Catherine herridge is live in washington as this issue heats up. Reporter thats right, dana. Good afternoon. Right now were on a temporary break, about an hour, as they get to some votes. They will resume in about half an hour. We had passioned arguments on both sides this morning, 3 1 2 hours of debate on this resolution for the attorney general, the ranking chair ranking republican and chairman and this exchange at the table. No person and certainly not the top Law Enforcement officer in the country, can be permitted to defy a valid subpoena. No person, not the attorney general, not the president can be permitted to be above the law. This is the first step. What a cynical counter productive irresponsible step it is. Democrats have no plan, no purpose and no legislative agenda beyond attacking this administration. Reporter things did break down into a couple different buckets. On the issue of oversight, they engaged democrats right up until the last hour, made a good faith effort to make the special counsel report and the under lying records more broadly available to lawmakers. Then negotiations fell apart over a number of issues. The Senior Justice Department official told the president to expert executive privilege. For democrats, it comes down to the issue of whether the legislative branch will be able to execute legitimate oversight. I can only conclude that the president now seeks to take a wrecking ball to the constitution of the United States of america. By citing the attorney general of the United States for contempt of congress, youre saying im standing up for the law. I am not going to break the law by complying with that part of your subpoena shows an overreach on the part of the majority. Reporter another thing that emerged is that the republicans made the argument that the democrats did not like the findings of the special counsel, so now theyre seeking, in their words, the weaponize the oversight process. Democrats countered that theres ample evidence in the special counsel report for obstruction. This is not a witch hunt. If it looks like a duck, walks like a duck and quacks like a duck, its a duck. And if it looks like obstruction, sounds like obstruction, smells like objecting obstruction. Our democratic colleagues have weaponized our critical oversight responsibility. Reporter so all of this is taking place against the back drop where there has been no formal or official opening of impeachment proceedings, and the republicans hit hard on this point today. They feel democrats are trying to do impeachment like or faux impeachment proceedings. Well get to that vote probably in about half an hour. Dana well check back in with you if that happens. President trump pushing back against New York Times story about his tax returns. The times proposed tax figures that trump showed losses of apparently a billion dollars, losing more money than any other taxpayer during that time. President trump calling the report highly inaccurate. John roberts has more from the north lawn. Reporter this happened between 1985 and 1994 according to the New York Times. During that time period, the president lost 1. 7 billion. This was all during the art of the deal period. At one point, 1990 and 1991, the New York Times said the president lost 250 million each of those two years which they say was more than any other wealthy american did, and that he used those losses to not pay any income taxes. The president tweeting ant it saying, Real Estate Developers in the 80s and 90s were entitled to massive writeoffs and depreciation which would what was actively building show losses and tax losses in almost all cases. Much was nonmonetary, sometimes considered tax shelter. You would get it by building or even buying. You always wanted to show losses. Almost all Real Estate Developers did and often renegotiate with banks. The president said it was sport. Additionally, the very old information is a highly inaccurate hit job. Chuck shumer was asked about the story an gave this rather curious answer. Listen here. The greatest worry i have, the greatest worry i have is that this man is so despicable in how he govern, so little respect for the rule of law, so little respect for honor and decency and humanity and the norms and values that have made america great. How can so many people follow him . That is one issue that eats at me. The others i think if we do our job, things will fall into line appropriately. Trump will not win the presidency or he wont last that long to even get there if we do our job right. Reporter he wont last that long to even get there if we do our job right which, dana, to me, sounds like an indication that twhaeupbt to try to take him out before the 2020 election. Thats the first time we heard that from the Senate Minority leader. Dana it didnt look like it was off the cuff. It looked like that was something he wanted to put out there. Reporter it looked like something he had been giving considerable thought to. The treasury secretary refused to hand over the president s tax returns to the house ways and means committee, continues to do that. Well see if that whole issue winds up in court. Dana watching him doesnt change that much, does it . Reporter its never boring around here. Dana we are not bored. Thats why you watch. Thank you, john. Lets