About the accusations that have been thrown against them, thats totally off limits and outrageous. Dana chief Congressional Correspondent mike emanuel is live on capitol hill. Things are heating up, mike. Reporter dana, no question. The fbi is expected to sends a single copy of its report to capitol hill after it sends it to the white house, which im told will be kept in a safe just to show you how tight security concerns are here. All 100 senators and nine staffers will be authorized to read it. Im not worried about a leak. Im confident there will be leaks. Something will say something. Thats not unreasonable. When the fbi information comes out, all of us have a response bltd to read through it and go through it, the same way we have access to the previous fbi investigations that judge kavanaugh went through. Reporter Senate Majority leader Mitch Mcconnell has promised a vote on the kavanaugh nomination this week. Heres how it would go down. Day one, senator mcconnell would file closure. Day two a layover day for the petition. Day three would be a procedural vote on whether to end debate. They four would be the Senate Voting on final confirmation. Theres been careful scrutiny of professor christine fords testimony last week. An exboyfriend of fords said she never mentioned sexual assault, harassment or misconduct and that she flew on small planes and ha no fear of flying. A member of fords team said she stands by her testimony. Now Senate Judiciary chairman Chuck Grassley trying to lower the temperature tweeting, i have long history of respecting people with courage to step forward. Judiciary Committee Gave dr. Ford serious consideration she deserved. As soon as i learned about her. People can decide who to believe, but i plead with all, stop personal attacks and destruction of dr. Ford and her family or judge kavanaugh and family. Now some are expressing critique with President Trumps critique. Its incredibly unfortunate the president uses that kind of language. It does nothing but further divide this country. We are in a bad place in this country, where a Supreme Court nomination has divided this country so much. Its because of rhetoric like that. Reporter with the Senate Getting close to action, things are clearly heating up here on capitol hill. Dana . Dana thank you, mike. President trump last night taking aim at the Senate Testimony of kavanaughs accuser, dr. Ford. Watch. I had one beer, right . I had one beer well, you think it was nope, it was one beer. Oh, good. How did you get home . I dont remember. How did you get there . I dont remember. Where is the place . I dont remember. How many years ago was it . I dont know. I dont know. I dont know. Dana heres Sarah Sanders moments ago. She was defending the president s remarks after she got many questions about them. Campaign rally assault on a woman who says shes a victim of sexual assault. What do you get out of that . Is that to help kavanaughs nomination . Is this to rally the base . Is this gonna help with the midterms . Whats the point in doing that . Again, i dispute that it was anything other than the president stating facts. Facts that were laid out in the prosecutors memo that she put forward to the senate. Dana south dakota senator john thune, you saw him yesterday after the policy lunch. He came to the podium. Thanks for being on the show today. Question on the exchange you just heard between Sarah Sanders and the reporter about the president s comments last night. John gizzy, a reporter there from human rights magazine, said it was counter productive for senators murkowski, collins and flake. I wonder what you think about that. I know youre counting the votes very closely. Well, youre right, dana. Its an audience of three we have to win over, at least at the moment. As is usually the case, the president sometimes style and tone and approach perhaps not all that helpful. The point he was making is correct. That is that there are factual inconsistencies, factual inaccuracies in dr. Fords testimony. How you make those points does matter. Right now its about getting the fbi report in and assessing that and moving forward in the next couple of days with the procedural vote and with the vote on the judges nomination dana do you know when youll expect to see the fbi report . Well see that sometime today. We expect it to be here. Dont know exactly when. Members will have an opportunity to take a look at it and then eventually, obviously, that will enable i think the process to move forward. We hope that were going to have the votes to get him confirmed when its all said and done. Dana one thing you do as a conference chair, you think about communications. Im wondering about the idea of the fbi report, there will be one copy and that copy will be in a safe. Senators can come and look at it, but you couldnt take it out of the room, take pictures of it. But, given that this nomination hinges on this fbi supplemental report, do you think its possible to keep it hidden and to not allow the public to see it because its lets say a democrat senator reads the report, leaves and then says something that republicans think mischaracterizes the report and then youll be back into this he said she said thing once again. I think it is usually the case up here, dana, that this will get talked about. In the end portions of that report may come out in some form. But