He admitted he leaked his infamous memo to his good friend and Columbia University professor and then instructed him to pass it along to the New York Times. Now comey claims he did this to make sure that an employment of an independent special counsel to the russian probe would happen, the plan clearly worked like a charm, hence the appointment of robert mueller. Along with that political comes a mountain of understandable legal scrutiny. Did comey break the law with his selfproclaimed leak and it did he reach privilege leaking a conversational conversation with the president . Surely thats what lawyers will assert when he makes his complaint looking into this with the doj next week. Lets look at this Million Dollar question. Is comey leak a crime . First, when comey shared his memo, he was no longer a government employee. Number two, the information within comeys memo was not classified. Number three, theres nothing that indicates them demo contains anything about National Security. For the privilege issue, we know comey was not acting as trumps lawyer and annie beverages did exist, trump waved to them repeatedly disclosing the contents of the conversation. Comeys actions dont meet the Legal Definition of a leak. I do not like the way jim comey pushed out this information. I wouldve had a lot more respect for him if he had just been straight up and directly given the memo to the oppressed. But as shady as his actions were, legally speaking, his actions may come in the clear. Why not just give it up yourself . Eric im not buying this, this whole i buy your docket. I get the definition of leaks. Here is my problem. A professional, ethical standard needs to be set. Did he violate either of those . Maybe not a legal violation, but professionally and ethically, did he violate . Would he apply the same rules to his agents . Is it okay for an agent to take a memo, often fbi computer about a meeting they had on work hours and leak that to the press . Im guessing that would be an unequivocal know. We can find this out if this part of the law. A lot of times when you can go to work for different groups and agencies, you have to sign a nondisclosure payment and nda. If he signed an nda, he clearly violated the nda. Eboni i dont know if he signed an nda, lets talk about your issue with the record. A lot of people on social media are debating. It was absolutely a record here. That memo pertained to his work as an fbi director, he talked about it. It was a legal record. But because he released it when he was no longer operating in that capacity, thats one of the reasons its not going to be considered a legal eric if they let this go under the guise of no law was broken, its going to be open season on leakers coming out of the agencies. Eboni thats why i think people are giving him backlash for the way he did it, right . If he said, i dont trust us for whatever reason im going to write it down and hand deliver it to the New York Times and say, this is my experience, does that bother you . Under that scenario . Eric it does at well, but on the opposite side. Eboni do you feel there is any point where you say i felt encumbered with this and not get backlash . Katherine no, i dont think so, necessarily. But this, eric, talking about the people in the agencies . That would be a different thing because they are still working for the government. Obviously the way he handled it eric lets say they leak. Katherine okay, it wasnt cool, wasnt morally way . Was a cool way to handle it . No, it doesnt. It certainly break some sort of broke code but it doesnt break the law. Eric leaking information that could be detrimental to the United States. Katherine not a fan of that. But doesnt break the law . Not really. Intelligence agencies are dealing with a lot more than someone whos not working there anymore leaking something where nothing was classified. Eboni eric brings up a good point. Once the information is deemed to be detrimental to the United States, thats a different standard. Thats why comey is in the clear, that wasnt the content of this memo. But lets say it was. What you see it differently . Eric no, i dont think there is any legal issue here. I dont think trump thinks there is. Hes been complaining ever since he was sworn in that nobody is talking about the leaks. You hear him say it. Why arent we talking about the leaks . This is a way to talk about the leaks, the legality of it there and in the end might come when he knows there are no legal issues, but he wants us to discuss it because everyone is thinking, thats right, the fbi is the guy doing the leaking. There may still be a weaker and they should be fired for doing that, but they shouldnt be cross of prosecuted.
