They sent a sharp warning out to anyone, any u. S. Research organization thats looking into coronavirus treatments or vaccines. A warning, chinese sponsored cyber hackers and other entities are trying to hack into the Computer Systems of research organizations. This advisory saying these actors have been observed attempting to identify and obtain valuable intellectual property and health data. The potential theft of this information jeopardizes the delivery of secure, effective and efficient treatment options. The advisory goes on to say if your organization is getting any press attention, that researchers should take more stringent steps to protect them from intruders. They had recognized more stringent guidelines than notes that are adapted by the white house. A coordinated National Response for detailed stepbystep instructions for employers and there was a real conflict for what the white house eventually came up with. They came up with nonessential travel that could be avoided until phase three and even when they got to phase three, nonessential travel will be considered within and between low and controlled jurisdictions. The white house put resume nonessential travel with phase two. There were also detailed indicators and thresholds for mitigation strategies that were included in the cdc guidance including Community Demographics that would affect the indicators including limited english literacy, people below the Poverty Level and Economic Health indicators as well. The white house guidelines were far more broad than that during yesterdays Senate Hearing and dr. Robert redfield saying he hopes that the cdc guidelines which are currently under further review will be released in the near future. Although some lawmakers say they need to be released now, listen here. I do anticipate this product guidance to be posted on the cdc website soon. Soon isnt terribly helpful, thank you mr. Chairman. That was senator chris murphy that you heard there. Its possible that more detailed guidance could come out soon. However there is that conflict will make conflict in terms of resuming nonessential travel. The so in order for the white house to adopt the cdc guidelines they would have to backtrack which would cause some complications so we may just see some more detailed stepbystep guidelines to help the states but i wouldnt bet that the white house is going to walk back on that nonessential travel provision. The judge is granting time for outside groups to submit friends of the court briefs on the Justice Departments request. Number two they wanted to protect whatever lies it now turns out that they were saying and im saying this about the Intelligence Community at large. In a situation like this for the Justice Department wants to drop the case and they want to drop the case and flynn wants to drop the case, why should outsiders, the socalled friends of the court, get a chance to weigh in . Good afternoon, dana. From judge sullivans perspective you have a defendant who has pled guilty twice under oath now saying hes not guilty and both of the statements made under oath were incorrect. You have a Justice Department which said for two and a half years, hes guilty, we can prove it, he admitted it, hes convicted, now changing his mind is saying we should never should have prosecuted in the first place. So the judge has both litigants before him, the government and the defendant saying the opposite of what theyve been saying for three years. And the government in its application submitted last thursday asking judge sullivan to dismiss the indictment relied on the words of a former doj official who, when she saw what they did with her words said it, i never said that. All of this is enough to cause judge sullivan to scratch his head and say, okay, whats going on here . Somebody in my courtroom could make the application that i should hold a hearing and find out why the doj changed its mind. After all, the documents on which the doj relied to change its mind had been in its possession for two and half years. You put general flynn through this for the last two and a half years, why did you not make that decision the last two and a half years ago . These are questions that they will want to have answered. Dana tell me about your thoughts on the Justice Department culture, you say they never want to admit they were wrong . No. The documents that they submitted last thursday which was the motion to dismiss the indictment and the documents in support of it were startling. It was not startling that the Justice Department had targeted someone for political or petty reasons and all the documents that weve seen now seem to indicate that they did. That there was no legal or constitutional basis to have and interrogated general flynn three and a half days since the donald Trump Presidency because they have the transcript of what he said to ambassador kislyak. No purpose was served to an answer about the transcript unless they were going to try to trap him. The culture of the doj is that they can trap people and the reason they have that culture is because of the half dozen Supreme Court opinions that allowed them to do so. They cant break the law but they can come very, very close to breaking the law. But its absolutely startling that they admitted that they did this this time. Not startling that they did it because theyve been doing it since the j. Edgar hoover years but the fact that they admitted it is startling. Not the academic admission. If the doj admits there was no basis for the prosecution, that means that the defendant can see the prosecutors for his legal fees and in this case, hes got 6. 