Of course, bill cosby was convicted back in april on three counts of aggravated indecent assault on andrea constant who worked couple universities. Befriended bill cosby. He brought her to his home thats where it was proven he drugged her and took advantage of her there are 60 other women who suggested bill cosby did the same thing. Andrea constand is the only ones resulted in a criminal trial and he was convicted on a second trial. The first one ended in a mistrial back in april. Each one could carry up to 10 years in prison. The judge merged those charges yesterday and today we wait to find out what he is sentencing bill cosby to. It could be 5 to 10 years, which is what the d. A. Asked for. But, again, were just not sure what the sentence will be just yet, julie. Julie what did Andrea Constand say when she spoke at the hearing yesterday . Im just picking up this victim impact statement. She sent a five page letter to the judge. Her testimony in court was pretty brief and her mother and others in her family also spoke before the judge. Andrea didnt read this whole letter in court. I wanting to read you a portion that she did file with the court. She said when the Sexual Assault happened i was a young woman brimming with confidence and looking forward to a future bright with possibilities. Now almost 15 years later im a middle age woman stuck in a Holding Pattern for most of her adult young life unable to mo forward. Bill cosby took my beautiful young spirit and crushed it he robbed me of my health and vitality. My open nature and my trust in myself and others. And clearly the judge agreed. He believed the state psychologist who argued that bill does bhi an uncontrollable to your knowledge violate young women and would do it again if given the opportunity. This 81yearold man legally blind will be sentenced to state prison and waiting to find out how long he will be put behind bars, julie. Murkowski did speak briefly to reporters this afternoon but did not tip her hand. I have an opportunity, a long with other members of the senate and really people all over the country to hear from dr. Ford and equally important to hear from judge kavanaugh. They will be on the record, under oath, and it will be an opportunity for us to, again, hear both sides of this story. So that is the bottom line. We are seeing basically tension building here on capitol hill as we look ahead to this high stakes hearing on thursday. Julie . Julie what is the update from democrats, mike, and professor fords attorneys specifically . Well, we just heard from chairman Chuck Grassley who told some reporters that essentially the republicans had hired an outside female attorney. That they are not giving out her name because of concerns about her safety. And we have heard some protests from professor fords attorneys who wrote to the chairman basically sharing concerns about this shae saying quote this is not the criminal trial in in which sex expert would be appropriate. Neither dr. Blasey ford nor judge kavanaugh is on trial. The goal should to be drop facts not trying the indicates. The firing back at leader mcconnell. Leader mcconnell owes an apology to dr. Im Julie Banderas in new york. A judge in pennsylvania just sentencing bill cosby to three to 10 years in prison for a 2004 Sexual Assault. Im joined now by Rick Leventhal who is outside the courtroom with the very latest. 3 to 10 years. Not as much as he could have served but, nonetheless, bill cosby is going to prison, rick. He is, indeed, julie. No less than three years. No more than 10 years. The judge ruling that bill cosby must cover the cost of the prosecution, 25,000. Apparently over the first 12 months not to contact the family of the alleged victim Andrea Constand or Andrea Constand and is subject to sex offender program. So bill cosby 81. And according to his defense team legally blind will be going to state prison. It is our understanding that he will first be taken to the Montgomery County jail in lower providence township to await transport to the State Correctional Institute phoenix north of philadelphia where bill cosby had an estate. Where bill cosby took Andrea Constand and he gave her drugs and sexually assaulted her. The bailiffs of the aggravated inel decent Assault Charges. Now bill cosby has been sentenced 3 to 10 years in state prison. That means that he will most likely, we assume pretty shortly be taken out a back door of this courthouse in handcuffs, put in a Police Transport and taken to that county jail to be transferred to a state prison facility where he will be evaluated and then presumably spend at least the next three years of his life, julie. Julie lets talk appeals process as you know, of course his lawyers are going to appeal this by sentencing him to 3 to 10 years. Does that hurt ace appeals process . Does it make it harder for his defense trying to appeal considering a minimum of three years is not nearly as much as he could have served. Well, first of all, the judge merged the three charges that he was convicted of into one. He could have faced 10 years on each count. They personal them so the max he could face was 10. The judge stead 3 to 10 touching on that maximum sentence that he could have received based on the merging of the charges. One of the Big Questions was would the judge allow him free on bail while he considered any appeal that might be filed and the d. A. Kevin steele said because you deemed him a sexually violent predator he doesnt qualify for house arrest that may have played into the judges decision. Were just not sure about that. Tell you this. Bill cosby could have spoken in court today in his own defense. He