it is important. Theres a lot riding on this, as you said. All senators will have an opportunity to look at this. My guess is there will be plenty of discussion about it. Eventually some of it will make its way out into the public, into the mainstream. Most importantly, at least right now, is that all senators who are going to have the responsibility to vote on this nomination have the opportunity to review it, assess it and come to their ultimate conclusions. This is fbi report number seven that theyve done on judge kavanaugh. Dana Lindsey Graham, senator from south carolina, was talking about President Trump and kavanaugh today. It got a little heated at an event today. Take a look. So President Trump went through a factual rendition that i didnt like. Youre not helping. I dont like what the president said last night. Im the first person who said, i want to hear from dr. Ford. I thought she was handled respectfully. I thought kavanaugh was treated like crap. Yeah. Boo yourself. Dana i want to ask you about the president s comments and that audience reaction and the thingious ear hearing from constituents. What are you hearing from back home . Well, i think that was probably a left leaning audience. I think people back in my state of south dakota believe in due process. They believe in the presumption of innocence. And those are foundational, not only to our legal system, but also a matter of our history, heritage and culture. Those are things that are important in american jurisprudence. As we look at this nomination, you want to look at the facts, at the evidence. Thats what were talking about here. I understand people want to make this about emotion. It is an motional issue. I understand that. If there is a woman in this country who is a victim of sexual assault, she deserves to be heard and to come forward. They shouldnt suffer in silence, victims of crime. But at the same time, when were making determination about someones guilt or innocence or eligibility and qualifications to serve on the Supreme Court, there have to be facts. You cannot take something where the evidence is as filmsy as this is and try and indict an individual who has given most of his life to Public Service and has served with great honor and distinction as we all know is supremely qualified to serve on the Supreme Court. Dana well be keeping in touch with you. If this vote is to happen this week, things have to get in motion very soon. They do indeed. Thanks, dana. Dana Sarah Sanders also asked if the president s support for kavanaugh could hurt republican candidates in the midterm. The tone with which is president did it last night clearly has an effect on two key swing votes for his nomination. Is the president concerned that he may have put those votes in danger by doing what he did last night . I dont think so. The president is very confident in his nominee as he stated time and time again. We expect the senate to vote. We hope they do that soon. Dana im joined by chris stirewalt. Theres not a lot of room to play here. Theres only ab four, five seats that the president has to be concerned about. Not seats, but votes. What the reporters were getting at is, if the comments actually hurt the possibility of those senators voting, was it worth it . Your thoughts. They were so close. Sarah sanders likened as she was talking about dr. Ford, likened her to an faberge egg. The real egg is a nomination of a very conservative justice to the Supreme Court which is enormously popular with the Republican Party, with the Republican Base and is considered the fruits of their labors with donald trump. They worked in the vineyard with trump and these are the fruits of the vine. So theyre so close. Theyre so close. And the president couldnt make it all the way to the finish line and needed to give the red meat, wanted to express the feeling that im sure he has felt all along. Wanted to express those things. It damaged, maybe ruined, i dont know, but certainly damaged the republican effort to say just what Lindsey Graham have said. We have let the process work. Dana when they get the supplemental report, what senator thune just said, we are supposed to look at that and decide on the facts. That doesnt always work. You had a really good well, always good point on halftime report. You said there are red state democrats and then about four red state democrats and four republicans who possibly could be helped in their senate races. I wonder if you could talk about that. Well talk about the democrats who might be in trouble. Well, look. The big four that are the key to this election, and democrats have say a one in four, one in five chance to retake the u. S. Senate. Its a slim pass, but its there. If theyre gonna be stopped theyre gonna lose two of these four states. If that happens, theyre basically shut out. These are overwhelmingly republican states that makes it absolutely clear that kavanaugh is popular, as voters want them confirmed. Joe manchin is slightly different because hes part of the effort to save the nomination with the fbi check. Manchin may end up looking like moses here and it may actually help him. No votes on kavanaugh and the intensification and unification of the Republican Party in these states bad for democrats in those places. Dana where do you think it could hurt republicans, these other states . Florida, nevada, arizona and