Practice of law as all consuming while losing sight of everything else. But that makes for a shallow and unfulfilling life. I worked hard as a lawyer and professor. I owe that to my clients, my students and myself. I never let the law define my identity or crowd out the rest of my life. Similar principle applies to the role of courts. Court have a vital responsibility to the rule of law, which is critical to a free society. But courts are not designed to solve every problem or right every wrong in the public life. The policy decisions and the value judgments of government must be made by the political branches. Elected by and accountable to the people. The public should not expect courts to do so and courts should not try. That is the approach i strived to follow as a judge on the seventh circuit. In every case, i have carefully considered the arguments presented by the parties, discussed the issues with my colleagues on the court, and done my utmost to reach the result required by the law. Whatever my own preferences might be. I try to remain mindful that while my Court Decides thousands of cases a year, each case is the most important one to the it will lis involved. Cases are not like statutes which are often named for their authors. Cases are named for the parties who stand to gain or lose in the real world often through their liberty or livelihood. When i write an opinion resolving a case, i read every word from the perspective of the losing party. I ask myself how i would view the decision if one of my children was the party that i was ruling against. Even though i would not like the result, would i understand that the decision was fairly reasoned and grounded in law . That is the standard i set for myself in every case. Its the standard i will follow so long as i am a judge on any court. When the president offered me this nomination i was deeply honored. But it was not a position i had thought out and i thought carefully before accepting. The confirmation process and the work of serving on the court is confirmed. It requires sacrifices; particularly, from my family. I chose to accept the nomination because i believe deeply in the rule of law and the place of the Supreme Court in our nation. I believe americans of all backgrounds deserve an independent Supreme Court. That interprets our constitution and laws as they are written. I believe i can serve my country by playing that role. I come before this committee with humility about the responsibility that i have been asked to undertake. And a appreciation for those who have come before me. I was 9 years old when Sandra Day Oconnor became the first woman to sit in this seat. She was a model of grace and dignity throughout her distinguished tenure on the court. When i was 21 years old and just beginning my career, Ruth Bader Ginsberg sat in this seat. She told the committee what has become of me could only happen in america. I have been nominated to fill justice ginsbergs seat. But no one will ever take her place. I will be forever grateful for the path she marked and the life she led. If confirmed, it would be the honor of a lifetime to serve alongside the chief justice and seven associate justices. I admire them all and would consider each a valued colleague. And i might bring a few new perspectives to the bench, as the president noted when he announced my nomination. I would be the first mother of schoolage children to serve on the court. And i know it would make senators young and braun happen to know i would be the first justice to join the court from seventh circuit in 45 years. Id be the only sitting justice who didnt attend school at harvard or yale but im confident notre dame could hold its own and maybe i could teach them a thing or two about final. As a final note, mr. Chairman, i would like to thank the Many Americans from all walks of life who have reached out with messages of support over the course of my nomination. I believe in the power of prayer and it has been uplifting to hear so many people are praying for me. I look forward to answering the committees questions over the coming days. I have known judge Amy Coney Barrett for shy of 20 years and i want to thank you, the Ranking Member of distinguish feinstein, senator young and the opportunity to speak about her today. First came to meet her when as dean of the law School Together with my colleagues who recruited her to the faculty in 2002. I was aware of her reputation as a law student but i had not taught her. So i can well remember in the initial interview from my standpoint i was not thinking of her so much of notable quotables alunote notre damea candidate of many will have an interest. She was first in the class, executive editor of law review and held two clerksship for demandingjuriousists judge silverman and justice antonin scalia. Short period of private prac for at baker boss and fellowship at George WashingtonUniversity Law school. So from my standpoint as dean in a market in which the lawsuits compete aggressively for the candidates with the sterling credentials like hers, Amy Coney Barrett was a big hit and a big win for us. In the course of the next two years i was responsible creating an environment in which she could take potential and reach maturation to meet necessary of the demanding standards of excellence of scholarship and teaching promotion to tenure. I want to assure you it was the easiest task of my tenure as