You might expect him to have a booming, powerful voice and a reassuring presentation, you would be disappointed. He seemed and sounded older than his 74 years, almost tired and exasperated. And yet determined to throw elbows on his way out the door. The order appointing the special counsel authorized us to investigate actions that could obstruct the investigation. He it has set forth in the report after that investigation, if we had had confidence that the president clearly did not commit, a crime we would have said so. Laura and how one statement from mueller, the man who we heard was a consummate professional speaks volumes about perhaps the true motivation behind this investigation and speaks to prosecutorial bias and a sense of unprofessionalism. Alan dershowitz is accusing mueller of putting his thumb on the scale saying, mueller went beyond the conclusion of his report and gave a political gifh to democrats in congress who are seeking to institute impeachment proceedings against President Trump by implying that President Trump might have committed obstruction of justice. Mueller effectively invited democrats to institute impeachment proceedings. As i said in my podcast today this kind of reminded me of jim comey, if you remember the fbi directors, his absurd nonindictmentindictment back in 2013. Ur although we did not find evidence that secretary clinton or her colleagues intended to hide classified information, they were extremely careless in their handling of classified information. Laura i watch that whole thing several times today. It is more disturbing every ten you watch it. As with mueller, remember comeys job was not to opine his job as investigator was to investigate the case and merely present his findings to the attorney general, and his bosses at the department of justice. Instead what he ended up doing was managed to tick off everyone. Setting aside that glaring fact that hillary got off for what others would have been jailed for, comey did enormous damage to the integrity of the fbi and rule of law. Although there are potential violations of the statutef regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case. Laura theres nothing reasonable about a system of justice where at least half the country thinks the entire thing is rigged. I think it was totally appropriate for mueller to make a brief statement upon closing his office. I think we need to make a distinction between criticizing the Mueller Report, which i have criticized repeatedly, and a good portion of which deserves criticism, particularly the obstruction part, and criticizing his performance today. Contrary to what pressurey dershowitz says he did not go beyond anything that was in hist written report. He went out of his way i believe to help attorney general barr. He said he appreciated the him replacing releasing the report and did not appreciate his releasing itt in the way that he did. Laura you have to listen to them very carefully on that because i did. He said it, i dont question his good faith on that issue. Look through our parsing on that issue, we are all lawyers. He has the right to speak anytime he wants. My question is, sol, and you are giving him a pass, im not giving him a pass. There was no reason he had to come out. They were giving away the staplers today so he had to come out in front of the camera to resuscitate the wholeo impeachment thing . There was no reason he had to come out today. What chris said about the olc guideline, limiting muellers ability to charge trump, thats not true. There are witnesses and multiple people at the doj saying that bob mueller said not once but three times that the olc guidelines did not prevent him from making the decision, which means he punted for obviousgu reasons, to set up barr.