7 million to get him to this point. It also means they have exposed themselves to prosecution themselves. Dana indeed. And then you had written to me, if the judge decides to hold a public hearing and takes testimony on all of this, you say it will not be a good day for the doj. So we will all be watching that. What do you know about that . Lets be clear about it. The gbi, they are criminal investigators and they are not civil investigators. The Georgia Attorney general wants to get to the bottom on whether or not these prosecutors in their early days of the investigation were candid with his office in their communications when it came to the issue of appointing a conflict prosecutor. D. A. Barnhills biggest mistake i think was getting involved in this case before the attorney general invited him to do so, and then to make matters worse, of course, he dropped this letter, that i call a clearance letter into the file during a time when he had an arguable conflict of interest. Those things the ag says may not have been disclosed in the office and its a crime for Public Officials to engage in unprofessional conduct if it rises to this level. It could either be a misdemeanor or felony violation of oath of office. Dana what might the defenses argument be when they are able to make your case . If they will file right out of the gate a motion to mike for immunity. That will be based on georgia law which says if you are engaged it will trigger a Court Hearing and a judge will have to decide whether or not to confirm immunity for these individuals. If so, the cases over and if not the defense gets another crack at that apple and they can present it to a trial jury and ask a trial jury to equate on the basis of lawful citizens arrest and lawful selfdefense, if they can make up that case. Dana okay, you just mention citizens arrest. How often is this used . Ive never seen it before in my professional career and ive been around the Justice System since 1989. There are some cases but georgia doesnt exactly make it easy for citizens to engage in this and when they do, if they have to use force it has to be objectively reasonable. Much like police officers. So its not something that will be an easy case to make. There is sometimes a fine line between lawful citizens arrest and an assault on an individual. When you have individuals looking at this case like the head of the gbi who says its definitely a crime and the d. A. Barnhill who says its definitely not, sometimes how is a citizen to know if what they are doing is lawful or not . Its probably best to stay away from it. Dana right. The state of georgia once it got involved fairly quickly, within about 48 hours, the federal government asked the Justice Department to look into this case. What would you like to see them uncover here . First i would like to say, attorney general car, thank you for looking into it. I had an opportunity to and speak to him yesterday and hes looking at the chain of command as it relates to the case. Number two i think the federal department of justice i spoke with, attorney general barr yesterday and encouraged him to get involved as well since the Georgia Attorney general asked for the dojs involvement. So what im looking for is frankly justice and transparency. I want all the facts to be eliminated, the facts are quite, but every sequence of this case should be understood by the public especially the six week delay as it relates to this case coming to light. Dana speaking of that delay, when he first heard about this and understood the case you tweeted a message about how you felt personally about it. Maybe you could share that with all of our viewers . I was three weeks ago taking a look at some new construction in south carolina, some really new houses and you know theres some nice houses in bluffton but also in the charleston area. And i can just imagine. If someone said i called the police because i was looking into the house and i ended up laying on the ground in the middle of the street at 1 00 p. M. In the afternoon shot to death by two guys, one with a 357 and the other with a shotgun, what kind of crime did i commit . This is a fox news alert, apparently the acting director of National Intelligence has just released the names of Obama Administration officials who requested the unmasking of Michael Flynn. On the list apparently is former Vice President joe biden. Again, im reading this cold. Others former fbi director james comey, former director of National IntelligenceJames Clapper and former u. S. Ambassador to the United NationsSamantha Powers. Obviously you are getting this information just as i am, any thoughts about this develop meant . This kind of sheds more light on and reinforces the fact that there is a stench coming from this investigation and the president , president obama writing a letter and trying to keep those records at the university sequestered as well as trying to keep a lid on so many of these steps or missteps in the investigation, it seems that we need to have more light brought into the subject and frankly the fact pattern is really concerning and i understand now even more why Vice President biden has been trying to step away from the situation. John, i said that we would get back to you if we had any developments but this was not the develop meant i anticipated. Yesterday the Justice Department said they would not release the names and that that document belongs to the director of National Intelligence so now he has decided to release the names and, joe biden is on the list . They actually came off of capitol hill. We have a list of 39 names in these documents that were handed over to the department of justice by the acting dni ric grenell which included people who may have received information about the unmasking of general flynn. Its not to say that they did it, but they possibly could have. There were a request that was put in by 16 authorized individuals for the unmasking. But among the people who may, and again i must stress, may have seen their information regarding Michael Flynn, the u. S. Ambassador to United NationsSamantha Power who had put in an inordinate amount of requests for unmasking, so many its a price even her and she thought maybe her subordinates were involved in putting some of those in under her name. James clapper, the director for National Intelligence was in there, the director of the cia, john brennan, treasury secretary jacob lew, james comey, the director of the fbi at that time, Denis Mcdonough who is the chief of staff to president obama and joe biden, the Vice President of the United States, that was on the 12th of january, 2017, that he received that information about flynn. Now we do know that earlier in the month joe biden had been in a meeting with president obama at which james comey said to them that the fbi interested in interviewing general Michael Flynn. That was right about the time as we know now from documents that have been released but the people who are looking into crossfire hurricane which was the investigation into whether there or not there was collusion between the Trump Campaign and russia had already said that Michael Flynn, who was identified in crossfire hurricane as cross fire razor appeared to have no derogatory information