could have said something to the charge about remorse for what he had done. He didnt do that. And there was talk before hand that he probably wouldnt because if he says he has remorse, that wouldnt support an appeal if he claims innocence. We can tell you that when bill cosby in court was informed of the responsibilities he would have as a sex offender, he was told that the victims in this case would be notified. Bill cosby asked if he had to notify them and was told no. And cosby, according to our producer in the courtroom replied good. So, thats being handled by the state. Bill cosby is not notifying his offenders. He has been told you cant contact excuse me, his victims. And there is one confirmed victim here but more than 06 women claim that bill cosby assaulted them. And several of them were in the courtroom. Including former supermodel Janet Dickerson she was here to hear the sentence read inside the courtroom in norris town courthouse. We expected to hear from a d. A. At a news conference. Probably some of these women who have been spending much of this time in the courtroom who claim bill cosby did the same thing to them perhaps the victim Andrea Constand will speak. We will be waiting to find out. I want to bring in judge Andrew Napolitano. He joins me in the studio. He asked the judge to sentence cosby to 5 to 10 years. The cosby definition had asked for house arrest. They also had hoped for less time because is he over 80 years old and legally blind. The judge did not have sympathy there. However, did he get a lot time than he could have been sentenced. He could have been sentenced to 30 years. Sure. Which would be odd for a person 82 years old. It has been done before. Yes, it has been done before. This judge showed no sympathy whatsoever during the trial and may have exposed the trial to and did expossession the trial to appealable issues about which later if you want to go there and has been given a rather lenient sentence. So much lenient i wouldnt be surprised that cosbys people guilty verdict rather than of the sentence. If they do file an apeeflt sentence, expect the state to cross appeal which would raise the sentence up. Right now between 3 and 10 means he must 80 of three. Two and three quarter years in jail. Thereafter, its up to prison officials based upon his health, his demeanor, his work in the prison, his attitude in the prison. Whether and if he can leave before the 10. A lot of people thought that this guy got off easy. I mean, if he served or if he is stepsed to a minimum of three. You know he is not going to serve three years in prison. He will get off on Good Behavior. Im sure bill cosby is not going to be a then nasa behind bars. The Good Behavior reduction wouldnt kick in until he serves two years and nine months. So the minimum he could serve. Julie two years nine months . Correct. Julie lets talk about the fact that three counts of aggravated indecent assault that these three charges were combined into one charge. You are talking 10 years per charge. Many would argue why combine them into three . You have one woman accuser who says this literally destroyed her life. She is the only one who is being taken into account. Her story into the particular case. However, the judge allowed the jurors to consider the 60 other women who, in fact, accused bill cosby of the same. So its very confusing when you have one accuser, one court case but there were 60 on or about accusers who have nothing to do with this particular case that the jurors had to consider. As reprehensible as bill cosbys behavior has been and convicted in this case his rights were severely violated by permitting the events that were not charged in the indictment to come before the jury. In most states, not pennsylvania, those events called prior bad acts to show a pattern of behavior can only come in to play at the time of sentencing. They are not revealed to the jury. The jury only hears the allegations of the charge in the indictment which, in this case was just Andrea Constand not the other women. Bill cosby sentenced 3 to 10 years in prison. We should see him being escorted out of this courthouse in handcuffs just moments from now. His lawyers would almost be doing their client a disservice if they were to actually fight. This because they could potentially end up getting more time. I would strongly urge them to appeal the conviction but. Julie but not the sentence. No. The sentence is almost too light given everything that the jury heard. Exactly. Of course i dont know everything this judge knows and i havent even seen the reasons he has given. He spent an hour putting them on the record and we will know them in a couple of minutes when our producer comes out to be debriefed by Rick Leventhal but, yes, its a light sentence. I would be surprised if they appeal it. If they do the state is going to cross appeal. They must appeal the conviction, the violations of his Civil Liberties on the face of it by permitting uncharged acts to be revealed to the jury begs for an appellate review. Julie i want to go back to the courthouse to Rick Leventhal in june of 2017, ms. Constand described cosby gave her briles that left her frozen she also said and she provided a statement to prosecutors by the Prosecution Team to truly understand the impact the Sexual Assault has had on my life you have to understand the person i was before it happened. She says she was robbed of her spirit by all of this. Bill cosby has presumed innocent and has maintained his innocence since the day he was accused by 60 plus women of this. His wife has also stood by his side. Was she in the courtroom today . We didnt see camille today. I do have a copy of that letter constand filed, she said during the assault i was paralyzed and completely helpless. Powerless to protect myself. After the assault she said the shame was overwhelming. I felt completely alone unable to trust anyone including myself. She says her life was in essence ruined by what this man did to her. I wanted to weigh in on the sentence because more than 100 other people were convicted of the same an aggravated indecent asought assault charge bill cosby was here in pennsylvania. 