Immunity from criminal investigation and both cases back to lower courts. We have team fox coverage with chief Legal Correspondent and fox news host, excuse me fox news shannon bream. Also then iced us to host, shannon. Thank you very much. Two big cases today but lets start with the ones with three House Committees. In the 72 decision, yes congress can have the power to subpoena what the president , but you have special consideration. Essentially laid out four tests but there can be additional things like is it narrowly tailored or coming up with legislative general in nature with a fishing expedition but you have to say the president of the United States for a legitimate purpose. The chief justice riding the opinions today but the house says congressional subpoenas information from the president implicates special concern with regarding the separation of powers. The courts below did not take adequate account of concern so they send it back to lower courts thing we have given you criteria to consider so take another look at the case. Those documents are not going to the House Committee anytime soon. Okay, just as thomas had a different take on this whole thing and he said the power to subpoena nonofficial documents is not necessary implication of congress and the legislative powers. It if it is contra congress to impeach the powerboat if the president gets reelected we hear the rumblings from some that they would not be upset to go dn this path again. We will watch and see about the case with the new york prosecutor and grand jury there, trying to get at the president s record with a state criminal subpoena. The court said, listen, no president is absolutely immune in this case, but also said this the present here with the court of appeals was limited to absolute immunity. The court of appeals however has direct the case be returned to the District Court where the president may raise further arguments as appropriate. That case is not buttoned up either. The legal team, they will fight on both of these cases but the bottom line is, the documents are not going to be turned over any time soon. That may happen further down the road. Dana, we will have to see how this case plays out. Dana the litigation continues, shannon bream, thank you. The Fox Team Coverage with prison fishe kristin fisher, whs the white house reaction to these rulings this morning . They may have to step down in a few minutes because we have the twominute warning from the White House Press secretary, but the overall sense here at the white house is there is a little bit of relief in the sense these financial records from President Trump that they are going to remain private, at least for now. Anytime you have the highest court in the land saying no president of the United States has absolute immunities from prosecution while in office, that certainly is concerning. President trump tweeted about this seven times in two hours. In so many time he does Something Like that, that just shows you the level of concern from the president. And he was talking about things like a witch hunt. He was calling it not fair. He was saying this is political prosecution. But the president s personal attorney chase coelho who argued this in front of the Supreme Court, he painted a bitd in a statement a decision was issued for the Supreme Court to temporarily block both congressm obtaining the financial risk l constitutional and legal issues in the courts. So after years of President Trump fighting to keep his tax returns and financial records private, today we essentially learned that that fight is only going to continue. So now, dana usually before the briefings the White House Press secretary has a chance to speak to President Trump to get more insight how he is feeling. We wait to see if she has done that and what exactly she says when she stepped to the podium any minute now, dana. Dana it is any minute now, thank you kristin fisher, we will bring it to your life as soon as it starts. An allstar panel, the Fox News Contributor and wall street journal main street columnist, you have to read that every week. John, attorney general and law professor uc berkeley, and Judicial Crisis Network council and policy director. So panel, we are going to get this White House Briefing but let me just get some quick thoughts from you, carrie, good day for the president in a way, given that this is actually not going to disrupt the election . I think it is going to be clear that his tax returns will not be disclosed before the election. Actually, in both decisions the respect of the role for the president for the new york case. The court laid out a clear road map for the argument the president would need to make to explain why this is unduly burdensome to him, harassing him, trying to interfere with his policy goals. I think there is a lot of room for the president to prevail in this. Dana all right, carrie carrie, standby. The White House Press secretary stepping to the podium. Press secretary mcenany black and hispanic students made the largest gain in educational excess because of School Choice according to a credo study. That is why President Trump has been clear in the state of the state of the union for too long. Countless American Children have been tracked in feeling government schools to rick who to mike rescue and School Choice in the form of opportuniy scholarship here the programs are so popular that tens of thousands of students remain on a waiting list. Now i call on congress to give 1 million American Children the same opportunities. Pass the education freedom scholarship, and opportunities act because no parent should be forced to send their child to a feeling government school. Now, as democrats have their way, children will not have access to schools at all. That is not acceptable to President Trump. President trump continues to fight for equal opportunity in our schools by boldly and firmly underscoring the absolute necessity of american schools to reopen this fall. The data is clear. Sustained School Closures hurt students who have fewer resources than most. Mckinsey created these models for you to estimate the potential impact of School Closures, and they found this how much learning students lose during full closures is very significant by access to Remote Learning, the