defeat for democrats, how so . Kimberley in my mind the ruling that came in about in particular which dealt with congressional subpoenas for the first time layed out some tests that congress has to hit if it wants to obtain and get subpoenas against the executive branch demand my mind that does put new restrictions on congress and what it can do and makes it harder Going Forward for them to get information. Paul you know, if i disagree a little bit with that, kim, if that was kimberley i know you do. Paul if that was real disruption on congress, here is the prong test and they dont meet it and we are demanding it back to the court. Thats what i wonder about. Kimberley so i totally agree with that, the decision that Clarence Thomas likes to say should have gone further. [laughter] kimberley they should have got rid of it and said you failed, so try again, but this was a concession roberts clearly made to get the liberals on the court to go along with him. Paul okay, all right, kyle let me ask you about the term more broadly, other cases, big victories for religious liberty this week. How significant are they . Kyle i think they are very significant. Roberts is very strong on religious liberty. The two cases, both 72 uphold ing broad concessions for catholic nuns, Little Sisters of the poor who dont want to have contraceptive plans and schools to hire and fire teachers as they please essentially. Paul so it was interesting a couple of liberal justices signed onto broadens of the ministerial and you can fire teachers for religious purposes. Does that mean that we are really seeing a court that is going to be much more receptive to free exercise of religion cases . Kyle well, i think thats part of it. The decision was 72 which was not quite as strong. The last case on the exception at a Lutheran School was 90, Unanimous Court that time. The facts are a little different here, but yeah, the opinion of the court by Justice Alito essentially said that the federal government has no business getting involved with schools, religious schools, trying to figure out why they why they chose not to renew a teachers account. Paul dan, two new justices, one for a couple of years, neil gorsuch and brett kavanaugh. How did you how do you see them emerging on the court . Whats notable about them . Daniel well, i think that whats notable about them is that obviously as the saying goes they have their own minds and at times when they are going to surprise us especially Justice Gorsuch and Justice Kavanaugh i think is sensitive shall we say to the political wins inside the court and occasionally i believe he aligns himself with Justice Roberts and gives him some support as well. But i think we have to look forward to the future as well, paul, there probable write is going to be a vacancy on the court, maybe this year or during next president ial term and if joe biden wins the election, i dont think theres any possibility that the democrats would nominate another steven briar or elena keggan, too moderate. The next liberal nominee would be left of sonia sotomayor, thats how polarized law has become in the United States, so i think maybe we are seeing with Justice Briar and elena keagan occasionally siding with the conservatives. Dont expect that if joe biden wins the presidency. Paul kim, do you think this is the conservative court, a lot of people thought theyd get with gorsuch and kavanaugh . Kimberley i think they have been solid conservative votes, i do. There are times when they have surprised us, but if you look at their Overall Record for this last term, they are largely with the alito and thomas on the courts and the real question with john roberts. Hes the swing vote, hes the Anthony Kennedy of the court who does seem to be more focused on the courts reputation than questions of solid juries prudence at times. Paul and so do you think that he is he is politicizing the court in the kind of wrong way as being hyperpolitical and too sensitive to the to what people outside the court might think . I can tell you that clarence and samuel alito dont think so. They are not worried about what people say. Kimberley well, right, they dont care, what really worries me, paul, when you bend this way you encourage more of the same attacks from the left and the threats that they have been making to remake the court and instead of standing up to that. Jason, everything about covid19 is politicized now why not going back to school . Seems like we are going to have a fight over that. What do you make of the arguments and the case for going back to school . Jason i think the president is right. Hes on very solid ground. Its what the education evidence tells us about the importance of inperson learning and frankly, paul, this sort of partial reopening where kids go back a few days or home a few days isnt feasible to the vast majority of families in this country. You know, school doubles as child care for a lot of families, particularly lowincome families where both parents work and if kids cant go back to school, parents cant go back to work and so i think the president is on quite solid ground here. He also understands that this little impromp to experiments with distant learning did not go over very well in terms of school attendance, in terms of School Instruction and so we already had an achievement gap in the country and delaying reopening is only going to exacerbate that achievement gap. Paul yeah, kim,i i know you wrote for us, you had good experience with your children in school but i can tell you that isnt universe sell and the evidence for a lot of cases kids lost essentially a half a year this year and if you dont open for half year, thats a full year of instruction and that puts them behind. What about the health issue . Do you think its safe for children to go back . Kimberley