7 of them were sentenced to prison time. The average sentence somewhere between 22 months and three years. Those were the guidelines that this judge steven oneil was working under. I would be curious what judge napolitano has to say about that if the guidelines were 23 months and. He got three years it seems to be pretty much in line with other defendants convicted of the same crime were given in similar circumstances. Rick is absolutely great correct. But the break the judge gave him bine combining of the three charges as if they had been one. If the average rick is talking about. Glinel is 22 months per charge he really was convicted of three but sentenced as if he was only convicted of one. Julie rick . The only thing about that yes there were three charges but one act. You mentioned these dozens of other women claimed similar acts drugged and assaulted by him. There was only one instance here being considered in this courtroom. Its not uncommon for judges and im sure judge napolitano can weigh in on that as well if its not uncommon with a single incident when there are multiple charges that they basically mirror each other to combine them into one and sentence him based on that. What do we expect to see right now . We are looking as reporter are starting to file out of the courtroom. We have a producener that courtroom as well. We are also waiting to see bill cosby come out in handcuffs which will be quite alarming to see who was once considered americas dad come out ashamed for this conviction and sentence. It may well be that he doesnt come out that door as a civilian waiting to find out his fate. He may be going through a back door as a criminally convicted defendant heading to prison. So they may take him in the back and then they have to process him and bring him down a back stairway and put him in a police van. We may not see him. We have cameras all around this building, but its possible he is going to get in a van in a sally port or some hidden location there behind the courthouse and be driven out of here. We will seat van or Police Transport. But we may not see bill cosby again for quite some time. Julie i would assume his lawyers are trying to make a deal with the judge to escort him out of the building. At this point he is a convicted felon. Final at the point of sentencing. I dont know this courthouse but almost all of them are built so that once the defendant is sentenced to jail that person never sees the light of day again. So if they are going to get him in a van i think without us seeing it at all. Julie rick, you were going to Say Something . Just that the court is now in recess. The producer is telling us it is not over yet. The definition is asking for bail pending appeal. Prosecutors say thats not appropriate. Apparently the judge is now considering that request. So they are in recess. And when they come back and he makes a ruling on that, then i will guess we will find out bill cosbys fate, his final fate. Julie he was considered a sexually violent predator i dont believe this judge is going to be granting bail. The judge is required to consider all reasonable applications made by defense counsel. No way is he going to give him bail. He it could be appealed to an Appellate Court this afternoon or tonight. Former doj department of justice prosecutor he joins me now, you know we are talking about the sentencing here between 3 and 10 years. What i think is interesting is the fact that this judge decided to fold all three counts of the aggravated indecent Assault Charges into one combined charge. Now Rick Leventhal mentioned there was only one act and we are talking about Andrea Constand. However, interestingly enough, and something you dont often see is for jurors to be allowed to be influenced by outside accusers who have nothing to do with this case and im talking about the 60 other accusers who join Andrea Constand who maintain they were sexually abused and drugged by bill cosby. Are you surprised first of all a that the judge folded these three charges and combined them into one and, b, that he allow you had the jurors to be influenced by outside accusers . No. And so the first part is called merger. Its not a matter of mercy by the judge. He is not saying i only i want to restrict the sentencing to a potential of 10 years. Its a legal determination that the acts that support each of the counts of conviction are the same. And so ultimately, although it was properly charged as three counts, you cant stack up the sentencings because its all one single criminal act. That wasnt a function of the judge saying i want to reduce the punishment. So that part is no surprise that will not lead to any sort of successful appeal by either party. The second part is the concept of other crimes evidence. And this was litigate you had. Its an issue for appeal but i have to tell you i think its extremely uphill for the dengets. The standard is whether the trial judge abused his discretion. The judge didnt let all 60 come in. He let five. Three or five. I think it was five independent witnesses come in and testify about similar incidents there are very narrowly crafted