dean. I watched her develop to exceptional teacher and superb scholar. But watching her develop is a misnomer because she sprang full grown in the academy. The first of the three Teaching Awards she holds from the students presented by her by only the second class she taught. In my annual visits to observe her classroom teaching it became clear to me why it was the case. Our students then and now hold her in awe for the power of her intellect and for her consummate professionalism. To read her student teaching evaluations is like a story only with superlatives in it. The classes are known for clarity and the presentation of the substantive legal material and openminded, nondirective discussion, questionandanswer, respectful of differences and different learns styles of the students. The students thrive to meet her high and demanding expectations. They dont want to disappoint her and they appreciate her availability outside the classroom and mentoring and support. At the same time she produced incredible portfolio of the scholarship of the depth and the quality. Scholars around the academy hold her work in the highest regard. And so when it did come time for her tenure case, i can only tell you without breaching the confidentiality of the process that it was as easy as it a tenure case could possibly be. Her work appears in the leading law reviews, university of chicago, columbia, cornell, texas to name a few. I was not surprised in later years when she was tapped for service on the federal appellate rules of procedure and elected to the prestigious american law institute. In her three years as a judge on the court of appeals for the seventh circuit, her opinions have been characterized by the same qualities of her scholarship. Intellectual rigor, painstaking analysis, clarity of legal reasoning and writing, accompanied by her deep commitment as a jurist to apply the laws to the facts of the case before her. Stellar as her professional accomplishments are, no introduction of Amy Coney Barrett is complete without talk about her personal qualities. She is brilliant. But humble. Fair and impartial, but empathetic. Openminded and respectful of differences, a skilled listener and able to build consensus. Generous, especially to those who need. If i had to describe her in a few words, i would tell you that Amy Coney Barrett is a woman who leads an integrated life of mind, heart and soul. Its that integration that allows her to move so seamlessly between her professional responsibilities and her family commitments. It humbles me now as it did then, 12 the years ago, i was tasked at one point in my life with evaluation the professional qualifications of judge barrett in a university setting. Truth be told, she ran circles around me. As a junior faculty member and in the intervening years she has left me completely in the dust. And nothing gives me more joy than to be able to say so. Because this is the standard of excellence we should demand for institutions of singular importance to us. I have only had two opportunities to communicate with the distinguished committee. The first was ten years ago when i wrote a very strong letter of support for then nominee and now Justice Elena kagan whose tenure of dean of Harvard Law School overlapped with my tenure of dean here. The second is today to present and endorse Amy Coney Barrett in strong terms. There may be some who find the two recommendations in the juxtaposition but i find them consistent. Over the course of my 40 years in the legal academy, i have been blessed with the opportunity to meet many Supreme Court justices. To the justices i have met, while their judicial philosophies may differ and the methodologies may differ, they share powerful intellect, rigorous work ethics, skilled listening skills, the ability to be open to purr situation and also to persuade themselves. To be fair and impartial and people of integrity and a commitment to apply the law to the facts of the case before them. They understand the role of justices is to advance the rule of law, not to advance the personal policy preferences. They understand the solemn responsibility to preserve the court as an institution. Not wings of the court. The court. Single institution that plays a singular role in our republic. I know firsthand from having worked closely with judge barrett for almost 20 years that she possesses all the same qualifications in abundance. And i trust over the course of the next few days with the opportunity to engage in the dialogue with her, she will come to the same conclusion and recommend her for confirmation as associate justice to the Supreme Court of the United States. Martha i couldnt agree more. I was so thankful they were able to connect with the patricia ohara, the dean of the law school at notable quotables. I thought her words were so e university of notre dame. I thought her words were so professional glowing in her review of Amy Coney Barrett. Something she said i thought was interesting. This is one of the highest compliment a human being could give to another one. Her integrated life, heart and soul and that allows her to balance her life beautifully. Part of that is paraphrased but something that everyone strives for. Judge barrett quoted Ruth Bader Ginsberg, who said, i think this is another profound moment in the history of the nomination processes, what has become of me could only happen in america. That is incredible