talk about the bill barr vote with former general counsel and david burstein, with run for america, which is not a race. You did get here on time, which we appreciate. Alex, youre a lawyer. Nothing against lawyers. I imagine you love this kind of fight to watch between the legislative branch, the executive branch, the Founding Fathers imagined this might be how it goes. It is a pretty Remarkable Exchange going on between the attorney general. Look tprrbg the purely legal perspective, trying to remove politics from this, which i know is hard. Dana lets do that for a moment. The attorney general is not refusing to engage with the legislative branch. He testified the other day in the senate. What hes refusing to do is to be forced to turnover and make public grand jury information which is in violation of the law. The chairman can go to court any time he wants and ask the court to do that, as its his right. Im not sure the court will agree with him. What he cant do is hold someone in contempt for complying with the law. Dana hes also invited the democrats to come down to the Justice Department and read the report. Why do they not do that . Is that strategic . Theres two things going on here. One the political fight the democrats want to have. The other is a legitimate responsibility of oversight. One would argue, if you think about whats happened, for instance w the Hillary Clinton investigation and under lying documents that were gotten before democrats i think controlled congress, it would say that the principle footwork there is not being put forth here. So the question about whether these things are classified, confidential. This is the kind of material thats almost always been provided to congress. Dana even grand jury information. Yeah. It was done in the Hillary Clinton case. On the other hand, this white house is showing a historic level of noncooperation with congress. Eric holder was held in contempt. Even he cooperated more with congress than bill barr is. Dana the Judicial Branch doesnt want to get in the middle of the executive branch and the congressional branch. Listen to nancy pelosi just on the politics of, this talking about impeachment and how she feels about Congress Versus the executive. Watch this. Impeachment is a very divisive, very divisive course of action to take. We shouldnt have passion or bias. It has to about the presentation of facts and patriotism not partisanship. I think we are a superior branch, quite frankly. We have the power to make the law and the president enforces the law. So we have a big role, closest to the people. Dana thats classic, right. Speaker of the house thinking they are superior to the executive. Thats not how the Founding Fathers thought of it. Coequal. Dana i want to read to you a quote from john yu. Hes a professor at berkeley. He says this about this exertion of executive privilege. It would be extraordinary if the president were to try to stop all congressional testimony on subpoenaed issues. That would be unprecedented if it were a complete ban. Hes treating Congress Like they are the chinese or a local labor union working on a trump building. What i wonder about that, sometimes a president will go full bore and say you cant have anything. But when they reach court, theyll say you have to turn something over and hell say im being accommodating. The presidere are very speci justified reasons why each of these has been pushed back on. I dont think the executive branch is experting a concrete ban. Dana zoom out. Now were 30,000 foot level, david. Republicans who watch all of this and think this is such a waste of time. I understand, go back to the ben ghazi hearings. I get it. Democrats said the same thing. Is there a concern on the democratic side that youll spend so much time and all this energy not showing that you can actually govern when you go to run for reelection in 2020. Many of those freshmen democrats are seats President Trump won in 2016. Democrats need to strike a careful balance here, which i am afraid they are not quite doing. They do need to hold the Trump Administration accountable. Thats what they were lected to do. They did not have a mandate to impeach him. I think impeachment is the wrong move. But the kind of cooperation Congress Needs to be afforded on a whole host of issues. Some have to do with cabinet secretaries and other things that have gone on. They do need to put together proactive things. I think i heard it was finally infrastructure week. There are movement of those kind of things that would behoove the democrats. Accountability where they can actually have a win. Places where they can actually get something changed, get someone removed, instead of barr who will never be removed. Dana thank you. Two democratic president ial candidates unveil 100 billion plan to fight opioid crisis. We speak to the governor of one state hit the hardest. One of the suspected attackers in the Colorado School shooting is set to appear in court soon. Schools should be places where students can learn and grow, safe places, and we shouldnt have to worry about being marched out or having to be air lifted to hospitals or even losing ones life. Here you go little guy. A cockroach can survive submerged underwater for 30 minutes. Wow. Yeah. Not getting in today. Terminix. Defenders