exceptions why other crimes might be helpful for the current jury. And the judge made very previce finding and used discretion didnt go with 10 or 15 or 60. Said pick your best five and you can use those. I think its certainly harmful stuff for a defendant to hear the other victims testifying in the trial of one victim. But its a very welltrodded road. This is an area thats been seen many times. And i dont think its going to lend itself to any great appeal because the judge did use discretion and didnt just automatically give the government what they wanted. Julie do you think bill cosby got off easy or do you think his sentence was just . You know, this kind of sentencing scheme where you have a range of years is to anticlimatic because we dont have a real number. I dont think i dont like that whole system its either 3 or 1 10 really what the judge does is abdicate to the judicial system. Everybody will go home and no one knows if he is serving two years and 9 months or 10 years. Thats the way the legislature set it up. At the end of the day, the judge hasnt told u. S. What bill cosby is going to serve. Julie have you sentenced over 1,000 criminals to prison. Can you explain to me 3 to 10 . Its difficult for me to do that because i did so in a system federal system where our colleague is accustomed to working where you are sentenced to finite number, this pennsylvania system which is shared here in new york is considered Old Fashioned and was undone in many states but not in new york and not in pennsylvania. And it basically, as our colleague has just said, transfers the decisionmaking power from the judge to the prison authorities. In my experience, in the federal system, in the new jersey state system is inconceivable that a judge would give that much discretion to prison authorities. How do you give prison authorities that much power after so much money and time has been devoted to a trial. They do have guidelines. Its not a blanket. An up checked power. There actually is a mathematical form l formula that they can check. Seems like a great span between 3 and 10. It is. I will go back to rick lesson that i will i. Wanted of to remind julie this man lived as a celebrity. I spy arted in the 1960s. He has been living a patriarchy good health. He is my according to his attorneys legal live blind. Now he will find himself in a state of state prison for at leers 3 years of my understanding gloss of bills miss blindness they will assign an inmate to bill does bif because he is in prison and will need help. When he has been out of the courthouse he has had his assistant to help him out of the vehicle and up the sidewalk and into the courthouse and in and out of the courtroom. Some people were suggesting that was an act. It doesnt matter now. If he needs help apparently they are abouting to give it to him. Very are r. For this most famous people in the world now is he going to find himself with a number on his chest. Julie that is pretty i didnt know credible the fact that he will be sharing a cell with another inmate and that inmate would be assigned to making sure he can get around the place okay . Judge he himself will get credit for having helped bill cosby and that will reduce whatever he is in for will reduce that inmades time. The state is going to do his own evaluation of his site. They are not going to accept the evaluation that bill cosby or his own doctors have given. I suggest to you that the states standard for legal blindness is probably different than the one his personal opthamologist has used. Having a personal assistant n jail is almost unheard of. I dont think get personal assistants in working lifsz a lonks with prisoner. As far as this thence goes, i was talking about this very much between three and ten years. Judge napolitano was toss about how prison officials are the ones who make the final decision as to whether its going to be three years or whether its going to be 10. Something seems off there. Well, the judge is right. Its the system we are living with in pennsylvania and i guess in new york as well. And its kind of a maddening system because we dont have any certainty. Im sure again the judge is right that there are formulas that are in play, that there analyses, periodic reviews done within the prison sentence just like a parole board to try to figure out, you know, what the balance is, whether mr. Cosbys health becomes failing. Whether is he going to serve 10 years or three years. Its just a strange setting that it gets left, you know, all of the drama of having a judicial sentencing gets turned into an administrative action thats pretty much behind closed doors. So, you know, we are left with nonanswers that we dont really know. Going to start and doesnt get on bail for at least another couple of years i have joseph who represents seven of cosbys victim. Thank you for joining us. Thank you for having me. Your reactions to the judges sentence. As the judge said the day and time has come. Justice is gig to be served. Justice was served i the court impose dollars a a signature sentence that the judge said gave a to the jurys verdict the decision was affected by the impact that this serious offense on andrea constant tan feel and effected had on the community. The court said and recognized several times it was a serious offense he had heard the words of the victim and her family, Andrea Constand and her family that that this serious Sexual Assault had a Significant Impact on her, continues to have saying cant impact on her and her family and the court impose you had the sentence that was consistent with that Significant Impact. The minimum that he will serve is