yeah, by the way, we have realworld examples of this. We know that its safe. You had the president tweeting about certain European Countries that have gone back to school. I happened to be looking at what they did in the netherlands where the kids have been back since may, in fact, the beginning of may and their National Institute of Public Health only recently updated a document saying, look, we dont have a problem here because children make up relatively few cases and they play a minor role in spread and they do not even advocate children 17 and younger need to maintain social distancing at school. They point out that the big issue is adults giving the virus to kids, not kids giving it to each other or to adults. Paul would you feel safe bringing your kids back to school . Kimberley oh, yeah, absolutely, day one. Paul dan, that still leaves the teachers, of course, and they play a big role here and the teachers unions and some supporters in School Districts are basically saying we are not going to go back until we think the terms are safe enough and, in fact, thats going to require a lot more money. How do you think this is going to go from the teachers point of view . Daniel well, if they belong to the union they will go along with the union, paul, because they want more money. Look, im a little bit embliviant and as jason pointed out, huge achievement gap in the United States. Its not as though American Public schools are a beacon of performance in the United States. I think, yeah, we have to probably restore the function of these schools, parents cant stay home from work forever, the archdiocese will close because most parent, inner city parents cant afford to send kids to school, nonetheless, the teachers unions are opposing the whole thing and they are doing the holdup, states and the federal government for more money, and something rubs me the wrong way that the reopening of the schools is just going to be so that the teachers can go back to work without any pressure being put on this failing American PublicSchool System to do better than it does. Its a stopgap. Paul jason, are we headed here to a Major Political showdown between President Trump and some of the other political leaders who want to say, lets open up, weve got to open up and the unions who may say, no, you better fork up, i dont know, tens of billions of dollars or else we are not going back or we may even strike. Is it headed to a showdown here . Jason i believe we are particularly with the unions, paul, we know last year, remember, Union Teachers unions went on strike and several large School Districts throughout the country including los angeles, second largest School System in the country and they did so over more way and less work, smaller class sizes and the like and i have no doubt that there are plans to leverage covid, to get more education spending, more spending on pensions and so forth, this is what the unions do, their pricey is their members, the kids are not members and the parents are not member, duepaying members and the unions are looking out for their members. Paul all right, jason, we will see how that goes. Still ahead a dramatic rise in gun violence in cities across the country cast new scrutiny on cities to defund the police. Its not just fund fees that matter. Fund taxes matter too. Every time a fund manager sells a stock it triggers a Tax Liability for you. Paul new york mayor de blasio addressing surge in gun violence in the city and blaming the spike of disruption caused by the coronavirus pandemic, 64 people were shot and 10 killed in new york city over the july 4th weekend. In july Independence Day celebrations turned deadly can 15 People Killed and 64 wounded. And a state of emergency was declared in atlanta this week with georgias governor authorizing the activation of the National Guard after a weekend of gun violence that left 5 dead including an 8yearold girl. So dan, first lets look at the numbers, how bad is this crime surge . Is it really significant . Daniel it is significant. The numbers here in new york city are up by several hundred percent, the shootings over last year and, of course, all was high in chicago. Although minneapolis and atlanta are also experiencing a surge in shootings, and, indeed, homicides and it is literally directly causally related to the pullback by the police, without policing people with guns step forward and start shooting and there are cops here in new york city who are telling people privately but quite forthrightly that they dont want to put their jobs at risk. Look, paul, earlier when the demonstrations started when they had them in new york, the police were out there keeping order. I sat at home and watched attorney general Latisha James say from her house that she explicitly wanted people to send videos of Police Violence because she would prosecute cops if necessary. As a result they have pulled back, as a result theres more violence in cities like atlanta and minneapolis, new york and chicago, and now after the extraordinary weekend violence in chicago, you have black leaders in these neighborhoods saying, enough is enough. They would like the police to come back and start protecting the neighborhoods, but standoff because the progressive leadership in these cities wont let it happen. Paul jason, do you agree its cause and effect here amid the police the attacks on policing and the calls for change and in some cases including new york defunding the police, new york is going to cut a billion dollars from a budget of 5point some billion, is it cause and effect . Jason absolutely. I agree with everything that dan said. The left wants to talk about the role that coronavirus has played in this and theres probably some some truth to that. Theres also some truth to the fact that when the weather gets warmer we