It was captured on Police Body Cam and surveillance video. Atlanta mayor Keisha Lance Bottoms calling the use of deadly force unjustified. The Atlanta Police union says Proper Police procedure was followed. The officer, garrett rolf, has been fired. The citys police chief resigned yesterday. Reporter as you can see behind me, the group of protesters is getting larger and larger as we go into the afternoon, surrounding this wendys. Meanwhile, Atlanta Crimestoppers is offering a 10,000 reward for information leading to an arrest and indictment of the arsonist or arsonists responsible for destroying this wendys last night. No one was inside the building at the time but police have taken note of social media posts showing a woman at the scene as the fire first started. There were so many people in the street, firefighters couldnt reach the restaurant until it was fully engulfed in flames. Protesters temporarily blocked traffic in both directions along a 14 lane stretch of i75 and i85, known as the downtown connector. Police arrested at least 36 people over the course of the night. The protests were over fridays Fatal Shooting of Rayshard Brooks, the 27yearold was reported sleeping in a car that was blocking the wendys drivethrough lane. Police say he failed a sobriety test and resisted arrest, he allegedly grabbed an officers taser and ran off. During a brief foot chase, police say he turned around and appeared to aim the taser at the officer. An ambulance took brooks to the hospital where he was later pronounced dead. City official immediately terminated the officer and placed a fellow officer, devin bronson, on administrative leave. The citys response has some critics. Listen. Mr. Brooks, he didnt just resist a lawful arrest, he did so violently. He fought with the police again and again. He took their weapon. One of their weapons. And tried to use it against him. While there may be debate as to whether this was an appropriate use of deadly force, i firmly believe that there is a clear distinction between what you can do and what you should do. Reporter Atlanta Police chief erica shields resigned shortly after video of the Police Shooting became public. She explained in a written statement, quote, i have faith in the mayor and it is time for the city to of move forward and build trust between Law Enforcement and the communities they serve. The Georgia Bureau of investigation has been called in to conduct an independent probe into the shooting. Eric, back to you. Eric all right, jonathan, thanks so much. Arthel. Arthel eric, thank you. For more on all of this were going to bring in now former if federal prosecutor, titus nichols, a professor at the university of Georgia Law School and love to of have you with us, professor nichols. Id like to start with this. Once Rayshard Brooks got ahold of that taser, was it considered a Deadly Weapon . Arthel, thanks for having me on the show. I think i want to point out something thats already been brought up by mr. Brooks attorney. A taser is not a Deadly Weapon. Law enforcement cant have it both ways. They cant argue that when they use a taser its not a Deadly Weapon but when a civilian gets his hands on it it magically becomes a Deadly Weapon. Rayshard brooks was running away from the officers. The officers had mr. Brooks car right there. They could have gone to his house and arrested him later on. There was no need to shoot him three times in the back. Arthel and you know, again, youre a former federal prosecutor. Atlantas mayor says deadly force was unjustified, saying there is a difference between what can be done and what should be done and then have you the Atlanta Police saying the officers were justified in investigator response. How do you in their response. How do you see it. Im a former state prosecutor. You do have two different sides. You have the mayor of atlanta stating that just because you can use deadly force absolutely does not mean that you should use deadly force. In my experience as a prosecutor, Law Enforcement are trained to use different tactics depending on the situation. Theres not a one size fits all that says you shoot someone in the back because they have your taser. There is other option thats could have been exercised here that would have protected the immediate surroundings, placed mr. Brooks under arrest and allowed everyone to go back home alive. Arthel you want to elaborate on that, what else do you think they could have done . His attorneys, the attorney for mr. Brooks family is saying, listen, you could have something to this effect, he said earlier or friday night, he says, listen, its hello, buddy, you see a guy who has clearly fallen asleep in the drivethrough line, maybe had a little too much of to drink, fell asleep, hey, why dont you pull over, lets get you an uber and get you home and nothing else would have happened after that. Do you agree with that . Thats absolutely correct. On one end, Law Enforcement could have told him to call an uber and go home and they tow his vehicle. On the other hand of the spectrum, you have the fact that Law Enforcement could have allowed him to run away. As a prosecutor, i prosecuted cases where individuals came into conflict with Law Enforcement, ran away and the police let them run away. Why . Because they have their car. They know the persons not going to get far and theyre going to arrest him. If the purpose is to serve and protect the community, what danger was mr. Brooks going to be with a bright yellow taser at 11 00 in the morning 11 00 at night in downtown atlanta. Arthel i know what you meant, sir. Do you feel that the police get some consideration, just a question, do you feel like the police should get some sort of consideration considering the tensions thats so high right now regarding incidents like this . I think the better question is, is what is the genesis of this problem. And the problem is, a lack of recognizing the humanity of black men. Michael