quote. Amy Coney Barrett is feeling that a bit today. We see where it goes tomorrow when the tougher chapter of this gets underway with the actual questioning from the senators. We did get glimpses today of where it will go. Dana a little bit. I want to play for you two pieces of sound from earlier. The first from the chairman Lindsey Graham. The second from the Vice President ial nominee from the democrats, Kamala Harris. Listen to Lindsey Graham first. I think i know how the vote is going to come out but i think judge barrett is required for the good of the nation to submit to your questions and ours. This is going to be a long, contentious week. I ask just one thing of the committee. To the extent possible, lets make it respectful, lets make it challenging. Lets remember the world is watching. More than 9 million americans voted. Millions more will vote while this Illegitimate Committee process is underway. A clear majority of americans want whomever wins this election to fill this seat. And my republican colleagues know that. Yet, they are deliberately defying the will of the people in their attempt to roll back the rights and the protections provided under the Affordable Care act. Dana the role of the senate is clear. They can do this and it looks like they are going to do this before the election. I felt like the republicans in the Opening Statements focused on substance. The democrats continue to argue the process point. How do you think it will turn out . You know, just listening to the senator harris for a second time. Its clearly constitutionally, its clearly a legitimate process that is underway. The president has chosen the nominee. The senate can give their advice and consent. They can do that in the form of not having the hearings which we saw in Merrick Garland. That was a painful process for a lot of people but it is within their rights. Today we have the other version of advise and consent to move forward to have the hearings and the questions and the answers in the coming days. I agree with you 100 . What we have heard so far from the republicans is that this is a constitutional role for the body. The president is the president for four years as ginsberg was quoted many times being said. What we heard on the other side a lot about coronavirus. A lot of discussion of the danger of this hearing. Kamala harris brought that up as well, as you heard when we were listening to this. Then you had a moment interesting i thought with senator graham. Senator kennedy chimed in and said can you explain to us why the c. D. C. Has sanctioned the erring . Hearing . They went through the protocol to hold it safely. Graham saying people all across america going to work today. His argument is why shouldnt we . Dana indeed. Martha, i was thinking back to the last time we sat together in the kavanaugh hearings. It feels like this one is going to be different. Maybe last thought on that from you . Martha it does. There is a feeling. We know anything can change. But there is a feeling that the democrats decided this process is going to move forward, it didnt reflect well on them last time around when they put kavanaugh through the ringer with absolutely no evidence as it turned out in the end. So i think they are refraining and more restrained in this process. No doubt you will hear zingers and very sort of ominous warnings about this judicial nominee from them in the course of the next couple of days. Dana i look forward to being with you for that. Thank you. Dana lets bring in Vice President of the United States, mike pence. What a pleasure to have you here today. I know you are out campaigning. [applause] there is an election underway. I want to quickly ask you about the Supreme Court nominee. Earlier today, joe biden talked about Amy Coney Barrett in regard to faith. Take a listen to what he had to say. [no audio] theyre working to get me the sound. Former vice pres. Biden i tell you what, we are already in the midst of a real fight here. Everyone knows in 28 days, 20 million americans may lose their healthcare. This nominee said she wants to get rid of the Affordable Care act. The president wants to get rid of the Affordable Care act. Keep our eye on the ball. This is about whether or not in less than one month americans will lose the Health Insurance. Dana mr. Vice president as martha pointed out the hearing focused a lot on the coronavirus and healthcare. I wonder if you think it would have been easier for the Trump Administration to have withdrawn the lawsuit that has caused so Many Political headaches for the republican party. Vice president pence well, dana, good to be with you from columbus, ohio. Tremendous enthusiasm out here across the buckeye state. [cheers applause] for President Trumps reelection. I think it is because this president has kept the promises he has made to the people of this state. As the late Ruth Bader Ginsberg said the president is elected for four years. So lets begin there. There have been 29 vacancies on the Supreme Court during Election Years since George Washington through barack obama and in all 29 cases, the president made a nomination. The senate is now participating, in the constitutional role to advise and consent. The Opening Statements will give way to hearings in the course of the coming week. Everyone is doing their constitutional duty. I think what is really striking is that im curious mr. Joe biden in ohio today