generally get more Violent Crime in the inner cities. Theres a history of that as well. But leftwing policies have exacerbated this situation. In recent years we have seen socalled bail reforms put in place around the country which amounts to making it more difficult to pull criminals off the street once they are caught, they are automatically released back into society and then, of course, we had response to coronavirus to release inmates from prison for Health Reasons supposedly and that i too has also contribute today this. When you relieve people from prison or fail to lock them occupy, people that have already proven not to adhere to the norms of society, youre going to get spike in crime including Violent Crime, and as dan said you get on top of scapegoating of law enforcement. Id be surprised if crime did not go up if we are going to fit arguments on the backseat of cops and say to them, even if you make an honest mistake, youre not only in jeopardy of losing your life, youre in jeopardy of being prosecuted, so, yes, we are in a whole new world here. Paul kim, lets talk about the politics, the president thinks he can make an issue of the rise in crime in cities, hes saying they are democraticrun cities and defunding the police and a lot of people on the left say, democrats say thats out of touch actually, that misses the real cultural moment here which is all about race and and Police Reform, how do you think this plays out . Kimberley well, look, donald trump is right that there are a lot of people who are very concerned about this in their cities and communities and theyd like to see it stop and so that is potentially a very potent issue, but i i also believe the president is missing an opportunity here because its about how you talk about it. You know, tweeting out law and order in all caps is not really the way to handle it. You do want to talk about the need for rule of law, you do want to talk about failure of democratic leadership but you also want to express empathy for the sort of root causes of some of this, the inequality and lack of opportunity in too many areas and offer solutions for that. That could be a huge part of a secondterm agenda for the president but so far he doesnt seem to be there. Paul you know, dan, briefly, to kims point, i thought the republicans and the president missed a change to capitalize on the fact that the Senate Democrats killed tim scotts Police Reform bill, now whether or not the Police Reform bill would have done a great deal of good, i dont know, but they killed it and they paid no price for it. Daniel yeah, they did, and so i agree with kim. I think its up to the president and i would urge to give Mount Rushmore kind of speech directed at the problems in the inner city neighborhoods. Paul two of the nations largest utilities announcing they are pulling the plug in Atlantic Coast project which would have transported natural gas across the appalachian trail and the decision comes as federal judge ruled monday that the Dakota Access pipeline, oil ruth from North Carolina to illinois was shut down pending a new Environmental Review and as the Supreme Court rejected a request by the Trump Administration to allow construction to begin on the long dayed Keystone Xl Oil pipeline, so this weeks setbacks a sign of whats to come in a Biden Administration . Kyle, i thought the fracking boom Natural Gas Oil boom was creating tens of thousands of new jobs, making us less dependent on Foreign Energy and generally good for the country. Why all of the opposition to the pipelines . Kyle well, green groups want to essentially keep natural gas on the ground and what makes decision so strange the Atlantic Pipeline that was going to take gas from virginia to West Virginia just won case last month and other litigation in montana that put permits at risk. We cant risk years more of litigation. Paul well, theyve already invested so much in this and the other places. I mean, what does this portend for you of what is going to happen here . Does it mean they are not going to get a lot of the natural gas and Oil Infrastructure to bring oil and gas to market . Kyle yeah, thats already a problem. I mean, in the dead of winter you see headlines about russian liquid natural gas and tanker coming to Boston Harbor and will make that worse. In the question of joe biden, he will put a Greenhouse Gas test on basically all federal permitting and so youre looking the companies are looking at a situation where in a foreseeable future they might not be able to build pipelines. Paul do you think this is a decision that is directly related to the anticipation that joe biden may win the presidency and therefore youll see all of the new regulations and higher costs on Energy Projects . Kyle well, that may that may be part of it. The prospect of joe biden, but thats just the litigation environment already is pretty miserable. I mean, if youre building a pipeline, a different pipeline in montana get ruling against it, putting in question some permits from the u. S. Corp. Army corps of engineers and you have permits and sitting and thinking, how long is it going to take before i get the same lawsuit against me. Paul kim, it wasnt too long ago that i recall the environmentalists supported natural gas and they did so because it replaced coal in power production, coal, of course, gets more co2 omissions than natural gas. Maybe the main reason the u. S. Has been able to reduce co2 omissions in recent years is natural gas, so what is going on here . I mean, are we talking about just flatout hostility to anything involving carbon . Kimberley well, this is the Environmental Movement thats been taking over by radicals, like so much that has taken over on the left by radicals and youre right, one of the greatest things that we have done to our environment is make