quality of promote instruction, home support, and the degree of engagement. As you can see in this chart, students who experience average quality Remote Learning progress but at a slower pace. Students who are getting lower quality Remote Learning stagnates current grade levels and students who are not getting instruction at home with significant ground with some students dropping out altogether. As you can see in the three scenarios mapped on this graph, if students return to school in the fall, the disparities are far less then if they return in january of next year or the fall of next year or the disparities of learning are enormous. The School Closures epic more than just learning. As the naacp has pointed out, for students of color all levels across the country, school clothings closings with the interruption of their education. Student surveys the Community Network for food and housing. Rest assured that President Trump knows more than anyone the importance of opening the schools, which is why he has been the most vocal advocate for reopening. President trumps america, make no mistakes that he will continue to be the biggest fighter for equal opportunity in our schools and continued access to the American Dream for all. With that come i will take questions. Thank you, kaylee, after todays Supreme Court ruling, how is President Trump feeling about the two justices he appointed to the Supreme Court, Brett Kavanaugh . Press secretary mcenany the justices are entitled to their branch of government, but President Trump underscores in the oval office, justice Brett Kavanaugh in the new York State Court case, unanimous agreement that this should be to d. C. , the District Court where the president may make constitutional arguments. It was a unanimous agreement. Also a note in the robert opinion that the new york state case, basically the grand jury said they were prohibited from arbitrary fishing expeditions and initiating investigation out of malice or unrest. That language made it pretty clear that this is a win for the president. Reporter when you were speaking to the president in the oval office, was there a decision about Brett Kavanaugh . Press secretary mcenany we didnt speak about that periods reporter these guidelines yesterday about reopening schools, yesterday, came out and said that the cdc would be putting out new guidelines next week in terms of reopening, but the head of the cdc he was on another network this morning and said that they would not be changing the guidelines and just putting out additional documents. Can you explain the discrepancy between the two . Press secretary mcenany there cdc director and the Vice President noted as well but we are on the same page with dr. Redfield who said i dont want this guidance to be a reason for schools not to be reopened. And he said these were not meant to be prescriptions but guidelines. Certainly it is up to state and local governments. That is what the guidelines look like, 47 states issued their own guidelines so far. I would also note the cdc recognizes and there are guidelines that many of these things that they are recommending or not feasible which is why they use the words not possible 18 times and not feasible nine times. We want schools to reopen in comparative for the wellbeing of the child. Reporter did you ask the president whether he supports the idea of staggered reopening school schedule, but did you have a chance to talk to him . Press secretary mcenany i will get to him today but because of the Supreme Court ruling, we did not quite get to that but that is one thing to follow up. Reporter im sorry, two Different Things as the Vice President and dr. Redfield described. One was changing the guidelines, the guidance that was previously released. And with dr. Redfield, just adding temperamental guidance. Which of those actually is happening, and in addition, press secretary mcenany dr. Redfield is noting he does not plan to extend the current guidance out there. It will be supplemental guidance. These are not requirements and not restrictive. It was the way he characterized the initial guidance, and he said this guidance should not be used as a reason for schools not to reopen. We all have the same goal here and that is for schools to reopen. To help the child and absolutely depends on it. It is imperative as the presentation that i showed to get the schools opened. Reporter reporter and addl documents as well . Press secretary mcenany i have no announcements on that. Not in the works, but that does not mean it wont happen. Thank you, kayleigh, still under audit command specifically the this year, the president s taxes . Press secretary mcenany they are under audit. Reporter he can releases texas any time in this case meant to this marine corps. Why shouldnt the American Public at this point believed that this president has something to hide . Press secretary mcenany first, let me note something. The texans are under audit and he said he would release them when no longer under audit. The justice did not rule against him. In fact, it was a unanimous opinion saying that this needs to go back to the District Court. They even recognize the president had an ample arsenal of arguments that he can make. In fact, i would show the vast majority made laid out a road map. The vast majority said the president has a right to challenge the pin on any grounds by state law, be bad faith or undue burden or threat. They went on to say the president can raise subpoena specific constitutional challenges and specifically mentioned a violation of the primacy clause has one thing he can raise. Today they essentially laid out a road map. Reporter okay, fine i i dont dispute anything you just said. The president whatever the course, the president can release his taxes whenever he likes. So why shouldnt americans at this point believe that the president isnt trying to hide something . Press secretary mcenany you have been asking this question for four years in the present as the same thing. The taxes are under audit and when no longer under audit, he will release him. The excruciating ruling for how House Democrats called out for their partisan games, they also subpoena the president s information Financial Information and Justice Roberts far for accounting for separation