new jersey. Pity always dean heller. The most vulnerable republican who is hanging on to some drift road after the ship wreck. Hes got a chance to hold on. Its a very tough seat in a state Hillary Clinton won. Outrage among democrats. Everything thats happening there. Candidates like that, republicans running in blue states, this is not good. If youre running against the grain of the state where you are politically, this is hurting you, whether youre republican or democrat. Dana all right, chris stirewalt, thanks for that update. You bet. Dana no, nothing is wrong, but your cell phones are about to make that sound. Be assured it is only a test. We will explain the system the government is testing just minutes from now. But its only a test. The first ever test of the wireless Emergency Alert system. We have fox coverage with brett larsen. First lets go to doug mcelway. He is in washington. Doug . Reporter we all know the sound of that sometimes intrusive alert. This is a test of the emergency broadcast system followed by a sound finger nails coming down a blackboard, as if you had accidentally dialled somebodys fax number. Thats a bit outdated so today we get a new alert on our cell phone. All of us, 225 million of us, roughly 75 of cell phone users in the united states. It wont be the ring tone that you prefer or the text alert sound that you prefer. It will be sounding more like this. That will cause phones to ring very similar to if youve ever received a flash flood or an amber alert that also came through the same system, the wireless alert system. So the phones will they buzz very loudly. Reporter and there will be an accompanying text that reads president ial alert. The text will say, this is a test of the National WirelessEmergency Alert system. No action is needed. And then a second alert will go off on radio and television at 2 20, two minutes later. Unlike amber alerts or national Emergency Alerts, you cannot undo a president ial alert or abstain from receiving. Youll get it regardless of if you want it or not. At the same time, the president cannot use it to send you personal messages. He cant ask for campaign donations. He cant say such things as Chuck Shumers mother wears combat boots. There is a tiny risk in all of this, dana, we we create some panic. Lot of americans are not lot of americans were called the believe we were being invaded by martians. My phone is making the sound right now. And i see no panic. I hope your phone is turned off, dana. Im gonna turn it back to you right now. Dana thank you very much. Im joined by brett larsen. Morning anchor on Morning Headlines on sirius xm. The alert worked. My phone is on silent. So is mine. I havent gotten the alert yet. Whats interesting about this, the alert goes from fema. It goes to the cell towers and the cell towers will start sending out the alert over and over for about a half hour period of time until everyone who has their phone on gets it. If you have your phone turned off, if you leave it off for the next 45 mints. Dana i did get the alert. It just didnt make the sound. I must be on a special list that youre not on. You have a different security clearance. Dana its a good idea to have this system. It is a good idea. As doug mentioned, weve all gotten alerts before. I remember many years ago during Hurricane Sandy standing out watching the hudson river coming up the street. We all got the warning at the same time. Its a good idea when you consider how much, how many of us are using our cell phones and arent necessarily, we dont have a radio in our pocket. We do have a radio. Dana but flooding and amber alerts. Those are localized events. What would be an issue that would rise to the occasion . I can imagine. But what do we know . We would assume Something Like a 9 11 attack would result in an alert like this. Something that definitely has an effect nationwide. Not, as you mentioned, an amber alert will be localized, flooding. Those are localized. Dana if you get one of these, its for real. Hopefully we will not have a situation like we had in hawaii where someone dana accidentally. Right. Im sorry you still arent on the list. We are call 1600 pennsylvania avenue. A political battle for the ages could be taking shape pitting Elizabeth Warren against President Trump in 2020. A republican super pact has already raised more than twice this much compared to the overall total in 2016. Meanwhile Michael Bloomberg pledging 20 million to help democratic candidates. We start with the executive director of the Democratic Campaign committee in 2016, colin reed, Senior Vice President of the public affairs. These are monster numbers. I was interested in seeing for democrats raising more in 2018 than they did in 2016. You were at the dccc. These are big numbers. Huge numbers. And i think it just shows that in the era of trump, everything is bigger and everybody is more focused on the importance of these elections. Its manifesting itself in small dollar contributions, its manifesting itself in huge 20 million, 30 million contributions. Sometimes in the era of trump and everything that he sort of brings to the table on both sides, its providing an energy that i havent seen. It is off the charts. Dana it feels off the chart. Colin, i do wonder, what should we be looking for in the next month . When money moves. Weve already seen both committees figuring