about him in anything that they had found in the course of their investigation. But that is when peter strzok who went on to interview flynn later on in january raised his hand and said, wait a minute. Dont close out this investigation just yet, we have more to ask him. So again. This stipulates that we do not know if all of these 39 people received information about Michael Flynn that they were among the people who were authorized to do it and likely received reports that include Michael Flynns name. So we are just beginning to scratch the surface of this and these documents just came out, we will get back to you as we have more details. Dana can i just clarify something though . So these names, we know that these people could have received information or that they asked for this information. Do we know that specifically . Let me read directly from the document. It says, below is a list of their recipients who may have received general flynns identity. In a process request to unmask identity that had been generically referred to in an nsa foreign intelligence report. Each individual was an authorized recipient of the report but we do not know if they actually saw the report, saw general flynns name, but they were on the list of people who would have received it. Dana at this point john, would anyone on that list be allowed then to talk about it publicly . Because conceivably, the investigation and those aspects of it are still classified. Yes, but the unmasking has now been declassified. We now know that National Security advisor to president obama had requested the unmasking. Susan rice says it was not done for political purposes, it was done for National Security reasons. She even wrote an email saying they wanted to be sure that they could share freely intelligence about russia with members of the trump transition without worrying about it ending up the wrong hands. So we already know about the unmasking. We now know that this has been declassified, the people who have potentially received the information about unmasking. So its not inconceivable that some of these people now may feel free to talk about what they knew or didnt know. Dana yeah. While they are welcome to come on the show and talk about it. Lets go back to judge Andrew Napolitano, he stuck around for us as this news breaks. 39 names, thats quite a lot of people within the federal governments that have disabili disability. While some of the names are well known to us, particularly the last one on the list, then Vice President joseph biden. Some are not, some are in the Intelligence Committee and some worked for the george w. Bush administration as your data, and some were still in the Obama Administration at the end of president obamas second term. Im relying for this information on the up to the minute as always email from our colleagu e gillian turner, herself a former intelligence official. The issue is, for what reason was this released . Because the statute that keeps the secrets as it can only be released for a compelling National Security reason. It appears it was released for a political reason but thats for others to decide. But john roberts is quite correct. Once its out there, its fair game. Joe biden could say i dont want to talk about it but there is no law preventing him from talking about it because he has been outed as one of the unmask hers, even though he had absolute authority to request the unmasking. Dana so the other day, or i guess it was just yesterday morning on good mornin on Good Morning America the former Vice President answered questions on this. He said at first, i had no idea about any investigation. Then he said actually i knew there was an investigation but i didnt know anything about it. Now we see his name on this list. Just to clarify, john roberts says we dont know if these people actually got the information but it was available to them. Do you think that the Vice President has some clearing up to do here . Judge napolitano, maybe you cant hear me. Judge . No. That was a great question though. We will try to get him back, having a few technical difficulties. We will be right back. Some of it sticks out, its a little audit. I dont know why the u. S. Ambassador of italy would be asking about this unmasking. I mean general flynn at one point had a commercial relationship with some political figures in turkey but the unmasking of course was about materials that didnt directly involve turkey. This is a can of worms that is going to ask more questions on its going to answer. The actual list was released by capitol hill, by two u. S. Senators. Of course the acting director of intelligence ric grenell who we obviously know knew what he was doing, but giving it to two senators, we knew that would be released in a heartbeat. The question was, what reason was it delivered to the senators and for what reason was that released, because this information is supposed to be kept secret unless there is a compelling National Security reason as for the statute to release. Dana what might Michael Flynn make of this especially as we were talking earlier about the Justice Department not wanting to dismiss the case, the flynn people wanting to dismiss the case and the judge in the case saying i need to wait and have a hearing on this. Does this list have any bearing on that hearing . I dont think it does. This list does have bearing as to how the Washington Post learned about this, the Washington Post is the entity that revealed to the public the existence of the conversation. One could infer that somebody on this list passed it on to the Washington Post. There would be a serious problem for the person who did that but i dont think that this in any way implicates the legal issues for the court. The court as we talked earlier is trying to determine whether there is a real basis for dismissing this poor weather somebody is trying to do the general a favor. Dana ic. Judge, if you could stand by, we are also going to bring in andy mccarthy. Hes a Fox News Contributor and i just read his piece this morning about the case and this is a whole other element. What do you make of the release of these documents including former Vice President joe biden was on the list of people requesting to know flynns identity . Well i certainly agree with judge napolitano, dana, that when the two senators asked for this information after the director of National Intelligence shopped it to the Justice Department that it was a