of power concerns. The houses approach aggravates them by leaving essentially no limits on the congressional power to subpoena the president s personal records. So leave it to House Democrats to get a partisan impeachment, a political witch hunt against the president. Yet another partly to be rebuked by the Supreme Court. Reporter kayleigh, hospitalizations and the country or around 50 since midjune. How can the president say that the country is in good shape right now . Press secretary mcenany hospitalizations come a lot of these hospitals, i spoke this morning about 10 , 40 reaching high capacity or covid so a lot of hospitalizations are not pertaining to covid. What i would also note reportera lot is surgeries te opened up 10 to 40 reaching capacity or covid related but im glad you asked about covid. I want to take a moment to highlight some of the things the federal government has done. Reporter why are we in good shape right now with hospitalizations despite of what you said. Press secretary mcenany one of the things i would note mortality rate, which has had if you look at the weekend numbers tenfold and even greater decrease if you compare to the highest dates. We are seeing the fatality rate in this country come down. That is a very good thing. Even we grieve with one life lost but progress as we enter the next phase. Reporter thank you, kayleigh. On to china, and the administration with sanctions against chinese officials and the leader, but can you speak overall but that does to u. S. Relations with china and does it jeopardize the deal . Press secretary mcenany i think with regard i look at these sanctions that the administration does, not with regard to phase 1 trying to deal. These are very serious sanctions that were put in place by this administration to take strong action against the human rights usage of the Chinese Communist party. I just want to emphasize and underscore that. These ancient officials, several of them, the secretary, the former deputy, and Current Party secretary also former party secretary. And todays announcement is the latest in a series of actions by the trump administration, not just the sanctions put in place. They were export patrols at the president signed the human rights policy act. We have taken a strong stance on human rights and the atrocities we have seen just so the American Public knows. Some of these atrocities have been forced abortion and sterilization, despicable things that have been done. Reporter communicating to the chinese, this issue is separate from the trade . Press secretary mcenany human rights is a paramount issue, very important. We took action and a phase 1 deal but we hope the Chinese Government will honor that, yes. Reporter you mentioned the court today was a win. It didnt sound from the president s speech this morning that he viewed it that way. As hes had more time to digest . Press secretary mcenany the president was making general point of reference. Of absolute immunity, the principles, the posture that the president took in court. You know, he believes there should have been more deference there. Justice with the harvard law, you made a good point that constitutionally speaking the president never tweets peer of the president must be ready at a moments notice to do whatever it takes to preserve, protect and defend the constitution for the American People. We wish there would have been more deference to that point of view. But justice Brett Kavanaugh all nine justices said this needs to be remanded back to the lower courts. That, in fact, the attorney had not established the ability to secure access to those records from the breed proceedings required. Reporter those documents, no doubt not something the president is happy about. Im wondering in general after relaying and ruling on defenses, whether the president regrets at all his criticism of the secret Justice Roberts periods before i think underscored after all of these rulings is that we need more conservative justices on the court. That is something he has said strong about releasing the list of conservative justices in the court. That has been the take away, not particularly with regard to this ruling but the previous ones that you mentioned. Reporter he has to cope judges on the court nell. Press secretary mcenany and there needs to be a decision remanded, as i know to become a road map set for house proceed in the lower court and several arguments propose that the president can make in lower courts. Yes. Reporter i have two questions, one on the ruling to Supreme Court is rejecting from the president that he is immune to investigation while in office. Does he agree that he is not immune . Press secretary mcenany well, where the president stands, he still maintains his position integrates with Justice Thomas that demands on the president s time and importance are extraordinary in the office. The president cannot be delegated to subordinates, and the demands on the president s limited time a burden. He went on to describe that position that he agrees. He agrees with the dissent by Justice Thomas. He takes issue with the points that the majority made on absolute immunity, but nevertheless, i would underscore the victory here on the attorney was not given what he wanted, which was access. Reporter he thinks immunity is immune to the investigation . Press secretary mcenany the president stands by his posture and accepts any Supreme Court as lord of the land, but nevertheless, it does not change his view point and he can disagree with the opinion but you will certainly follow it. Reporter my question on the coronavirus. You are saying that you dont want the cdc guidelines to be on11side and how these schools e reopened. So why is it one size fits all and they need to reopen fully at the same time . Press secretary mcenany there is no way to safely do it. There is a lot at stake. I mention 60,000 pediatricians represented by the American Academy of pediatrics who say it is imperative schools reopen. I would underscore by another 1500 United Kingdom pediatricians, the costs are high when your network cnn is reporting about child abuse. I mentioned the study yesterday. A good piece by cnn reporteralleged child abuse because kids are not in school, a lot of times we will catch that if abuse. The