of home. Dana in about an hour one of the suspected School Shooters will appear in a colorado courtroom. Police accusing the 18yearold and the second juvenile suspect of opening fire at a k12 school yesterday. One student was killed, eight injured. Alicia cuna is live in highlands ranch. Reporter hi, dana. Colorados governor has ordered flags lowered to half staff to honor the victims of yesterdays tragedy. Kendrick casillo was three days shy of his high school graduation. We are also hearing about a hero. The kwraoupbd marine corps confirmed one student, brendan biley who was in the delayed entry program, assisted in subduing one of the shooters. The marines said brendans courage to swiftly ending this at the risk of his own safety is admirable and inspiring. His actions resulted in safety and protection of his teachers and fellow classmates. Brendan was one of the 1800 plus students inside the Stem School Highlands Ranch when the sheriff said the two suspects walked in through the middle School Entrance and into the high school before they began shooting in two different classrooms. The district attorney, who will prosecute this case, all headed the case against the aurora theater shooter. He lives in this community and had this to say at a News Conference earlier today. In 20 years and 20 miles we would have dealt with columbine, aurora theater, rapajo high school, shooting of zach parish and four deputies. You would have thought mad. Here we are again. Reporter and they have asked the media not to give the suspects notoriety, dana, as we are reporting what has happened here. Dana agree with that. What do we know about todays Court Appearance . Reporter from what we understand, this will be an advisement hearing for both of the suspects, the adult and the minor, both of whom are students here at the stem school. Law enforcement did search their homes last night and today, as well as the vehicle belonging to one of them. We are hearing that it is covered in some kind of graffiti. Right now the sheriff said he isnt commenting on any possible motive or target here. Dana all right, alicia, thank you very much. We are keeping a close eye on the House Judiciary Committee as they consider voting to hold the attorney general in contempt. Plus, 2020 candidates going all in for the key early voting state of New Hampshire. But whos up and whos down . Hey, who are you . Oh, hey jeff, im a car thief. Site of the first president ial primary. According to the real fair politics polling average, joe biden leads Bernie Sanders but just by a point, followed by Pete Buttigieg and Elizabeth Warren. What is it like being the governor of the first primary state . Is it already madness . Its getting there. Theres no doubt its getting there. New hampshire, we tweet it as kind of our fifth sport. Whether its republican or democrat. We take a great responsibility in that theres a reason we are the first in the nation. We have a whole different set of tests. Dana joe biden is up by a point, but what is it really . Thats very telling. Bernie is from vermont, so naturally bernie should do well in New Hampshire. Dana Elizabeth Warren is from massachusetts. Shouldnt she do well in New Hampshire . No. Our first litmus test is being genuine. Do we buy into you as a person . Do we connect with you at a gut level. Bernie, his policies are just insane, but at least he is what he is and he doesnt apologize for it. Warren is more a phoney and people dont buy into genuineness. Dana biden is a no quantity . The fact that hes up on bernie is quite telling. Theyre pulling everyone to the left. Dana tell me about 2020. In play for President Trump . Absolutely. Our four electoral votes always become very much in play for a lot of candidates. It will probably be a closer race. Again, trump is gonna win in 2020 but theyre going to put some money in, make an investment. Dana i remember in 2016, one of the things one of the candidates told me is as they went up to New Hampshire the first question everyone got was about the opioid crisis. Yes. Dana i wonder if you think they should still do the same today. Amy klobuchar announcing a 100 billion plan today. That would cover mental health, opioids and other kinds of drugs. The money 40 billion of it would be from a 0. 02 per milligram fee on opioids new york just passed out. Dana i just wonder if we talked about this, it was the first question in 2015. In 2019, has there been progress . Without a thought. New hampshire is one of the states to truly recognize the crisis. We will be one of the first states out of it. The death and overdose rate keeps going up. Ours is going down. This isnt just about money. When it comes to government r putting more money at something is pushing harder in the same direction. What new infrastructure are you bringing to bear . Were creating a whole new system in New Hampshire. Dana do you think the states can do it better than the federal government . Are you joking . This is why a lot of candidates arent going to do well. Congress job is to approve funding. Dana u and stay out of the weeds. Youre reading the local papers and seeing the impact. Were talking to people on the front lines. Dana who would be a gop challenger to President Trump. This is bill wells. Is he gonna play in New Hampshire . Bill