matter of time, short matter of time before he got out. But what i would be very interested in is making the distinction that general flynn, you know when we are talking about unmasking, we are talking about people who are americans who are incidentally captured or monitored in foreign intelligence. General flynn we now know on the basis of all of these disclosures that have been made in the last few weeks was not incidentally anything, he was a target. They made him the target of an investigation which seems to me, if you have him as the roving target in the Trump Campaign then anyone he comes into contact with could be incidentally collected in connection with foreign intelligence collection because they identified him preposterously as a clandestine agent of russia. Dana i was just looking at the dates, this letter from the National Security agency is as per your email request i am providing this list of identities of any officials that ask for this nsa information between the 8th of november 2016 and the 31st of january 2017. So im thinking that timeline is very interesting because its right after the election or right before, i cant remember the date of the election. So right after the inauguration, does that tell us anything . November 8th was election day. So this was basically the Obama Administration realizing against all odds that trump has one end of that in ten weeks hes going to have access to all of the intelligence files in the United States, so they are going to get busy and, since they have been investigating him and his campaign as if it was a russian operation, they now have two pull together and project some evidence to suggest that that was not something that was fabulous and that was actually real. So i think, you have to combine this with all of the Intelligence Leaks that we got from election day going past Inauguration Day. Dana and andy, on this list of course the dni at the time James Clapper and the director of the cia, john brennan, both of those individuals had been quite willing to talk publicly about the russian collusion story, all up through impeachment. Really willing to go on the record and to talk about that. Do they have some obligation now to explain themselves in this action and why did they ask for it . I would also point out that clapper appears to have been involved in the leak of the dossier, the ridiculous steele dossier that in the beginning of january, cnn got first and then buzzfeed publish the whole thing. And i think klapper is on records admitting he spoke to cnn about it so it seems to me that what went on here is they were trying to protect the image of something they hadnt been able to prove with evidence, which was that trump was in cahoots with the kremlin. Dana can i ask you something about this list . Do you think andy, in your experience, that all of these individuals would have asked for this unmasking separately or do they communicate amongst themselves and all agree that they are going to ask for it at the same time . Dana, we are years overdue for a hearing on exactly how this happened because as i understand it, cement the power is on paper responsible for over 200 unmaskings. She says she didnt do it. So i dont think we know how they did this and i dont think we know whether these names are just names that are being used like nominees and somebody else was actually doing the dirty work. Today, catch us up because you have perspective from the doj. Im actually outside of the Supreme Court, we kind of change the shot because this happened breaking news right now. This is something the doj said they were going to let o. D. And i release. Kerri kupec, every spokesperson for attorney general bill barr said this was going to be released and eventually came from senator ron johnsons office, senator ron johnson from wisconsin and senator Chuck Grassley from iowa. They wrote a letter specifically asking for this information to be released and proof, a couple hours later it was released by senator johnsons office. Last week, dana, ric grenell, the acting director of National Intelligence was spotted over at the Justice Department going in and giving a trove of documents. Now we know what some of those documents are, what you were just discussing. This request of unmasking. He made that request of doj and that was last week. Doj looked over those documents and set at this point they are waiting for the john during the investigation to released some of their investigation. Thats kind of separate looking at the origins of the russia probe so they said od letter and letter i would release this. Some of these names are mostly security officials, but whats really surprising, Vice President joe biden made a request for unmasking according to these documents that were released today. Dana although, i wonder about the Vice President. Again, i go back to that Good Morning America interview and i dont have the transcript to memorize, but i remember him saying, he did know that there was an investigation but he doesnt go any further. I wonder if he will want to clarify anything now that we know that this is here. Now, he does have Constitutional Responsibilities as a president of the United States did and we see here that the chief of staff Denis Mcdonough also asked. There are some other questionable ones. Do you have any sense from that Justice Department on what they think about that and how long they are willing to sort of wait it out . Everything i can tell from Justice Department officials is that they believe that their brief stands for itself. They want to drop the case and they believe this was an erroneous case against general flynn. It will be a challenge for judge sullivan because after all he will be walking into a courtroom if he chooses to continue the case where you have the prosecution and the defense on one side agreeing. You really dont have prosecution anymore so what hes doing now is simply delaying the process and he wants these friends of the court briefed to essentially hear from more people involved. Its possible though that he could call another hearing. Its possible he could call for an actual hearing and bring both sides in and have justice go on the record, the department of justice i should say go on the record to explain why they dropped this case. But as far as the doj is concerned they totally stand behind this and they believe this was a major injustice to general flynn. Dana davids bunt, stay there with me.