out a way to pull some money from somewhere, put it in another place. This cash infusion from Michael Bloomberg in the last home stretch. Thats something we should watch. What else should we be paying attention to . Dana, thats a great point. Groups like clf on the republican side are doing a lot of cool things with that money instead of just pumping it into tv ads which can have little impact down the stretch with all the noise out there. Theyre doing unconventional things whether its door to door, direct voter contact, or mail or things that they can take off the hands of the traditional candidates. That can make a difference in a close race. Some of these races are gonna go down to the wire. Its a tough Political Climate for republicans, but in some of these close races, things like that can make a difference. I think clf will have some Success Stories to show at the end of the cycle. Dana when i look at those, i think i should have been a media buyer. But i love my job. Elizabeth warren, shes not on the Senate Judiciary committee. Hasnt gotten a lot of attention, but she made some news this weekend. Take a listen to her and what President Trump said last night. It is the honor of a lifetime to have a chance to go to washington and fight on behalf of the people. After this i will take a long hard look at running for presidency. They have moved so far left that pocohontas is considered a conservative. Thats right. Elizabeth warren, she said shes considering a run for the presidency. Please, please run. Dana just a month ago she said she was not considering it. Colin, do you think she needed to find a way to get some attention . Its not a secret that Elizabeth Warren wants to run for president. Shes been trying to for the last several year. Whats more surprising is shed come out and say it. Lot of that has to do with the attention her opponents are getting. Shes going to run. Shes going to be a crowded field. Her moment would have passed. She should have run in 2016. She wouldnt have had a whole field of competitors to contend with that shell have in a couple years. Dana i read someplace someone said they had a list of possible 30 possible names of democrats who want to run for president in 2020. I suppose its not too early for them to start thinking about it. No. I mean, i think 30 would be a short list. Youve got you could probably get that up to 40 people who think theyll be the next democratic nominee. Whats more important is the election in 34 days. And i think everybody should be sort of focused on that. There will be plenty of time for 2020 politic. It has really got to be about the midterm. The democratic goal is to advance the democratic agenda. The best way they can do that is to win these midterm race. Dana the president loves to talk about 2020. He is ready and spoiling for a fight. Hes gonna get one. Thank you. Happy anniversary. Dana thanks. All right. A new report claiming President Trumps father fred helped his family evade hundreds of millions in taxes. The white house coming out swinging against the New York Times report on the president s taxes which claim he participated in schemes, including outright fraud. Sarah sanders calling it fraud. David miller joins us in washington. Reporter the report says despite cultivating an image of a selfmade billionaire he acquired much of his fortune from gifts from his father and used improper, maybe even illegal ways of paying taxes. Quote, controversial tack returns reveal mr. Trump received the equivalent today of at least 413 million from his fathers real estate empire starting when he was a toddler and continuing to this day. The report goes on to say, quoting again, much of his money came to mr. Trump because he helped his parents dodge taxes. He and his siblings set up sham corporations to disguise millions of dollars in gifts from their parents. Paper says much of the giving was set to avoid gift and inheritance tax and that according to tax experts, methods were improper or possibly illegal. One section of the story said that by age 3, mr. Trump was earning 200,000 a year in todays dollars from his fathers empire and was a millionaire by age 8. Paper said the article is based on interviews with former employees and advisers of the president s father as well as 100,000 pages of documents including 200 pages of tax returns from fred trumps business interests. The paper did not rely on President Trumps tax returns for the report which mr. Trump has declined to release. The president s lawyer addressed some of the specific claims and walked through how the allegations of fraud and tax evasion are 100 false and highly defamatory. There was no fraud or tax evasion by anyone. He went on much further and i would encourage you to read every word of his statement which completely under cuts the accusations made by the New York Times. Reporter a spokesman for the new York State Department of taxes, the agency is now reviewing the allegations in the times article and is vigorously pursuing all appropriate avenues of investigation. New york citys mayor bill deblasio said the city is going to try and seek any back taxes that are owed. Dana all right, david lee. Thank you. Next the attack on Brett Kavanaugh and his teenage drinking habits. A bar fight when kavanaugh was a College Student on the five last night. This just in. New york times says Brett