cost is too high, the schools to shut down and they can safely reopen. The American Academy of pediatrics and the president will stand on the side of the child always. Reporter and no one is disagreeing with child abuse. How can you say you will tell of the schools to reopen but told him all to reopen . Press secretary mcenany there are 47 guidelines issued by the states. There is local guidelines that have been put in place that can be done safely. It can be done well. The American Academy of pediatrics, i pointed out, let up what they put out, they put out their own set of guidelines. A number of guidelines out there and doing it safely. The child will always come first in this administration. Reporter la dr. Followup for the line of questioning, if a person believes he has absolute immunity, it makes him sound as though he thinks he is above the law while he is president of the United States. Press secretary mcenany it is almost as if folks dont understand the legal term of absolute immunity. I can go went describe that may be best described that by quoting Alexander Hamilton who was a reference in the opinion. Alexander hamilton created the posture and the outlook and laid the foundation for absolute immunity. It was this community and the executive is a leading character in the definition of good government. It is essential to the protection of the community against foreign attacks. It is not the potential of the administration of the law, protection of property against those irregular highhanded combinations which sometimes interrupt the ordinary justice to the security of liberties against the enterprises and households. Ambition affection and anarchy. A feeble executive implies an execution of the government. The point he was making is the executive is viewed with many constitutional authorities, many responsibilities to protect this nation from threats, foreign and domestic, and he must be able to operate unencumbered peer that is where the absolute immunity comes from here that is what the administration is defending in court. We are pleased by the 90 opinion and sent back to lower court. We are not pleased by the absolute immunity component. Reporter can you expand a little bit on the education secretary today to cut money to schools but to shift funding to families . In the second question, a comment on colonel vindman. Press secretary mcenany to your first question i did not speak to the secretary about the comments and leads me to believe it was a reference to the president s tweet yesterday about changing Education Funding if schools dont reopen. As i noted yesterday, this administration, funding be tied to the child, not to the School District if schools are staying close to peer that our paramount guiding two of what that looks. That is forthcoming and we hope the schools reopen the information, that is the goal and we are hoping for more educational funding, as i noted. And colonel vindman come i will not focus or comment on the forr junior employee. I know the white house has not spoken to him since he left. I would refer you to further. Reporter kayleigh picking up on the coronavirus, North Carolina has seen a record high number of coronavirus related hospitalizations, more than a thousand a day and five day rising hospitalizations. So it is the white houses position that schools in North Carolina and hardhit areas by coronavirus should absolutely reopen next month . Press secretary mcenany it is our opinion to reopen. I would refer you to dr. Redfield embassy d. C. This has a limited effect on kids, this virus and he went on to say like the flu, the kids are not driving the transmission cycle. He is in agreement with scott atlas, the former chief of neuroradiologist at stamford and children under 18 virtual 0 risk of covid become a zero risk of serious illness which is also underscored by Yale Public Health professor albert but the text of covid19 on children or minimal or very low compared to other age groups. Is there risk for children and his people not reporting child abuse . These are very serious consequences that are at display in the educational disparity i noted when kids stay home from school. Reporter they said yesterday there was not enough data on the effect on children. They were originally testing children for same rate as adults but to the point, again, North Carolina, where they have been hardhit, you think they should absolutely reopen next month . Press secretary mcenany we believe that they should absolutely reopen the schools in this country. Kids are at low risk, and i would also quote to you the American Academy of pediatrics and venture to say 67,000 pediatricians care deeply about the children they treat. They have said that children and adolescents are at considerable risk of morbidity and some cases mortality should they stay home from school. This president will fight for the health and wellbeing of the children. Yes. Report to make thank you, kayleigh. Out of detroit last week, the president tweeted about it, showed it kept us, the American People by government agencies, the fda and governmental experts say it is not effective for the coronavirus. So the American People come up what are they supposed to think . The position from the administration on this therapy . Press secretary mcenany im glad you asked this pair the president said he sees hydroxychloroquine as a promising prophylactic, but that every person should not take it unless they get a prescription from their doctor peer that is paramount from a very important. The president has taken it himself as a prophylactic. And there has been a lot of studies out there heavily touted. There was a lancet study that was published in many in the media pounced on this lancet study and questioned hydroxychloroquine. You had folks like in vcs will encourage nursing the president should resign over the lancet study with hydroxychloroquine. And cnn spent over 90 minutes heralding the study is debunked and retracted. What we have found the lancet study has been detracted but we have seen Henry Ford Health study that Henry Ford Health system study showed that it is very promising leaving cnn to tweeted a Surprising New study found that the controversial antimalarial drug hydroxychloroquine helped covid19 patients survive in hospitals