three years. At the end of three years he will be eligible for parole. If he doesnt get parole, then he will continue to serve another year. He will be up again in the fourth year for parole. And if he will have repeated attempts to get parole up until the 10th year when his sentence will end. Julie right. He has a three year minimum, 10 years max with ability to get parole over the years 3 so 7. So, thats where things stand there were five accusers among the 60 who were brought in to testify as witnesses. Were one of your clients among them . No, they werent. My clients are seven individuals. A couple of them were three of them were the original jane does in the case that andrea constant brought back in 2004 against mr. Cosby. They are my client in the a case thats pending against mr. Cosby in federal court for defamation. The women that testified the judge said he heard what they had to say. He reread their testimony. It wasnt factor that he could take into account in rendering his decision as to what the sentence would be because they were uncharged crime and that was not a factor that was appropriate for him to consider. So, the evidence he did have was powerful enough to send a significant message that this is not something thats going to be tolerated in a civil rised society that there was impact on the community as well as Andrea Constand and her family. Julie i want to ask you to stand by i have to go back to our reporter Rick Leventhal who is on scene. He has information as he stands outside the courthouse. Rick . We have some notes, julie from our producer who has been in the court throughout this sentencing hearing. There was a peak he was ledge to ryan from her notes. She said while waiting for the judge cosby just took off his tie and gave it to his friend. Before reading out the sentence the judge steven oneil told the court the reason for the specific sentence he said this is a serious Sexual Assault. That he put seriousness on the weight of the crime as the crime as he came to light in testimony he says he is not permitted to treat bill cosby differently because of who he is or who he was. He said he recognized cosbys age and that he is blind but that is not the fact that he would not put the most weight in. And he did, in fact, sentence bill cosby to a minimum of three years and no more than 10 years in state prison, total confinement as he put it and we are waiting now for the judge to rule on appeal that the defense made as to whether or not bill cosby can rye main free why they consider that appeal. There is a couple of lawsuits against bill cosby. Julie which reminds me of o. J. Simpson. The civil suits once those were done and federal suits as well. Correct. The civil suits kant come to fruition until the criminal says is over. The criminal case ended 15 minutes ago. Mr. Camerota and his colleagues can begin pursuing the civil litigation against him. Does he get out of jail to testify in those civil suits . Julie what do you do when you are being called to court and serving prison time. Sometimes people will let people out under very, very restrictive circumstances in order to testify on their own behalf. Other times that testimony is taken by videotape in the prison because everybody in the case knows they are in prison. You dont have to hide it from the jury with plaintiffs lawyers and defense lawyers there and a judge there just as if it were in the courtroom. Julie Rick Leventhal is outside the courtroom with more. We are still waiting to hear if bill cosby has been released from that courtroom and transferred into a Police Vehicle that will take some time because, of course, they need to process him. Rick, what do you have for us . This is more from judge steven oneil in court when he was addressing bill cosby and explaining why he gave the sentence that he gave. He said he had to be cognizant are of the 404 b testimony of the other alleged victims who came forward to speak about bill cosbys prior behavior. He said not as a victim impact to hear voices from the past, your past mr. Cosby saying this happened to me, the defendant six times over im reading her notes but basically the judge was saying that he had to consider all these other women who were saying that he did the same thing to them. He said he reread their testimony. Heard their voices loud and clear. And said that while its nothing has happened for the past 14 years and he said he is very old now the judge would say you were old back then. Im getting a note Janet Dickerson one of the other alleged victims is in the hallway and someone asked how she felt she said vindicated. The judge said that he had to consider Andrea Constands victim impact statement how she had said that her life was ruined. How she had said what an impact this had on her and her family. And that also played into the judges decision to sentence bill cosby to between 3 and 10 years. I will continue to read through these notes. I will try to do a better job of breaking it down for you. Julie all right. Yeah. Janet dickerson was there. And there have been a lot of accusers who have been standing outside the courtroom. And another thing to note is that they never had their day in court. Many of these accusers who had experienced their versions of this sexual abusive pattern by bill cosby long long ago exceeded their statute of limitations. They never got their day in court. There are civil suits which are now coming. What does it say to these accusers who have these civil suits and chomping at the bit to have their day in court with bill cosby. They will get their day in court there is something called the discovery rule repressed the