Kavanaugh once threw ice cubes in a bar. I know. Ice. Frozen water shaped like cubes. Obviously, we cant have this on the Supreme Court. If he treats ice like a weapon, what might he do with a snow cone . Maybe they do want to abolish ice. Dana that was greg. The New York Times publishing this letter kavanaugh wrote to friends planning a 1983 beach week trip saying, quote, it would probably be a good idea on saturday the 18th to warn the neighbors that we are a loud obnoxious drunks with prolific pukers among us. Advise them to go about 30 miles. Im joined by Tucker Carlson, author of ship of fools. Great to have you here. You were on the five with me last night. We were talking about ice cubes. Aside from joking about it, is this really where the reporters want to go . This is the perfect weapon because it leaves no fingerprints then becomes vapor. Its diabolical. Im old enough to remember when the less worried about the right turning this into some kind of theocracy and imposing its values on the rest of the country. The irony is theyre doing it right now. Its a theocracy run by athiasts. I understand this is a political tactic. Thats what Political Parties do. But the fact that is press is playing along with it, adding no perspective to it, reporteding on a guy whos written over 300 opinions as a federal judge all which ought to be open to debate as far as im concerned. How about his behavior when he worked for ken starr . Its absolutely within bounds to debate all of that. There is stuff to debate if you wanted to. Instead were arguing about his year book and some dumb phrase he and his friends used and behavior . Who cares . Honestly. Dana then they make the leap that he lied during testimony about his drinking because now theyre finding evidence that he actually planned a beach week which a lot of High School Students in america do. I also want to ask you about temperment. That was the other thing democrats loved these accusations. He finally had a chance to defend himself. Got motional. He was outraged. So now the democrats say, he has a terrible judicial temperment. He has spent 31 hours in front of the committee. Remember all of the protests that erupted . He never once lost his cool then. It wasnt until he was accused of a heinous crime that he lost his temper. Within bounds. By the way, speaking for myself, i would have judged him if he hadnt. Having been accused fally of a crime, i know how frustrating and tear fight and lonely it is. The net effect on the rest of us leaving aside the kavanaugh nomination is forcing everyone to lie. If you can be held accountable, theres no forgiveness. You can be destroyed because of something you did when you were 18, then nobody can admit anything. We all have to pretend to be blameless. It makes society far more dishonest and fearful. It has a truly crow seufrb effect. Thats not partisan. Dana you did write in your book about the kavanaugh nomination. In reading your book and watching this unfold, a lot of what you write about is happening. Ship of fools, one of the things you write about is the plight of men. Its very interesting to me. We didnt have a chance to talk about it on the five. You said something awful is happening to men in america. Whats odd is how rarely you hear it. Our leaders pledge to create more opportunities for women and girls who they imply are failing. The opposite is true thanks to intimidation from a relatively small group of feminists nobody can admit. Part of me feels like the feminist Movement Really succeeded. Okay . I reread the feminist mystique. She was right in a lot of things she asked for. Equal opportunity among them. Women once given more equal opportunity now have higher high school and College Graduation rates, rising iq scores. Far fewer drug abuse, alcoholism rates, incarceration. Theyre doing better. You should be very concerned if an entire sex starts to fall off the map. I have three girls. I want decent men to marry them. Right . We all are vested in this. One sex cant collapse without affecting all of us. Its not a zero deal which people argue that it is. Its totally wrong. Decent people should stand up and say wait a second. Human beings, all have a right, i think torque the basic presumption of innocence, etc. You know . Dana you also write, you end that chapter by saying nobody wants to talk about, so nobody does. Because everybody has to lie all the time. One of the reasons people voted for trump was in the hope they could say what they thought was true. Not attack other people. Just be honest about what you think. The deep irony is two years later, youre more afraid. Youre more likely to get fired by the Hr Department or thrown out of college for saying what you think is true. Its a disaster. Thats the thing we should be much more worried about. Much more than a partisan fight. Dana i loved the book. I read it. Did you read the audio book . Good commuter book, too, if you are looking for that. Its hard to do an audio book. Dana im sure you were great at it. Tucker carlson, thank you. Dana, great to see you. Dana secretary of state announcing new action against iran in a move he calls decades overdue. Every single word second by second of his testimony has been picked apart. Yet, if anybody says anything about the accusations that have been thrown against them, thats totally off limits. Donald trump is