will answer the question that he refused to answer in the president ial debate. Kamala harris refused to answer in the Vice President ial debate. That is whether they will yield to the radical left and pack the court if they somehow win this election . It really is outrageous that on friday joe biden said that the American People dont deserve to know whether or not he will pack the court. A court that has been nine justices for 150 years. But here the liberals go. They will say if we cant win by the rules we will change the rules after the election. Well add the seats to the court. Obviate what republicans are doing in the constitutional duty. I think the American People see through it and why you will see four more years of President Donald Trump in the white house. Dana i definitely think the courtpacking question keeps coming up over and over again. They do refuse to answer it. So that is a fair question to be put to them. I want to ask you once again Vice President pence but dana, ill speak, im happy to speak about the healthcare issue. Happy to talk about that. I wouldnt want to presume how a justice Amy Coney Barrett would rule on any case. But President Trump has made it clear that we are going to repeal and replace obamacare with the kind of the healthcare that lowers the cost of Health Insurance without growing government and protect preexisting conditions in the way we did when we move legislation. We got within one vote of legislation that protected the preexisting conditions. You got them pushing in joe biden with the obamacare plus a public option is a government takeover of healthcare. When the people of ohio know, people across this country know obamacare was a disaster. They said if you like your doctor, you can keep it and if you like your Health Insurance you can keep it, premiums would go down. When we came in Office Premiums doubled it under obamacare. We managed it in the ways to help americans deal with it. But the American People deserve better healthcare than the failed policy of the obamacare. With four more years of President Donald Trump in the white house, we will protect preexisting conditions and give them more options and a free market economy solution. Not a government take over of healthcare that will set up an inexorable path to socialized medicine. Dana do you regret the Trump Administration hasnt put together a comprehensive legislative plan to address the issue of preexisting conditions so the republicans fighting for their seats, especially in battleground seat for the senate, hangs in the balance . And the democrats have so much money and running the ads against republicans based on the questions about the preexisting conditions . Vice president pence well, we had a bill. In 2017, it passed the house of representatives a couple of times. It came within one vote on the floor of the senate. Democrats totally opposed it. It included Health Saving account. It used the highrisk pools where the people with preexisting conditions could get subsidized coverage on the state level to allow others to purchase Health Insurance on open free market. You could buy Health Insurance across state lines. Much less expensive. I say again, obamacare, we saw the Health Insurance premiums double. It was a disaster. What we have done is managed to repeal the individual mandate. I mean think about that. The American People when joe biden was Vice President had to pay for Health Insurance whether you got it or not. The president got rid of the individual mandate. But look, look, this is all kind of predictable Election Year politics. They talked a lot about it in the hearing today. The American People know, no one is more committed to giving the American People lowcost Health Insurance to protect the americans with the preexisting conditions than President Donald Trump. Let me ask you more about the hearings because in addition to healthcare, i think you will hear a lot about roe v. Wade. Josh hawley the senator from missouri says he wants to vote for her because she understands in his words that roe is an active judicial imperialism. Is that how you see it as well . Vice president pence well, look, im prolife. I dont apologize for it. But again, im not going to presume how a justice Amy Coney Barrett would rule. President trump selected judge barrett, nominated her to the Supreme Court because she is a principled brilliant jurist who will apply laws as written, will not slate from the bench, will uphold the constitution of the United States. I think the American People could see in the Opening Statement today, they could see as they look at her life, her family, her extraordinary career. That america and our constitution will be better off the day that judge Amy Coney Barrett becomes justice Amy Coney Barrett. Dana the indiana contingent continues to grow in washington, d. C. She was impressive in her Opening Statement. Let me move to the other issue. Coronavirus, you are out on the campaign trail. The president says he is able to now travel and do rallies. You are the chairman of the White House Task force. Are you comfortable with the rallies Going Forward . Vice president pence i am. We had a great rally in columbus, ohio. [applause] a lot of enthusiasm. Great outdoor rally. Look, one of the things that the American People proved in the last eight months people know how to put their eight first, the health of the families and neighbors