vick went to prison for two years for killing a dog. Thats two more years than t amira rices killers got for shooting in the chest. There has to be a recognition that when a black person kills another black person, theyre going to be arrested and immediately prosecuted. We see time after time when a Law Enforcement officer kills a black person we twist ourselves into a knot to try to come up with some type of legal just at justification to explain what else could have happened. Arthel if you could its unfair to ask you for this in 30 seconds, but whats the work that needs to be done, most immediately, and then in the future. The work that needs to be done is reform of Law Enforcement and how they engage there needs to be greater emphasis on deescalation tactics and accountability. Here, the officer was fired. He should not be able to join a different countys Law Enforcement agency simply because theres no accountability. Arthel all right. Listen, we appreciate your perspective of course. Now, as you know, a lot of these have been focused on shaping the future of policing. In new york city, mayor bill de blasio promised to spend more Police Dollars on youth and social programs. According to local reports, the mayor apparently is against the City Councils recent proposal to cut a billion dollars from the nypds 6 billion budget. Meanwhile, confederate monuments are taken down across the country, either by protesters or municipalities including the Jefferson Davis statue in frankfort, kentucky. Crews removed the monument on saturday. It has been a fixture inside the State Capitol since 1936. As the country heads into week three of unrest, lawmakers say the pressure is on to create meaningful changes that everyone can agree on. Republican senator tim scott who by the way is leading the gops efforts in all of this says reducing qualified immunity for officers is off the table. Here he is on of face the nation this morning. From the republican perspective and the president sent a signal that qualified immunity is off the table, they see that as a poison bill on our side. We could use a decertification of officers, except for the Law Enforcement unions say thats a poison pill. Were going to have to find a path that helps us reduce misconduct within the officers. Reporter and this is really interesting. The city of beverly hills, apparently just banned public gatherings of more than 10 of people after 9 00 p. M. Each night, essentially banning protesting all together. The action comes after a group of protesters apparently were using bull horns and playing loud music during a protest at night and, quote, disrupted the tranquility of the residential neighborhood and according to that emergency order now violators could face a misdemeanor charge. That is the question obviously a lot of people would like to be answered. Well, the Seattle Police chief was on cbs face the nation earlier today. She said frankly she wishes she knew how long this would go on. She basically has no idea. But she says it is likely to need negotiations between these protesters and the local authorities including the Seattle Police department and she said that will be anything but easy. Listen here. Its incredibly difficult but with every challenge theres opportunity. Theres opportunity to move forward and bring people together and get positive change. I absolutely believe that. So some stressful situations are not going to deviate me or my organization so im leading the way and trying to make things better for all of us. Reporter a very large crowd here right now, arthel, but i can tell you it dwindles to a few hundred at night, a lot of them sleeping at tents over here on this sports field here and those are the ones who say they want to be here every minute of every day as long as it takes to get their demands met. Among those demands, obviously defunding the police and the permanent closure of what is up there on the righthand side towards the blue tent, you see the big white tent in the middle, to the right of that is the Seattle Police departments east precinct, that is the one that the police abandoned last monday, after intense clashes around it for several days. That is the one that these protesters would like now to see turned into a community center. That of course leaves all sorts of questions open about what policing would look like in this part of a major city. Questions the police chief says she is willing to talk about. What a lot of people here and across the country want to know is when the authorities can take back the streets. We simply do not have any answers to that question right now, arthel. Arthel authorities in palmdale california are investigating the death of a black man found hanging from a tree near city hall last week. 24yearold robert fullers death was initially ruled a suicide, prompting outrage in the Community North of los angeles. Yesterday the city issued a statement that it fully supports calls for an independent investigation and autopsy. Meanwhile, police in neighboring San Bernardino county are looking into the death of a 38yearold black man whose body was found two weeks ago hanging in a tree near a library. Eric in the wake of the latest Police Action that ended with the death of a black man there is renewed debate this sunday on the use of police force. Police in atlanta shot and killed 27yearold Rayshard Brooks friday night at a wendys drivein after Officials Say he was sleeping in his car, he resisted arrest and then grabbed an officers taser. One of those officers, garrett rolf, has been fired. He allegedly fired the fatal shots. The other who was there was placed on administrative leave. An attorney for the Brooks Family says the actions are not enough. Hes calling for charges against rolf who allegedly shot brooks but the police union it says that rolf followed proper procedures. For more on this lets bring in former new york city Police Department lieutenant, darrin