and the ceo of Henry Ford Medical Group said it is important to know in the right settings, this potentially can be a lifesaver for patients. Our position is where we has always been, the present weeks and weeks before the study came out. This is a promising drug. But it should only be taken in consultation with your doctor. Reporter is the fda with an emergency use . Press secretary mcenany i will refer you to the fda on that. Reporter one word on what the president talked about a few weeks ago regarding antifa, and to designate as a terrorist organization. We havent heard anything about that. Is that still the plan . Press secretary mcenany that is the department of justice saying they will prosecute these cases as domestic terrorist cases. But i will refer you to the doj how that is working out relationally, but the doj has arrested many individuals, including seven out in portland, oregon for a variety of offenses and attacks on law enforcement. We are working hard to ensure antifa does not dominate the streets and the Administration Stance against out. Reporter so you think this is a terrorist Organization Customer press secretary mcenany the president stands by what he says. Reporter one question, the new york d. A. , a history of protecting the president and talking republicans. Case in point for nonnew yorkers come upwards to reduce in 2015. Nypd had audio evidence of one team admitting race and advances to prosecute. All this while President Trumps family. Given this history, what does President Trumps personal standpoint and political standpoint if he just politically abusing the court system . What is President Trumps views on this . Press secretary mcenany you have some good points on the partisan attorney in manhattan. Justus said this is an opinion that stood out to me, as for the potential use of subpoenas to harass, we need not exhibit from which ordinary are free as we have recognized a president is an easily identifiable target. We are more than 2,300 local prosecutors and District Attorneys in the country, many local prosecutors are elected, and many prosecutors have ambition for her elected office. Bring in a democrat, someone Justice Thomas pointed out to me very interesting from a Justice Thomas noted the District Attorney for the county of new york served a subpoena on the president s personal Accounting Firm that nearly identical to the subpoena issued by a Congressional Committee requesting nearly ten years of the president s financial records. The partisan attorney, the democrats from new york aiding and abetting the democrats, lawless democrats like nancy pelosi who have pursued this president with charges of collusion, bogus charges of impeachment and query now pursuing this only to be resisted by the Supreme Court. Report Legal Recourse against a critical d. A. Here . Press secretary mcenany yeah, this was an individual who was elected at the state level. I guess the report would be ballot box, but i would also note to point that president obama invited president biden, who were caught spying on the Trump Campaign from opposition party. You had former Vice President biden in the oval Office Supporting the inauguration, talking about the low kinect and weaponized and used against Lieutenant GeneralMichael Flynn in a way that was so unfair anda great mist character of justice. But you have obama and biden that get away with this but investigate President Trump and it is quite nonsensical. Reporter the Supreme Court decision this morning, he said he thinks the court treated him differently that it would have treated other president s. So does he thinks this is a political decision by the Supreme Court or somehow, legal reasoning . Press secretary mcenany you are referring to the tweet and what he was trying to note there, noting was just that there should have been further deference to this notion read by Alexander Hamilton and others about immunity to allow the executive and the president an important drop of protecting the country and all tests given to the president of the United States. Reporter the same court would have never given to another president . Press secretary mcenany i would also point you with regards to that my think justice polito said in the clinton case for example the court held a sitting president could be sued in federal court but the courts have to reserve judgment on the question on whether the comparable claim might exceed in the state tribunal. Any over the president might raise concerns about protecting federal officers from possible local prejudiced peer that is to say even back in the clinton case where federal Court Prosecutions were agreed with a grave reservation for a state Court Proceeding of this nature. So i think he was noting the distinguishing features there. Yes. Reporter i would like a question earlier. The president s head would like to see more conservative justices. Is he comfortable with the number of nine justices. There is no law he only needs nine. Would he come appoint more . Press secretary mcenany he has not said he would appoint more justices but the democratic part said they would to get around what they dont like. Reporter 1. 3 million additional claims last week, bit of a slowing down of that recovery. Or you all concerned the numbers continue to be so high still on the four months in the unemployment claims . Press secretary mcenany i would note the number fell 100,000, the 14th consecutive weekly decline that we have seen. And from its peak in late march my initial claims are down 5. 