disgusting. Dr. Ford gave honest and heartfelt testimony and she has a right to be treated with respect. Dana the ceo of cofounder of desin hall resources. Hes author of a brand new book best of enemies. Crisis management one of your specialties, and this is a crisis for republicans and democrats. Everything is at stake. Who do you think has the upper hand . We dont know until the fbi report comes out. I think one of the things that was very interesting to me is how Brett Kavanaugh was criticized for his demeanor during the hearing. I disagree. He had no choice. If you remember the morning after dr. Fords testimony, it was considered that he was done. By later that day, he was back in the game. When youve got a 120 mile an hour Freight Train coming and you have to derail it, you have to hit it hard from the side. He had to be emotional. Was it pretty . No. Did it make him look great . No. Crisis management is all about the best of your bad options. If i came on your show and you said, eric, i heard you sell drugs to small children and i said, welsh thank you for that question, id look like a lunatic. You have to hit back hard in Something Like that even if it looks bad. Dana does it help when the president hits back toward even if hes taking criticism for basically taking aim at dr. Ford last night . Probably not. I think that one of the thins you learn in Crisis Management business is different people can do Different Things consistent with what they are able to get away with. One of the things thats interesting is, when you are a victim of something, as dr. Ford is discussing, you have no power until youre on tv. Thats where you have power. That is where she has gotten back into this game. Dana is it harmful for Brett Kavanaugh to not have been seen since last week . No. Its the right thing. You cant win. One thing you learn in damage control thrrbg are some fights you cannot win. Sometimes going away is the best of your bad option. Dana in washington there seems to be a lot of enemies. You wrote a book about the cold war and an unlikely friendship. Youve got a cia legend named jack platt and a kgb guy. They were assigned with terminating each other. They ended up becoming best friends. It turned deadly because, as this book points out for the first time, jack platt was the man who brought back the file that proved that Robert Hanson was the mole, the fbi agent who turned mole. The russians ended up blaming his friendship wrongly with vasolenko and it landed him in a russian prison. Dana basically, its about human intelligence. Is there any lessons from the book that you learn that could be applied to today . Well, yes. One of the lines we use is jack platts boss said it is the job of the cia to break the laws of the countries where they operate. That tells you a lot. Its their job. Jack platts job was to help train cia people to defend themselves and to be able to spy abroad. With all the talk we have now a days about cyber intelligence, as jack platt said, Edward Snowden had to take the thumb drive out of the building. Thats still a human act. Dana procontrols a state owned port . Now a question for a court to decide. Washington is being sued by western coal producing states for not allowing their product to be shipped out of the long view port. Regulators claim it poses too big a threat to the environment. Dan, this is coming from the west. This is a big deal. I wonder what you think is at stake. Reporter it really is. Whats at stake, dana, is the ability to land lock states to get up to 2. 5 billion tons of their coal to foreign markets. That means thousands of jobs. Also, hundreds of millions of dollars in tax revenue to those states. Now, two of the states are wyoming and montana. Officials, theyre among sick states suing washington over denial of a coal terminal at the port of long view. The pun river base is the largest coal deposit in the entire country and supplies 40 of the u. S. Coal needs right now. But domestic coal use is dropping, making exports critical to the future of the industry. Were already exporting some, but were really capped out because we have to take the coal were mining through british columbia. Theres only so much capacity there. Reporter the lawsuit says washington is violating the Commerce Clause of the constitution by interfering with other states ability to do business. Now, washington Officials Say environmental laws allow them to block projects like the coal terminal if the impact on state residents are too harmful. The main Environment Impact revolves around the coal train. They claim diesel fumes would potentially pollute the columbia river. A major point of this lawsuit will be all the statements the governor made blasting coal. In his 2007 book he wrote, quote, coal is killing us. He ran for governor promising not to allow coal terminals in the state and just recently announced a 32nd lawsuit against the trump administration. This one over coal emissions. Were breathing smoke from mississippi. Were breathing smoke from the rest of the united states. We have an interest in reducing coal smoke from all over the united states. Reporter a federal judge in tacoma denied washington states motion for dismissal, so this case will be Going Forward and will be watched closely by states around the country, as they try to get their products through washington into these foreign markets.