porcher. Thanks for joining us. On video thanks for having me. Eric you can see brooks runs away and turns around with the taser and appears to fire it. Is that considered a Deadly Weapon and what is your view of the use of deadly force in this case . Well, the purview of the Deadly Weapon is very large. Anything, a bottle, a chair, anything that you can think of and it could be a Deadly Weapon. Generally we take into consideration the range of a taser. It runs between 15 and 25 feet. So when we look at the view on the video, specifically the wendys video, it appears as if hes in the purview of the 15 to 25 feet. Going back to the use of Deadly Physical force, its an awesome responsibility and never should an officer want to use Deadly Physical force. However, if you have no plausible alternative then the introduction of Deadly Physical force would be something thats necessary. But we look at the actions that were taken by the mayor eric let me interrupt. If i could interrupt. Theres technical issues, its hard sometimes. You said if theres no other alternative, i mean, you know, here brooks is running away. They had his car. Why do you think the officer even had to take his Service Revolver out . Well, theres two sides of this. First thing is, whenever a crime is committed, i should say a felony is committed, thats not something that falls within the purview of a discretionary act. You have to take action when a felony is committed. Initially this started as someone that was sleeping in their car. When it progressed to the officer being assaulted and his taser being removed, now it elevated to the level of a felony. As a result of that, the officer had to take action. Its subjective as to the action that the officer took. When we look at the legal purview, it does appear that appear to be a justified shooting. Often times i investigated incidents of this caliber. And when we had the taser that fell within that range of the 15 to 25 feet of effectiveness of the taser, this would be deemed as a credible shooting. Do i see other plausible alternatives . Sure. You can argue the case from both sides. When we move forward with this particular case, the officer should have been afforded due process and that was cut at the legs in connection with the mayor specifically stating that, hey, look, i want the officer terminated as a result. Eric the union is fighting that. Lets take a look at the point when theyre talking, going for about 20 minutes and mr. Brooks is polite to the officers and theyre very professional with him and then after the sobriety test and doing some of that lets look at and watch and listen to the video when they put the handcuffs on and he starts to fight. I really dont i think youve had too much to drink to be driving. Put your hands behind your back for me. Put your hands behind your back. Hey, stop fighting. Stop fighting. Stop fighting. Eric you can hear one of the officers say stop fighting. Mr. Porcher, with all the tensions and all the issues dealing with police and police procedure, what is the responsibility for citizens . He did not comply with the Law Enforcement directives. He apparently by that resisted arrest and engaged in a violent struggle. If he had not of done that one could argue he would have been booked and perhaps alive today. Absolutely. The goal for all citizens is to enter and exit a Police Interaction as quickly and safely as possible. This merely results in you abiding by whatever the officers commands are in connection with the situation. Here we had a situation where it initially started out as sound. Ithere was a discourse between the officer and mr. Brooks and it seemed to be somewhat normal sotospeak, i believe it was a dwi stop. Then it progressed. When it got to the point whereas the officer was involved in a violent scuffle with mr. Brooks and mr. Brooks subsequently removed or took the taser, then thats when it elevated to another level and as you look at the video, i dont know if you have the wendys video, but you can clearly see that as mr. Brooks is running away, he turns towards the officer and he engages the taser. You can see the taser is engaged in the officers direction because the taser rule enates as rule nat ruminates as a r. As a result, this is the action the officer took. It goes back to, i dont believe that the necessary provisions were followed in terms of him being terminated without a hearing. I think that this is something that you really need to sit down and put a strong set of eyes to, to make the assessment. It takes hundreds of hours to investigate these Police Shootings. However, we had a mayor that had a snap judgment that caused the termination of the officer and i feel that that was inappropriate as a result. I understand the tensions are running high in connection with what happened with mr. Floyd. I got that. Is Police Reform necessary in society . Absolutely. But this is not the answer. Eric we just saw that video as you were explaining it. Certainly this will be a focus of Law Enforcement and possibly prosecutors and resisting arrest, though, did not at all excuse what happened to him. Darren pour cheer darrin porcher, thank you. The shooter, 66yearold james hotchkinson, he walked onto the field and opened fire on republicans who were practicing for an Upcoming Charity game. Members from the church, Civic Leaders and members of religious organizations were out here as well. Arthel, you mentioned mayor muriel bowser, definitely hundreds flocked to her northwest home last night. A lot of people dancing in the streets, some called it somewhat of a light atmosphere, to talk about defunding the police. That is a big issue here in washington, d. C. , not only in washington, d. C. But really on a national scale. Tomorrow night, arthel, the local d. C. City council will be talking about the budget for next year as far as the Police Department is concerned. Already several hundred people have signed up to