6 million. Also continuing claims, the number, and other metric, out today, actual benefit payments no 700,000 in its peak may 8th and down nearly 7 million. And combined as eric kudlow shared with me those facts. In may and june the labor bureau of statistics, 8 million jobs gains and i say larry likes to say, the rebound continues. Reporter are there any concerns those jobs are not returning fast enough, particularly in the market you notice the unemployment claims more in recent weeks . Press secretary mcenany the two job reports, 8 million, recordbreaking months are encouraging signs. We like what we see on the horizon. Of course, there was more work to be done. We have the job of the present at the home to do the work. Reporter hi, the Health Department director in tulsa has said President Trump likely contributed to a big surge in coronavirus cases in the area. Does the president regret holding that rally . Press secretary mcenany we have not seen data to reflect that and no we dont regret holding the rally. Yes. Reporter [inaudible] press secretary mcenany im grateful that you bring up the wall that is being built. An accelerated case, 500 miles by the end of the year. We appreciate the help of the Mexican Government in securing the border with the troops that they provided. Reporter does the president intend to contribute like directly to fund . Press secretary mcenany im not aware of the discussions that may have had to. What i would note that mexico is a big part of making it happen and bringing tons and tons and tons of money and revenue into the United States. We are very grateful for that, yes. Reporter thank you, kayleigh two quick questions from the first of all giving United Airlines recently announced they would have to furlough some 36,000 workers, the president , does he support the standing aid given to the airlines further and second, on a vaccine, does the president have any views on whether or not, students should be mandated to get vaccines against covid19 that is safe and effective . Press secretary mcenany i havent talked to him about that point specifically on vaccinations or they are line extensions but i can do that. One thing my think i got to everyone so just one last note i want to leave everyone with because i do think it is an important point is just that there is a poll that came out recently that showed 64 of americans are concerned about the growing risk of Americas Police and that will lead to a shortage of Police Officers and reduce Public Safety. Of all of the demographics polled, black americans fear most for Public Safety 67 acknowledging their concern for this. This is why President Trump is taking action, calling strongly for law and order and peace in our streets. He set the phone at the top for mayors and governors. Additionally, we have had hundreds of federal executive order to enhance the Police Department and operation which i announced yesterday from the justice department. In honor of a 4yearold boy who was tragically killed in his sleep in kansas city. As we head into the weekend, the last press conference for the week so i want a plea for its peace in the streets because far too many children have been lost. It is important to know their names. It is important to see their faces. And we all hold them in our prayer and keep them close to our hearts, the families of Natalia Wallace who was seven, all of the children. We have pizza in our streets this weekend and hold the families in our prayers. Dana Kayleigh Mcenany with a press briefing where she took a lot of prayer questions about the two Supreme Court decisions. Lets bring it back our panel. We have john yoo. Let me go to you, the white house is characterizing todays Supreme Court decisions as a win for the president. Do you agree . It is a shortterm win it delays any resolution of this until after the election. But i think it is a longterm, body slam against the presidency. This is a case where the Supreme Court is effectively allowing 2,300 District Attorneys, in any single one to harass and embarrass the president. I think this runs in the face of the supremacy clause that says states cannot interfere with the federal government and carrying out of the constitutional duties, particularly the president which concentrates and usually all the executive power into a single official. If you allow people to harass and embarrass the president s litigation, hundreds of Different Cases for example, than the president cant do his other duties. Let me close by adding the shoe could be on the other foot. If joe biden wins, District Attorneys in red states that will bring suits about joe biden and hunter pregnant and distract him from doing the job of his presidency. Dana and it could take a while to get that all sorted out. Of course if there are other cases. Let me ask you about new york. And i just think it is very interesting and im sure the president is disappointed that the city he grew up in and decided that he loves is a city that has become his political nemesis. It looks like it will be that way even in a postpresidency because basically what he was saying no matter what they will continue to pursue this. Right, look, we have a very highly political District Attorney and mr. Vance. He made that clear. I agree with don. Im looking at the opinion, the arguments, and what i see, what i always wonder about judicial case has now become our ruling on donald trump, or are they ruling on the presidency . And you would think it would be different. But the president made the claim for absolute immunity i think no one agrees with that. Even Justice Thomas objected that in their opinion. But i think this opens the door to all sorts of mischief. We can just imagine it. So as they punted on the big issue, i think, and that way. I dont quite, i dont quite see it as the White House Press secretary does as a victory. Because i think with john, i think it is a real loss for the presidency. Dana for the office as a whole. All right, thank you, im going to have to run. Bill mcgurn, john yoo, thank you so much. And lets take a listen to the briefing. Another hot topic is the reopening of the schools. 