is an old friend. I sat with him a month ago. No. Dana larry hogan talking about the possibility of running. Good idea, bad idea . Terrible idea, frankly. Not only trump could never get beaten in a primary and hes going to win in the general election. When you look at the policies of those, to win a conservative primary in any state, you got to understand dana then you have senator jean shaheen. Any chance you might challenge her and go to the senate . Theres a lot of talk. Right now my focus is making sure the democrats in New Hampshire within the state and that the state senate and state house dont do anything silly including income tax. Those are the democrats im worried about beating now. Dana when do you have to make a decision . Look, the quicker you start making a decision, the more you put politics in your decision making. Thats never a good thing. You want to take politics out to get the best outcome for people. Democrat love having you. Thank you. Any time. Dana fox news alert. House Judiciary Committee set to reconvene any moment now. Theyll hold a vote on Holding Attorney general william barr in contempt. Reaction is pouring in, not only to that move, but also to the white house excerting executive privilege over the entire mueller report. Mike emanuel is live on capitol hill. Reporter the chairman of the Senate Judiciary said he is not sure where this will land. Saying President Trump and the white house were correct in experting executive privilege. It will be hard for them to do their job, if people come forward if theyre going to be hauled before congress which is a political exercise here. So if i were the administration, i would protect mr. Mueller. If he were any other prosecutor, in front of a bunch of politicians becoming prosecutors. Reporter theres been clear frustration inside the House Judiciary Committee. Republicans saying its time to move on following two years of investigation and the mueller report. But some democrats say they want to go further, beyond going after attorney general william barr to get President Trump. I have talked to people saying we need to do something stronger. Show me why we shouldnt go as far as we can. I definitely believe this man committed impeachable offenses. He threatened the constitution. Hes threatened what we know about democracy, rule of law. Its a question of how best to remove him from office. Reporter democrats clearly having impeachment on the brain, its not entirely clear how the white house and congress cut deals on issues ranging from infrastructure to a trade deal between canada and mexico and even funding the government. Theres a great deal of tension and bad blood, dana. Dana indeed. Thank you. Campaign finance is becoming a hot topic in the 2020 election. House democrats have previously called for an end to what they call dark money which refers to political funds from groups that dont disclose their funding source. President ial campaigns could still be exceptions. Lets start with Elizabeth Warren. How much has she divulged when its come to accepting big checks now that shes running for president . Reporter a lot. She said she wont even make time for a phone call with a rich donor. When joe biden went to a comcast supporter she used that. She said welcome to the race, joe biden raised 3. 3 million. How did joe biden raise so much money . It helps he hosted a swanky private fundraiser for wealthy donors at the home of the guy who runs comcast lobbying shops. Well, as it turns out, in 2017 those folks, including the guy who runs the comcast lobbying shot hosted warren in philadelphia. Warrens Spokes Person explained to the philadelphia enquirer, elizabeth decided to not do any closed door events because special access for the wealthy and well connected should not be how we choose the democratic nominee for president. She believes that this primary is an opportunity to build the kind of Grass Roots Movement that will win the general election and bring structural change to our government. A group called issue one found Democratic Candidates actually accepted 54 of all the dark money which is tough to trade in the midterms. Dana also they talk a lot about the 1 , but theyre willing to take money from the 1 . Reporter and for some, those donors the 1 are from those who represent wall street. 2700 tickets are you going to have the fundraiser or not . Of course. Im going to ask americans across this country to support my campaign. But taking away the influence they have, the fact that lobbyists get to control everything you dont see a contradiction . I dont. At the end of the day people will support our campaigns because they believe in us. Reporter gillibrand draws a line. She will make time to meet with wealthy contributors but wont accept money from corporate pacts. Dana thank you so much. More on this with philip wedeman. So, you can help clear this up for us. I may be pointing out hypocrisy is pointless but you do have many Democratic Candidates have said they wont take money from specific places, maybe lobbyists or just lobbyists that work for fossil fuels, etc. A front runner like biden, what would he do . Thats a big question for biden and all of the campaigns to grapple with. Whats happening now is theres a mismatch between rhetoric and action. You see candidates