first. President trump and i trust the American People. The progress we have made in eight months in ohio where the Positivity Rate is well below 3 , we are going to continue to make sure we surge p. P. E. And supplies and resources even as we drive relentlessly toward a vaccine. We all know this election, this election may be one of the most important elections in the life of this nation. The president made clear in remarks on the south lawn and he will make clear tonight in florida, well take our case to the American People. American people have a right to peacefully assemble and a right gather, hear out our candidates and our cause. We will carry our message all across the country. All the way to victory on november 3. And after that, i believe with all my heart before the end of year well have the first safe and effective vaccine for the coronavirus. We will have tens of millions of doses to administer to the vulnerable among us. The day will come, dana, when we put the coronavirus in the past. With four more years of President Trump in the white house we will bring the economy back stronger than ever. Dana nobody would love it more than the people behind you and across the country, people do want that to happen. In the meantime, you are seeing the increases, especially in europe. Our situation lag three months behind. Europes are two months. What do you know about what is happening there and what we can expect here and can you commit that there would be no additional calls for the lockdowns from the Trump Administration . Vice president pence we are watching, we are watching cases rise in central europe. Look, dana, this is a global pandemic. Our focus has been on the health of the American People. We recognize that we are seeing cases rise in other places around the world. We are not having it behind us until we have a safe and effective vaccine. That is why it really is remarkable under President Trumps leadership with the operation wart speed, we are on track for one or more safe and effective vaccines before the end of the year. I want viewers to understand, at the president s direction we are also manufacturing vaccines right now so that the second the f. D. A. People of praise. As if it was Something Holding women back as we just watched her give an Opening Statement in her confirmation to become associate justice of the United StatesSupreme Court. Yeah, well, first of all, she makes a good impression. Amy Coney Barrett was gracious, humble. She talked about how she would be the first working mother with the Young Children on the high court and the only sitting justice who didnt go to harvard or yale. Took a jab talking about football, notre dame football. But the same time when you have pieces like the Washington Post saying she faced questions how her catholic faith might influence her jurisprudence. The long articles, i cant imagine someone writing an article about orthodox jew or any other religion that gave republicans fodder in the Opening Statement. Dana i was taken by the introduction of her family. We didnt see them but the way she talked about each of them as the individuals who make up their family of nine. How do you think the media will respond to that . Or maybe they just ignore it. Well, you cant ignore it. Its part of who she is. The media will give her that. She seems to be a fabulous mother. Taking on two adopted kids from haiti and all of that. I think the media may take the lead from the democrats who tried to turn it in to a hearing on obamacare. One senator after another all the bloviating from both parties that went on for five hours before we heard from Amy Coney Barrett who had to zet there masked and muted. It was almost like a hostage situation. Enough with all the congressionalbolviatio congressional bloviation. The democrats know that they will lose and barrett will be confirmed so they want to turn this to a referendum on healthcare as you discussed with Vice President pence. I think we will see coverage of that. Dana what is interesting by many counts and this is from conservative judicial scholars its likely that the Trump Administration backed on obamacare the week of the election is going to fail in the Supreme Court. You just wonder what the coverage will be like then. Will the media then say oh, President Trump put his hopes in Amy Coney Barrett and it didnt work out . At what point can they just say a judge is a judge . We dont know how she will vote. We know things she said in the past and the Affordable Care act. But it seems when you have a situation like this, the difficulty that Vice President pence talking about healthcare with you. First, he had to talk about the failed attempts, the three actually to replace obamacare with something else. Secondly President Trump and i will have better healthcare. Obamacare is a disaster. The president for months has been promising a detailed Healthcare Plan and has not produced it. So they are on the defensive on the issue. That is one reason they seized on it. This plays to the base. The judicial appointments generally and putting a third justice on the Supreme Court may remind people who voted for them last time, maybe they have the doubts that this is a reason they want the president reelected. Dana its remarkable to start the third Supreme Court confirmation hearing in four years. A lot of stuff has happened in four years. And in the final weeks of the campaign. Dana indeed.