12 states including texas with a major spike in coronavirus cases in the past two weeks. Texas governor just minutes ago called for elective surgery and 11 were counties to free up some beds to treat covid patients. This comes as School Districts across the country scramble to finalize the plans for the fall. In new york city, the nations largest district, students will see a hybrid schedule in class and virtual learning. Lets see how that works, laura ingle has more, laura. Hey, dana. New york city bill de blasio said school simply cannot hold all students in any one given time with the social distancing. So this is really going to be the best plan for the city as he sees it. The plan unveiled by the mayor will have students going back to school two to three days a week wearing a mask. The other days, students will continue to remote learn. It is an idea that needs work, according to the president of the United States or his federation and says working parents are going to require a distance to pull this one off. There is another crisis coming in the city of new york and other communities because this blended learning model means that they are his children not coming to school in person every day. So they are and have like going to be a child care crisis. That is something the city needs to tackle and get on top of. The mayors proposed model still needs to be signed off on by Governor Andrew Cuomo who said state officials make the ultimate decision for 700 School Districts in the state the first week of august. Parents will have the choice to keep their child home doing online only classes, which some parents say they will take advantage of. In my opinion, it doesnt matter if you are there five days or two days. If you are still in an environment with the other kids, with the germs, and kids dont think about social distancing the way we do. Even if you explain it to them. And district Officials Say they will be doing deep cleaning at the schools every night, cleaning throughout the day, and then will or trust that as the Health Guidance warrants. We will see how it goes. Again, august 1st is when we will learn, the first week of august medina. Dana laura, is there anything else they are looking for with guidance with Health Officials before they make any additional decision . You know the cdc put out a wide variety of plans, basically kind of a menu for School Districts and for state officials to look at and see if this is what works for us. As we were talking to Union Officials yesterday, some School Districts that have a lot of kids, a mass population of others that dont. It is not a onesizefitsall plan. They will look at the guidance put forward by the feds to see what works best for them. Dana and then, im curious about the funding. Even when you talk about doing the extra cleaning every night and what they will need, it is a big problem. Lots of complexity. We appreciate your report, laura, thank you so much. I want to bring in pedro martinez, the superintendent of san antonio School District there, independent School District. The board chair chief of educational leaders across the United States. Sir, thank you for joining me. I know you have your hands full trying to figure this out. What is the plan right now for san antonio . So a lot to consider. Where do things stand for you now . Absolutely. We have been part of the solution in the community. We ourselves have distributed more than 1 million meals during the covid period and during spring break. Between march and june come over 1 million meals. And we are getting another million over the summer. So we want to help the community. Right now, you can imagine, the first day of school. The first day of school will be august 10th. We received guidance from the state. And so the plan is to open up, we have 100 schools opening up their schools. And really families to allow twophase children in. So bringing them in a small percentage the beginning of the year and so we can get procedures and safety guide so we can execute them well and then allow them to grow as we see them and balance safety in our communities. Dana pedro martinez, we appreciate you coming on because we know you have so many decisions in front of you in consideration from the government, from parents, teachers, and of course, the student your love very much. Dana Vice President mike pence and presumptive nominee joe biden are both hitting the campaign trail today pier they went to pennsylvania is a critical battleground state and as we see, peter doocy has more from pennsylvania. He is in denmark, pennsylvania, peter. Dana, today, biden 2020 sounds kind of like 2016. The headline of his economic plan he will rollout right now is buy american. And to pitch 700 billion of federal spending where he would force federal agencies and offices to buy clean cars and American Steel for a project that they might be working on. Plus research and development. The campaign claims to 3 million new jobs. That language again very similar to what President Trump campaigned on and tried to later accomplish with president ial executive corridors. The Trump Campaign today trying to paint biden unqualified on this issue because of his vote for the nasa trade deal in the 90s. Something that Bernie Sanders use to hit biden on the time saying it cost americans jobs come up with those two patching things up and the staffers released 110 pages of Community Task force bullet points and to make the biden platform as much as possible with these proposals they just released to make biden look progressive as fdr. But bernies progressive pillars are all missing. Nothing about medicare for all. Nothing about the Green New Deal in there. Biden comes to pennsylvania almost every single time that he campaigns outside of delaware as a comfortable drive away from his home there. Today the Trump Campaign with a programming and mike pence to hear the president s message under 25 miles away, dana. Dana peter doocy, thank you. Lets bring in stephen mori, the trump Economic Advisory board member. Always good to have you, steve. It is pretty interesting to see the Biden Campaign out link on by america. What do you think about this . It is certainly a trump theme by america but the details of the plan, i call it by china. The truth is if you look up the provisions of what biden is proposing on the economy, let me give you one example, the biggish stomach biggest job gain in the United States has been in new orleans gas industry and biden wants to wipe out oil and gas industry, 6 million jobs down the drain right there. Also when major part, what is releasing today, dana, dramatically increases the tax rate on american business. In fact, he goes back to obama year. So we simply erase the tax cut. The problem is, you are making it much more difficult, much more expensive to do business in the United States. You will drive a lot of investment and jobs out of the u. S. If you do the tax cut. Dana James Friedman of the wall street journal is writing about that today. I saw it briefly before i came on air. One of the things he said, wall street not sort of freaking out about the 18 presidency oh, well, the tariffs will come down to pure the