memory of something and the memory doesnt come back to you until after the statute of limitations has run and demonstrate this scientifically through expert testimony. The court will begin of the statute of limitations from the time your memory comes back stated differently there are circumstances under which and the cosby case someone of them where people can sue for civil damages, for money damages now, not for criminal prosecution but for money damages well beyond the twoyear statute of limitations. Julie basically bill cosby is responsible for paying for the prosecution charges, 25,000, which is really nothing. That must be some statutory fix. Julie exactly. He said that he puts a high degree of weight on the impact of crime on the victim and her family. The judge told bill cosby 34 months, 34 long months since the criminal complaint was brought. Its time for justice in the court of law. Mr. Cosby had all circles back to you, the time has come. And then he told him his sentence of a minimum of three years and maximum of 10 years in a state prison that he would be responsible for paying 25,000 in court costs that he can have no contact with his victim, Andrea Constand or his family and that he is, in fact, subject to the sex offender program. So forth rest of his life, he will be considered a sex offender. And not just a sex offender but a sexually violent predator. Someone who according to a court expert suggested that he could likely do it again if given the opportunity, which is apparently one of the reasons why judge oneil gave him three years in state prison and not less than two years in county or even house arrest. Bill cosby going to state prison, most likely today as we wait for the appeal to be no bail. All right. So the producer is now telling me bill cosby no bail. Is he, in fact, going to prison, being processed today. There we see Andrea Constand coming out of the courtroom and, judge, she is quite pleased. Janet dickerson hugging her as she has been standing beside her side. A lot of these accusers have banded together. She has been living with this for an awfully long time and finally finally she sees finality and she has a judge who did the right thing, if anything he was a touch generous, but he did the right thing by sending cosby to a maximum facility, maximum security facility and no bail, im sure she is happy that justice was done in her own mind. We were San Diego State talking about state prisons in general and the condition of state prisons just so we can make this clear. Is he not going to federal prison. Is he going to state prison there is a big difference here. Federal prisons have hospitals. State prisons, some of them are in not good condition. Schwabby. Shabby. Is he going to be ina jail cell just like you see from hollywood. This is not a pleasant environment for him. This is not a place where the hospital is right there. This is a place with minimally trained guards and with violent people in the next jail cell. Julie this is high crime prison, major crime prison. Do you believe that he belongs in a prison like this you . Are talking murder errors here. Its clear the judge found that by characterizing him as a violent predatory. The judge is sending a signal. Up to the executive branch. The people who run the prison system to determine where he goes. Must take into account and cannot reject any of the judges findings and they must take all of them into account. Julie do you take into account his celebrity status when you place somebody like him in a prison and you choose a cell mate . Only if you think that the celebrity status might be disruptive to the prison. Thats the only reason. Julie how couldnt it be . This is bill cosby. Everybody in america, everybody in the world knows who this man is. Sometimes celebrity status can actually lessen the tension in the prison, if it becomes popular amongst other prisoners, other time the celebrity status could incease the tension in prison if the word in the prison alley way is this guy god off easy and were going to compensate. Julie thats what im saying he is not going to be greeted by happy guys. These are guys serving life behind bars for murder. So they are certainly not going to have any sympathy on this man. This is a cultural environment. Unlike anything he has been in before. His lawyers did the right thing. They hired people. This is a cottage industry. They hired people who educate him about this cultural environment and how to live with minimal interference by other prisoners in this environment. Julie ultimately once you are convicted your options are done. Have you no say in anything . Correct. If they choose to put him with a cell mate potentially serving life behind bars who wants to act as his helper if he is indeed legally blind which has to be determined obviously by a doctor and not by somebody who works for him. He has no say in that. Correct. Key volunteer for solitary confinement or does he have no say if that. I cant imagine volunteering for solitary confinement. Julie what if you fear for your life . If he fears for his life the government has a duty to protect you not from everything but from known and likely threats to your safety. Now we see an attorney. Thats galore i don gloria. Con stand was the leader and gloria has gotten involved or tried to anyway with just about every one of them. She does represent multiple accusers. She is in the middle of all these cases. She is a fabulous lawyer. Whatever you think of her politics she is tenacious and serves her clients well. She does. And she likes the spotlight and she gets it im surprised leventhal isnt there with her. She likes the