talk about defunding the police. Eric well, arthel, the white house is looking at Police Reformer yours that it could support reform measures that it could support while President Trump tries to maintain his law and order of stance. He argues that there will always be in his words bad apples. Obviously, we do not want to create a situation where the police are under the microscope and they dont want to do their job because theyre afraid. That is not going to be useful. Reporter last week the president had a chance to meet with Law Enforcement officials at the white house. Its unclear if this latest shooting in atlanta will prompt any additional meetings in the week ahead. The president , though, said in a recent interview with fox he is certainly willing to listen. We are going to do lots of i think good things but we also have to keep our police and our Law Enforcement strong. They have to do it right. They have to be trained in a proper manner. Reporter the issue of Police Reform will likely be a big factor out on the campaign trail. President trump will resume his rallies next weekend, first one going to be in tulsa, oklahoma. Former Vice President joe biden appears eager to get back on the campaign trail himself. He says were facing some of the greatest challenges in our nations history and its clear donald trump isnt up for the job, we need real leadership right now. President trump has spoken out about the situation when it comes to Police Brutality and the protests after George Floyds death. Theres no indication there will be additional comments today. The state reporting 32 related deaths yesterday, its lowest number since the pandemic hit. But now coronavirus cases are spiking in over a dozen states, mostly in the south and west with several hitting record or near record highs. Regina coleman is Christina Coleman is live in los angeles with the latest on that. Reporter nearly half of the states in the u. S. Are seeing an increase in coronavirus cases, though thousands and thousands of americans have survived this virus. More than 68,000 people have recovered from it in the hardhit state of new york. New york has recently seen a dramatic decrease in coronavirus fatalities and hospitalizations. But at least 21 states are seeing a rise in confirmed cases including california, texas and arizona. Texas reported an uptick in covid19 hospitalizations this week, mostly in houston and austin areas and ap is reporting that in arizona hospitals have been told to prepare for the worst. Florida has also seen an uptick in cases, theres been more than 75,000 cases of covid19 and more than 2900 deaths in florida so far. Nationally, theres been more than 2 million confirmed cases of coronavirus in the u. S. And more than 115000 fatalities. Now, while some attribute the increase in cases to additional testing, theres so much to learn in terms of tracking the spread of the disease and impact on different communities or whether more restrictions could be needed. If cases begin to go up again, particularly if they go up dramatically, its important to recognize that more extensive mitigation efforts such as what what implemented back in march may be needed again and the thats a decision that needs to be made locally based on what is happening within the community regarding disease transmission. Arthel so what legislation might ultimately end up on President Trumps desk . Lets bring in jeff mason now, the White House Correspondent for reuters. So jeff, you know, can the house and senate agree on Police Reform legislation and talk about whats being proposed on both sides. To your first question, arthel, thats the key question. Its remarkable in a way if you think about the context. This is june of 2020. An election year. Normally at this point in a congressional calendar youre not going to expect to get any legislation passed, let alone anything massive like this. But you do hear both sides talking about a desire to come up with something that would be bipartisan. There is some possibility there, that they will. Because obviously to get anything passed, both by the Republican Controlled Senate and the democratic controlled house there will have to be some compromise. Looks like they may be able to compromise on at least agreeing or banning choke holds or most choke holds. Both sides agree to support collecting more data about these types of issues. There is some disagreement on the issue of qualified of unity, which the white house has also said it would not support. Thats the term that describes the ability to sue Police Officers who commit these types of acts. Arthel well, then lets stay right there and talk about President Trumps position on Police Reform and how much the president s perspective will weigh on congressional action. Ultimately, hes the one who has to sign off on it. Thats exactly right. Ultimately, for any bill to become a law the president of the United States has to sign it. He so far has indicated some interest in looking into these issues and listening on these issues. Last week, he talked about perhaps doing an executive order but white house officials have made clear that its legislation that would really have to be done to move the ball. The white house as i said before has made clear that qualified immunity, that is an issue that they do not see as any sort of any leeway on and thats going to be a problem for some democrats. I think theres also just a question, back to what i was saying at the very beginning, as to whether or not they can come up with a bill that is enough that fills enough squares for both sides, republicans and democrats, to even make it to the president s desk. Arthel dont they understand that america is watching . You see whats happening on the streets. You see the mosaic of colors and complexions out there. Everybody wants change. So do they realize that everybodys watching what theyre doing . Absolutely. And i think thats a key question, arthel.