way they are looking at it now, they think it might be worse. Beco i will give you one example of that, dana. One of the provisions of the biden plan is to almost double the Capital Gains tax. The Capital Gains tax is an investment on the United States. He would take that rate up to 40 . That would have a devastating impact and not just on the stock market but on american workers. My worker is if you keep raising these taxes on American Companies, how will you make america a place where people want to invest in and how do you increase . Lets not forget, we created as of january 2020 right before the coronavirus, created almost 2 million manufacturing, construction and mining jobs in the United States. Remember, without barack obama who said you will never bring those jobs back and we did. Dana actually, speaking of that, the president really made the push to get American Companies who are Holding Money overseas to bring it back to america. That is a trend we continue to see, even especially, perhaps because of the pandemic . Great point. One of the most successful features, dana, the trump tax code, was this reaper eth and come up we lowered the tax and all of a sudden the number is about a trillion dollars, 1 trillion. 12 zeros that came back from the United States from places like china. Lets have a zero repatriation tax to bring money back from china. You want to create jobs in the United States, do Something Like that. Dana do something dramatic come i agree, steve morey, thank you so much. I want to bring in the panel read a former Campaign Manager for scott brown and former Senior Advisor to governor chris christie, the biden 2020 circuit and former spokesman for the obama Biden Campaign, collin and zach, one of the things i was thinking, and i will start with you, mike pence and joe biden both in pennsylvania today, if you live in pennsylvania, what can you expect the next three and a half months . You can expect a lot of Television Ads so if you dont like them turn off your tv or find a different place to live. And lo, plenty of electoral votes in pennsylvania, a state that hangs on read in 20 years until donald trump came along in 2016. I think it will be a lot closer than polls might suggest and heres why. There was a story last week that caught my eye, two counties in pennsylvania, lackawanna county, those are counties that went vague for president obama twice and went big for donald trump in 2016. There was a story that said the Voter Registration and those two key counties and by the way the site of where joe bidens today come the democratic Voter Registration is a 20 year low, voters are shifting away from the Democratic Party to the left. That is a lagging indicator. The Voter Registration was not allowed to happen. There is a shift in pennsylvania which means more competitive polls right now. Dana no better person to ask then you, zack, the changes that might have happened between president obama was in office and reelected to now, what do you think joe biden needs to do to get those voters to come back to his side . I think one of the main reasons obama won pennsylvania as having joe biden on the ticket. It is a sarah got home and he races great points. It is a swing state. No path to the presidency without pennsylvania for either of these two campaigns. The reason she will see significant amount of time and investment is the area of pennsylvania, if he doesnt go for biden to me doesnt have the path and he doesnt have a pal. Dana the other thing that happened overnight, is you have this Bernie Sanders, joe biden committees getting together, and have released information and you hear on the bernie side of things, the left did not win every argument but still you have biden trying to reassure the Progressive Side that he should be there guy, what is your take on that . It boggles my mind, dana because four months since the nomination and he did it without moving too far to the left but now ensuing time continuing to move to the left when hes running against a guy in some polls my 40 in approval rating. They electoral votes run up the middle. And the fact joe biden is talking about Bernie Sanders and alexandria ocasiocortez indicates to me he must see troubling numbers in his internal numbers with support among his core voters. Dana what about that, zach . You know as the governor used to say, the main thing is to keep the main thing the main thing in right now the main thing is the virus handle job loss of the virus. This presentation of american jobs, that has been the focus. Remember he won the primaries. As much as we like to talk about the democrats running to the left come at the end of the day, the most moderate. And the most likely to carry this industrial midwest states. Speaking of that men may be the last question if we can get both of you with one minute le left, colin what about the energy jobs in pennsylvania . Something like 600,000 jobs i think to be eliminated by joe bidens support, and of course a part of the new green deal he supported. But look i agree with his point, you want a primary without moving to the left so it makes no sense to move to the left at this point in the race. Dana what about the energy and Environmental Issues in pennsylvania, zach as Biden Campaign tries to figure out how to navigate that . This has been a difficult place to navigate and for strong union party, i think joe has known well pennsylvania. I think people trust him in pennsylvania and trust his judgment. Dana you guys are good on the time. Colin reed, zach friend, love to have you. Thank you for joining us. And we thank all of you for joining us. I am dana perino and i will see you on the the five. In a few minutes. You choose to get back to us. Dana domain thank you, dana. Bill and bill hemmer. Good afternoon, everybody. We have two main events, first left, joe biden making his pitch on the American Economy and 1. 3 million americans file for unemployment but meanwhile screen right, the president signs an executive order and boosting Economic Opportunities for hispanicamericans. We are waiting to see if he talks about the Supreme Court ruling which allows manhattan prosecutor to pursue President Trumps financial records. Although experts say it is highly unlikely that will be before the election now less