spotlight in the end what matters most is justice. As we are waiting for possibly seeing possibly getting a site of bill cosby. A lot of these women would not be leaving if they thought they would get a chance to see bill cosby in land cuffs. He is going to come out of a van where we see that opening. Julie exactly under that garage. The van will have tinted windows and there will be more than one van and we wont know which one he is in. Julie i wonder why his wife wasnt in court with him today she was by his side during this whole thing. There is bill cosby. There he is. Im quite surprised that we are seeing this. Julie i cant believe we actually have cameras in there. There is he wearing suspenders and soon that outfit is going to change. He will be in a jumpsuit presumably within the hour as he gets processed now and heading out of the courtroom and put into a police van and taken off to state prison. Judge he got his first favor handcuffs in front rather than behind. Julie interesting to note. Judge up to the discretion of the commander of that team escorting him. Julie i dont think they thought he was going to go out fists flying. They are required to handcuff him in this environment to ensure their own safety. Julie exactly if they think, in fact, that he is going to deem a physical threat to the officers while is he a violent predator according to the judge. Is he not physically a threat i would have believed to them. We have fox news producer lisa caplin. She has been inside the courtroom. She joining me on the phone. She was there when cosby was sentenced. That must have been incredible to hear that sentencing come down and the reaction. I want to know what the reaction was specifically inside the courtroom. Hi, julie, having a little bit of trouble hearing you. I think you want to know what happened. The courtroom was very calm. Everyone had been warned not to react. Not to act out when the sentence was read. And no one did. You know, the judge gave a whole explanation of why he decided on the sentence that he was imposing. And the actual sentence was read kind of after that whole list of reasoning. So, everyone had been listening and he announced that and so very calm. What was the look on bill cosbys faces a he heard his sentence . You know, he was just kind of looking straight ahead there was really no reaction. I dont know if his lawyers told him to just be calm and not react. But, there was really very little reaction. Julie i want to listen to gloria all redd she is outside the courtroom we respect the fact that they have undergone and endured this journey to justice. The court has imposed a three to five year term. Three years after which he can seek parole this is a very important day. Judgment day has come. The court has said that its efforts and its decision was based on the guidelines and the law of pennsylvania. And the protection of the public. There is undue risk to the public if he was given probation. And given the gravity of the offense and other factors, this was his sentence. So, were glad the judgment day has finally come for mr. Cosby. Mr. Cosby has shown no remorse. None. And there has been no justice for many of the accusers who were barred from a court by the ar arbitrary time limits imposed by the statute of limitations. Many of them were brave enough to speak to Law Enforcement and some of them were chosen to testify as prior bad act witnesses. We are very proud of those who cooperated with Law Enforcement and did what they could do to have a just result. Very quickly, were going to make a longer statement at the hall. I dont know if you want to say anything about the sentence and how you feel about it and then we will do the victim impact in the hall. This is one of my clients. She testified in the criminal case as a prior bad act witness. Go ahead. As everyone know i wanted 30 years. But im very happy to know that mr. Cosby will do time in prison. That he is touchable like he touched us unwillingly. Okay. Good, thank you. We got justice. Yes. Also prior bad act witness. Again, give her a longer statement at the hall which we have a copy of for you. How you feel about the sentence right now. Im more emotional than i thought i would be. All i can say is that this is going to help change the statute of limitations in nevada. Were going to get it accomplished. And were going to support whats happening here in pennsylvania and this is just going to show victims that they can make it through and that there is justice at the end and, hallelujah. Hallelujah. Its interesting that one the accusers, there were five or six total that were used as witnesses, six total accusers that were used as witnesses and there they just said that they are hoping one of the witnesses said they are hoping that this changes the law in nevada on the statute of limitations. Thats up to the state legislators. Most are five or seven years. There has been a movement to change them but not a successful one yet. Julie is the statute of limitations unfair. Earlier you mentioned there were memory issues. Some people seemed to block out memories, it could be years before psychologists and therapist could say help them redevelop. Its a policy judgment made by legislators who take into account limited resources that the government has with which to prosecute. Its not an act of forgiveness. Its just an act of rationality. How difficult is it to prove these old cases. Pretty i didnt know credible. Today a lot of news coming. In most importantly, bill cosby not only convicted of these crimes but he, he has been sentenced to 3 to 10 years. First night in jail is tonight. Julie wow, what an hour.