swearing off a lot of the pact money, dark money, but operatives are gearing up to spend so much of it in the cycle. Operative that i spoke with, like the director of america future, theyre preparing to spend upwards of 60 million this cycle because they dont want to go into this president ial race with one arm tied behind their back. So the question for these candidates is, are you going to swear off this money but then let it be spent on your behalf . Its an awkward question. Dana it is. Lets transition on the same topic into one of the candidates, senator Amy Klobuchar. Tonight she will be doing a town hall. Shes already got a pretty high burn rate, right . Got all these things going. What is her position financially . I think whats interesting about Amy Klobuchar, she doesnt have the momentum or deep pockets like joe biden or Elizabeth Warren does. But what she does have on her side, she has geography. Party insiders on both sides see the path to the 2020 white house as going through wisconsin, pennsylvania and michigan. What do all of those states have in common . Theyre industrial. Theyre midwest. Klobuchar is hoping they will see her as one of their own, identify her and hopefully give her the break she needs. Tonight will be huge for her. Dana this is something she said about the economy. Economys great, so how do these candidates try to draw a distinction between President Trump and themselves. Watch her on this issue. Do you give President Trump the credit . I give our workers and our businesses the credit, jake. When youre out there across the country, you see people working harder and harder every day. That being said, a lot of people arent sharing in this prosperity because of the cost. The cost of college, the cost of healthcare. The fact that the president had promised he would bring down the prices of their prescription drugs. That just hasnt happened. Dana she wont give President Trump credit but do you think if she were asked do you give president obama credit for the economy that she would be compelled to say yes, so she can appease the base . This is the quibble that all democrats and republicans have. Who is responsible for the Strong Economy . Certainly the Trump Campaign thinks the best argument they have going into this race is the lives of individual voters is better now after four years under President Trump than they were under obama. I dont think were going to see any 2020 candidates give any room to President Trump. Theyre going to make that argument that life is Getting Better for people, for 1 life is Getting Better for people already wealthy, but not people in the middle class. Thats a hard needle to thread when you see a lot of voters think President Trump is doing a good job on the economy. Dana i have a quick question. Did you happen to see the interview we had with the governor of New Hampshire . I did. Dana i asked him, are you going to challenge the incumbent Senate Democrat of New Hampshire . He didnt answer specifically but did you get a lean either way . So i didnt get a lean either way. I think his answer was very coy, very interesting that he talked about making certain that his decision was going to be focused on not the politics but actual policies. I think hes playing this one close to the chest. This is a sharp guy who is quick on his feet. He is rising into a prominent star. I think he would give shaheen a run for her money if he decided to jump into the race. Dana thank you. Thank you. Dana be sure to catch that town hall with Amy Klobuchar tonight at 6 30 p. M. Iran will stop complying with the parts of the 2015 nuclear deal, setting a 60 day deadline for european leaders to reach a new agreement or withdraw like the Trump Administration declared it would. Minutes ago the president just imposed sanctions on iran. Greg palkot explains from london. Reporter first of all on the First Anniversary of the Trump Administration pulling out of the Iranian Nuclear deal, irans president did fire back, announcing his country will no longer implement the aspect of the internationally agreed pact and yet warning if new arraignments arent made, it could restart production of highly enriched uranium used in Nuclear Bombs to ramp up a nuclear plant. As you just mentioned, just in the last minutes, getting confirmation from the white house that there is yet another round of unilateral sanctions being imposed by the u. S. On iran, specifically on the steel, iron, copper and aluminum second tors. Advanced word on that, dana, it could be very serious for irans economy. Dana thats right. As mike singh said, iran cant fight sanctions with other sanctions. How is secretary of state mike pompeo reacting . Hes in london today. Reporter exactly. Hes in london today after that surprise visit to baghdad, to iraq, on the heels of the Trump Administration saying that they are getting indications at least, of a serious offensive activity, possibly coming from iran. He met today with Prime Minister may and others. He chose to agree not to agree with the u. K. Regarding iran. Britain, along with france, germany, russia, remain party to the deal. Here is what the secretary had to say about the word coming out of tehran today. I think it was intentionally ambiguous. Well have to wait to see what irans actions actually are.