switch to natural gas and as recently as Barack Obamas presidency people understood that. He actually bragged about the fact that he increased natural gas production, but now there is an absolutist view, you keep it in the ground no matter what, and i think the real sad thing here and concerning is the environmentals know that they have already lost the argument at least politically. The politically will is not there to simply turn off fossil fuels so they have turned to the courts and they are trying to destroy the infrastructure and the work of these companies and this industry and they are succeeding. Paul what is joe bidens policy on natural gas and shale fracking . Dan well, thats layed out in new bidensanders task force and their policy is basically, paul, the Elizabeth Warren model which i would describe as imposing extensive regulatory requirements on fracking and exploration of that sort which ultimately would strangle the industry as we are seeing with the pipelines and they squeeze them out of business slowly and then displace them explicitly the document says with wind and power. The idea being that everybody who worked in the the fossil fuels industry would transfer to wind and Solar Industry and all those jobs would be highpaying unionized jobs, thats pretty much where biden is take us if you choose to believe it, i have a bridge i have to sell you. Paul when we come back a letter defending free speech and land prominent liberals in hot water the countdown has begun. til everyone can enjoy a professional clean feel. At home. This virus is testing all of us. And its testing the people on the front lines of this fight most of all. So abbott is getting new tests into their hands, delivering the critical results they need. Paul open letter published in harpers magazine condemning canceled culture as attack on generating backlash from online left titled letter on justice and open debate and signed by more than 150 writers and academics. The statement warns that, quote, the Free Exchange of information and ideas, life blood of liberal society is daily becoming more constricted while we have come to expect this on the radical right since its spreading more widely in our culture. Intolerance of opposing views of public shaming and the tendency to dissolve complex policy issues in a blinding moral certainty. At least two participants are now disavowing the letter after learning that not not all signatories share beliefs. We are back can dan henninger, kim strassel and jason riley. Jason, what do you make of this letter, are you glad to see it . [laughter] jason yes, i am, i am glad to see it as someone who spends a fair amount of time speaking on College Campuses. Ive seen this going on for a while now and its clearly spilled outside of College Campuses now and so i was i was happy to see the letter, but, you know, the backlash that weve seen, i think, indicates the need for the letter and also what struck me about this is sort of purity test you now have here, even if youre someone who has spent decades in Good Standing on the left, if you dont check every single box, you will be cast out into the wilderness and an issue like transgender rights which came about 5 minutes ago, if youre not on board with gender as social construct, goodbye. We dont care about any of your other views even if we support other views. Paul steven, the harvard professor, hes being ostracized for his view. Kim, the thing that that struck me about the letter, some of the signers, they were only too happy to attack and have the mob attack us, conservatives when when the targets were conservatives, but now its spilling over to them and im glad they are speaking up. Im glad they are speaking up for liberal values but, you know, i mean, welcome to the welcome to the fight, guys, weve been here for a while. [laughter] kimberley yeah, two problems with the letter from my view, one is the hypocrisy which you just mentioned, i know for a fact several of those names were out cheering people on as the mobs came for conservatives, so theyve been more than happy to cancel conservatives in the past, but the other thing is, if youre going to put your name on a letter like this and defend free speech, stick with it even when the mob comes for you and the number of people that have since fled their position on this and say, oh, never mind, i didnt really mean it, please dont be mean to me, i mean, talk about fair weather beliefs and certain Core Principles and thats been on display as well. Paul you know, dan these are individual writers and academics and what is missing from the whole debate are leaders of institutions, some of great institutions, universities, where are they . Where are the museum leaders, for example, and where are the Democratic Senators on capitol hill standing up and saying you know, what we need to be open to debate . The striking absence of them in this debate is really concerning. Daniel it is concerning especially in the United States, paul, where in fact, the first amendment, free speech rights still do, in fact, exist. This isnt quite the french revolution where during the terror the jacobs were taking people to the team, that hasnt quite happened here yet, but is quite similar to what happened back then and the silence of our institutional leaders i think will be looked back at a very, very low moment in american political and cultural light and a lot of those people will be identified as having hidden when their voices were most needed. Paul jason, briefly, some people think that will all end when President Trump leaves office. We will all get back to sweet reason, do you think so . Jason no, no, i dont, i dont, paul. I think this will continue because the extended wing of the Democratic Party seems to be the progressives here and this is a fight among them.
